Consideration of a budget and programme of work for the Conference of the Parties for the financial period 2008–2009 1. In accordance with Article 23.4 of the WHO Framework Convention on Tobacco Control (Conference of the Parties), the Conference of the Parties is mandated to adopt a budget for each period between its regular sessions. In consideration of decision FCTC/COP1(10), Establishment of a permanent secretariat of the Convention, which, in conjunction with resolution WHA59.17,1 established the Convention Secretariat within WHO, and with reference to decision FCTC/COP1(9), Adoption of the Financial Rules of the Conference of the Parties to the WHO Framework Convention on Tobacco Control, in which the Conference of the Parties adopted the Financial Regulations and Rules of WHO as their own, budgets and affiliated programmes of work for the Conference of the Parties fall most conveniently into biennial periods, as is the case throughout WHO. This comports with decision FCTC/COP1(11), Budget and workplan 2006–2007, wherein the Conference of the Parties adopted a biennial budget and workplan for the financial period 2006–2007, and reflects Rule 4 of the Rules of Procedure of the Conference of the Parties, which states that from the fourth session onwards, regular sessions of the Conference of the Parties will be held every two years. 2. To this end, this document presents a review of decision FCTC/COP1(11) and a draft budget and programme of work for the financial period 2008–2009, in order to facilitate the Conference of the Parties’ discussions on these matters.
DECISION FCTC/COP1(11), BUDGET AND WORKPLAN 2006–2007 3. In decision FCTC/COP1(11), the Conference of the Parties adopted a US$ 8 010 000 budget and programme of work for its first biennial period. In paragraph 1 of the decision, five items reflecting Article 24.3 of the WHO Framework Convention were identified as the primary areas of work for the 2006–2007 financial period:

4. Annex 1 to this document provides an overview, by area of work, of expenditures for the period 18 February 2006 through 31 March 2007.1 Document A/FCTC/COP/2/3, Report of the interim secretariat, provides an overview of the activities undertaken in these areas of work as mandated by the Conference of the Parties in the decisions taken at its first session and supported by the 2006–2007 budget. 5. In decision FCTC/COP1(11) paragraph 3, the Conference of the Parties adopted a distribution of voluntary assessed contributions, based on WHO’s scale of assessments for 2005 and adjusted to accommodate for the number of Parties to the WHO Framework Convention on Tobacco Control being fewer than the number of WHO Member States. This distribution, with a maximum assessed contribution of 22%, included the 112 countries that were voting Members of the Conference of the Parties by the close of its first session, together with the European Community.2 Annex 2A of this document provides an overview of those voluntary assessed contributions indicated in the decision FCTC/COP1(11) distribution that have been submitted as of 31 March 2007. Annex 2B provides an overview of those voluntary assessed contributions indicated in the decision FCTC/COP1(11) distribution that remain outstanding as of 31 March 2007. 6. Following the close of the first session of the Conference of the Parties, more than 30 additional countries have become Party to the WHO Framework Convention. The voluntary assessed contributions of these post-first session Parties will be kept in a miscellaneous income account and the Conference of the Parties will decide how to distribute that income as part of its consideration of the budget in the following year or biennium. Annex 3A provides an overview of those voluntary assessed contributions submitted as of 31 March 2007 by countries that became Party to the WHO Framework Convention after the close of the first session. The outstanding voluntary assessed contributions from post-first session Parties are reflected in Annex 3B. These dates comprise the period from the close of the first session of the Conference of the Parties through the internal deadline for completion of documents for the second session of the Conference of the Parties. The European Community has been assessed at a percentage consistent with other multilateral agreements to which it is Party. 2 1

7. In decision FCTC/COP1(11) paragraph 4, the Conference of the Parties authorized the Convention Secretariat to receive extrabudgetary contributions for activities under the second area of work, Reporting system under the Convention and support to Parties in fulfilling this obligation, and the fifth area of work, Elaboration of guidelines and protocols and other activities, of the budget. No extrabudgetary contributions have been received under this provision.
