Introduction of the Project Suzhou Urban Environment Project (SUEP), is one of Jiangsu Urban Environment Project (LTUEP), which includes SUEP and Wuxi Urban Environment Project (WUEP). After the construction of the project, a complete and comprehensive urban sewage treatment system will be formed in Suzhou municipal, with an integration of sewage collection, transfer and drainage with meeting the drainage standard after treatment, sewage recycled, and sludge utilization, so that the quality of ground water environment can be improved, and underground water source can be protected, then sustainable development in economy can be promoted in Suzhou. 1.1.1 SUEP (1) WECTP WECTP includes three sub-projects, which are Suzhou Downtown Sewage Treatment Second-stage Project, Watercourse Dredging Project, Jinghang Canal Sludge-blocked Project. Suzhou Downtown Sewage Treatment Second-stage Project mainly includes, Fuxing WWTP Second-stage Project with scale of 100,000 m3 per day, and Loujiang WWTP Second-stage Project with scale of 80,000 m3 per day. For both of them, original reserved land for construction in first stage can be used, so there is no land acquisition and house demolishing involved in the projects. Watercourse Dredging Project involves dredging 36KM watercourse in 1 downtown, and deepens it to 0.8m. The project does not involve permanent land occupation, and mud-removing field will occupy rural collectively-owned land. Jinghang Canal Sludge-blocked Project includes Xujiang Hinge and Shangtang River navigation lock. The project involves land acquisition of rural collectively-owned land and transfer of state-owned land, residents' houses and enterprises demolishing and resettlement. The above-mentioned projects make use of World Bank loan for construction, land acquisition, house demolishing, impacts of resettlement and rehabilitation plan are included in this RAP. Impacts of land acquisition and Retroactive review of resettlement policies of Fuxing and Loujiang first stage projects of Suzhou Downtown Sewage Treatment Project can be seen at Appendix 1. Impacts of land acquisition and policy framework of resettlement policies of project related to the project, which are supporting projects financed by domestic capital, including Project for Sewage Pipeline to Household in Downtown can be seen at Appendix 2. 1. 1.2 Wuzhong Sewage Treatment Project (WSTP) Wuzhong Sewage Treatment Project includes constructing one WWTP, and 23.5KM Sewage Pipelines Net System. One WWTP is proposed to be constructed, with scale of 30 thousand ton per day at first stage, which locates the south of Tonglin chemical industry in Hedong industry area, and M-SBR techniques process is adopted in sewage treatment techniques, sludge will be conveyed to bury in Qizi Mountain after be inspissated and dewatered. Land with 140 mu will be occupied by the project, which is transferred from state-owned land without pay. The 2 state-owned land is unused land, which is reserved for construction of the WWTP, and land acquisition is completed by Administrative Committee of Wuzhong Hi-tech Development Zone, which is collectively-owned land originally, owned by Lufeng Village, Guoxiang Town, Wuzhong. Impacts of land acquisition and Retroactive review of resettlement policies of the land acquisition be seen at Appendix1. Sewage Pipelines Net System is to be designed and laid out with the construction of three zones such as Dongwu Industrial Park and Hedong Hi-tech Development Zone etc., which is 23.5 KM in length. The pipelines net system is buried and laid out with the usage of green belt along the road, without land acquisition, and the green belt occupied temporarily is state-owned, owned by Administrative Committee of Development Zone, and the impacts are included in this RAP. 1.2 Area Affected and Served by Project 1.2.1 Areas Served by Project Lake Tai river basin bestrides Jiangsu, Zhejiang and Anhui three provinces and Shanghai city, with the acreage of 36500km2, among which there are 52.5% in Jiangsu. There are 37 big and medium cities and county-level cities. Areas served by the project include surrounding area of Lake Tai river basin, especially Suzhou city and Wuzhong Hi-tech Development Zone. The implementation of project will improve environment in Suhzou efficiently, and promote economic and tourism development strongly, then fulfill the sustainable development of Suzhou. 3 (1 ) Environmental Benefits Sewage will be conveyed to WWTPs with relative complete collecting system for treatment, and discharged to receiving water area after meeting the discharging standard. Sewage treatment rate of city central area will be increased from 36% to 85% after implementation of the project, which will drastically change the condition that most of the sewage was discharged to city river net without treatment in the past, pollution drained to city river net will be decreased dramatically; the decrease of pollution quantity will decrease the pollution quantity of city river net, and water quality will be improved relatively, the visage of Jiangnan Water Countryside with clear water and live water recovered initially, at the same time the improvement of water quality in Lake Tai is promoted. (2) Social Benefits Improve Sanitation Environment. Sanitation condition and environment is improved evidently through increasing water quality and improving water quality of river net, which do a favor to decrease diseases and improve health level of residents'. Improve dwelling condition. Life quality can improved dramatically with the evident improvement of water quality in river net and environment in city, which will bring notable social benefits. (3) Economic Benefits Water environment will improved greatly after construction of the project, which will promote the development of tourism industry, and increase economic benefits of tourism industry. Investment environment will be improved and increase appeal of attracting investment, and strongly promote 4 economic development. 1.2.2 Areas Affected by Project Areas affected by the project includes Suzhou and Wuzhong Hi-tech Development Zone. Suzhou Downtown Sewage Treatment Second-stage Project. In the planning and construction of Fuxing WWTP and Loujiang WWTP first-stage project, design of general area reserved land for development at second-stage at the long term plan with scale of 80,000 tons per day and 60,000 tons per day, and needed city planning supporting facilities have be constructed. Therefore, there is no need for other land acquisition. Watercourse Dredging Project. The impacts are induced by temporary land occupation for pile-up sludge and treatment. According to the plan, sludge dredged from river bottom will be shipped to bury in Xinyu Village, Huqiu Town, pounds with 786.6 mu of the village will be occupied temporarily. Jinghang Canal Sludge-blocked Project. It includes Xujiang Hinge and Shangtang River Hinge, which will occupy 23.9 mu permanently, 35.8 mu land temporarily, 2442m2 residential houses and 6341 m2 workshops in total. (2) Wuzhong Sewage Treatment Project Land for construction of WWTP is the reserved land during the plan of Development Zone, which are stated-owned land, so there are no land acquisition involved in the project. The pipelines net system is buried and laid out with the usage of green belt along the road, without land acquisition, and the green belt occupied temporarily is state-owned. 5 WWTP and pipeline net do not involve house demolishing. 1.3 Social and Economic Background in the Project Area 1.3.1 Social and Economic Background in Suzhou The city of Suzhou is originally established in 514 BC with a long history of over 2500 years. At present it is still on the original site of Spring and Summer Era with the setup of double chessboard of "rivers go together with lands and streets live beside rivers", and the river ways water system of "Three length and three breadth with one circle" and the significant scene of "little bridges above water, powdery walls with black tiles and historic places of famous gardens". In Suzhou, the city is dotted with classical gardens with extractive art. Now there are more than 60 classical gardens that have been preserved in good condition, among which nine gardens including the Poor Administrative Garden, Lion Woods and others have been listed in the World Civilization Heritage Fame. In recent years, Suzhou fully uses the advantages of rich tourism resources and exerts itself to set up a new tourism frame of the old and the new together. Therefore the tourism industry in Suzhou has developed rapidly and it is becoming the new supporting industry. In 2001 there are 16,720,000 from overseas to Suzhou and the tourism foreign exchange income amounts to 0.234 billion which increases by 16.3% from that of the last year; it has got tourism total income of 17.1 billion, increased by 21% from that of the lat year; and thus it has occupied 9.7% of the domestic Production Total value. At the end of 2001, Suzhou has the total population of 5805.3 thousand, among which the urban has 2094.5 thousand. The distribution of the urban population is as follows: the central district (including Huqiu Hill, Pingjiang, 6 Canglang, Jinchang four districts) 871.1 thousand, new district 81.4 thousand, industrial park 177.3 thousand, Wuzhong District 585.1 thousand, and Xiangcheng district 379.6 thousand. Suzhou is one of the economic developed places in China. Since the Reformation and Open to outside, Suzhou has insisted the center of economy construction and vigorously actualized thriving city through science and education, economic globalization, sustainable development and strategy of urbanization with fully promote the systematic and scientific innovation to keep the economy develop continuously, rapidly and healthily. In the Period of "the ninth five" the domestic production total value has increased by 11.6% averagely in the comparative price and the finance income increased by 24.1% averagely. In 2001, Suzhou accomplished the domestic production total value of 176 billion and it increased by 12.3% from that of the last year in the comparative price, which listed in the sixth in the cities of Chinese mainland. The average domestic production total value exceeded 30 thousand and 3600 US Dollars in the current exchange rate. The finance income amounted to 20.9 billion which got the first of Jiangsu Province and the proportion of the three industries is: 5.3:56.7:38. According to Suzhou City General Plan(1 996-2010) revised in 2001, the target of Suzhou city construction and development is that Suzhou city construction and development shall observe the harmonizing development tactic of economy, society, population, environment and resources, that it shall vigorously develop high technological industries and the third industries with wholly protecting the old city's views to construct Suzhou step by step as a modern city of glory economy, civilized society, proper setup and elegancy environment with characteristics of south of Yangtse River and rich historic 7 traditions. Due to city plan, Suzhou has its target in environment protection as well, to keep the economy, urban and suburban, environment in the same step of layout, implementation and development; to emphasize on water environment renovation to realize the consolidation of economic benefit, social benefit and environmental benefit and to improve the reform of Suzhou city environment quality and country economy develop continuously, rapidly and healthily; in the near future to carry out the city renovation and prevention and care of industrial pollution emphasizing on water environment renovation and firmly control the new pollution origins and thus the environment pollution has been controlled basically and the environment quality has been improved to some extent. The first classic protection districts for drinking water origins shall go up to the 11 standard of ground water; the metaphase target is to get the inside and outside rivers to go above to Standard IV-V of ground water; and the long-term target is to get the waters quality up to Standard IV. Suzhou lies in the south of Yangtse River with developed water systems of rivers in length and breadth, which has taken good condition for city drainage. In Suzhou old city, before the 80's there were no perfect drainage system and the drainage for the roads took the principle of draining to the near river with pipelines. And so the domestic sewage and industrial waste drainage drained into the rivers, and polluted the rivers seriously. Suzhou City General Plan (1985-2000) worked out in 1986 and the relative City Drainage and Sewage Treatment Project Plan have the confirmation of the drainage system of old district that is 'to adopt interflow system and cut to treat the sewage and original rain, to rebuild the system to distribution in the new districts and reconstructive districts including the south garden and north garden'. For the other districts such as the east, west and the south, it shall be distribution system. 