Social Security (Special Rules for End of Life) Act 2022
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1"><num>1</num><heading>Rules to apply where death expected within 12 months</heading><subsection eId="section-1-1"><num>(1)</num><content><p><mod>In section 66 of the Social Security Contributions and Benefits Act 1992 (rules for attendance allowance in cases where death can reasonably be expected within 6 months), in subsection (2)(a) (meaning of “<term refersTo="#term-terminally-ill" eId="term-terminally-ill">terminally ill</term>” in relation to attendance allowance and disability living allowance), for “6” substitute <quotedText>“12”</quotedText>.</mod></p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p><mod>In section 82 of the Welfare Reform Act 2012 (rules for personal independence payment in cases where death can reasonably be expected within 6 months), in subsection (4) (meaning of “<term refersTo="#term-terminally-ill" eId="term-terminally-ill">terminally ill</term>”), for “6” substitute <quotedText>“12”</quotedText>.</mod></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><mod>In the Universal Credit, Personal Independence Payment, Jobseeker’s Allowance and Employment and Support Allowance (Decisions and Appeals) Regulations 2013 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2013/381">S.I. 2013/381</ref>), in regulation 2, in the definition of “terminally ill”, for the words from “expected” to the end substitute <quotedText>“expected within 12 months”</quotedText>.</mod></p></content></subsection></section>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Extent, commencement and short title</heading><subsection eId="section-2-1"><num>(1)</num><content><p>This Act extends to England and Wales and Scotland.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p><ref href="#section-1">Section 1</ref> comes into force on such day or days as the Secretary of State may by regulations made by statutory instrument appoint.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>Regulations under <ref href="#section-2-2">subsection (2)</ref> may contain such transitional, transitory or saving provision as the Secretary of State considers appropriate.</p></content></subsection><subsection eId="section-2-4"><num>(4)</num><content><p>This section comes into force on the day on which this Act is passed.</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>This Act may be cited as the Social Security (Special Rules for End of Life) Act 2022.</p></content></subsection></section>
