‫‏ت ‏يف ‏تشرين‏‬ ‫‏د‬ ‫‏ق‬ ‫‪ .1‬عقب ‏الدورة ‏االستثنائية ‏للمجلس ‏التنفيذي ‏ملنظمة ‏الصحة ‏العاملية ‏بشأن ‏اإلصالح ‏اليت ‏ع‬ ‫‏ت‏‬ ‫‏ت‏يف‏كانون‏الثاين‪/‬يناير‏‪،2012‬‏شرع‬ ‫‏د‬ ‫‏ق‬ ‫الثاين‪/‬نوفمرب‏‪ 2011‬‏والدورة‏الثالثني‏بعد‏املئة‏للمجلس‏التنفيذي‏اليت‏ع‬ ‫‏ة‏(تصريف‏الشؤون)‏يف‏إطار‏خطة‏شاملة‏لإلصالح‏تتناول‏ثالثة‏‬ ‫‏م‬ ‫ك‬ ‫منظمة‏الصحة‏العاملية‏يف‏برنامج‏إلصالح‏احلو‬ ‫‏ة ‪.‬‬ ‫‏م‬ ‫ك‬ ‫جماالت‏بالغة‏األمهية؛‏وهي‪:‬‏الربامج‏وحتديد‏األولويات‪،‬‏واإلصالحات‏اإلدارية‪،‬‏واحلو‬ ‫‏دارت ‏يف ‏االجتماعات ‏املتعاقبة ‏للمجلس ‏التنفيذي ‏ومجعية ‏الصحة ‏العاملية ‏عن‏‬ ‫‏ت ‏املداوالت ‏اليت ‏‬ ‫‏ض‬ ‫‪ .2‬وقد ‏متخ‬ ‫سلسلة‏من ‏التوصيات ‏الرامية ‏إىل ‏تعزيز ‏إجراءات ‏األجهزة ‏الرئاسية ‏وعملياهتا ‏وزيادة ‏التنسيق ‏فيما ‏بينها ‏على ‏نطاق‏‬ ‫املنظمة‪.‬‬ ‫)‏الذي‏أقرته‏مجعية‏الصحة‏العاملية‏‬ ‫‏‬ ‫ً‏بالفقرتني‏الرابعة‏واخلامسة‏من‏منطوق‏املقرر‏اإلجرائي‏ج‏ص‏ع‏‪65‬‏(‪9‬‬ ‫‪ .3‬وعمال‬ ‫الستون‪،‬‏قررت‏اللجنة‏اإلقليمية‏لشرق‏املتوسط‏يف‏دورهتا‏التاسعة‏واخلمسني‏يف‏‪ 2012‬‏تنقيح‏عدد‏من‏مواد‏‬ ‫‏‬ ‫اخلامسة‏و‬ ‫‏جنة‏اإلقليمية‪.‬‏ومشلت‏التنقيحات‏(أ)‏القسم‏أوالً‪،‬‏املادة‏‪2‬‏حول‏حضور‏الدول‏غري‏الدول‏األعضاء‏‬ ‫النظام‏الداخلي‏لل‬ ‫واملنظمات‏غري‏احلوكومية؛‏(ب)‏القسم‏أوالً‪،‬‏املادة‏‪3‬‏اخلاصة‏بوثائق‏التفويض؛‏(ج)‏القسم‏عاشراً‪،‬‏‬ ‫يف‏اللجنة‏اإلقليمية‏‏‬ ‫املادة ‏‪ 37‬‏حول ‏التصويت ‏على ‏تقدمي ‏االقرتاحات ‏إىل ‏اللجنة ‏اإلقليمية؛ ‏(د) ‏القسم ‏حادي عشر‪ ،‬‏املادة ‏‪ 48‬‏حول‏‬ ‫‏حني‏لشغل‏منصب‏‬ ‫‏رش‬ ‫انتخاب‏املدير‏اإلقليمي‪،‬‏واملادة‏‪51‬‏حول‏تسمية‏املدير‏اإلقليمي‪،‬‏مبا‏يف‏ذلك‏معايري‏تقييم‏الـم‬ ‫املدير‏اإلقليمي‪.