8 In the early of the 80's, Suzhou began to carry out the construction in large scale. And due to the above drainage plan, especially the WECTP begun in 1998 promote the distribution system and change sewage cut pipelines to be sewers. The basic condition of the whole city and urban social economy of Suzhou in 2001 is as follows: total population is 5805.3 thousand and agricultural population is 3147.7 thousand, the country acreage is 8488.42 km2, among which the plowland is 298.49 kha. The domestic production total value is 176.028 billion, among which the first industry is 10.181 billion, the second 98.949 billion and the tertiary 66.8980 billion. The industrial total production is 398.075 billion and the GDP per capita is 30322.00yuan. For the urban residents, the distributable income is 10515.00 yuan and the net income for the peasants is 5790.00 yuan. 1.3.2 Social and Economic Background in Wuzhong Hi-tech Development Zone Wuzhong Hi-tech Development Zone (previously Jiangsu Wuxian Economic Development Zone) lies in the south of the old city, to the east of China-Singapore Industrial Park and to the west of Shihu Lake Places of Interest. Jinghang Canal and Provincial way 205 go through the whole area and Huning, Sujiahang highways pass nearly. The carryout of the Wuzhong District Sewage Treatment Project enhance the attracting funds to develop the economy rapidly. Currently, there are over 700 industrial enterprises in the Zone, and the foreign invested enterprises amounts to 231 from 16 countries and districts such as America, Japan, Holand, Korea, Singapore, Canada, Hong Kong, Taiwan and so on. The invested fields include engine, electron, medicine, fine chemistry, 9 clothing, constructing resources and real estate with the total amount fund of 1.4 billion US Dollars. Meanwhile, some inner project has been set up in the Zone as well. The Zone has one sub-zone of 'Wangshan Photoelectricity Hi-tech Industrial Park" which contains development zone, Changqiao Town, Hengjing Town and Puzhuang Town with the total area of 60 km2. Currently it has been in the actual realization period. The Industrial Park sticks to develop in high standard, construct in high speed, invest in high intension, output in high benefit to form it to be a zone with classical soft and hard environment and to attract classical high-tech enterprises from abroad and at home. In 2000, the export exceeds 0.33 billion Dollars and the zone have been prized as 'Perfect Development Zone" by Jiangsu Province People's Government. Wuzhong Hi-tech Development Zone is the provincial economic tech development Zone. To perfect the investing environment of the zone, to increase the attraction to the fund and to enhance the attraction of investing, the environment of Wuzhong must be promoted. Wuzhong Sewage Treatment Project is built in accordance of the construction of the Development Zone. 1.4 Project Design Procedure 1.4.1 WECTP Lake Tai River Basin is one of the most rapid economic development area, and one of areas with relatively high degree of industrialization and urbanization. With the economic development, city enlargement, population growth, the 10 conflicts of supply and demand of water resources have become standing-out and water pollution is serious increasingly. Induced water shortage of quality and water pollution has restricted sustainable development of national economy and improvement of living standard in Lake Tai River Basin. In 2001, Lake Tai Water Pollution Treatment Tenth-five Plan (Tenth-five Plan for short)was compiled by National Environmental Protection Bureau together with Jiangsu, Zhejiang and Shanghai related departments, by the end of 2005, changing better of water quality in Lake Tai will be fulfilled, which lays a good foundation for settling water pollution issues ultimately and recover ecological system of good recycle. Suzhou water net is a part of Lake Tai River Basin, city proper of Suzhou is fallen in Tenth-five of water pollution treatment range, which is Suzhou control area of Jiangsu planned area, therefore, water pollution treatment of Suzhou city proper is an important part of Lake Tai water pollution treatment, so the implementation of treatment project should be followed to objectives and guidelines of Tenth-five Plan. In 1998, WECTP of Suzhou city proper has been carried out, which includes Sewage Pipeline Net System, Loujiang and Fuxing WWTP first-stage project, leading water of Lake Tai to Gucheng District river net and River Net Renovation Project. According to general deployment and requirement of Tenth-five Plan, in July, 2002, Suzhou Planning Committee submitted Suzhou Downtown Water Pollution Treatment Project Proposal to Jiansu Planning Committee, then Jiansu Planning Committee transferred the proposal to National Development Planning Committee, in order to perfect and reinforce WECTP, and enlarge ranges and effects of treatment, on the base of implemented Suzhou WECTP. 11 1.5 Total Investment and Capital Source The project is belonging to urban infrastructure, invested by Suzhou Peoples' Government, and the capital source consist of two parts, domestic supporting capital and World Bank loan. Short term investment of Suzhou WECTP is 1.138 billion, among which 0.889 billion yuan is settled by Suzhou Peoples' Government, the rest 0.249 billion yuan is settled through applying for loan from World Bank, amounting to 30 million US dollars. 0.16092 billion yuan will be invested for Wuzhong Sewage Treatment Project, among which 0.1049 billion yuan is settled by local government, and the rest 56.02million yuan is settled through applying for loan from World Bank, amounting to 6.75 million US dollars. 1.6 Measures for Reducing Project Influences 1.6.1 Plan and Design Stage of the Project During the plan and design stage, the design unit and project owner have adopted some effective measures to reduce project impact on local social economy. The main measures are shown as below: A, In the project planning stage, project impact on the local social economy should be taken into account as much as possible and as the key factor in choosing the scheme; B, Sewage pipes and rain pipes to be laid in the edge of or in the middle of the road to avoid house demolishment; C, During the positioning process of routes of urban roads and rivers, the design unit make a reasonable analysis of it to reduce the house 12 demolishment as much as they can; for example, through optimizing planning of Xujiang Hinge Project, demolishing of main workshop of Shunchang Cotton Mill is avoided, and impacts on more than 200 employees are avoided; impacts on shops are avoided in Shangtang River Hinge Project. D, Optimize design, arranges the overall layout in preservation area, and reduces house demolishment as much as they can. 1.6.2 Construction Stage of the Project A. Reducing the Influences on Urban Transportation Laying .and construction of pipes are usually in the center. or along one side of the road. The exaction of roads will seriously influence the traffic of that area, which should be taken into consideration by the project developers. For the roads with busy traffic, they will set up temporary convenient access, arrange traffic policemen to maintain the normal order and try to avoid the rush hours for construction, such as constructing at night to ensure the smooth traffic in day time; as far as construction methods are concerned, they will construct section by section. Moreover, they try to finish the excavation, pipe laying, land filling in the shortest time as possible as they can. B. Measures to Reduce the Dust Soil excavated from the trenches is laid beside the roads. Wind in the dry season and machines raising the soil will cause the dust flying, nearby residents and factories will be influenced. In order to reduce the adverse effects on the environment, abandoned soil should be sprayed water on the surface if several days of fine weather and wind blowing are encountered in the process of construction. Units of construction should treat the abandoned soil promptly and in the loading and carrying process, try not to overload the 13 soil to prevent the falling of soil on the roads. Wheels of the vehicles should be cleaned by compressed water before the vehicles begin to work to keep the environment clean. Meanwhile, construction units should clean the roads in time if there is abandoned soil. C. Control the Noise from Construction Noise of construction comes from laying the pipes, excavating trenches, blowing of horns, mixing noise of concrete and noise of earth cover road roller. In order to control the noise, the construction in the area of 200 meters around the residences is prohibited from 11 o'clock at night to 6 o'clock next morning. And construction units should choose suitable construction facilities and methods, use machinery with low noise. And if sometimes, construction during the night is needed and residents nearby will be influenced, construction machinery should be equipped with noise elimination devices. Meanwhile, temporary noise interception devices should be set up around the building site or around the residences to keep the noise environment of residences. D. Treatment of Waste Materials in the Site of Construction Project developers and construction units should contact the local environment hygienic department to clean the domestic waste materials on the site of construction promptly to keep it clean. E. Decrease Pollution of Mud and Impacts Induced by Temporary Land Occupation of Mud-removing field The mud cleaned from watercourse have quite a number of water, if they are transported, conveyed, piled up and treated in an inappropriate way, they will lead to secondary pollution. They are conveyed with ship rather than car, which avoid secondary pollution in transporting and loading. Through choosing 14 pile-up site and reasonable place, secondary pollution is avoided or decreased, and reasonable utilization of land occupied temporarily after planting recovery, efficiency of land usage is resumed and increased. 1.6.3 Preparation of RAP & Implement Stage of the Project When resettlement is inevitable, following measures will be adopted for decreasing the local impact caused by the construction. A, Enhance basic data acquisition, analyses on local socio-economic status and development in the future, and formulate practicable action plans with due consideration of actual situation, thus ensuring that the people affected by the project will not suffer loss. B, Actively encourage the public participation in the resettlement works, and accept supervision of the public. C, Strengthen internal and external independent monitoring activities, establish highly efficient and smooth channel for information feedback, reduce information processing period, thus ensuring that problems can be resolved timely. 15 2 Project Impacts In order to find out the impacts of this project, PMO and designing organization made the socio-economic investigation of the affected family, enterprises and institutions and collectively economic organizations in affected area by this project comprehensively in September, 2002 to July, 2003 according to designed process of sub-projects. The mode of combination of investigating households and units one by one and interview are adopted. It involves all areas of land acquisition; the content of investigation includes physical quantity of land acquisition and house demolishing and socio-economic of DPs'. DPs took part in investigation work. Investigating group heard opinions on land acquisition, demolition and resettlement from residences, enterprises and rural collective economic organization, land administrative department of municipal and related groups, and discussed with them widely. 