DRAFT BUDGET FOR THE 2008–2009 BIENNIUM 8. Annex 1 provides an indication of the draft budget for 2008–2009. The provisional calculations of the voluntary assessed contributions for 2008–2009 are based on the schedule of distribution of voluntary assessed contributions adopted by the Conference of the Parties at its first session1 and on the WHO scale of assessments for 2005 as adopted by the Fifty-seventh World Health Assembly.2 Annex 4 reflects the provisional voluntary assessed contributions for the 2008–2009 biennium. It includes all Parties for which the Convention will have entered into force by the opening of the second session of the Conference of the Parties and is based on an assumed budget of US$ 8 010 000. 9. In its discussion of the budget for its next financial period, the Conference of the Parties may wish to note that it is possible to divide its activities into two overarching categories. The first is the continuation of activities under the work areas identified in the 2006–2007 budget; the second is the initiation of new activities either under the extant areas of work or under new areas of work identified during the second session. 10. In considering these matters, the Conference of the Parties may wish to take note of resolution WHA59.17, in which the Health Assembly requested the Director-General to support and, where appropriate, to strengthen WHO’s Tobacco Free Initiative in order to assist the Convention Secretariat in the implementation of the WHO Framework Convention. Reflecting this decision and the explicit articulation of tobacco control as a priority, WHO’s Medium-term strategic plan 2008–2013.3 which will be proposed to the Sixtieth World Health Assembly, includes, in strategic objectives 3 (To prevent and reduce disease, disability and premature death from chronic noncommunicable conditions, mental disorders, violence and injuries) and 6 (To promote health and development, prevent and reduce factors for health conditions associated with use of tobacco, alcohol, drugs and other psychoactive substances, unhealthy diets, physical inactivity and unsafe sex), updated targets for the global reduction of tobacco use and tobacco-related illness as part of WHO’s overall noncommunicable disease strategy. Pursuant to these targets, the Medium-term strategic plan has significantly increased budget support for WHO’s tobacco area of work programmes from 2008–2013. 11. As part of the strategic planning exercise, WHO has noted the unique nature of the Conference of the Parties and the Convention Secretariat and has accordingly distinguished and separated the budget of the Conference of the Parties from the budget of WHO (including its tobacco area of work). As indicated in the Proposed programme budget 2008–2009,4 although the Convention Secretariat’s budget is not factored into the total budget of WHO, WHO recognizes that the Convention Secretariat 1 See decision FCTC/COP1(11). contributes significantly to the achievement of WHO’s relevant strategic objectives. In the Mediumterm strategic plan, it is anticipated that the regular budget for the Conference of the Parties will remain at the US$ 8 010 000 level for the 2008–2009 biennium. The plan is silent regarding possible or expected extrabudgetary contributions to the Conference of the Parties.