‬‬ ‫‏جنة ‏اإلقليمية ‏ملنظمة ‏الصحة ‏العاملية‏‬ ‫‏يالت ‏األخرى ‏على ‏النظام ‏الداخلي ‏لل‬ ‫‏قرتح ‏هذه ‏الورقة ‏عدداً ‏من ‏التعد‬ ‫‪ .4‬وت‬ ‫قرتحة‏على‏العمليات‏اليت‏يتبعها‏إقليم ‏شرق‏املتوسط‏فيما‏يتعلق‏‬ ‫‏ ‏‬ ‫بني ‏أيضاً‏اإلصالحات‏الـم‬ ‫‏ ِ‏‬ ‫لشرق‏املتوسط‪.‬‏كما‏ت‬ ‫‏ة‏‬ ‫‏م‬ ‫ك‬ ‫بتسمية‏البلدان‏لتمثيل‏اإلقليم‏يف‏اجتماعات‏اجمللس‏التنفيذي‏ومجعية‏الصحة‏العاملية‪،‬‏باإلضافة‏إىل‏مسائل‏احلو‬ ‫األخرى‪.‬‬ ‫تسمية المدير اإلقليمي لشرق المتوسط‬

‫قرتح ‏تعديالت ‏على ‏النظام ‏الداخلي ‏للجنة ‏اإلقليمية ‏لشرق ‏املتوسط ‏يف ‏اجملاالت ‏التالية ‏(املرفق ‏‪ :)1‬‏القسم‏‬ ‫‏‏‬ ‫‪ .5‬ت‬ ‫سادساً‪،‬‏املادة‏‪15‬‏حول‏تقارير‏الدورات؛‏والقسم‏حادي‏عشر‪،‬‏املادة‏‪51‬‏(ب)‏حول‏مدونة‏قواعد‏السلوك‏فيما‏يتعلق‏‬ ‫بتسمية‏املدير‏اإلقليمي‏(املرفق‏‪،)2‬‏واملادة‏‪51‬‏(ز)‏حول‏اإلجراءات‏املؤقتة‪،‬‏واملادة‏‪51‬‏(ي)‏حول‏إعالن‏اسم‏املرشح‏‬ ‫‏ة‏تعيني‏املدير‏اإلقليمي‪.‬‬ ‫لشغل‏منصب‏املدير‏اإلقليمي‪،‬‏واملادة‏‪51‬‏(ك)‏حول‏مد‬

‫قرتح‏مدونة‏لقواعد‏السلوك‏فيما‏يتعلق‏بتسمية‏املدير‏اإلقليمي‏إلقليم‏شرق‏املتوسط‏(املرفق‏‪ .)2‬وتتماشى‏هذه‏‬ ‫‏‏‬ ‫‪ .6‬وت‬ ‫املدونة‏مع‏املقرر‏اإلجرائي‏ج‏ص‏ع‪ 65‬‏(‪)9‬‏الذي‏يدعو‏إىل‏زيادة‏املواءمة‏على‏صعيد‏اللجان‏اإلقليمية‏فيما‏يتعلق‏‬ ‫بتسمية‏املديرين‏اإلقليميني‪،‬‏واملقرر‏اإلجرائي‏ج‏ص‏ع‏‪69‬‏(‪)8‬‏الذي‏يدعو‏كل‏جلنة‏إقليمية‪،‬‏مبا‏يتفق‏واملقرر‏اإلجرائي‏‬ ‫ج‏ص‏ع‏‪65‬‏(‪،) 9‬‏إىل‏النظر‏يف‏اإلجراءات‏الالزمة‏لتحسني‏عملية‏تسمية‏املديرين‏اإلقليميني‪،‬‏مع‏األخذ‏يف‏االعتبار‏‬ ‫أفضل‏املمارسات‏يف‏األقاليم‏الستة‏التابعة‏للمنظمة‪.‬‬ ‫انتخاب رئيس اللجنة اإلقليمية ونائبي الرئيس ومقرر اللجنة‬ ‫‪2-2‬‬