2.1 Affected Land 2.1.1 Permanent Land Occupation In the project, permanent land occupation is needed for Jinghang Canal Sludge-blocked Project, the land includes,15.48mu state-owned land and 8.42mu collectively-owned land; temporary land occupation is needed in Watercourse Dredging Project for piling-up sludge; the reserved state-owned land in first-stage has been utilized for Fuxing and Loujiang WWTP; reserved state-owned land has been used for Wuzhong WWTP, so there is no need for new land acquisition. Suzhou Downtown Sewage Treatment Second-stage Project. In Fuxing and Loujiang WWTP first-stage projects, general floor plan layout of WWTP is planned once with long term scale, and implementing by stage and land is 16 reserved for sewage and sludge treatment at second stage. Among them, the land acreage occupied by Fuxing WWTP is about 7.26ha, 4.16ha land was requisitioned by first stage project, and the reserved land for sewage treatment locates in north end of WWTP, for sludge treatment locates in northwest of WWTP, with the acreage of 46.5mu(3.1ha);land acreage occupied by Loujiang WWTP is about 8.25ha,all land was requisitioned by first stage project, and the reserved land for sewage treatment locates in southeast end of WWTP, for sludge treatment locates in southwest of WWTP, with the acreage of 45mu(3.Oha). There is no permanent land occupation in Watercourse Dredging Project. Jinghang Canal Sludge-blocked Project. The permanent land occupation mainly includes land occupied for construction (including within 10m away of sideline of construction,but the water surface should be deducted) and living administriative district. Watercourse Dredging Project. According to Feasibility Study Report on Suhzou Downtown Watercourse Dredging Project, Watercourse Dredging Project will temporarily occupied 786.6 mu pounds and pools of Xinyu Village Huqiu for pile-up the sludge, which will last for two years. Jinghang Canal Sludge-blocked Project. It will temporarily occupied 35.8mu (23866m2 in total) totally, among which there are 18.9 mu state-owned land, 16.9 mu rural collectively-owned land, lasting for two years. Wuzhong Sewage Treatment Project. It occupied land temporarily for construction of pipelines, with 532.56 mu land for temporary land occupation. The pipelines net system is buried and laid out with the usage of green belt along the road, so the land temporarily occupied is land for green belt. Condition of temporary land occupation can be seen at Table 2.2. Watercourse Dredging Project, Fuxing and Loujiang WWTP, the Shangtanghe part of Jinghang Canal Sludge-blocked Project and Wuzhong Sewage Treatment Project do not involve house demolishing. According to Feasibility Study Report on Jinghang Canal Sludge-blocked Project, constructions, within 15m along Xujiang, which is surrounding with Canal, should be demolished for structure and constructing reason, and residential houses with 1 5m north side of Xujiang are needed to be demolished. Shangtang River Hinge. Flat houses owned by Suzhou Fruit and Sock LTD. Corporation and some concrete floor and fence etc. need to be demolished. Watercourse Dredging Project affect 172 persons due to temporary using land for mud . The project direct affect 339 persons, details of direct DPs can be seen at Table 2.6. The project affect no any institutions and shops. During the social-economic invastigation, the vulnerable cannot be found. 27 3 Objectives of Resettlement Objectives of resettlement involved in the project are as follows, * To optimize the design and keep the project away from area with much population, multi-story high buildings, to reduce quantity of demolition ass much as possible, and to minimize the involuntary resettlement. * To carry out involuntary resettlement as a component of the project, to provide adequate funds for DPs resettlement and to assure that they can benefit from the project. * To give help to DPs when they move out and resettle down. * the demolished households improve the living environment by resettlment * To minimize the loss of enterprises and institutions caused by land acquisition and demolition. If demolition is inevitable, they will be compensated for the loss of suspense of business and production. What's more, they will be resettled properly and get help to restore the business or production as earlier as possible. * As for rural production land occupied temporarily, the planting should be recovered after the occupation, great efforts should be made to recover and increase the production activities, employment opportunities and economic income for DPs. * To encourage DPs to take part in compilation of RAP and resettlement. The way that DPs choose to be resettled should be respected fully. * To improve DPs living standards or at least restore their former living standards. 28 4 Socioeconomic Sampling Survey of People and Units Affected In order to grasp the socio-economic condition in affected area and basic condition of DPs, PMO made the socio-economic investigation in affected area initially in August, 2002 to July, 2003 according to the requirements of World Bank, which provides basic information for project analysis. During January to July, 2003, when PMO conducted the survey on physical quantity, they made sampling survey of affected households and PAUs about socio-economic condition, and the combination of questionnaire and interview has been adopted in the survey. The survey involves 48 rural households directly affected by Watercourse Dredging Project, 9 urban households and 8 enterprises directly affected by Jinghang Canal Sludge-blocked Project. Suzhou Downtown Sewage Treatment Second-stage Project and Wuzhong Sewage Treatment Project do not have PAP, so the socio-economic survey did not involve it. 4.1 Watercourse Dredging Project According to Feasibility Study Report on Suzhou Downtown Watercourse Dredging Project, 786.6mu pounds in Xinyu Village, Huqiu are needed to be occupied temporarily for piling-up sludge, lasting 2 years, and there 48 temporarily affected households with 172 persons. There are 17 villager groups, 720 households of 2083 persons. There are 1069 labors, the structure by employment, agriculture 317; industry 358; others (business, transportation and service etc.) 394. In June, 2003, there are 1040 mu plowland, 680mu pound and 220mu other water surface. 29 If the plowland is distributed averagely, the quantity is 0.5mu per capita. Among the plowland, there are 520 mu paddy field, planting one season wheat or rape, one season ripe, net income per mu is about 350yuan; 420mu vegetable land, among which 60 mu cote vegetable, mainly planting aloe and vegetable against the season, net income per mu is about 5000yuan; 360 mu field vegetable, planting all kinds of vegetables, net income per mu is about 2000yuan; 100mu dry land, mainly planting all kinds of vegetables, for family food. The age of labors seeking in planting is ranging from 40 to 60 years old, among which male accounts 30%, and female accounts 70%. There are 680mu pound, contracted for running by 48 peasants voluntarily, and one contract period is 3 years, when the contract period is over, the contracting peasants put forward proposal for further contract on the base of their wills and labor conditions, and negotiate with the village' Committee. This round contract period begins from January, 2002, and cost is 400 per mu, and hand in by every year end. Four fishes and weever etc is breed in pound, and net income is about 2000yuan per mu. Benefits of breeding aquatics is decreasing for the add of breeding acreage in south of Jiangsu recent years, among the culturists, there are 60% making profit, 20% not making profit or loss, and 20% making loss. The age of labors seeking in breeding aquatics is ranging from 40 to 60 years old, among which male accounts 60%, and female accounts 40%. There are 13 enterprises in village, with 360 employees. In 2002, industry general value was 22 million yuan, and turning-in tax was 1.05 million yuan, as estimated, it is up to 30 million yuan in 2003, and turning-in tax is 1.5million yuan. Among them, there are six electroplating factories, with 85 employees; one reclaiming factory of noble mental, with 80 employees; one colored cement work, with 20 employees; one colored brick fieldl, with 15 employees; one Shaxing Filtering factory, with 30 employees; one Jinxing oxidation factory, 30 with 80 employees; one die-casting factory, with 20 employees; one cooper material factory, with 30 employees; among them, there are 300 employees from the village, their age ranging from 20 to 40 years old, among which male accounts 60%, and female accounts 40%, and annual income is 8600yuan per capita in 2002. Above-mentioned enterprises rented all land and workshops from village, and turn in rent to village. In 2002, the village got rent of 1.05million yuan, as estimated; it is up to 1.5 million yuan. In July 2003, 200mu plowland was used for building flower and tree base to develop the production of flower, tree and seedling tree, through introducing external capital and technology, and sell them to Suzhou, Wuxi and Shanghai etc. area. According to the contract signed between the investor, village' committee and land contractor, the investing corporation uses the land for ten years, and pays to original land contractor 500 yuan per mu annually, at the same time, the labors of land contractor can work in flower and tree base, with pay of 20 to 30 yuan per day. The village has stably increasing collective economic income, and good community administrative system and preliminary rural social safeguard system. 1.15 million rent was got in 2002, through renting out land, collectively-owned houses etc. to enterprises in village, which is up to 1.50million yuan; 0.27 million yuan can be got through contracting out the pound. These incomes are used to put out pension for the old without the working ability (as for male above 60-year-old, female above 55year-old) at the standard of 150yuan per person per year, and provide the labor 100yuan per person for insurance of serious illness. 31 4.2 Jinghang Canal Sludge-blocked Project 4.2.1 Survey Results of Affected Family Basic Situation 9 households, all non-agricultural residents, are affected by the project, living in Shuangqiao Village, Hengtang Town. (1) Family Population This survey covered 9 households, with 40 persons who are non-agricultural people without exception. There are 21 females, accounting for 52.5% of total population. 29 city labors, accounting for 72.5% of total population, among which there are 11 female labors, 2 students, accounting for 5% of total population. (2) Age Distribution Among 9 households with 40 people which have been investigated, 4 people are under 8 years old, accounting for 10% of total population; 3 are under 8- 18 years old, accounting for 7.5% of total population; 30 are under 19-60 years old, accounting for 75% of total population; 3 are above 61 years old, accounting for 7.5% of total population. (3) Education Distribution Among 9 households with 40 people which have been investigated, 2 people are illiterate, accounting for 5% of total population; 14 people have finished elementary school, accounting for 35% of total population; 17 people have finished middle school, accounting for 42.5% of total population; 3 people have finished got three-year college or above, accounting for 7.5% of total population, 4 are under school age, accounting for 10%. 32 (4) Labor Employment Among 9 households with 40 people which have been investigated, 29 people are city labors. Among them, 7 people are in enterprises or institutions, accounting for 17.5% of total population. (5) House Construction Area Among 9 households which have been investigated, house construction area is 2908m2. Average area for each household is 323m2. Most residential house is two-storied buildings. (6) Family Annual Income According to the statistics of 9 households, average family annual income is 29873yuan, among which annual wage is 10733yuan, accounting for 36% of family annual income; income from house-renting is 10733yuan, accounting for 54%; other income is 2953yuan, accounting for 10% of family annual income. (7) Family Annual Expenditure. Average family annul expenditure is 16380yuan, among which charges for electricity is 533 yuan, accounting for 3.3% of total family annual expenditure; cost of domestic water is 413yuan, accounting for 2.5% of family annual expenditure; cost of communication is 822yuan, accounting for 5% of family annual expenditure; cost of children education is 889yuan, accounting for 5.4% of family annual expenditure; cost of medical treatment is 2222yuan, accounting for 13.6% of family annual expenditure; cost of fuel is 789yuan, accounting for 4.8% of family annual expenditure; cost of non-staple food is 8933yuan, accounting for 54.5% of family annual expenditure; Other cost is 1778yuan, accounting for 10.8%. Income and expenditure structure can be 33 seen from Table 4.1. Customs of living and production, social and cultural backgrounds of 35 them are the same as those of other residents in Suzhou. When the residents affected purchase houses in the market, they will take their work, living and all kinds of social relations into consideration. So did other residents who have lived in the residential sub-districts. Therefore, it is easy for DPs and original residents to live together. Based on the above analysis, a conclusion can be drawn that the relocated people should have no problem integrating with the host residents. 