and</p></content></level><level class="para1"><num>(b)</num><content><p>if the charity is not an exempt charity, the mortgage shall also contain a statement, in such form as may be prescribed, that the restrictions on disposition imposed by section 36 above apply to the land (subject to subsection (9) of that section).</p></content></level></subsection><subsection><num>(1B)</num><intro><p>Where—</p></intro><level class="para1"><num>(a)</num><content><p>an application is duly made for registration of a person’s title to land in connection with such a mortgage as is mentioned in subsection (1A) above, and</p></content></level><level class="para1"><num>(b)</num><content><p>the mortgage contains statements complying with subsections (1) and (1A) above, and</p></content></level><level class="para1"><num>(c)</num><content><p>the charity is not an exempt charity,</p></content></level><wrapUp><p>the registrar shall enter in the register, in respect of the land, a restriction in such form as may be prescribed; and if he does so at a time when that sub-paragraph has operated to negative the transfer effected by section 11 above, it shall be taken not to have so operated.</p></content></subparagraph></quotedStructure></mod></p></content></subparagraph><subparagraph eId="schedule-1-paragraph-7-2"><num>(2)</num><intro><p>In paragraph 53(4) of Schedule 2—</p></intro><level class="para1" eId="schedule-1-paragraph-7-2-a"><num>(a)</num><content><p>for “section 123(2)” substitute “section 123A(10)(a)”;