‫‏ ‏من‏‬ ‫وتستثن‬ ‫‏بعة‪،‬‏يقرتح ‏أن‏يوكون‏وزير‏الصحة‏بالبلد‏املضيف‏هو‏رئيس‏اللجنة ‏اإلقليمية‪،‬‏ ‏‬ ‫الً‏باملمارسات ‏املت‬ ‫‪ .7‬عم ‏‬ ‫‏ت ‏اللجنة ‏اإلقليمية ‏باملوكتب‏‬ ‫‏ ‏املوكتب ‏اإلقليمي‪ .‬‏فإذا ‏ما ‏انعقد‬ ‫‏د ‏مبقر‬ ‫‏عق‬ ‫ذلك ‏اجتماعات ‏اللجنة ‏اإلقليمية ‏اليت ‏ت‬ ‫اإلقليمي‪،‬‏حينما‏تنظر‏اللجنة‏اإلقليمية‏يف‏تسمية‏املدير‏اإلقليمي‏مثالً‪،‬‏ينبغي‏اختيار‏رئيس‏اللجنة‏من‏بني‏البلدان‏‬ ‫احلاضرة‏يف‏االجتماع‪،‬‏وفقاً‏للرتتيب‏األجبدي‏ألامساء‏البلدان ‏باللغة‏اإلنوكليزية‪ .‬‏وعندما‏تنظر‏اللجنة‏يف‏تسمية‏املدير‏‬ ‫‏خبني‏من‏بني‏البلدان‏اليت‏لديها‏مرشحون‏لشغل‏‬ ‫‏نت‬ ‫اإلقليمي‪،‬‏ال‏ينبغي‏اختيار‏أعضاء‏هيئة‏موكتب‏اللجنة‏اإلقليمية‏الـم‬ ‫منصب‏املدير‏اإلقليمي‪.‬‬ ‫‪ .8‬وبينما‏حتظى ‏املبادئ‏املبينة ‏بالدعم‏يف‏مجيع‏األقاليم‏التابعة‏للمنظمة ‏بصفة‏عامة‪،‬‏فقد‏اختذت‏اللجنة‏اإلقليمية‏‬ ‫أحياناً ‏قراراً‏خاصاً ‏بتعيني‏الرئيس‏من‏بني ‏أولئك‏الوزراء‏احلاضرين‏والذين‏تسمح ‏ظروفهم‏بالبقاء‏طيلة‏انعقاد‏دورة‏‬ ‫‏ى‏إىل‏متثيل‏غري‏متسا ٍ‬ ‫‏خبني‪.‬‬ ‫‏نت‬ ‫و‏للبلدان‏يف‏أعضاء‏هيئة‏موكتب‏اللجنة‏اإلقليمية‏الـم‬ ‫اللجنة‏اإلقليمية‪.‬‏وهو‏ما‏أد‬ ‫‏‏‬ ‫‏د‬ ‫‏ع‬ ‫قرتح‏اإلبقاء‏على‏اختيار‏رئيس‏اللجنة ‏اإلقليمية ‏ونائبيه‏وفق‏الرتتيب‏األجبدي‏باللغة‏اإلنوكليزية‪،‬‏إذ‏يـ‬ ‫‏‏‬ ‫‪ .9‬ومن‏الـم‬ ‫وسوف‏‬ ‫وشفافية‏ويتمشى‏مع‏املمارسات‏املتبعة ‏يف‏مجيع‏اللجان‏اإلقليمية‏األخرى‪.‬‏ ‏‬ ‫‏ج‏هو‏األكثر ‏إنصافاً ‏ ‏‬ ‫هذا‏النه‬ ‫‏ى‏األولوية‏إىل‏البلدان‏اليت‏مل‏يسبق‏هلا‏قط‏ أن‏شغلت‏أحد‏املناصب‏الثالث‏باللجنة‏اإلقليمية‏اليت‏يتم‏شغلها‏‬ ‫‏عط‬ ‫ت‬ ‫باالنتخاب‪،‬‏مع‏االلتزام‏بالرتتيب‏األجبدي‏باللغة‏اإلنوكليزية‪.