Driving Instructors (Registration) Act 2016
Part 5 of the Road Traffic Act 1988 (driving instruction) is amended as follows.
In section 126 (duration of registration), omit subsection (3).
After that section insert—

After section 128 insert—
In section 128 (removal of names from the register), in subsections (6), (6A) and (7), after “the register” insert “ under this section ”.
In section 131 (appeals), at the end insert—
Schedule 6 to the Road Safety Act 2006 (which makes amendments to Part 5 of the Road Traffic Act 1988 which are not in force) is amended as follows.
In paragraph 8, in section 126 of the Road Traffic Act 1988 (duration of registration) as substituted by that paragraph, in subsection (4) for the words from “ he ” to the end substitute “—
the person is required again to fulfil such of the conditions prescribed under section 125ZA(1) as may be prescribed, and
if the registration is in relation to the giving of driving instruction, the person, if required by regulations to do so, must also pass such an examination of continued ability and fitness referred to in section 125ZA(4)(a) as may be prescribed.”
After paragraph 8 insert—
Schedule 6 to the Road Safety Act 2006 (which makes amendments to Part 5 of the Road Traffic Act 1988 which are not in force) is amended as follows.
After paragraph 10 insert—
In paragraph 10, in section 128 of the Road Traffic Act 1988 (termination of registration) as substituted by that paragraph, in subsections (4), (6), (7) and (8) after “ person's registration ” insert “ under this section ”.
In paragraph 11, in section 128A of that Act (power to give direction as to further applications) as inserted by that paragraph, at the end insert—
In paragraph 13 (which amends section 131 (appeals) of that Act), after sub-paragraph (8) insert—
The Secretary of State may by regulations made by statutory instrument make such provision as the Secretary of State considers appropriate in consequence of this Act.
The power conferred by subsection (1) includes power—
to make transitional, transitory or saving provision;
to amend, repeal or revoke any provision of primary legislation or secondary legislation which is passed or made before this Act or in the same Session as this Act.
A statutory instrument containing (whether alone or with other provision) regulations under subsection (1) which amend, repeal or revoke any provision of primary legislation may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.
Subject to that, a statutory instrument containing regulations under subsection (1) is subject to annulment in pursuance of a resolution of either House of Parliament.
In this section—
“primary legislation” means—
an Act of Parliament;
an Act of the Scottish Parliament;
a Measure or Act of the National Assembly for Wales;
Northern Ireland legislation;
“primary legislation” means—
an Act of Parliament;
an Act of the Scottish Parliament;
a Measure or Act of the National Assembly for Wales;
The Secretary of State may by regulations made by statutory instrument make such transitional, transitory or saving provision as the Secretary of State considers appropriate in connection with the coming into force of any provision of this Act.
Sections 1 to 4—
extend to England and Wales, and Scotland, and
come into force on such day as the Secretary of State may by regulations made by statutory instrument appoint.
The regulations may appoint different days for different purposes.
Sections 5 and 6 and this section—
extend to England and Wales, Scotland and Northern Ireland, and
come into force on the day on which this Act is passed.
This Act may be cited as the Driving Instructors (Registration) Act 2016.
