CONFORMED COPY CREDIT NUMBER 528 IN (Amendment) Agreement Amending Development Credit Agreement (Tenth Industrial Imports Program Credit) BETWEEN INDIA AND INTERNATIONAL DEVELOPMENT ASSOCIATION DATED MARCH 7, 1975 AGREEMENT AMENDING DEVELOPMENT CREDIT AGREEMENT AGREEMENT, dated March 7, 1975, between INDIA, acting by its President (hereinafter called the Borrower) and INTERNATIONAL DEVELOPMENT ASSOCIATION (hereinafter called the Association). WHEREAS (A) The Borrower and the Association entered into a Development Credit Agreement (Tenth Industrial Imports Program Credit) dated February 14, 1975 (hereinafter called the Tenth Credit), whereby the Association agreed to lend the Borrower an amount in various currencies equivalent to one hundred million United States dollars (U.S.$100,000,000) to finance the import program described therein; and (B) The Borrower and the Association have agreed to amend the Tenth Credit in order to increase the amount from U.S.$ 100,000,000 to U.S.$200,000,000 equivalent. NOW THEREFORE the parties hereto hereby agree as follows: ARTICLE I Section 1.01. The Tenth Credit is hereby amended as follows: (a) Section 2.01 is amended to read: "Section 2.01. The Association agrees to lend to the Borrower, on the terms and conditions in the Development Credit Agreement set forth or referred to, an amount in various currencies equivalent to two hundred million dollars ($200,000,000)." (b) The table set forth in paragraph I of Schedule 1 to the Tenth Credit is amended to read: Amount of the Credit Allocated (Expressed "Category in Dollar Equivalent) (1) Fertilizer and Pesticide 75,000,000 Sectors (2) Other Sectors 125,000,000 TOTAL 200,000,000" 4 ARTICLE II Section 2.01. This Agreement shall come into force and effect on the date on which the Association dispatches to the Borrower notice of its acceptance of evidence that: (a) the execution and delivery of this Agreement on behalf of the Borrower have been duly authorized or ratified by all necessary governmental action; and (b) an opinion or opinions satisfactory to the Association of counsel acceptable to the Association showing that this Agreement has been duly authorized or ratified by, and executed and delivered on behalf of, the Borrower and that, therefore, the Tenth Credit as amended by this Agreement constitutes a legally binding obligation of the Borrower in accordance with its terms as so amended. Section 2.02. If this Agreement shall not have come into force and effect by March 31, 1975, this Agreement and all obligations of the parties hereunder shall terminate, unless the Association, after consideration of the reasons for the delay, establishes a later date for the purposes of this Section. The Association shall promptly notify the Borrower of such later date.