‬‬ ‫‏للرئيس‏‬ ‫ون ‏من ‏رئيس ‏املوكتب ‏ونائب ‏‬ ‫‏خب ‏‬ ‫‏نت‬ ‫‪ .10‬ويف ‏الوقت ‏احلايل‪ ،‬‏يتوكون ‏أعضاء ‏هيئة‏موكتب ‏اللجنة ‏اإلقليمية ‏الـم‬ ‫ورئيس ‏املناقشات ‏التقنية‪ .‬‏علماً ‏بأن ‏عضو ‏هيئة ‏املوكتب ‏األخري ‏"رئيس ‏املناقشات ‏التقنية" ‏مل ‏يرد ‏النص ‏عليه ‏يف‏‬ ‫‏جنة‏اإلقليمية‏تعيني‏رئيس‏ملوكتبها‏ونائبني‏له‪.‬‬ ‫املادة‏‪10‬‏من‏النظام‏الداخلي‏الذي‏جييز‏لل‬ ‫‏ت‏إىل‏فوكرة‏خاطئة‏مفادها‏أن‏هناك‏رئيسني ‏اثنني‏‬ ‫اليت‏جرت‏بتعيني‏رئيس‏للمناقشات‏التقنية‏أد‬ ‫‏‬ ‫‪ .11‬وهذه‏العادة‏‬ ‫‏جنة‏اإلقليمية؛‏أحدمها‏لرئاسة‏دورة‏اللجنة‏العادية‪،‬‏يف‏حني‏يرأس‏اآلخر‏املناقشات‏املوضوعية‏لورقات‏تقنية‏معينة‪.‬‬ ‫لل‬ ‫‏جرت ‏بتعيني ‏رئيس ‏للمناقشات ‏التقنية‪،‬‏‬ ‫قرتح ‏إلغاء ‏املمارسة ‏اليت ‏‬ ‫‏‏‬ ‫‪ .12‬ومتشياً ‏مع ‏املادة ‏‪ 10‬‏من ‏النظام ‏الداخلي‪ ،‬‏ي‬ ‫واالقتصار‏على‏تعيني‏رئيس‏للجنة‏اإلقليمية‏ونائبني‏له‪.‬‬ ‫‪ .13‬ويبني ‏املرفق ‏‪ 3‬‏عدد ‏املرات ‏اليت ‏اختريت ‏فيها ‏البلدان‏ملنصب ‏رئيس ‏اللجنة ‏اإلقليمية ‏ونائبه ‏ورئيس ‏املناقشات‏‬ ‫التقنية‪.‬‬ ‫إنشاء لجنة فرعية معنية بالبرامج منبثقة عن اللجنة اإلقليمية‬ ‫‪3-2‬‬

‫قرتح‏إنشاء‏جلنة‏فرعية‏‬ ‫‏‏‬ ‫‪ .14‬يف‏إطار‏عملية‏التنسيق‏واملواءمة‏بني‏أساليب‏عمل‏اللجان‏اإلقليمية‏على‏نطاق‏املنظمة‪،‬‏ي‬ ‫‏ع‏هلا‏اختصاصات‏حمددة‪،‬‏وتوكون‏عضويتها‏بالتناوب‪.‬‬ ‫معنية‏بالربامج‏تنبثق‏عن‏اللجنة‏اإلقليمية‏لشرق‏املتوسط‪،‬‏توض‬ ‫‪2‬‬

‫‏جنة‏اإلقليمية‏لشرق‏‬ ‫‏جنة ‏اإلقليمية‪،‬‏مبوجب‏املادة‏‪ 16‬‏من‏القسم‏سابعاً ‏من‏النظام‏الداخلي‏احلايل‏لل‬ ‫‪ .15‬وجيوز ‏لل‬ ‫‏ئ‏ما‏تراه‏ضرورياً‏من‏جلان‏فرعية‏لدراسة‏أي‏بند‏من‏البنود‏املدرجة‏على‏جدول‏أعماهلا‪.‬‬ ‫‏نش‬ ‫املتوسط‪،‬‏أن‏ت‬ ‫‏أ‏هذه‏‬ ‫‏نش‬ ‫‏ما‏تدعو‏احلاجة‪.‬‏وت‬ ‫‏ب‬ ‫‪ .16‬ومجيع‏اللجان‏اإلقليمية‏اخلمس‏األخرى‏هلا‏هيئات‏فرعية‏تتبع‏اللجنة‏اإلقليمية‏حس‬ ‫‏ة‏هبا‪.‬‬ ‫اللجان‏الفرعية‏هبدف‏تعزيز‏عمل‏اللجان‏اإلقليمية‏وأدائها‏وتقوية‏الوظائف‏اإلشرافية‏املنوط‬

