Решение Коллегии ЕЭК от 13 ноября 2012 года № 226 «О признании утратившими силу некоторых решений Комиссии Таможенного союза в части принятия декларации о соответствии продукции обязательным требованиям в рамках Таможенного союза, оформленной по единой форме» DECISION November 13, 2012 № 226 Moscow On Recognizing Some of the Decisions of the Customs Union Commission as Repealed with Regard to Adoption of Declaration of Conformity of Products with Mandatory R equirements within the Customs Union of Common Form In accordance with Article 3 of the Treaty on Eurasian Economic Commission of 18 November 2011 the Council of Eurasian Economic Commission has decided to: 1. Recognize as repealed : the third sub-paragraph of paragraph 1 of the Decision of Customs Union Commission of 9 December 2011 № 886 "On A mendments to the Decision of the Customs Union Commission” ; Decision of the Council of the Eurasian Economic Commission of 5 April 2012 № 17 "On Amendments to the Unified List of P roducts Subject to M andatory Conformity Assessment (Confirmation) within the C ustoms Union with Issuance of Common D ocuments". 2. Third sub- paragraph of paragraph 9 of the Decision of the Customs Union Commission of 18 June 2010 № 319 "On Technical Regulation in the Customs Union" shall be amended as follows: "- for products imported from third countries, the certificates of conformity or declaration of conformity in accordance with the legislation of the Customs Union member -states or certificates of conformity or declarations of conformity of a common form can be issued". 3. Paragraph 1 of the N otes to Unified List of Products Subject to Mandatory Conformity Assessment (Confirmation) within the Customs U nion with Issuance of Common Documents, approved by the D ecision of the Customs Union Commission of 7 April 2011 № 620, shall be amended as follows: "1. For products included in the Unified List of Products Subject to Mandatory Conformity Assessment (Confirmation) within the Customs Union with Issuance of Common Documents (hereinafter – the Unified list), at Applicant’s choice, certificates of conformity or declarations of conformity of a common form and (or) certificates of conformity or declarations of conformity in accordance with the legislation of the Customs Union member - states can be issued. For products supplied from third countries, certificates of conformity or declaration of conformity in accordance with the legislation of the Customs Union member states or certificates of conformity or declarations of conformity of a common form shall be issued. When issuing declaration of conformity of a common form, a legal entity registered in accordance with the legislation of the Customs Union member -state in its territory or a physical person as an individual entrepreneur, which is producer or person authorized by producer, or supplier, or seller, could act as an applicant . ". 4. This Decision shall enter into force after 30 days from the date of its official publication. Chairman V.B.Khristenko