36 6 Legal and Policy Framework 6.1 Laws and polices * Land Administration Law of the People's Republic of China(Come into force since Jan 1, 1999) * Urban Real Estate Administration Law of the People's Republic of China(Come into force since Jan 1, 1995) * Urban House Demolition Administration Regulations (Come into force since November 1, 2001) * Jiangsu Province Enforcement Methods of Land Administrative Law of P. China * Jlangsu Province Urban House Demolition Administration Regulations (come into force since Jan 1, 2003) * Suzhou land acquistion temporary methods (issued Suzhou government in 2000, the 41 th government file) * Suzhou Urban House Demolition Administration Regulations ( Issued by the Suzhou Regular Committee of People 's congress, come into force since May 29, 2002) * World Bank OP4.12 Involuntary Resettlement and Appendix (Come into force since January 1, 2002) 6.2 Relative Laws and Policies Involved in Resettlement 6.2.1 Limits of Acquisition and Nature of Compensation 6.2.1.1 Limits of Land Acquisition and Nature of Compensation Land Administration Law of the People's Republic of China stated that all units and individuals that need land for construction purposes shall in accordance with law apply for the use of state owned land. Article 58 Under any of the following circumstances, the administration department of the people's government concerned may, with the approval of the people's government that has originally approved the use of land or that possesses the approval authority, take back the right or the use of the State-owned land: 37 (1 )The land is needed for the benefits of the publics; (2) The use of the land needs to be readjusted for renovating the old urban area according to urban planning. Article 47 Land requisitioned shall be compensated for on the basis of its original purpose of use. Main provisions of "P.R.C. Urban Estate Administration" are as follows: Article 22 Allocation of land use right means that approved by the government over country level, after the land users have paid compensation, relocation costs etc., they can use the land, or they can get the land use right free of charge. Article 23 If the land use of the following land for construction is really necessary, it can be approved and allocated by the government over country level: land for urban infrastructure and public utilities, land for energy, transport, water conservancy etc., project which are the state key project. The compensation include land compensation, resettlement subsidy, pension, the compensation for ground attachment and young plant fee. 6.2.1.2 Limits of Demolition Houses and Nature of Compensation Urban House Demolition Regulations stipulate: Article 6 The unit who demolish the houses can not carry out the demolition until getting house demolition license. Article 22 The unit who demolish the houses should compensate the unit whose houses are demolished in accordance with the regulations. Jlangsu Province Urban House Demolition Administration Regulations stipulate: Article9 the demoliting party should pay the compensation to the demoshed party according to the Urban House Demolition Regulations and Jlangsu Province Urban House Demolition Administration Regulations Suzhou Urban House Demolition Administration Regulations stipulate: Article6 the unit that need to demolish house, have to apply to house demolition administrative department for licence of demolition, and pay management fee. 6.2.2 Laws and Administration Procedures Land Administration Law of the P.R.C. Article 46 Where land is to be requisitioned by the State, the requisition shall, after approval is obtained through legal procedure, be announced by people's governments at or above the country level, which shall help execute the requisition. Units and individuals that own or have the right to the use of the land under requisition shall, within the time limit fixed in the announcement, register for compensation with the land administration department of the local people's government by presenting their certificates of land ownership or land-use right. Urban House Demolition Administration Regulations: Article 8 As the house demolition permission license was given, the department in charge of house demolition shall propagate the demolition unit, the demolition scope, 39 the deadline of demolition and other items in the form of house demolition notice at the same time, the department of in charge of house demolition and the unit who demolished the houses shall in time propagate and explain the policies to the persons whose houses are to be demolished. Relevant provisions of Jlangsu Province Urban House Demolition Administration Regulations Article4 the urban house demolition should obey the following procedures: (1)conducting the evaluation to demolished object; (2) applying for licence of demolition to house demolition administrative department; (3) house demolition administrative department issue bulletin; (4)signing written contract about the compensation for resettlement and demolition. (5)the demolishing unit pay compensation according to the contract. (6) carrying out demolition Suzhou Urban House Demolition Administration Regulations stipulate: Articl 7 after decideing the range of demolition, the house demolition administrtive department should notice the relevant department, including industry and business, planing, house management, national land, and so on, to temporarily stop transacting the procedures of business license, building and mending houses, selling, hiring out mortgaging and dividing houses, and converting use of land and houses. The suspending span is no more than one year; the demolishing party need to relay the suspending span, have to get approval of demolition management department, the extending length is no more than one year. Article8 the house demolition mamagement department should announce the household, range and time of demolition whthin seven days since issuing the license of demolition 6.2.3 Compensation Provisions Urban House Demolition Administration Regulations: 40 Article 23 House demolition can be compensated in the way of exchanging ownership, or in cash. Article 24 Amount of money for compensation is determined by evaluation price in real estate market considering location , function and construction area etc. of demolished house, and is paid at. Detailed measures are formulated by Peoples' Government of Province, Municipal Jiangsu Province Enforcement Methods of Land Administrative Law of R R. China : Article26 the compensation for land includes land comensation, resettlement subsidy, the ground attachment compensation and young plants compensation, the compensation standard is decided by county government with district, and is reported to province government to record. Relevant provisions of Jlangsu Province Urban House Demolition Administration Regulations: Article9 the demoliting party should pay the compensation to the demoshed party according to the Urban House Demolition Regulations and Jlangsu Province Urban House Demolition Administration Regulations. The compensation way may be money compensation and ownership exchange, the demolished party have right to compensation way, except for the following conditions: (1) the compensation way for the demolition of the attachment of non-pubic houses is not ownership exchange but money compensation; (2) among the demolition of rent houses, the demolished household cannot agree with lodger on terminating contracts, ownership exchange should be adopted for compensation. Relevant provisions of Suzhou land acquistion temporary methods: Article 16 the copemsation rate for land: (1)the compensation rate for farmland acquisition is ten times the average output value of farmland in the lately three years; Article17 the standard of resettlement subsidy (1) the resettlement subsidy of farmland acquisition is calculated on the rural 41 population to be settled down. the rural population to be settled down can be calculated by the average individual farmland dividing the total land acquisition area, the resettlement subsidy standard is six times the average output value of farmland in the lately three years. The resettlement subsidy every hectare is no more than fifteen times the average output value. In principle, for acquiring non-farmland, the resettlement subsidy should not be paid, and the rural population should not be settled down. Suzhou Urban House Demolition Administration Regulations stipulate: Article19. The compensation for demolishment may take the way in currency compensation or housing ownership exchange, and that may be decided up to the relocates. Article 20. The sum of currency compensation for housing demolishment should be settled in line with marketing valuation price of real estate according to the following factors. The city people's government according to the relative regulations of the province may draw up the details. (1) the replacement price of the demolished houses, assessment value of housing decoration, assessment value of attachment. (2) Some region factors such as the basis price of the region of demolished houses, discount of transferred land, the surroundings, convenience degree of commerce service and traffic, and the infrastructures of public affairs. (3) The building acreage of the demolished houses. If the demolished house is within five years since the date of completion to the date of demolishment license issued, the currency compensation to the relocates should be increased by 10%. Article 21. The replacement price of the demolished houses is only referred to the reconstruction and re-installment costing, which will be decided and 42 announced annually by the price and housing management department of city and county according to the structure and rank of houses. The demolished region and basis price is settled according to the following regulations: The demolished region within Suzhou city is decided and announced by the city people's government according to the rank classification of land; the city people's government according to the usage and region of housing located decides the basis price of the region. Moreover, the demolished region and basis price of Suzhou Industrial Region, Suzhou New Area, Wuzhong Area, and Xiangcheng Area should be decided by the region management committee or people's government and reported to the city people's government for approval. The basis price and compensation methods approved by the city people's government should be reported to city people's present represent daily committee and be announced annually. The demolished region and basis price of the county level should be settled and announced by the county people's government and reported and put on records to Suzhou city housing demolishment management department. The region compensation should be in line with the land usage acreage if the building acreage of the demolished house is less than the land usage acreage. The transferred land discount means that remising price of the transferred land should be deducted from the region compensation. Article 22. The owner and building acreage of the private house of individual and unit should be confirmed according to the housing ownership certificate. The housing renter and building acreage of the public house should be confirmed according to the documents provided by housing ownership 43 management department. The land usage acreage is decided according to state-owned land ownership certificate. Article 23. The demolished houses is classified into residential house and non-residential one, and that should be decided according to the usage recorded in housing ownership certificate or the function recorded in construction work planning license. The demolished non-residential house is classified into commercial housing and non-commercial one, and that should be decided according to the business range and way recorded in the business license. Article 24. The relocates should consign and contract with the demolished housing assessment agency that is announced by housing ownership management department (HOMD) and housing demolishment management department (HDMD) of city and county level. The relocates should take on the assessment cost. Article 25. In housing ownership exchange, the relocates should assess the currency compensation of demolished house and the market value of the exchanged house in line with the 20th item of regulation and settle the price difference in ownership exchange. The attachment of demolished non-commonweal cannot conduct ownership exchange and will be compensated in currency. Article 26. The non-productive house and attachment used for commonweal facilities that will be demolished should be rebuilt according to relative laws and regulations as well as the requirement of city planning. The relocates may choose currency compensation and still plunge it into commonweal facilities construction. 