‫‏ة‏بالربامج‬ ‫‏جنة‏الفرعية‏املعني‬ ‫قرتحة‏لل‬ ‫‏‏‬ ‫االختصاصات‏الـم‬

‫‏جنة‏اإلقليمية‪،‬‏سوف‏تزاول‏اللجنة‏الفرعية‏املعنية‏بالربامج‏مهامها‏وفق‏‬ ‫‪ .17‬مع‏مراعاة‏املادة‏‪16‬‏من‏النظام‏الداخلي‏لل‬ ‫االختصاصات‏التالية‪:‬‬ ‫ير‏ومسودات‏‬ ‫‏‬ ‫‪ ‬دعم‏األعمال‏التحضريية‏للجنة ‏اإلقليمية‏من‏خالل‏مراجعة‏جدول‏األعمال‏ووثائق‏العمل‏والتقار‬ ‫دمها‏املدير‏اإلقليمي‪،‬‏باإلضافة‏إىل‏ما‏يرتتب‏عليها‏من‏آثار‏مالية‪.‬‬ ‫القرارات‏اليت‏يق ِ‏‬ ‫‏د‏تنفيذ‏التوصيات‏واملقررات‏اإلجرائية‏الصادرة‏عن‏اللجنة‏اإلقليمية‪.‬‬ ‫رص‬ ‫‪ ‬‏‬ ‫‪ ‬رفع‏توصية‏إىل‏اللجنة‏اإلقليمية‏ بتخصيص‏موارد‏إضافية‏حيتاج‏إليها‏املوكتب‏اإلقليمي‪،‬‏واقرتاح‏آلية‏تستطيع‏من‏‬ ‫خالهلا‏الدول‏األعضاء‏املسامهة‏بتمويل‏إضايف‏من‏أجل‏تنفيذ‏القرارات‏واملقررات‏اإلجرائية‏الصادرة‏عن‏اللجنة‪.‬‬ ‫‪ ‬النظر‏يف‏التقارير‏اخلاصة‏بتنفيذ‏توصيات‏مراجعي‏احلسابات‏الداخليني‏واخلارجيني‪،‬‏وإسداء‏املشورة‏إىل‏اللجنة‏‬ ‫اإلقليمية‏بشأن‏أي‏إجراء‏تصحيحي‏تدعو‏إليه‏احلاجة‪.‬‬ ‫‪ ‬النظر‏يف‏أي‏مسائل‏إدارية‏أو‏مالية‏أو‏ذات‏صلة‏بالربامج‏أو‏امليزانية‏حتيلها‏اللجنة‏اإلقليمية‏إىل‏اللجنة‏الفرعية‪،‬‏مبا‏‬ ‫يف‏ذلك‏املسائل‏اليت‏يقرتحها‏املدير‏اإلقليمي‪.‬‬ ‫‪ ‬تقدمي‏تقرير‏مبداوالهتا‏إىل‏اللجنة‏اإلقليمية‪.‬‬

‫قرتحة‬ ‫‏‏‬ ‫العضوية‏واالجتماعات‏الـم‬ ‫‏ة‏بالربامج‏من‏‪ 8‬‏دول‏أعضاء؛‏ست‏منها‏من‏بلدان‏اجملموعتني‏الثانية‏والثالثة‏‬ ‫‪ .18‬سوف‏تتألف‏اللجنة‏الفرعية‏املعني‬ ‫‪1‬‬ ‫بواقع‏‪3‬‏بلدان‏من‏كل‏جمموعة‪،‬‏ودولتان‏من‏بلدان‏اجملموعة‏األوىل‪.