Foreign Limitation Periods Act 1984
Subject to the following provisions of this Act, where in any action or proceedings in a court in England and Wales the law of any other country falls (in accordance with rules of private international law applicable by any such court) to be taken into account in the determination of any matter—
the law of that other country relating to limitation shall apply in respect of that matter for the purposes of the action or proceedings , subject to section 1ZA and section 1B; and
except where that matter falls within subsection (2) below, the law of England and Wales relating to limitation shall not so apply.
A matter falls within this subsection if it is a matter in the determination of which both the law of England and Wales and the law of some other country fall to be taken into account.
The law of England and Wales shall determine for the purposes of any law applicable by virtue of subsection (1)(a) above whether, and the time at which, proceedings have been commenced in respect of any matter; and accordingly, section 35 of the Limitation Act 1980 (new claims in pending proceedings) shall apply in relation to time limits applicable by virtue of subsection (1)(a) above as it applies in relation to time limits under that Act.
A court in England and Wales, in exercising in pursuance of subsection (1)(a) above any descretion conferred by the law of any other country, shall so far as practicable exercise that discretion in the manner in which it is exercised in comparable cases by the courts of that other country.
In this section “law”, in relation to any country, shall not include rules of private international law applicable by the courts of that country or, in the case of England and Wales, this Act.
Subsection (3) applies where— and in this section the law relating to limitation that applies for the purposes of that action is referred to as “the relevant foreign limitation law”.
the law of another country relating to limitation applies by reason of section 1(1)(a) in respect of a matter for the purposes of an overseas armed forces tort action, and
the commencement condition applies in relation to that action,
The commencement condition applies in relation to an overseas armed forces tort action if the action commenced on a date which is after the end of the period of six years beginning with—
the date on which any limitation period specified in the relevant foreign limitation law began to run, or
where the relevant foreign limitation law has the effect that the action may be commenced within an indefinite period, the first date on which the action could have been commenced.
The relevant foreign limitation law is to be treated as providing the defendant with a complete defence to the action so far as relating to the matter (where that would not otherwise be the case).
An “overseas armed forces tort action” means an action—
which is an overseas armed forces action as defined in section 33(1ZB) of the Limitation Act 1980, and
which (under the law of the other country that falls to be taken into account) corresponds to—
an action to which section 11 of that Act applies (personal injuries),
an action in respect of false imprisonment, or
an action under the Fatal Accidents Act 1976 (death).
In the application of subsection (2) to an action in respect of which— the reference to the period of six years is to be treated as a reference to the period of six years plus the period of suspension or interruption or (as the case may be) the period that was so disregarded.
in accordance with the relevant foreign limitation law, a limitation period specified in that law has been suspended or interrupted for a period by reason of a person's lacking legal capacity or being under a disability, or
in accordance with the relevant foreign limitation law, a period during which a person lacks legal capacity or is under a disability has been disregarded in computing a limitation period specified in that law,
In the application of subsection (2) to an action in respect of which a limitation period specified in the relevant foreign limitation law has been suspended in accordance with section 1(1) of the Limitation (Enemies and War Prisoners) Act 1945, the reference to the period of six years is to be treated as a reference to the period of six years plus—
the period during which the limitation period was suspended, and
any extra period after the suspension ended during which the action could have been brought only because of an extension provided for by section 1(1) of that Act.
In any case in which the application of section 1 above would to any extent conflict (whether under subsection (2) below or otherwise) with public policy, that section shall not apply to the extent that its application would so conflict.
the application of section 1 above in relation to any action or proceedings shall conflict with public policy to the extent that its application would cause undue hardship to a person who is, or might be made, a party to the action or proceedings.
Where, under a law applicable by virtue of section 1(1)(a) above for the purposes of any action or proceedings, a limitation period is or may be extended or interrupted in respect of the absence of a party to the action or proceedings from any specified jurisdiction or country, so much of that law as provides for the extension or interruption shall be disregarded for those purposes.
and, in a case to which section 1(1) of the Foreign Limitation Periods Act 1984 applies, so much of the law of any country outside England and Wales as applies by virtue of that Act.

Where a court in any country outside England and Wales has determined any matter wholly or partly by reference to the law of that or any other country (including England and Wales) relating to limitation, then, for the purposes of the law relating of the effect to be given in England and Wales to that determination, that court shall, to the extent that it has so determined the matter, be deemed to have determined it on its merits.
In this section—
“ADR” has the same meaning as in Chapter 4 of Part 4 of the Digital Markets, Competition and Consumers Act 2024;
“ADR entity” means a person who carries out ADR in compliance with section 293(1) of that Act (which prohibits persons from carrying out ADR unless exempt, accredited, or acting under special ADR arrangements, in accordance with Chapter 4 of Part 4 of that Act);
“consumer contract dispute” has the same meaning as in Chapter 4 of Part 4 of that Act.
Subsection (3) applies where—
a limitation period prescribed by any law applicable by virtue of section 1(1)(a) relates to the subject of the whole or part of a consumer contract dispute;
ADR in relation to the consumer contract dispute starts before the period expires; and
if not extended by this section, the period would expire before the ADR ends or less than eight weeks after it ends.
