Taxis and Private Hire Vehicles (Disabled Persons) Act 2022
The Equality Act 2010 is amended as follows.
After section 164 (exemption from taxi accessibility regulations) insert—
In section 165 (passengers in wheelchairs)—
for the heading substitute “Disabled passengers in wheelchairs: duties of drivers of designated vehicles”;
in subsection (1), after “taxi” insert “or designated private hire vehicle”;
omit subsection (2);
before subsection (3) insert—;
in subsection (4)—
omit paragraph (b);
after paragraph (c) insert—;
after paragraph (e) insert—;
after subsection (4) insert—;
in subsection (5)—
for “Mobility assistance is” substitute “For the purposes of this section “mobility assistance” means”;
in paragraph (c), after “luggage” insert “or mobility aids”;
in subsection (9), for “the offence” substitute “an offence under subsection (7) in relation to the duty mentioned in subsection (4)(a) or (c)”;
after subsection (9) insert—;
omit subsection (10).
After section 165 insert—
Section 166 of the Equality Act 2010 (passengers in wheelchairs: exemption certificates) is amended as follows.
In the heading, for “Passengers in wheelchairs” substitute “Disabled passengers”.
In subsection (1), for “duties imposed by section 165” substitute “mobility assistance duties”.
After subsection (2) insert—
In subsection (3)—
omit “designated”;
for “duties imposed by section 165” substitute “mobility assistance duties”.
In subsection (4)—
omit “designated”;
for “duties imposed by section 165” substitute “mobility assistance duties”.
Omit subsection (5).
Section 167 of the Equality Act 2010 (lists of wheelchair-accessible vehicles) is amended as follows.
In subsection (1)—
for “may” substitute “must”;
after “maintain” insert “and publish”.
Omit subsections (3) and (4).
In subsection (6), after paragraph (a) insert—.
In subsection (7) omit “which maintains a list under subsection (1)”.
After section 167 of the Equality Act 2010 insert—

In section 168(2)(b), after “not make” insert “, or propose to make,”.
In section 170 (assistance dogs in private hire vehicles)—
in subsection (1), for paragraph (b) substitute—;
in subsection (2)—
after “operator” insert “or driver of a private hire vehicle”;
after “making” insert “, or proposing to make,”;
in subsection (5)—
in the definition of driver, in paragraph (a), omit “(“the 1998 Act”)”;
in the definition of driver, in paragraph (b), omit “(“the 1976 Act”)”;
omit the definitions of “operator” and “private hire vehicle”.
In section 171(5), for “, “licensing authority” and “private hire vehicle”” substitute “and “licensing authority””.
In section 173(1)—
after the definition of “assistance dog” insert—;

This Act extends to England and Wales and Scotland.
This Act comes into force at the end of the period of two months beginning with the day on which it is passed.
This Act may be cited as the Taxis and Private Hire Vehicles (Disabled Persons) Act 2022.