‬‬ ‫‪ .19‬وينبغي‏أن‏يوكون‏أعضاء‏اللجنة‏الفرعية‏من‏مسؤويل‏الصحة‏العمومية‏الذين‏يتمتعون‏بوكفاءة‏عالية‏وخربة‏كبرية‏‬ ‫كالء‏للوزراء‏أو‏مديري‏الربامج‏التقنية‏الرئيسية‪.‬‏وجيوز‏ألعضاء‏موكتب‏اللجنة‏‬ ‫ية‏عليا‏بدرحة‏و‬ ‫‏‬ ‫ممن‏يشغلون‏مناصب‏إدار‬ ‫املقرر)‏أن‏حيضروا‏اجتماعات‏اللجنة‏الفرعية‏كمراقبني‪.‬‏وسوف‏خيتار‏أعضاء‏اللجنة‏الفرعية‏‬ ‫اإلقليمية‏(الرئيس‏ونائبيه‏و ‏‬ ‫بالتناوب‪.‬‬ ‫‏اً ‏للجنة‪ .‬ويستمر‏‬ ‫‏ومقرر‬ ‫‪ .20‬وسوف ‏تنتخب ‏اللجنة ‏الفرعية ‏املعنية ‏بالربامج ‏من ‏بني ‏أعضائها ‏رئيساً ‏ونائباً ‏للرئيس ‏‬ ‫أعضاء‏موكتب‏اللجنة‏الفرعية‏يف‏شغل‏مناصبهم‏ملدة‏عام‏واحد‪.‬‬ ‫‪ .21‬وجيوز‏للمدير‏اإلقليمي‪،‬‏بالتشاور‏مع‏رئيس‏اللجنة‏الفرعية‪ ،‬‏أن‏يدعو‏إىل‏اجتماعات‏اللجنة‏الفرعية‏خرباء‏يرى‏‬ ‫يف‏حضورهم‏أمهية‏إلثراء‏النقاش‏حول‏بند‏خاص‏(بنود‏خاصة)‏من‏جدول‏األعمال‏أو‏ورقة‏(ورقات)‏تقنية‏تنظر‏فيها‏‬ ‫اللجنة‏الفرعية‏املعنية‏بالربامج‪.‬‏‬ ‫‪ 1‬اجملموعة ‏األوىل‪:‬‏مصر‏وليبيا‏واملغرب‏وتونس؛‏اجملموعة‏الثانية‪:‬‏البحرين‏والعراق‏والوكويت‏وعمان‏وقطر‏واململوكة‏العربية‏السعودية‏واإلمارات‏العربية‏املتحدة‏‬ ‫واليمن؛‏اجملموعة‏الثالثة‪:‬‏أفغانستان‏وجيبويت‏ومجهورية‏إيران‏اإلسالمية‏واألردن‏ولبنان‏وباكستان‏والصومال‏والسودان‏واجلمهورية‏العربية‏السورية‪.‬‏‬ ‫‪3‬‬

‫المرفق ‪ .1‬التعديالت المقترحة على النظام الداخلي‬ ‫التعديل المقترح‬ ‫سادساً‪:‬‏تقارير‏الدورات‬ ‫املادة‏‪15‬‬ ‫تعد ‏لجنة الصياغة‪ ،‬تدعمها األمانة‪ ،‬‏مسودة ‏تقرير ‏اللجنة ‏لبحثها‏‬ ‫وإقرارها‏قبل‏ناية‏كل‏دورة‪.‬‏ويرسل‏املدير‏اإلقليمي‏إىل‏الدول‏األعضاء‏‬ ‫وإىل‏املدير‏العام‏التقرير‏النهائي‏لوكل‏دورة‏بلغات‏العمل‏الرامسية‪،‬‏مبا‏يف‏‬ ‫ذلك ‏القرارات ‏والتوصيات ‏وغريها ‏من ‏املقررات ‏اهلامة‪ ،‬‏مع ‏تفاصيل‏‬ ‫التصويت‪،‬‏إن‏حدث‪.