Continuation of activities under the areas of work identified in the 2006–2007 budget 12. Each of the five areas of work identified by the Conference of the Parties at its first session includes ongoing activities. The first area of work, Sessions of the Conference of the Parties, anticipates the Conference of the Parties’ third session. In so far as the third session is to be held in 2008 pursuant to Rule 4 of the Rules of Procedure of the Conference of the Parties, the 2008–2009 biennial budget must include the costs associated with convening these sessions. The Conference of the Parties designated US$ 1 800 000 for its second session, reflecting the cost of holding an intergovernmental conference for approximately 140 Parties in Geneva using the cost of the Intergovernmental Negotiating Body sessions as the basis for calculation. The Conference of the Parties should note that there are currently 146 Parties to the WHO Framework Convention, and as the number of Parties continues to rise, the budget for the third session of the Conference of the Parties may have to be increased commensurately. 13. The second area of work, Reporting system under the Convention and support to Parties in fulfilling this obligation, includes a portion of the professional and technical staff required to carry out the work of the Convention Secretariat. This area of work also has activities that will continue through the next biennium. As noted in document A/FCTC/COP/2/6, Synthesis of reports on implementation of the WHO FCTC received from Parties, 61 Parties were required to report on implementation of the Convention by the opening of the second session of the Conference of the Parties. The remaining 85 Parties will prepare and submit their first reports according to the schedule mandated by Article 21 of the WHO Framework Convention and will require support for preparation and submission from the Convention Secretariat. Additionally, a number of Parties will be required to begin the process of preparing reports against the Group 2 questionnaire, as indicated in decision FCTC/COP1(14). Support for fulfilling the reporting obligation includes the continuing development and refining of the electronic reporting tools,1 as well as providing both monetary and technical assistance to Parties during regional and national workshops on treaty implementation. 14. The third area of work, Report of the Convention Secretariat, comprises the reports of all intersessional activities undertaken pursuant to the decisions of the Conference of the Parties and a portion of the professional and technical staff required to produce these documents. These costs are reflected in the amount obligated through 31 March 2007 for the 2006–2007 biennium (see Annex 1). In so far as the Convention Secretariat will continue to report to the Conference of the Parties, this area of work will continue to require funding into the next biennium. 15. The fourth area of work, Coordination with other relevant bodies and administrative arrangements, includes acquisition of appropriate administrative equipment (such as computers) for the Convention Secretariat, the salaries of administrative professional and general staff for the Convention Secretariat and communication and collaboration with relevant intergovernmental and nongovernmental organizations, in conjunction with the Tobacco Free Initiative. As the Convention Secretariat staff is recruited, and in anticipation of international intergovernmental organizations

seeking observer status with the Conference of the Parties in accordance with Rule 30 of the Rules of Procedure, this area of work will continue to require funding into the next biennium. 16. The fifth area of work, Elaboration of guidelines and protocols and other activities, comprises activities undertaken in the development of guidelines and protocols, and includes the contributions of technical and professional staff that have provided consultation in this area of work of the Convention Secretariat. As anticipated by the Conference of the Parties in decision FCTC/COP1(15), Elaboration of guidelines for implementation of the Convention, the fifth area of work will require sustained planning and funding in order to achieve the mandated outcomes. Draft guidelines for one Article, Article 8 (Protection from exposure to tobacco smoke), have been produced in document A/FCTC/COP/2/7 for consideration by the Conference of the Parties. However, the working group convened to develop guidelines for the implementation of Article 9 requires additional time and potentially increased funding in order to complete its assigned tasks, particularly in light of the Conference of the Parties’ decision to include Article 10 in the mandate of this working group. This needed additional time and funding is detailed in document A/FCTC/COP/2/8, which contains the progress report of the Article 9 working group provided to the Conference of the Parties. As noted in that document by the working group, the Conference of the Parties has been asked to consider how to proceed with the work of developing guidelines for Articles 9 and 10. The working group has asked the Conference of the Parties to consider two tenable and feasible options on the issue of standards for tobacco product testing and measuring: to invoke competence to establish its own tobacco contents and emissions testing and measuring standards, or to request WHO, with the financial and political backing of the Conference of the Parties, to work with the International Organization for Standardization Technical Committee on Tobacco and Tobacco Products (Technical Committee 126) in the establishment of tobacco testing and measuring standards. If the Conference of the Parties decides to develop standards separately, as noted in the progress report, it may consider funding for the WHO Tobacco Laboratory Network to develop and validate tobacco testing and measuring standards. Either of the two options will have budget implications. The Conference of the Parties will also have to consider whether to initiate work on the elaboration of guidelines for another Article, as discussed in the next section of this document. 17. As its title indicates, the fifth area of work also focuses on the elaboration of protocols, on which work was begun during the intersessional period in accordance with decision FCTC/COP1(16), Elaboration of protocols. As such, if the Conference of the Parties decides to continue the process of developing protocols in either or both of the areas identified in decision FCTC/COP1(16), as discussed in the next section of this document, it will also have to consider continuing the mandate of and funding for the relevant expert group(s) convened to elaborate the templates presented in documents A/FCTC/COP/2/9 and A/FCTC/COP/2/10.
