<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading> Enforcement of controls on pesticides.</heading><subsection eId="section-2-1"><num>(1)</num><content><p><mod>In section 19 of the <noteRef href="#c878104" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Food and Environment Protection Act 1985 (enforcement powers), insert after subsection (6)—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(6A)</num><content><p>A notice under subsection (5) or (6) above may at any time be withdrawn by a person so authorised.</p></content></subsection><subsection><num>(6B)</num><content><p>Withdrawal of a notice does not affect the power to serve a fresh notice under subsection (5) or (6).</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p><mod>In Schedule 2 to the 1985 Act (officers and their powers), insert after paragraph 2—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><hcontainer name="crossheading" class="schGroup7"><heading> Power to question</heading><paragraph class="schProv1"><num>2A</num><subparagraph><num>(1)</num><intro><p>If an officer is carrying out functions conferred by Part III of this Act, he may require a person whom he has reasonable cause to believe is able to give information which will assist him in carrying out those functions—</p></intro><level class="para1"><num>(a)</num><content><p>to answer such questions as the officer thinks it appropriate to ask; and</p></content></level><level class="para1"><num>(b)</num><content><p>to sign a declaration of the truth of his answers.</p></content></level></subparagraph><subparagraph><num>(2)</num><content><p>Any person to whom questions are put under this paragraph may nominate a person to be with him when he gives his answers.</p></content></subparagraph><subparagraph><num>(3)</num><intro><p>When a person answers any such questions the only other persons who may be present (apart from the questioner) are—</p></intro><level class="para1"><num>(a)</num><content><p>the person (if any) nominated under sub-paragraph (2); and</p></content></level><level class="para1"><num>(b)</num><content><p>any person authorised by the officer to be present.</p></content></level></subparagraph><subparagraph><num>(4)</num><content><p>A person is not to be excused from complying with a requirement under sub-paragraph (1) on the ground that to do so might incriminate him or his spouse of an offence; but a statement or admission made in complying is not admissible in evidence against either of them in proceedings for any offence.</p></content></subparagraph></paragraph></hcontainer></quotedStructure></mod></p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p><mod>The provisions of paragraph 4 of Schedule 2 to the 1985 Act shall become sub-paragraph (1) of that paragraph and at the end add—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><subparagraph><num>(2)</num><content><p>An officer exercising any power of entry conferred by Part III of this Act may photograph anything which he has reasonable cause to believe may be relevant in connection with the exercise of his functions under that Part.</p></content></subparagraph><subparagraph><num>(3)</num><content><p>Nothing in sub-paragraph (2) affects the powers conferred by sub-paragraph (1).</p></content></subparagraph></quotedStructure></mod></p></content></subsection></section>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading> Short title, commencement and extent.</heading><intro><p>This Act—</p></intro><level class="para1" eId="section-3-a"><num>(a)</num><content><p>may be cited as the Pesticides Act 1998;</p></content></level><level class="para1" eId="section-3-b"><num>(b)</num><content><p>comes into force at the end of the period of two months beginning with the day on which it is passed; and</p></content></level><level class="para1" eId="section-3-c"><num>(c)</num><content><p>extends to Northern Ireland.</p></content></level></section>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-a"><num>(a)</num><content><p>may be cited as the Pesticides Act 1998;</p></content></level>