‬‬ ‫حادي‏عشر‪:‬‏التصويت‬ ‫املادة‏‪51‬‏(ب)‬ ‫ألي‏دولة‏عضو‏باإلقليم‏أن‏ترشح‏شخصاً‏واحداً‏أو‏أكثر‏من‏اإلقليم‏‬ ‫يوكون ‏قد ‏أبدى ‏استعداده ‏للعمل ‏مديراً ‏إقليمياً‪ ،‬‏على ‏أن ‏تقدم ‏مع‏‬ ‫الرتشيح‏معلومات‏عن‏مؤهالت‏ذلك‏الشخص‏وخربته‪.‬‏وتأخذ الدول‬ ‫األعضاء في اعتبارها مدونة قواعد السلوك التي اعتمدتها اللجنة‬ ‫اإلقليمية وتوجه إليها نظر هؤالء األشخاص‪.‬‏وترسل‏هذه‏الرتشيحات‏‬ ‫إىل‏املدير‏العام‏على‏أن‏تصله‏قبل‏املوعد‏احملدد‏الفتتاح‏الدورة‏مبا‏ال‏يقل‏‬ ‫عن‏اثن‏عشر‏أسبوعاً‪.‬‬ ‫املادة‏‪51‬‏(و)‬ ‫إذا‏مل‏يـعد‏املدير‏اإلقليمي‏قادراً‏على‏النهوض‏بأعباء‏وظيفته‏أو‏إذا‏شغر‏‬ ‫مي ‏اللجنة ‏اإلقليمية ‏شخصاً ‏لشغل‏‬ ‫منصبه ‏قبل ‏انتهاء ‏مدة ‏واليته‪ ،‬‏تس ِ‬ ‫منصب‏املدير‏اإلقليمي‏يف‏دورهتا‏التالية‪،‬‏وذلك‏شريطة‏التقيد‏باألحوكام‏‬ ‫األخرى‏الواردة‏يف‏هذه‏املادة‪،‬‏أما‏إذا‏تعذر‏التقيد‏باألحوكام‏األخرى‪،‬‏‬ ‫تتخذ‏اللجنة‏قراراً‏يف‏دورهتا‏التالية‏أو في دورة خاصة‪.‬‏‬ ‫النص األصلي‬ ‫سادساً‪:‬‏تقارير‏الدورات‬ ‫املادة‏‪15‬‬ ‫تعد‏جلنة‏الصياغة‏مسودة‏تقرير‏اللجنة‏لبحثها‏وإقرارها‏قبل‏ناية‏كل‏دورة‪.‬‏وال‏‬ ‫يلزم‏تعيني‏مقررين‏بصفة‏رامسية‏ما‏مل‏تقرر‏ذلك‏اللجنة‪.‬‏ويرسل‏املدير‏اإلقليمي‏‬ ‫إىل‏الدول‏األعضاء‏وإىل‏املدير‏العام‏التقرير‏النهائي‏لوكل‏دورة‏بلغات‏العمل‏‬ ‫الرامسية‪ ،‬‏مبا ‏يف ‏ذلك ‏القرارات ‏والتوصيات ‏وغريها ‏من ‏املقررات ‏اهلامة‪ ،‬‏مع‏‬ ‫تفاصيل‏التصويت‪،‬‏إن‏حدث‪.‬‏‬ ‫حادي‏عشر‪:‬‏التصويت‬ ‫املادة‏‪51‬‏(ب)‬ ‫ألي‏دولة‏عضو‏باإلقليم‏أن‏ترشح‏شخصاً‏واحداً‏أو‏أكثر‏من‏اإلقليم‏يوكون‏‬ ‫قد‏أبدى‏استعداده‏للعمل‏مديراً‏إقليمياً‪،‬‏على‏أن‏تقدم‏مع‏الرتشيح‏معلومات‏‬ ‫عن‏مؤهالت‏ذلك‏الشخص‏وخربته‪.‬‏وترسل‏هذه‏الرتشيحات‏إىل‏املدير‏العام‏‬ ‫على ‏أن ‏تصله ‏قبل ‏املوعد ‏احملدد ‏الفتتاح ‏الدورة ‏مبا ‏ال ‏يقل ‏عن ‏اثن ‏عشر‏‬ ‫أسبوعاً‪.‬‬