For the purposes of initiating judicial proceedings, the limitation period expires instead at the end of eight weeks after the ADR ends (subject to subsection (4)).
If a limitation period has been extended by this section, subsections (2) and (3) apply to the extended limitation period as they apply to a limitation period mentioned in subsection (2)(a).
For the purposes of this section, ADR starts in relation to a consumer contract dispute on the date when the dispute is first sent or otherwise communicated to the ADR entity in accordance with the entity’s rules regarding the submission of complaints.
For the purposes of this section, the ADR ends on the date of the first of these to occur—
the parties reach an agreement in resolution of the consumer contract dispute;
a party completes the notification of the other parties that it has withdrawn from the ADR;
a party to whom a qualifying request is made fails to give a response reaching the other parties within 14 days of the request;
the ADR entity notifies the party that submitted the consumer contract dispute to the ADR entity that in accordance with its policy, the ADR entity refuses to deal with the consumer contract dispute;
after the parties are notified that the ADR entity can no longer act in relation to the consumer contract dispute (for whatever reason), the parties fail to agree within 14 days to submit the dispute to an alternative ADR entity;
the ADR otherwise comes to an end pursuant to the rules of the ADR entity.
For the purpose of subsection (6), a qualifying request is a request by a party that another (A) confirm to all parties that A is continuing with the ADR.
In the case of any consumer contract dispute , references in this section to ADR are references to the ADR so far as it relates to that dispute, and references to a party are to be read accordingly.
This section is without prejudice to any enactment which has effect for the purposes of provisions—
relating to limitation or prescription periods, and
contained in an international agreement to which the United Kingdom is a party.
Subject to subsection (3) below, references in this Act to the law of any country (including England and Wales) relating to limitation shall, in relation to any matter, be construed as references to so much of the relevant law of that country as (in any manner) makes provision with respect to a limitation period applicable to the bringing of proceedings in respect of that matter in the courts of that country and shall include—
references to so much of that law as relates to, and to the effect of, the application, extension, reduction or interruption of that period; and
a reference, where under that law there is no limitation period which is so applicable, to the rule that such proceedings may be brought within an indefinite period.
In subsection (1) above “relevant law”, in relation to any country, means the procedural and substantive law applicable, apart from any rules of private international law, by the courts of that country.
References in this Act to the law of England and Wales relating to limitation shall not include the rules by virtue of which a court may, in the exercise of any discretion, refuse equitable relief on the grounds of acquiescence or otherwise; but, in applying those rules to a case in relation to which the law of any country outside England and Wales is applicable by virtue of section 1(1)(a) above (not being a law that provides for a limitation period that has expired), a court in England and Wales shall have regard, in particular, to the provisions of the law that is so applicable.

This Act applies in relation to any action or proceedings by or against the Crown as it applies in relation to actions and proceedings to which the Crown is not a party.
For the purposes of this section references to an action or proceedings by or against the Crown include references to—
any action or proceedings by or against Her Majesty in right of the Duchy of Lancaster;
any action or proceedings by or against any Government department or any officer of the Crown as such or any person acting on behalf of the Crown;
any action or proceedings by or against the Duke of Cornwall.
This Act may be cited as the Foreign Limitation Periods Act 1984.
This Act shall come into force on such day as the Lord Chancellor may be order made by statutory instrument appoint.
Nothing in this Act shall—
affect any action, proceedings or arbitration commenced in England and Wales before the day appointed under subsection (2) above; or
apply in relation to any matter if the limitation period which, apart from this Act, would have been applied in respect of that matter in England and Wales expired before that day.
This Act extends to England and Wales only.
Section 1ZA (overseas armed forces actions: restriction of foreign limitation law) applies to an action commenced in England and Wales on or after the date on which that section comes into force, whenever the events to which the action relates took place.
This Act has effect subject to section 43 of the Northern Ireland Troubles (Legacy and Reconciliation) Act 2023.
Where in proceedings in England and Wales the law of a country other than England and Wales falls to be taken into account by virtue of any choice of law rule contained in the Rome I Regulation or the Rome II Regulation, sections 1, 1ZA, 2 and 4 above shall not apply in respect of that matter.
In subsection (1) the “Rome I Regulation” means Regulation (EC) No. 593/2008 of the European Parliament and of the Council on the law applicable to contractual obligations as that Regulation has effect as assimilated direct legislation (including that Regulation as applied by regulation 5 of the Law Applicable to Contractual Obligations (England and Wales and Northern Ireland) Regulations 2009), unless the proceedings are ones in respect of which Regulation (EC) No. 593/2008 has effect by virtue of Article 66 of the EU withdrawal agreement, in which case it means that Regulation as it has effect by virtue of that Article.
In subsection (1) the “Rome II Regulation” means Regulation (EC) No. 864/2007 of the European Parliament and of the Council on the law applicable to non-contractual obligations as that Regulation has effect as assimilated direct legislation (including that Regulation as applied by regulation 6 of the Law Applicable to Non-Contractual Obligations (England and Wales and Northern Ireland) Regulations 2008), unless the proceedings are ones in respect of which Regulation (EC) No. 864/2007 has effect by virtue of Article 66 of the EU withdrawal agreement, in which case it means that Regulation as it has effect by virtue of that Article.