44 Article 27. In the demolishment of public house and private house owned by the units rent in standard reprise, the relocates that choose currency compensation and release from the renter should be compensated according to the following regulations. Residential house: 20% of the amount of currency compensation (not including housing decoration assessment value) will be given to the relocates, and the rest to the renter. The compensation for housing decoration will be given to the decoration cost contributor. Non-residential house: 30% of the amount of currency compensation (not including housing decoration assessment value) will be given to the relocates, and the rest to the renter. The compensation for housing decoration will be given to the decoration cost contributor. Article 28. The relocates that do not choose the compensation way of demolishment regulated in 1 gth item and cannot manage to purchase house by the same way may apply for the demolisher and thus be provided with house whose acreage is not less than that of the original one by the demolisher in standard rent. The demolisher will deduct region compensation from the housing currency compensation and pay for the relocates. The renter of public house and private house owned by units that do not choose the compensation way of demolishment regulated in 28th (1) item of this regulation and cannot manage to purchase house by the same way may apply for the demolisher and thus be provided with house whose acreage is not less than that of the original one by the demolisher in standard rent. Article 29. When the house used for housing ownership exchange is delivered to use, the demolisher must provide the relocates with the required relative documents for the transaction of housing ownership certificate and 45 state-owned land access certificate. The demolisher use the house sold in advance for housing ownership exchange according to the relative regulations of state commercial house selling management. Article 30. The demolisher should reward the relocates or renters that relocate ahead of schedule within the regulated time limit of relocation properly. The rewarding standard will be settled by the demolisher, reported to HDMD for approval, and announced for implementation. Article 31. The demolisher should pay the relocates or renter for relocation compensation according to relative regulations. In currency compensation, the demolisher should pay for one-off temporary relocation compensation of six-month. In housing ownership exchange, the demolisher should pay for the temporary relocation compensation according to the due transferring time limit. If the transferring time limit will be extended due to the demolisher, the temporary relocation compensation should be increased since overdue month. The standard of relocation compensation, temporary relocation compensation and telephone-transferred cost should be checked and announced by the prices management and HDMD of city and county level according to the relative regulations of the province. Article 32. The demolisher should compensate the relocates or renters that close down or stop production because of the demolishment of non-residential house for their losses properly. The compensation standard should be checked and announced by the prices management and HDMD of city and county level. 46 6.2.4 Responsibilities Land Administration Law of the People's Republic of China: Article 66 Land Administration department of the people's government at or above the county level shall supervise over and inspect violations of laws and regulations governing land administration. Supervisors over and inspectors of land administration shall be familiar with the laws and regulations governing land administration and they shall be devoted to their duties and enforce laws impartially. Article 70 Where, in the course of supervision and inspection, land administration departments of the people's government at or above the county level find any violations by State functionaries and believe that administrative sanctions need be given to such functionaries, they shall deal with such violation in accordance with law; if they have no right to do so, they shall propose in writing to the administrative supervision departments of the people's governments at the corresponding or a higher level that administrative sections be given to the functionaries, and the administrative supervision departments concerned shall deal with the violations in accordance with law. Article 79 Whoever embezzles or misappropriates the compensation or other relevant charges paid to a unit whose land is requisitioned, if the violation constitutes a crime, shall be investigated for criminal responsibility in accordance with law; if the violation is not serious enough to constitute a crime, he shall be given administrative sanctions in accordance with law. Urban House Demolition Regulation Article 5 The unit who demolishes the house shall, in accordance with this regulation, compensate and replace the people whose houses are demolished. And the people should submit themselves to the need of the city construction and move out with the given period. Article 6 The Real Estate Administration Department of the State council is in charge of the national urban house demolition. The Real Estate Administration Departments of the people's government at or above the county level or the departments authorized by the government are in charge of the urban house demolition in their 47 own regions. Article 7 The people's governments at or above the county level should strengthen their leadership on the urban house demolition. Jiangsu Province Enforcement Methods of Land Administrative Law of P. R. China Article54 the compensation incluing land compensation and resettlement subsidy, shoule have been paid to the farmers whose land are acquired, and is deducted or not paid enough, the government senior to county order to correct. The action of seizing and diverting the resettlement funds, including land compensation, resettlement subsidy, ground attachment compensation, young plant compensation and other fee happening in land acqusition, should be given to administrative punishment according to laws. If the action form crime, the criminal responsibility should be invatigated. Article55 After farmers building new houses,original houses cannot be demoshed according to the former contract, the land administrative department of local government senior to county orders to demolish in certain time; the project unit can apply to enforcing beyond deadline. Article57 the working personels of the land administrative department who neglect duties, abuse power and act malpractice, should be given administrative punishment by himself unit or senior department. If the action form crime, the criminal responsibility should be invatigated. Suzhou Urban House Demolition Administration Regulations stipulate: Article36 the following action against the regulations would be given administrative punishment by the land administrative department according to laws and regulations: (1) do not get the license of house demolition; (2)get he license of house demolition by deceiving; (3)the range of demolition disagree with license; (4)entrust unqualified unit to demolish house; 48 (5)lengthen the demolition span without application; (6)the entrusted demolition unit makes over demoltion business against contract. The demolishing party and entrusted demolition unit conduct one of the above, and result in the loss of the owner or user of demolishend house, should bear civil responsibility. 6.3 Resettlement Policies of the Project All the resettlement policies carried out in this project are under resettlement policies of P.R.C, of Jiangsu People's Government, of Suzhou People's Government and of the World Bank. The policy of demolition compensation in the Project as following: * The compensation rate for all property is decided by replacement principle * The compensation is paid before the land and property are acquired; * The compensation rate for permanent land acquisition, resettlement subsidy and resettlement ways are decided by the negotiation between Project Office and affected village or owner; * The municipal Project Office based on the policy of compensation for temporarily using land that issued by local government, pay land compensation to user and land recovery fee to owner; * The affected houses is compensated on replacement price; * In the course of urban house demolition, the Project Office directly pay compensation to urban residents, the residents buy house on their own willing. * In the course of enterprise houses demolition, the Project Office directly pay compensation to owners, the owners buy or build houses 49 on their own willing. * The enterprises are affected by project building, their loss of cease production should be compensated till recovery production, the compensation rate should be decided according to the average benefit, staff salary and the span of cease production. * Strengthen building management, try to lessen the loss of cease production as possible; * Affected infrastructure would be rebuilt at replacement cost by the owner or Project Unit. * the standard of the land compensation and resettlement should be paid according to Jiangsu Province Enforcement Methods of Land Administrative Law of R R. China, Jlangsu Province Urban House Demolition Administration Regulations, Suzhou Urban House Demolition Administration Regulations and Suzhou land acquistion temporary methods 6.3.1 the resettlement policy of permanent land acquisition A. compensation price According to the relevant policy, the using fee for national land should be paid, the fee standard should refer to that of the others project, is 180000 yuanRMB/mu. But this project is the key one, the project owner can apply free using to the Suzhou govemment in the courde of implementation. When the the rural land is acquired, the compensation rate is carried out according to the upper limit of Suzhou land acquistion temporary methods. Because the permanent land acquisition is collective non-farmland, the compensation rate should refer to that of the others project, is 180000 50 yuanRMB/mu. B. the resettlement policy Because the land affected by the Project is national land or collective noe-farmiand, not involving the farmland, the compensation way is money resettlement, there are no rural resettlement for farmland acquisition. 6.3.2 The policy of temporary using land A. the compensation price for temporary using land The compensation price for temporary using land is decided according to Suzhou land acquisition temporary methods and the using time calculated by Suzhou national land management bureau. The compensation rate in Xujiang Project is 3250yuanimu.year, the span is two years, so the compensation price is 6500yuan/mu. The compensation rate in canal dredging Project is 2000yuan/mu.year, the span is two years, so the compensation price is 4000yuan/mu. At the same time, the compensation for tools and equipments that cannot be handled with, is based on replacement price. The temporary national land using do not need to compensate, the ground attachment should be paid on replacement price or is rebuilt on original size and standard. B. the resettlement policy The temporary using land is national land or collective noe-farmiand, there is no resettlement. The Project office should pay land compensation for the fishing pond to the users and land recovery fee to the owner according to the policy drafted by 51 local government. The owner is in charge of recovering land, the original users can continue to contract. 6.3.3 The policy of house demolition The compensation policy for house demolition are money resettlement supplying directing selling houses and cheap-rental house for poverty household in the Project. The demoshed households have right to compensation way accoding to economic status and charact. The demolished houses are all private. the resettlment policy is as following: A. Compensation price The compensation for demolshed house is composed by the follwing three part: The region baseline price for urban house demolition. According to the file(NO.(2003)127) issued by Suzhou government, all the demolished houses sit in the forth grade region, the region baseline price is 1650yuan/m2. the enterprises sit in the forth or fifth grade region. The urban house replacement price. The replacement price of demoshed house is decided by estate evaluation institute with legal qualification. The replacement should be evaluated based on the basic replacement price issued by the government at the moment of approving license, combined with the compound factors, for examplethe type, contruction, furnitures, storey height, floor, and so on. The decoration price indoors should be evaluated according to decoration items, equipment, the number of attachments, the decoration grade and basic unit price. 