Initiation of new activities under the extant areas of work 18. In the decisions taken during its first session, the Conference of the Parties initiated a number of substantial and long-term projects, as required under various articles of the WHO Framework Convention. The following information is provided in order to facilitate the Conference of the Parties’ discussion on how to proceed with this work.
Elaboration of guidelines (decision FCTC/COP1(15))
for
implementation
of
the
Convention
19. In accordance with decision FCTC/COP1(15), the work of developing guidelines for implementation of Articles 8 through 13, as mandated specifically in the treaty, was begun. The

Conference of the Parties prioritized Articles 8 and 9, adopting templates for the elaboration of these guidelines (Annexes 1 and 2 to the decision), and requested the Convention Secretariat to prepare a workplan for the elaboration of the remaining Articles, based on the criteria identified in decision FCTC/COP1(15). 20. Once operational, the Convention Secretariat will have the latitude and mandate to develop workplans that not only give an outline of the work to be done, but also provide prioritization of guideline development per the 10 criteria identified by the Conference of the Parties. As the interim secretariat, WHO would request that the Conference of the Parties consider identifying those Articles that require particular and immediate attention in order to provide the Convention Secretariat with additional guidance in developing these workplans. 21. As noted in document A/FCTC/COP/2/12, the Conference of the Parties has already articulated basic workplans for the elaboration of guidelines for the implementation of Articles 11, 12 and 13 in Annexes 3, 4 and 5 to decision FCTC/COP1(15). It remains for these working groups to receive priority and commensurate budgeting to begin their programmes of work. 22. The Conference of the Parties should note that in the 2006–2007 budget, approximately US$ 200 000 was dedicated to each of the two guideline working groups prioritized at its first session. This amount allowed for each of the groups to meet two to three times during the intersessional period, with full Secretariat support. If the same amount were budgeted for the 2008–2009 period, the Conference of the Parties could again expect two working groups to operate concurrently, provided the needs of the groups were similar to those of the Articles 8 and 9 working groups. 23. In the event that the Conference of the Parties adopts the guidelines forwarded for their consideration by the Article 8 working group and mandates the Article 9 working group to continue its work, there is the opportunity to convene one new working group. The Conference of the Parties might wish to take into consideration the matter of expanding the budget for the work of the Article 9 working group, if the kinds of additional collaboration and support identified by the working group in document A/FCTC/COP/2/8 are to be undertaken.
Elaboration of protocols (decision FCTC/COP1(16)) 24. In decision FCTC/COP1(16), the work of developing protocols on cross-border advertising, promotion and sponsorship and illicit trade was begun. An expert group for each of these protocol development processes was convened by the interim secretariat, under the direction of the Bureau of the Conference of the Parties.1 Each expert group met twice, and each produced a template in accordance with its mandate. These templates are reproduced in the Annexes to documents A/FCTC/COP/2/10 and A/FCTC/COP/2/9, respectively. 25. The Conference of the Parties may wish to consider continuing the process of developing one or both of these protocols. Following the precedent of the Intergovernmental Negotiating Body for the WHO Framework Convention, this would involve establishing a subsidiary negotiating body of the Conference of the Parties in accordance with Rules 25 through 28 of the Rules of Procedure of the

Conference of the Parties; this body would need to meet approximately four to six times to complete the work of negotiating a protocol for adoption by the Conference of the Parties. 26. The membership of such a negotiating body would be identical to the membership of the Conference of the Parties. As such, the cost of convening a session of the Conference of the Parties could be used as a basis for determining the budgetary requirements for this activity. As indicated earlier, based on precedent, the Conference of the Parties budgeted US$ 1 800 000 for its second session; each session of a negotiating body would likely cost a similar amount.1 Given this, in order to convene a negotiating body four to six times, a budget of approximately US$ 7 200 000 to 10 800 000 would be required. This does not include the requisite staff that would likely be needed by the Convention Secretariat in the intersessional periods. An estimated staff of two to four professionals and one to two general staff would require an additional US$ 1 000 000 to 2 000 000 per biennium. 