things done or omitted to be done by him in the course of the performance of official duties as a member of the Office.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-2"><num>(2)</num><content><p>Sub-paragraph (1) shall not apply in respect of civil proceedings relating to damage alleged to have been caused by a motor vehicle belonging to, or operated by or on behalf of, a member of the Office.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="schedule-crossheading-exemptions-and-reliefs"><heading> Exemptions and reliefs</heading><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4</num><intro><p>The Treasury may by order confer in relation to the Office, to such extent as may be specified—</p></intro><level class="para1" eId="schedule-paragraph-4-a"><num>(a)</num><content><p>exemption or relief (by way of refund or otherwise) from prohibitions, restrictions, duties and taxes on the importation of goods;</p></content></level><level class="para1" eId="schedule-paragraph-4-b"><num>(b)</num><content><p>relief of the kinds set out in paragraphs 6 and 7 of Schedule 1 to the <noteRef href="#c863051" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>International Organisations Act 1968 (importation and supply of hydrocarbon oil and other goods or services).</p></content></level></paragraph><paragraph eId="schedule-paragraph-5" class="schProv1"><num>5</num><intro><p>The Treasury may by order confer in relation to members of the Office and members of their families who form part of their households, to such extent as may be specified—</p></intro><level class="para1" eId="schedule-paragraph-5-a"><num>(a)</num><content><p>exemption from income tax in respect of emoluments;</p></content></level><level class="para1" eId="schedule-paragraph-5-b"><num>(b)</num><content><p>the exemption set out in article 48 of the Convention (social security), construed in accordance with section 1(6) of the <noteRef href="#c863052" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Consular Relations Act 1968;</p></content></level><level class="para1" eId="schedule-paragraph-5-c"><num>(c)</num><content><p>the exemption and privilege set out in paragraph 16 of Schedule 1 to the International Organisations Act 1968 (imports);</p></content></level><level class="para1" eId="schedule-paragraph-5-d"><num>(d)</num><content><p>exemption or relief (by way of refund or otherwise) from prohibitions, restrictions, duties and taxes on the importation or purchase of motor vehicles.</p></content></level></paragraph><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6</num><subparagraph eId="schedule-paragraph-6-1"><num>(1)</num><intro><p>An order under paragraph 4 or 5 may provide for any exemption, relief or privilege to be subject to arrangements or conditions—</p></intro><level class="para1" eId="schedule-paragraph-6-1-a"><num>(a)</num><content><p>specified in the order, or</p></content></level><level class="para1" eId="schedule-paragraph-6-1-b"><num>(b)</num><content><p>to be made or imposed by the Secretary of State or the Commissioners of Customs and Excise.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><content><p>An order under paragraph 4 or 5 may make different provision for different cases (including different provision for different persons).</p></content></subparagraph><subparagraph eId="schedule-paragraph-6-3"><num>(3)</num><content><p>An order under paragraph 4 or 5 shall be made by statutory instrument and shall be subject to annulment in pursuance of a resolution of the House of Commons.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="schedule-crossheading-waiver"><heading> Waiver</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7</num><content><p>A privilege or immunity which would apply by virtue of this Schedule shall not apply in any case in respect of which it is waived by the head of the Office.</p></content></paragraph></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="schedule-crossheading-interpretation"><heading> Interpretation</heading><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8</num><subparagraph eId="schedule-paragraph-8-1"><num>(1)</num><content><p>In this Schedule—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>“archives of the Office” includes all the papers, documents, correspondence, books, films, tapes, discs and registers of the Office (wherever found);</p></item><item><p>“<term refersTo="#term-the-convention" eId="term-the-convention">the Convention</term>” means the articles of the Vienna Convention on Consular Relations set out in Schedule 1 to the <noteRef href="#c863053" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Consular Relations Act 1968;</p></item><item><p>“<term refersTo="#term-the-head-of-the-office" eId="term-the-head-of-the-office">the head of the Office</term>” means the person charged by the government of the Hong Kong Special Administrative Region with the duty of acting in that capacity;</p></item><item><p>“<term refersTo="#term-member-of-the-office" eId="term-member-of-the-office">member of the Office</term>” means, subject to sub-paragraph (3), a person employed by the government of the Hong Kong Special Administrative Region to carry on the business of the Office;</p></item><item><p>“<term refersTo="#term-the-office" eId="term-the-office">the Office</term>” means any office in relation to which this Act applies; and</p></item><item><p>“<term refersTo="#term-the-premises-of-the-office" eId="term-the-premises-of-the-office">the premises of the Office</term>” means the buildings or parts of buildings, together with any ancillary land, used exclusively for the official use of the Office.</p></item></blockList></content></subparagraph><subparagraph eId="schedule-paragraph-8-2"><num>(2)</num><intro><p>Where this Schedule refers to an article of the Convention, the article shall be construed for the purposes of the reference as if—</p></intro><level class="para1" eId="schedule-paragraph-8-2-a"><num>(a)</num><content><p>references to the sending State were references to the Hong Kong Special Administrative Region; and</p></content></level><level class="para1" eId="schedule-paragraph-8-2-b"><num>(b)</num><content><p>references to the head of a consular post or diplomatic mission were references to the head of the Office.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-8-3"><num>(3)</num><intro><p>If the Secretary of State notifies the government of the Hong Kong Special Administrative Region that a person—</p></intro><level class="para1" eId="schedule-paragraph-8-3-a"><num>(a)</num><content><p>is not acceptable as a member of the Office, or</p></content></level><level class="para1" eId="schedule-paragraph-8-3-b"><num>(b)</num><content><p>is no longer considered to be a member of the Office,</p></content></level><wrapUp><p>that person shall not, while the notification is in force, be regarded as a member of the Office for the purposes of any provision of, or made by virtue of, this Schedule.</p></wrapUp></subparagraph></paragraph></hcontainer></hcontainer></hcontainer>

1 to the <noteRef href="#c863053" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Consular Relations Act 1968;</p></item><item><p>“<term refersTo="#term-the-head-of-the-office" eId="term-the-head-of-the-office">the head of the Office</term>” means the person charged by the government of the Hong Kong Special Administrative Region with the duty of acting in that capacity;</p></item><item><p>“<term refersTo="#term-member-of-the-office" eId="term-member-of-the-office">member of the Office</term>” means, subject to sub-paragraph (3), a person employed by the if—</p></intro><level class="para1" eId="schedule-paragraph-8-2-a"><num>(a)</num><content><p>references to the sending State were references to the Hong Kong Special Administrative Region; and</p></content></level><level class="para1" eId="schedule-paragraph-8-2-b"><num>(b)</num><content><p>references to the head of a consular post or diplomatic mission were references to the head of the Office.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-8-3"><num>(3)</num><intro><p>If the Secretary of State notifies the government of the Hong Kong Special Administrative Region that a person—</p></intro><level class="para1" eId="schedule-paragraph-8-3-a"><num>(a)</num><content><p>is not acceptable as a member of the Office, or</p></content></level><level class="para1" eId="schedule-paragraph-8-3-b"><num>(b)</num><content><p>is no longer considered to be a member of the Office,</p></content></level><wrapUp><p>that person shall not, while the notification is in force, be regarded as a member of the Office for the purposes of any provision of, or made by virtue of, this Schedule.</p></wrapUp></subparagraph></paragraph></hcontainer></hcontainer>