52 According to Suzhou Urban House Demolition Administration Regulations, theproject office entrust the qualified evaluation institute to evaluate the demolished houses replacement price and decoration price after demolition announcement. The estate evaluation institute should listen to demolished househoulds' opinions before it make decision. B. resettlemnet policy After gain the compensation for houses, the demolished houses have three choices on their own: buying merchandise houses or directing selling houses built by government, or rent the cheap-rental houses supplied by government. ( 1 ) for the rich househoulds, in order to meet their character demand, they can buy houses in the Suzhou urban or the other place on their own. The selling behavior cannot be interfered. The demolished households who choose money compensation and buy house in the Suzhou, can be remited the tax by the number of the original compensation price (2) according to the government policy about directing-selling houses, the demolished households can choose to buy the directing-selling houses supplied by the government. Because the price of resettlement houses is less than that of merchandise house, the demolished households can buy houses at low price. Direct-selling commodity houses have fixed area and price. The area includes 45, 55, 65, 75 and 90m2. The extra 15% resettlement subsidy is paid to those who have right to buy derict-selling house but give up the rights. C.the moving subsidy policy (1)Temporary transitional fee is based on the area of demolished houses, 6 yuan/m2.mouth, the amount is 180 yuan at least.Pay six months temporary transitional fee one time to currency compensation for house demolition. For 53 property right exchange compensation way, whthin transitional span without accomplishment , Temporary transitional fee is 12 yuan/m2.mouth from the deadline,18 yuan/M2 for beyond three months, 24 yuan/M2 for beyond four months, analogize as this (increasing six yuan every month). (2)moving subsidy is decided by the number of moving.To residence houses,pay 300 yuan per household for whose area less 40m2, for the area of house exceeding 40m2, extra 100 yuan every 2Dm2, but the amount canot surpass 1 000 yuan. (3) The compensation for equipment indoors. The compensation for telephone set, installation of internet Ian, water and electricity, cable T.V.and gas pipeline are based on virtual loss. The transfer fee for hot-water machine and air-conditioner is 1 50yuan per set D. Other policy (1 ) the demolished households have rights not to pay any tax in the period of demolition and recovery. (2) the demolishing enterprise should help resettlers to handle the procedures of transfer of registered permanent residence and to transfer their chidren school. 6.3.4 The resettlement policy of demolished enterprises A.compensation price The compensation for demolshed house is composed by the follwing three part: The region baseline price for urban house demolition. B.resettiment policy At first, the demolishing enterprise should analyse the demolition and resettlement scheme from the angle of the technology and economic. Under the condition of meeting the demands for the production, it should be rebuilt and recovered in the original site as possible. It cannot be rebuilt in the original site, should be rebuilt in other place, the affected enterprises had better demolish and rebuild by itself, try to lessen the loss of production cease. The project office and planning department supply suitful site to enterprise to settle down. The resettlement site should be decided by discuss between affected enterprise and demolishing enterprise, and agree with the urban plan. The enterprises that resettle in the other place, should be arranged as possible as early, the rebuilding action should begin in advance. The enterprises that need rebuilding, can apply to remittingthe supporting facilities fee of original area, and the government should transfer the equal area land to the enterprises as rebuilding land in industry area. For the enterprises that rent houses to produce, if the original owners have surplus houses for hiring, the owners and the tenants can sign rent contract; if the original owners have no surplus houses for hiring, the domlishing enterprise supply aids to the demolished enterprises. 55 C.moving subsidy policy (1) resettlement subsidy. To houses not for residence, pay 400 yuan per household for whose area less 50m2; for the area of house exceeding 50m2, extra 400 yuan every 50m2;when the whole entewrprise would move, moving subsidy is decided by consultation. (2) Loss for cessation of business .Demolishing non-residense houses brings Loss for cessation of business to manager, the compensation for this loss is paid 300 yuan/m2 for business house and 200 yuan/m2 for non-business house. (3) temporary transsitional fee. D.other policy (1 ) the rights and interests of works including salary, medical treatmen, social insurance, dividends and bonus, cannot be affected during moving (2) the workers cannot lose their jobs for moving. 6.3.5 Compensation Policies for Affected Ground Attachments Affected ground attachments will be rebuilt by their ownership after project unit compensates ownership. According to above mentioned policies, compensation rates of this project are stipulated combined with local circumstances and requirements of WR, see chapter 6 for detail. If there are demurral during implementation, demolishing unit should discuss and solve with demolished people. 6.4 Resettlement Policies for Linkage Project If sub-projects involved in Suzhou Lake Tai Water Quality lmprvoment Project overall plan are related to land requisition and demolition no matter they are financed by WB or not, they will be dealt according to the compensation policies and rates in this report. 56 7 Compensation Rates 7.1 National and rural collective land acquisition The land involved in the project is urban planing using land, not belong to basic rural land. The compensation rate for permanent land acquisition refer to others similar project. The compensation for temporary using land is based on the span length and virtual loss. See table 6.1 for the compensation for land. (2) temporary using land resettlement the canal dredging project need to temporarily take up 786.6 mu fishing pond and pool for ooze storage for two years in Xinyu Village from Huqiu Town. Because income from fishing pond is affacted in this period, the compensation for the loss is paid at 2000 yuan/mu .year, the compensation can make up for a loss. In two years, PMO will return the pond to the Xinyu Village, and pay land recovery fee, and villagers committee organize project to recover land planting function, the land continue to be used for rural production. After storing ooze, the fishing pond cannot be used for fishery, just can be used for others production. Some fishing equipment cannot be used or handled with, PMO should pay compensation for these to property owners at rebuilding price . According to Suzhou middle and long term developing plan, this region is planed as ecology area. So, after land recovering, combined with the site, resource, labour, production project and DPs willing of the Village, the land 64 would be used for flowers and seedling production, enlarge production to be the basis of flower and seedling in Suzhou, the product sell to Wuxi and Shanghai. Due to the urbanization and modernization of the south of Jiangsu province demands lots of flowers and seedling to afforest and prettify city, based on market analysis, flowers and seedling production have good social and economic benefit. The production organization can refer to existing ways, the flowers company use land, investor sign contract with villager committee and land user, the company pay 500 yuan/mu.year to user for land, at the same time, the original users can work in the company, their income is 20-30 yuan /day, 300 working days per year, they can earn 6000-9000 yuan; on a voluntary basis, the original users have rights to contract the recovery land, manage flowers and seedlings to get benefit. According to local conditions, the income per mu can reach 3000-8000 yuan/ year, if each household contract eight mu land, average income of household can reach to 24000-64000 yuan/year. There are 13 enterprises in the Xinyu Village, these are good economic benefit, with income stable. On a voluntary basis, the young labours will be recommend to these enterprises to work, their income can reach to 8600 yuan/year. All DPs plant farmland, and the part of labours work in the village enterprises, this part income add up to the income from using recovery land, the DPs' income will surpass original income. 8.2 The resettlement of urban demolition Resettlement in cash, providing resettlement houses and cheap-rent houses for poverty household are adopted for the compensation and resettlement policies on demolishing residential houses of this project. Provided by more 65 choices, DPs can choose different resettlement mode according to their own economic status and individual demand. Suzhou government have already carried out the directing selling houses system in 2002, in order to ensure that DPs can resettle down well and afford to buy houses. So each of the demolition households can buy a set of merchantdise house, the area have 50, 65 and 75 m2, the price is1900-2200 yuan/M2, price difference is based on region and storey. If the demolished househould give up the rights to buy house, they can get extra 15% resettlement subsidy. So the demolished households in the Project can not only restore their living condition, but also improve their living condition. In Suzhou, a lot of houses can be found in real estate market. They distribute in each district of Suzhou. And around the area that are affected by the project, real estate markets can always be found, DPs can choose their houses in the market at their own will. What's more, the supporting systems such as the supply of water, the supply of power, traffic, the supply of gas and cable TV will also be designed and constructed. Around each residential sub-district, there are schools, post offices, saving banks, vegetable markets, bus stations and hospitals. Therefore, it can be concluded that it is convenient for people to live there. What's more, the DPs can choose their new houses at their own wills. The demolition site sit in the near by Hengtang Town, Lijiaqiao, Wangxi Road, Tongxin Garden, and so on, there are new residence, the residence price is between 2100 and 3100 yuan/M2. at the same time, DPs can buy second-hand houses whose price is between 2100 and 3000 yuan/M2. The average area of nine demolished households is 323 m2, but the houses distribution is very crowded, and more the most of houses is used for rent, the rental is about 16187 yuan/year. The renting houses have no independent toiletand kitchen, hygiene condition is terrible. After demolition, resettlers can 66 buy a suit of directing selling house and other 2-3 suits of merchandise houses, one of these houses is used for living themselves, the others are used for hiring out. According to investigation, the rental is above 100 yuan/m2.year for suiting houses in Suzhou urban.the new houses have independent toiletand kitchen, with good quality, can get higher rental. If the area of hiring out house is 200m2/ househould, the rental income can reach to 20000 yuan! year. So, after demolition, the income of affected households cannot decrease and even increase through buying new houses and hiring out the part of them. 8.3 Resettlement of Enterprises The Project involved the enterprises including Hengtang food and oil factory (HTFOF), Suzhou fruits and vegetable company limited, Shunchang cotton mill, Suzhou jingwang estate company limited(SZJWECL), Shuangqiao collective storehouse. The project just affect the part of storehouse, workshop and attachment, the daily production of enterprises cannot be affected. Based on enterprises's willing to recover, the compensation is paid to the affected enterprises, it is unnecessary to rebuild in others place. The part of storehouse of Hengtang food and oil factory is demolished. The factory have 1 8000m2 storehouse, the Prject affect m2. At present, the storehouse cannot be made full use, can still meet the demand for production through interior adjustment. The Factory hope the money compensation for demolition of storehouse. Suzhou Xingsheng heating-contraction plastic film factory is demolished entirely. At present, the factory rent the storehouse of HTFOF to produce. According to the consultation, the factory can go on to rent the other storehouse of HTFOF to produce, of course can rent other district house to recover production. Suzhou Xingteng bean products processing factory is demolished entirely. At present, the factory rent the storehouse of HTFOF to produce. According to the consultation, the factory can go on to rent the other storehouse of HTFOF to produce, of course can rent other district house to recover production. Suoda Company is demolished entirely. At present, the factory rent the storehouse of HTFOF to store products. According to the consultation, the factory can go on to rent 67 the other storehouse of HTFOF to use, of course, can rent other district house to use. The shunchang cotton mill is demolished partly. The demolition involve in some attachment houses, and does not affect normal production. The mill rents the house of SZJWECL to produce. The mill hope the money compensation for demolished house to propery owner. Suzhou jingwang estate company limited hires out the houses to the shunchang cotton mill to use, the demolition does not affect the company normal activities. The Company hope the money compensation for demolition of house. Shuangqiao industry company is demolished partly. At present, the demolished houses are used for storing tools and temporary living. The Company hope the money compensation for demolition of house, and rent other houses Suzhou fruits and vegetable company limited is demolished partly. Affected infrastructure and ground attachments will be rebuilt by their ownership after project unit compensates ownership to some degree. 