Inlervention Zones, of the Ex-OCP, the Management agrees hereby to engage the services of Dr Yumkella. The work to be performed is to : o Participate in the Mid-term review of SZ and ex-OCP countries field investigations. . Participate in the Mid-term review of SZ and ex-OCP countries, data management and report writing. of (Sierra Leone, Burkina Faso) for the period below : 22l0gt2OOS to0211012005, 1l days ??. 0211012005 to 1611012005, 15 days It is understood that the execution of the work does not create any employer/employee relationship. In this respect, the contractual partner shall be solely responsible for the manner in which the work is carried out. Thus, WHO shall not be responsible for any loss, accident, damages or injury suffered by any person whatsoever arising in or out of the execution of this work, including travel. Without prejudice to the foregoing, WHO may in certain cases provide insurance coverage for the contractual partner as set forth here below. For travel in WHO vehicles, WHO may provide passenger insurance covering the contractual partner. WHO may also provide accident insurance coverage if and while the contractual partner, exceptionally, carries out work on WHO's premises. WHO declines any responsibility for non-payment by the insurance company of all or part of a claim for any accident, in which case the contractual partner shall be obliged to immediately reimburse WHO all or part of any advance paid by WHO to the contractual partner. All rights in the work, including ownerships of the original work and copyright thereof, shall be vested in WHO, which reserves the right (a) to revise the work, (b) to use the work in a different way from that originally envisaged, or (c) not to publish or use the work. ...t2 BDI Arrlv6 la i-o d ';L! t-2- For the performance of the work, WHO will pay you for the period befween 22 September to 16th October 2005 an amount of US $3900 (three thousand nine hundred US dollars). tn addition, a WHO standard per diem will be paid to you during the period. Any dispute relating to the interpretation or execution of this agreement shall, unless amicably settled, be subject to conciliation. ln the event of failure of the latter, the dispute shall be settled by arbitration. The arbitration shall be conducted in accordance with the modalities to be agreed upon by the parties or, in the absence of agreement, with the rules of arbitration of the Intemational Chamber of Commerce. The parties shall accept the arbitral awards as final. If you agree to this proposal, it would be appreciated if you could sign both copies of this letter and return the original to us, indicating, if appropriate, your bank address where payment should be made; payments cannot be effected before receipt of the countersigned original letter.