27. The current US$ 8 010 000 budget, which has not been anticipated to increase for the 2008–2009 financial period, does not contemplate convening a subsidiary body. If the Conference of the Parties decides to move forward with one or both protocols, scheduling and convening the sessions of the subsidiary body or bodies and the additional staff for the Convention Secretariat will have to be accommodated in the 2008–2009 budget. As noted above, the 2006–2007 budget adopted in decision FCTC/COP1(11) allows the Convention Secretariat to receive voluntary extrabudgetary contributions for, inter alia, the elaboration of guidelines and protocols. It would therefore be possible for funds beyond the voluntary assessed contribution schedule to support all or some of the protocol negotiation process if received during the current biennium. The Conference of the Parties could also extend this authorization for extrabudgetary funds to support protocol negotiation, if it chose to do so, into the next biennium. 28. If the Conference of the Parties decides to continue with the protocol development process, it may also wish to consider extending the life of the expert group(s) convened to develop the templates provided in documents A/FCTC/COP/2/9 and A/FCTC/COP/2/10. As envisaged by the Conference of the Parties in decision FCTC/COP1(11), these groups comprise substantial expertise and could accommodate an expanded mandate as a resource for the negotiating body to draw on. In the 2006–2007 period, the Conference of the Parties budgeted approximately US$ 250 000 to each of the expert groups; this amount allowed for each expert group to meet two times during the intersessional period, with full Secretariat support. Similar amounts would need to be budgeted into the next biennium to continue the work of the expert groups in their current configurations. If the Conference of the Parties decides to continue with the work of only one of the two expert groups, funds would be available for the development of another guideline. The Conference of the Parties may wish to consider the initiation of work on a guideline on cross-border advertising, which Article 7 of the Convention mandates the Parties to propose and which the expert group for the development of a template for a protocol on cross-border advertising, promotion and sponsorship has proposed in their report to the Conference of the Parties.2 29. As a reference point, the following figures reflect two possible schedules for negotiation of one protocol. If more than one protocol is developed, the amounts would have to be adjusted accordingly.
The US$ 1 800 000 budget assumes that the session will be held in Geneva, at the seat of the Convention Secretariat in accordance with Rule 3 of the Rules of Procedure of the Conference of the Parties. If any negotiating sessions are to be held in other locations, the host Party would be expected to bear any and all additional expenses. 2

Initiation of activities under new areas of work identified during the second session of the Conference of the Parties 30. The Conference of the Parties may also wish to add areas of work beyond those identified in decision FCTC/COP1(11). Although such new areas may include currently uninitiated work, they may also include budgeting for meetings of the study group on alternative crops, convened pursuant to decision FCTC/COP1(17).
Establishment of a study group on alternative crops (decision FCTC/COP1(17)) 31. The first session of the ad hoc study group on alternative crops was convened in Brasilia from 27 to 28 February 2007. The Conference of the Parties has received the report of this group for its consideration in document A/FCTC/COP/2/11. 32. The mandate of the study group, as articulated by the Conference of the Parties in decision FCTC/COP1(17), is broad and will require continued meetings over the course of the medium- to long-term future. If the Conference of the Parties wishes to ensure that this work proceeds in a timely

fashion, it may also wish to consider including meetings of the study group in the biennial budgeting exercise.
CONCLUSION 33. Member States are invited to consider the draft budget and outline programme contained in this document. A detailed programme of work and results-based budget for the amount of US$ 8 010 000 proposed for 2008–2009 will be issued as an addendum to this document prior to the second session of the Conference of the Parties.