69 9 Participation and Consultation 9.1 Public Participation According to relevant resettlement policies and legal, to carry out the implementation efficiently, to guarantee the legal interests of DPs, to decrease the grievances and conflicts, and to fulfill the objective of well relocating the DPs, special attention will be paid to participation and consultation of the DPs in the project. During the resettlement policy developing, planning compiling and implementation phase of the project, the opinions of DPs are collected widely. During the project preparing phase--feasibility study phase, the PMO has consulted Suzhou City, Wuzhong District Government, People's Congress, Political Consultant Committee, people's groups, and representatives of DPs from the affected institutions, enterprises and shops about resettlement. All the suggestions and opinions on the resettlement have been considered in the RAP compiling. From October 2002 to July 2003, PMO organized workers to conduct initial census, property survey and socioeconomic survey within the scope of land acquisition and house demolition. The representatives of DPs took part in the survey, and made suggestions to resettlement compensation and rehabilitation. All the opinions and suggestions have been considered in the RAP compiling fully. From June to August 2003, PMO organized a special group and DPs representatives to take part in the physical and socioeconomic investigations on land acquisition and the effect of demolition. PMO solicited opinions from residence, enterprises and institutions, shops on land acquisition, house demolition, resettlement, and discussed the problems from all aspects. Meanwhile, a socioeconomic survey and a psychological investigation were carried out to know about the DPs' will for resettlement, what their attitudes are. All the detail work laid a good foundation for RAP. In the future, the following procedures and methods will be taken to encourage 70 public participation and consultation: (1) PAP Representatives Taking Part in the House Demolition and Relocation DPs, enterprises and institutions, shops choose their representatives in portion. By cooperating with sub-district office and neighborhood committee, the representatives solicit opinions and collect rationalization proposals from DPs. In addition to these, they regularly exchange views with DPs. Representatives of DPs take part in the process of survey for house and its adjoining parts, in confirming compensation standard, in negotiating the agreements on resettlement compensation and rehabilitation, in the construction and distribution of relocation house and so on, so as to reflect the DPs' opinions, and to ensure the judgment and transparency of the project resettlement. (2) Negotiating with DPs about resettlement ways. (3) Information and Discussion Meeting Representatives from DPs, house-demolished enterprises and institutions, shopkeeper of house-demolished shops, women (women should be more than 30% of all representatives) are organized to take part in discussion meetings six months before land acquisition and demolition. The meeting will inform them about the process and further obtain their opinions and suggestions. (4) Public Gathering Meetings The meetings are held 3 months before land acquisition and demolition, mainly to explain relevant policies, laws and regulations, compensation rates, etc. Thus, DPs can prepare for the resettlement earlier. (5) Propaganda through Media 71 (6) Making a Land Acquisition and House Demolition Announcement Prior to initiation of civil works for each street, the project will issue a formal announcement. The main contents are: brief introduction of the project, the demolition scope, resettlement policies(including compensation rate), organizations responsible for resettlement, scheme of resettlement, rights and obligations of DPs, grievance and appeals, monitoring and evaluation etc. (7) RAP disclosure Placing the RAP in Suzhou urban construction bureau and library before the World Bank appraise the project, propagate the notice in local main paper so that DPs and non governmental organizations can look it up. (8) PAP information handbook Compile the main part of RAP in PAP information handbook and send the handbook to PAP after the evaluation of the project and before movement. The main contents of information handbook are brief situation of the project, project impacts, compensation policies, implementation organization and appealing channel. 9.2 Public Opinions Survey In July 2003, PMO carried out a questionnaire Survey. Inquiry target including 9 demolished household, 8 affected enterprises, 10 farmers affected by land acquisition, and 6 workers in enterprises or institute and citizens.The questionnaire showed that, among the 33households investigated, 36% of the sampling households knew the project would be constructed; 64% do not clear or do not clear completely; 81% approved the project; 19% do not care, no one against; 100% thought the project will benefit the country; 91% thought the project will benefit the collective; 81% thought the project will benefit DPs; 64% thought economic loss would be resulted from environment pollution; 79% thought it would affect living quality; 52% thought it would affect 72 investment environment; 73% thought it would smear the images of Suzhou; 67% thought poor environment would bring seriously or very seriously impact on living and working, 30% thought not seriously impact, 3% thought no impact; 85% thought the project would improve living environment, 36% thought the project improve working environment, 33% thought the project could give more working chance ; 73% were clear on the compensation policies for land acquisition of the project more or less; 79% knew they were able to grieve if their rights were damaged. The procedures are the following. Stage 1 :If any PAP is aggrieved by any aspect of the resettlement anc rehabilitation program, he / she/it can lodge an oral or written grievance with DROSZUIRP; If it is oral grievance, House Demolition Offices is required to dea with it and keep in written record. This department shall resolve the issue withir two weeks. w Stage 2: If the aggrieved person is not satisfied with the decision on stage 1, he. she /it can bring the complaint to the attention of PMO after the receipt of thE decision on Stage 1. PMO will make a decision on the complaint within twc weeks. w Stage 3: If the aggrieved person is not satisfied with the decision on stage 2, he. she /it can appeal to Suzhou Construction Bureau or SZUIRPLG after hE receives the decision on Stage 2. Suzhou Construction Bureau or SZUIRPLC will reach a decision within 2 weeks. w Stage 4: If the PAP is still dissatisfied with the decision, he /she /it can appeal tc the People's Court in accordance with Civil Procedure Act after receiving thE decision of the institution for administrative arbitration. 77 PAP can make an appeal for any aspect of the resettlement and rehabilitation program including compensation rate. The appealing process, institute, site, leader, and telephone number for redress of grievances are publicized to DPs by meeting, notice and information handbook. So that DPs can realize they have right to appeal to the fullest extent. All the leaders have organized many municipal engineering involving resettlement and land acquisition, so they have much experience on those respects. In addition, 81 because they come from the people's governments at all levels and many departments, they will well organize and assist each other during the land acquisition, demolition and resettlement. The other organizations also consist of staff with much administrative experience on urban construction and reconstruction. The resettlement institutions involved in the project are well staffed. The number of regular staff is 20, of which 16 persons are professional workers, accounting for 80%. The number of staff at peak hours is 41. Telecommunications among the institutions are very good, which is very important to implement resettlement. The institutions for demolition administration and implementation have better transportation, vehicles and communication instruments. Institutions for survey, design, monitoring and evaluation have more advanced computers and their workers are good at operating them. Institutions for resettlement, monitoring and evaluation have rich experience of land acquisition, house demolition and rehabilitation. Table 10.1 shows details of the staffing of the resettlement institution involved in the project. will monitor on RAP and the implementation of it in all aspects and submit independent monitoring and evaluation reports to SZUIRPLG, PMO and the World Bank. 11.5 Measures for Strengthening Institutional Capacity * In April 2003, PMO trained staff which would do the demolition and resettlement work. They studied the OP4.12 of the World Bank, relevant demolition regulations, the theory and methods of socioeconomic survey etc. * PMO will go on with training the staff. They will know OP4.12 of the World Bank, the regulations of land acquisition and demolition, analysis of cases, simulate practice, cost control and resource allocation to increase their professional abilities to carry out the policies. * To ensure that funds and equipment can be got in time to increase the efficiency * To divide the work properly, and establish and improve the system of rewarding or punishing the staff of carrying out land acquisition and demolition to encourage their initiative. * To establish a demolition and resettlement information management system. with the help of that, to manage the data of land acquisition and demolition, to strengthen information feedback, and ensure that each department is well informed. Important problems will be discussed and decided by the leading group of the project. * To strengthen report system and internal monitoring, and solve the problems promptly. * To strengthen the independent monitoring and evaluation. The independent monitoring and evaluation institution should report promptly to relevant department about the problems and provide suggestions to solve them. 88 12 Schedule of Implementation 12.1 Resettlement and Implementation of the Project According to the schedule, the project is to be built from 2004 to 2006 at three stages. The schedule for resettlement goes with the schedule of each sub-project. Land Acquisition and demolition, resettlement are planned to begin in November 2003 and end in December 2006. The principles of connecting the project construction with the land acquisition, and resettlement are as the following: * To finish the work of land acquisition and relocation one month before project begins. The time to start the project will be decided according to land acquisition, relocation, resettlement and rehabilitation. * To reserve enough time for the land acquisition, relocation, resettlement and rehabilitation before the start of the project construction.. 