<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><content>The Secretary of State may make a determination as to the salaries or allowances payable under section 47 of the Northern Ireland Act 1998 for a period when there is no Executive.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><content>The Secretary of State may make a determination as to allowances or gratuities payable under section 48 of the Northern Ireland Act 1998 to or in respect of a person ceasing to be a member, or ceasing to hold office, during a period when there is no Executive.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><content>The power to make a determination under subsection <ref href="#section-1-1">(1)</ref> or <ref href="#section-1-2">(2)</ref> ceases on the first occasion after the passing of this Act on which all of the Ministerial offices are filled (but this does not affect the continuing validity of a determination made and not revoked before that time).</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><content>A determination under subsection <ref href="#section-1-1">(1)</ref> or <ref href="#section-1-2">(2)</ref> must be in writing.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><intro>As soon as possible after a determination under subsection <ref href="#section-1-1">(1)</ref> or <ref href="#section-1-2">(2)</ref> is made—</intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content>the Secretary of State must send it to the Northern Ireland Assembly Commission, and</content></level><level class="para1" eId="section-1-5-b"><num>(b)</num><content>the Commission must publish it.</content></level></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-6"><num>(6)</num><content>Section 12 of the <abbr title="Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011 c. 17 (N.I.)">2011 Act</abbr> (content of determinations) applies to a determination under subsection <ref href="#section-1-1">(1)</ref> of this section as it applies to a determination under section 2(1)(a) of that Act.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-7"><num>(7)</num><content>For the purposes of any determination under section 2(1)(b) of the <abbr title="Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011 c. 17 (N.I.)">2011 Act</abbr> so far as relating to pensions, members are to be treated as having whatever salary they would have apart from any determination under subsection <ref href="#section-1-1">(1)</ref> of this section.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-8"><num>(8)</num><intro>A determination under this section—</intro><level class="para1" eId="section-1-8-a"><num>(a)</num><content>may amend a determination under section 2(1) of the <abbr title="Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011 c. 17 (N.I.)">2011 Act</abbr>;</content></level><level class="para1" eId="section-1-8-b"><num>(b)</num><content>may be revoked by such a determination.</content></level></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-9"><num>(9)</num><intro>In this section—</intro><hcontainer name="definition"><content>“the <abbr title="Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011 c. 17 (N.I.)">2011 Act</abbr>” means the Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011;</content></hcontainer><hcontainer name="definition"><intro>“the Ministerial offices” means—</intro><level class="para1"><num>(a)</num><content>the offices of First Minister and deputy First Minister, and</content></level><level class="para1"><num>(b)</num><content>the Ministerial offices to be held by Northern Ireland Ministers (within the meaning of the Northern Ireland Act 1998);</content></level></hcontainer><hcontainer name="definition"><intro>“period when there is no Executive” means—</intro><level class="para1"><num>(a)</num><content>the period beginning when this Act is passed and ending on the next occasion when all of the Ministerial offices are filled, and</content></level><level class="para1"><num>(b)</num><content>any later period beginning when the duty in section 32(3) of the Northern Ireland Act 1998 arises and ending on the next following occasion when all of the Ministerial offices are filled.</content></level></hcontainer></subsection>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“the <abbr title="Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011 c. 17 (N.I.)">2011 Act</abbr>” means the Assembly Members (Independent Financial Review and Standards) Act (Northern Ireland) 2011;</content></hcontainer>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><intro>“the Ministerial offices” means—</intro><level class="para1"><num>(a)</num><content>the offices of First Minister and deputy First Minister, and</content></level><level class="para1"><num>(b)</num><content>the Ministerial offices to be held by Northern Ireland Ministers (within the meaning of the Northern Ireland Act 1998);</content></level></hcontainer>
