<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-d"><num>(d)</num><content>an offence under the Animal Health Act 1981;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-e"><num>(e)</num><content>an offence under the Animal Welfare Act 2006 or under regulations made under section 12 or 13 of that Act;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-f"><num>(f)</num><content>an offence under the Wild Animals in Circuses Act 2019.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><content>In this Act an “enforcement authority”, for a relevant offence, is a person who is specified in relation to the offence by regulations made by the Secretary of State (and the regulations

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><intro>The persons who may be specified by regulations under subsection (4) are—</intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content>the Secretary of State,</content>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><content>A fixed penalty notice issued under <ref href="#section-2">this section</ref> may be withdrawn at any time by the constable that issued it or another constable in the same police force.</

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><intro>The amount specified in a fixed penalty notice may not exceed whichever is the lesser of—</intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content>£5,000, and</cont

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-5-b"><num>(b)</num><content>the effect of <ref href="#section-3-6">subsection (6)</ref>, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-5-c"><num>(c)</num><content>when and how payment may be made.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-6"><num>(6)</num><intro>Where a fixed penalty notice is issued to a person (and has not been withdrawn)—</intro><level class="para1" eId="section-3-6-a"><num>(a)</num><content>no proceedings may be institut

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-7"><num>(7)</num><content>Where proceedings are instituted for the offence after the end of the relevant period, that period is to be disregarded for the purposes of calculating the period mentioned in section 127

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-1"><num>(1)</num><intro>An enforcement authority for a relevant offence or a constable must take into account the matters mentioned in <ref href="#section-4-2">subsection (2)</ref> in deciding—</intro><level c

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-1-a"><num>(a)</num><content>whether to issue a fixed penalty notice to a person under section 1 or 2, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-1-b"><num>(b)</num><content>the amount to be specified in the notice.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-2"><num>(2)</num><intro>The matters are—</intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content>the seriousness of the conduct to which the proposed notice relates (the “relevant conduct”);<

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-b"><num>(b)</num><content>the duration of the relevant conduct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-c"><num>(c)</num><content>any evidence of intention behind the relevant conduct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-d"><num>(d)</num><content>any evidence of previous acts or omissions by the person similar to the relevant conduct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-e"><num>(e)</num><content>any action taken by the person to eliminate or reduce any risk of harm resulting from the relevant conduct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-f"><num>(f)</num><content>any action taken by the person to remedy or mitigate any harm resulting from the relevant conduct;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-g"><num>(g)</num><content>whether the person reported the relevant conduct to the enforcement authority or constable;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-2-h"><num>(h)</num><content>the conduct of the person after the relevant conduct is drawn to their attention by the enforcement authority or constable.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-3"><num>(3)</num><intro>The Secretary of State must give guidance about—</intro><level class="para1" eId="section-4-3-a"><num>(a)</num><content>additional matters to be taken into account in deciding whethe

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-4-3-c"><num>(c)</num><content>how the matters mentioned in <ref href="#section-4-2">subsection (2)</ref> and any additional matters of the kind mentioned in <ref href="#section-4-3-a">paragraph (a)</ref> or
