CONFORMED COPY CREDIT NUMBER 128 NIR (AMENDMENT) Agreement Amending Development Credit Agreement (Highway Maintenance Project) DATED SEPTEMBER 23, 1968 BETWEEN REPUBLIC OF NIGER AND INTERNATIONAL DEVELOPMENT ASSOCIATION DATED NOVEMBER 26, 1973 CONFORMED COPY CREDIT NUMBER 128 NIR (AMENDMENT) Agreement Amending Development Credit Agreement (Highway Maintenance Project) DATED SEPTEMBER 23, 1968 BETWEEN REPUBLIC OF NIGER AND INTERNATIONAL DEVELOPMENT ASSOCIATION DATED NOVEMBER 26, 1973 AGREEMENT AMENDING DEVELOPMENT CREDIT AGREEMENT (HIGHWAY MAINTENANCE PROJECT) between REPUBLIC OF NIGER and INTERNATIONAL DEVELOPMENT ASSOCIATION. AGREEMENT, dated November 26, 1973, between REPUBLIC OF NIGER (hereinafter called the Borrower) and INTERNATIONAL, DEVELOPMENT ASSOCIATION (hereinafter called the Association). WHEREAS the Borrower and the Association have executed and delivered a development credit agreement (Highway Maintenance Project) dated September 23, 1968 (hereinafter called the Development Credit Agreement) for the purpose of assisting in the financing of a highway maintenance project of the Borrower (hereinafter called the Project); and WHEREAS the Borrower has requested the Association to provide additional financing for the Project and, for that purpose, to amend the Development Credit Agreement, and the Association is willing to agree to such request upon the terms and conditions hereinafter set forth; NOW THEREFORE the parties hereto hereby agree as follows: Section 1. Wherever used in this Agreement, unless the context otherwise requires, the several terms defined in the Development Credit Agreement shall have the respective meanings therein set forth. Section 2. Section 2.01 of the Development Credit Agreement is amended to read as follows: "Section 2.01. The Association agrees to make available to the Borrower, on the terms and conditions in this Development Credit Agreement set forth or referred to, a development credit in an amount in various currencies equivalent to six million four hundred seventy thousand dollars ($6,470,000)." Section 3. December 31, 1974 is agreed for purposes of Section 7.01 of the Development Credit Agreement. Section 4. Schedule 2 to the Development Credit Agreement is amended by substituting the table set forth in paragraph 1 thereof by the table set forth in Schedule 1 to this Agreement. 4 Section 5. (a) All the provisions of the Development Credit Agreement, as amended by this Agreement, shall remain in full force and effect. (b) If this Agreement shall terminate pursuant to the provisions of Section 7 hereof, the Development Credit Agreement shall continue in full force and effect, as if this Agreement had not been executed. Section 6. (a) This Agreement shall not become effective until the Association shall have received such evidence in respect of this Agreement as is required pursuant to Sections 10.01(a) and 10.02(a) of the General Conditions. (b) This Agreement shall come into force and effect on the date on which the Association dispatches to the Borrower notice of its acceptance of the evidence referred to in paragraph (a) of this Section. Section 7. If this Agreement shall not have come into force and effect by February 26, 1974, this Agreement and all obligations of the parties thereunder shall terminate, unless the Association, after consideration of the reasons for the delay, establishes a later date for the purposes of this Section.