12.2 Key Tasks for Residential Houses Relocation 12.3 Key Tasks for Private-owned Enterprises Relocation (1) According to document of approval for the project construction and land using permission, inform the construction scope of the project to police security, housing management department, urban construction department, industry and business administrative department, neighbor committee office, at the same time, stop going through all various kinds of formalities within construction scope of the project, such as: construction license, industry and business permission license, housing rebuilding, house property exchange, exchange of use right of houses and rental of houses, etc.. (2) According to frozen private-owned enterprises and data of property right provided by housing management department, organize staffs to investigate 89 frozen private-owned enterprises and check them up on field, that include amount of employees, character of housing property right, housing structure, housing area and attachments on land, annual income, etc.. (3) In accordance with documents of approval for the project construction, sanctified the project planning scheme, investigation results and building layout of housing to be dismantled, resettlement plan, and relative permission documents of land use for the project construction, apply for housing demolition to city department in charge of housing relocation. (4) Publicize housing relocation plan, policy for housing relocation, working procedure, drawing of housing allocation, resettlement plan, compensation standards and scope of housing demolition, duration of housing demolition, use purpose of land occupied, and accept participation and supervision of the public. (5) Within duration of housing relocation, sign written agreement of compensation and allocation with the owners about compensation form and funds, area of housing relocation, location of allocation, form and duration of temporary transition, etc., and popularize the resettlement policy as to remove smoothly. (6) The owners open their business. - ' 12.4 Key Tasks for Enterprises and Institutions Relocation (1) According to document of approval for the project construction and land using permission, inform the construction scope of the project to police security, housing management department, urban construction department, industry and business administrative department, neighbor committee office, at the same time, stop going through all various kinds of formalities within 90 construction scope of the project, such as: construction license, industry and business permission license, housing rebuilding, house property exchange, exchange of use right of houses and rental of houses, etc.. (2) According to data of property right provided by production department, organize staffs to investigate frozen collective and institution units and check them up on field, that include amount of units, total staffs, character of housing property right, housing structure, housing area, large-scale production facilities, annual production value, annual profit and average annual income per worker, etc.. (3) In accordance with documents of approval for the project construction, sanctified the project planning scheme, investigation results and building layout of housing to be dismantled, resettlement plan, and relative permission documents of land use for the project construction, apply for housing demolition to city department in charge of housing relocation. (4) Publicize housing relocation plan, policy for housing relocation, working procedure, drawing of housing allocation, resettlement plan, compensation standards and scope of housing demolition, duration of housing demolition, use purpose of land occupied, and accept participation and supervision of the public. (5) Within duration of housing relocation, sign written agreement of compensation and allocation with the owners about compensation form and funds, area of housing relocation, location of allocation, form and duration of temporary transition, etc., and popularize the resettlement policy as to remove smoothly. (6) The collective and institution units rebuild or purchase new houses. 91 (7)The collective and institution units move into new houses. 12.5 Implementation Schedule of Key Tasks of Resettlement. 12.5.1 The principles for making schedule of acquisition and resettlement: To determine the final scope of land acquisition according to every project design drawing, and to finish the determination before the census and property survey for the land acquisition. To calculate the result of census and property survey for the land acquisition according to the red line drawings of land acquisition and relocation. It will be done by both DROP and the owners before the agreements for compensation and resettlement are signed. To have a mobilization meeting, which should be presided over by DROP. The Demolition Department should promulgate the policies and ways of land acquisition, relocation, compensation, and resettlement methods. DPs should attend the mobilization meeting. The meeting will be held before they sign the agreements for compensation and resettlement. And formal announcements of land acquisition and relocation will be released after the mobilization meeting. To sign the agreements of compensation and resettlement after the census and property survey and the release of the formal announcement of land acquisition and relocation. To dispense transition funds to residents during their transitional period. And it should be dealt out before they start to move. To try to arrange resettlement field for enterprises in advance, and to avoid or reduce the losses of closing down caused by relocation. For those who have 92 to close down, the compensation should be dealt out before relocation. To construct new public utilities and municipal infrastructure in advance and then demolish the old ones. * To settle accounts and deal out compensation after the assignment, and before the relocation. * Confirm the resettlement work to satisfy demolished households. 12.5.2 Overall Schedule of Land Acquisition and Resettlement The overall schedule of the project is fixed in light of the schedule of the land acquisition, preparation for and progress of the resettlement, and the project construction. The compensation of housing relocation and other expenditures will 102 be paid to relative departments and individuals by owner through DROP; (2) Prior to demolition of resettlers' houses, the compensation will be paid to the households to be resettled; (3) Prior to demolition of collective and institution units, all compensations should be paid to the owners, so as to guarantee them to rebuild or purchase new houses smoothly. (4)1n order to ensure a smooth implementation of the resettlement, DROP will set up supervisory mechanism in the resettlement offices at all levels, so as to guarantee all the money to be paid to the DPs as specified. 103 14 Monitoring According to World Bank Operational Policies O.P. 4. 12 "Involuntary Resettlement " and "Operational Directory of Resettlement Monitoring and Evaluation of Projects in China" Assisted by World Bank, implementation of land acquisition and resettlement activities shall be monitored regularly to ensure those actions have proceeded in accordance with the provisions of RAP. There are two kinds of monitoring mechanisms in this RAP, the internal monitoring and the independent monitoring. Internal monitoring is carried out by JSUEPO, SZUEPO, LTWQISPO, demolition implement company, SZLRMB, DLRMB and SZHDAO to ensure that all the units follow the schedule and abide by the principles of RAP. The purpose of this internal monitoring is to maintain responsibilities of resettlement implementation institutions during the implementation. Independent Monitoring Organization is mainly responsible for regularly independent monitoring and evaluation on activities of land acquisition, house demolition and resettlement. NRCR of Hohai University will undertake the independent monitoring of the resettlement component to observe. * The function of resettlement network: * The implementation of land acquisition, house demolition, rehabilitation and compensation * The recovery of DPs, affected shops, enterprises and institution; * Survey on and analysis of the DPs living standards. The purpose of independent monitoring is to provide an evaluation of resettlement by an organization independent to the institutions for the project demolition, and to review the overall implementation from a broader, long-term point of view. 104 Independent monitoring institution follows the resettlement activities to evaluate whether the goals of resettlement are achieved through observing (1) the application of the laws of P.R.C. concerned on resettlement; (2) compliance with the principles of the World Bank's Operational Policies O.P. 4.12 on Involuntary Resettlement; and (3)an improvement in the standards of living of the DPs or at least maintenance of the former living standards. The Independent Monitoring Institution provides suggestions to the institutions for demolition implementation, so as the problems encountered in the implementation can be resolved in time. 14.1 Internal Monitoring and Supervision PMO has developed an internal monitoring framework to supervise the resettlement activities. It establishes relevant databank on land acquisition, house demolition and resettlement. And the databank contributes to compiling the resettlement planning, and carrying out intemal monitoring on the whole implementation process. 14.1.1 Implementation Procedures During the implementation, based on samples provided by monitoring institutions, JSUEPO, SZUEPO, LTWQISPO, SZLRMB, DLRMB, SZHDAO and demolition implement company collect and record implementation information of residents, shops, enterprises and institutions affected. Meanwhile, they deliver the record of the current activities in time to JSUEPO and SZUEPO, so as to keep a consistent monitoring on implementation. JSUEPO and SZUEPO conducts periodic supervision to the project resettlement. In the above monitoring system, there is a continuous flow of information on a regular format from SZHDAO to JSUEPO. JSUEPO, SZUEPO, LTWQISPO, SZLRMB, DLRMB, SZHDAO as the important components of internal monitoring and supervision system, will carry out periodic supervision and verifications. 14.1.2 Indicators to be Monitored * Payment of compensation to DPs and PAUs * Finding the houses for DPs replaced in cash * Construction of resettlement houses for DPs who will exchange ownership * Removal of DPs 105 * Reconstruction of replacement houses and removal * Rehabilitation of vulnerable groups * Resettlement and rehabilitation of shops affected * Resettlement and rehabilitation of institutions and enterprises affected * Rehabilitation of infrastructure * Arranging the schedule of the above activities * Conformity with the policies and regulations of RAP * Participation and negotiation of DPs during implementation * Staffing, training, work schedule and effectiveness of the institutions 14.1.3 Internal Monitoring Reports The LTWQISPO will compile an internal monitoring report every 3 months and submit to JSUEPO and SZUEPO. And JSUEPO will submit to the World Bank after collecting at the end of each year. 14.2 External Independent Monitoring Institution 14.2.1 Independent Monitoring Institution JSUEPO plans to entrust NRCR to do the independent monitoring and supervision. The monitoring and evaluation group is composed of 4 resettlement specialists with much experience on project resettlement and sociology. 14.2.2 Responsibilities Independent Monitoring Institution will periodically monitor and evaluate the implementation of RAP, including the progress, quality of resettlement, utilization of funds. It will give advice and suggestions. After checking quality of resettlement house, DPs' living standards and production conditions, the Independent Monitoring Institution will submit monitoring and evaluation reports to JSUEPO and SZUEPO and the World Bank. The detail outline of mornitoring work see appendix 1. 14.2.3 Procedures and Contents (1) Compiles outline for monitoring and evaluation 106 (2) Develops resettlement monitoring and evaluation information system (3) Prepares survey outline, table of questionnaire, recording card of sampling residents, shops, enterprises (4) Sampling scale: 10% of residents whose houses need to be demolished, 50% of affected shops, 20% of enterprises and institutions demolished (5) Carries out baseline survey A baseline survey is carried out on the residents, shops, enterprises and institutions affected by land acquisition and demolition to obtain basic data about their living standards and production condition(including living, business and income). (6) Establishes monitoring and evaluation information system A monitoring and evaluation information system is established. All the data in resettlement monitoring and evaluation are classified and stored in different databank to make the analysis and monitoring an easier job. (7)Conducts monitoring survey Conducts local socioeconomic survey on social and economic development situation in project area. Monitors resettlement implementation organization on its ability and efficiency Monitors sampling residents on allocation of urban residents' compensation funds, the houses for resettlement, moving, rehabilitation of income, resettlement quality; the progress of rebuilding houses, allocation of compensation fee and house quality. Monitors sampling shops affected on allocation of compensation funds, resettlement houses, progress of moving, business rehabilitation, income, 107 resettlement quality. Monitors sampling enterprises and institutions affected on allocation of compensation funds, new sites for enterprises and institutions, reconstruction, progress of moving, production rehabilitation, income rehabilitation, resettlement quality. Monitors public facilities on allocation of compensation funds, rehabilitation of them, progress of reconstruction. Monitors public consultation on participation in compiling RAP and DPs' activities during implementation, effects of participation. Monitors grievance on the mechanism and the efficiency. The successful experience of and the lesson drawn from the affected residents, shops, enterprises and institutions will be summed up to contribute to resettlement in the future. Ex-post evaluation will be carried out by external independent monitoring institution entrusted by JSUEPO and SZUEPO. The independent monitoring and evaluation institution should compile the outline of ex-post evaluation and develop evaluation indicators.
