Решение Комиссии Таможенного союза от 15 июля 2011 года №726 «О ветеринарных мерах» Decision of the Commission of the Customs Union No. 726 “On Veterinary Measures” of 15 July 2011 The Commission of the Customs Union has decided: 1.To amend the Section on "Final and Transitional Provisions" of the Common veterinary (veterinary-sanitary) requirements for goods subject to veterinary control (supervision), approved by Decision of the Commission of the Customs Union (hereinafter: Commissio n) No. 317 of 18 June 2010 (hereinafter: requirements), as following: - in paragraph 4 "2012" shall be replaced by "2013"; - after the words "1 July 2010", the words "with any subsequent amendments thereto, agreed by the parties and by the exporting country on the basis of an agreed position of the other Parties" shall be added; Section 5 - 7 shall be added as follows: "5. With a view of harmonizing veterinary certificates that are different from the form of common veterinary certificates for importatio n of controlled goods into the customs territory of the Customs Union from the third countries, approved by Commission Decision No. 607 of 7 April 2011 (hereinafter: common forms of veterinary certificates ) and certain provisions of these requirements, the authorized bodies of the Parties shall negotiate with the competent authorities of the exporting countries that have made reasonable request s for such negotiations. In the case of the request submitted before 1 January 2013 to the authorized body of one of the Parties with a request to develop a veterinary certificate that is different from the common forms of veterinary certificates and certain provisions of these requirements, the competent authority of the exporting country, and between which one of the parties before 1 July 2010 the veterinary certificate for import of controlled goods into the territory of the Party was initialed, the validity of the initialed veterinary certificate, as well as any subsequent changes to such certificate with the other Parties agreed, shall be extended for the period until the harmonization of veterinary certificate that is different from the common form of veterinary certificates and certain provisions of these requirements. 6. To extend the validity of veterinary certificates, initialed between Party and exporting country in the period from 1 July 2010 to 1 December 2010, that are different from the common veterinary requirements for the importation and consumption of controlled goods exclusively on the territory of that Party until 1 January 2013. In the case of address before 1 January 2013 to one of the authorized body of the competent authority of the exporting country, between which and one of the Parties in the period from 1 July 2010 to 1 December 2010 veterinary certificate for importation for consumption of controlled goods exclusively in the territory of the Party was initialed, with a request for the development of veterinary certificate that is different from the common form of veterinary certificates and certain provisions of these requirements, the validity of the initialed veterinary certificate shall be extended until the agreement of the parties and the exporting country on the basis of an agreed position of the
other Parties, veterinary certificate that is different from the common form veterinary certificates and certain provisions of this requirement. 7. Veterinary certificates shall be neg otiated by consensus by the authorized bodies of the Parties and the competent authority of the exporting country and shall provide the level of veterinary protection established by the Parties ." 2. To instruct the Secretariat of the Commission to prepare a schedule of the working group "Veterinary and Sanitary Measures" of consultations with the competent authorities of third countries to discuss the common veterinary requirements and common form of veterinary certificates. If necessary, including at the request of the competent authorities of third countries, the working group "Veterinary and Sanitary Measures" to make amendments and addenda to the specified consultations schedule. 3. To the Parties: 3.1. Upon negotiating veterinary certificates that are different from the common form of veterinary certificates, to ensure the inclusion of conditions not less favorable than those contained in international instruments in the field of veterinary and sanitary measures (for the corresponding goods), concluded until 1 July 2010 between the Party and the exporting country; 3.2. To develop requirements and common forms of veterinary certificates in respect of the products for which requirements of the Customs Union do not exist, as well as amendments to the common veterinary certificates and requirements, based on international standards set by the World Organization for Animal Health and the Commission "Codex Alimentarius"; 3.3. To provide amendment and addenda into Regulation on common procedure for joint inspections of facilities and sampling of goods (products) subject to veterinary inspection, approved by Commission Decision No. 317 of 18 June 2010, specifying (detailing) the procedures and criteria for joint inspections, approvals of their results and recording of organizations into the register of organizations from third countries for approval by the Commission in September 2011. The draft documents shall be submitted for public comments no later than 1 July 2011.