‫بغية‏تسمية‏شخص‪،‬‏وتقدمي‏اامسه‏إىل‏اجمللس‏التنفيذي‏يف‏أقرب‏فرصة‏‬ ‫مموكنة‪.‬‏وفي أثناء ذلك‪ ،‬يعين المدير العام مديراً إقليمياً باإلنابة إلى‬ ‫حين تعيين شخص جديد لشغل المنصب‪.‬‬ ‫املادة‏‪51‬‏(ط)‬ ‫ويعلن اسم الشخص المسمى على هذا النحو في جلسة علنية‬ ‫للّجنة اإلقليمية‏ويرفع‏إىل‏اجمللس‏التنفيذي‪.‬‬ ‫(ن)‏يعين المدير اإلقليمي لمدة خمس سنوات ويجوز إعادة تعيينه‬ ‫مرة واحدة فقط‪.‬‬

‫املادة‏‪51‬‏(و)‬ ‫إذا ‏مل ‏يـعد ‏املدير ‏اإلقليمي ‏قادراً ‏على ‏النهوض ‏بأعباء ‏وظيفته ‏أو ‏إذا ‏شغر‏‬ ‫مي‏اللجنة‏اإلقليمية‏شخصاً‏لشغل‏منصب‏‬ ‫منصبه‏قبل‏انتهاء‏مدة‏واليته‪،‬‏تس ِ‬ ‫املدير ‏اإلقليمي ‏يف ‏دورهتا ‏التالية‪ ،‬‏وذلك ‏شريطة ‏التقيد ‏باألحوكام ‏األخرى‏‬ ‫الواردة‏يف‏هذه‏املادة‪،‬‏أما‏إذا‏تعذر‏التقيد‏باألحوكام‏األخرى‪،‬‏تتخذ‏اللجنة‏‬ ‫قراراً‏يف‏دورهتا‏التالية‪.‬‏‬ ‫بغية‏تسمية‏شخص‪،‬‏وتقدمي‏اامسه‏إىل‏اجمللس‏التنفيذي‏يف‏أقرب‏فرصة‏مموكنة‪.‬‏‬

‫المرفق ‪ .2‬مدونة لقواعد السلوك فيما يتعلق بتسمية المدير اإلقليمي‬ ‫لمنظمة الصحة العالمية لشرق المتوسط‬ ‫هتدف‏مدونة‏قواعد‏السلوك ‏(املدونة)‏إىل‏تعزيز‏االنفتاح‏والعدالة ‏واإلنصاف‏والشفافية‏يف ‏عملية‏تسمية‏املدير‏‬ ‫اإلقليمي ‏ملنظمة ‏الصحة ‏العاملية ‏لشرق ‏املتوسط‪ .‬‏وسعياً ‏إىل ‏حتسني ‏العملية ‏كوكل‪ ،‬‏تتصدى ‏هذه ‏املدونة ‏لعدد ‏من‏‬ ‫اجملاالت‪،‬‏منها‏تقدمي‏الرتشيحات‏وإجراء‏محالت‏انتخابية‏من‏جانب‏الدول‏األعضاء‏واملرشحني‪.‬‬ ‫وتعد ‏املدونة ‏تفهماً ‏سياسياً ‏بني ‏الدول ‏األعضاء ‏يف ‏إقليم ‏شرق ‏املتوسط ‏(الدول ‏األعضاء)‪ ،‬‏وتوصي ‏بالسلوك‏‬ ‫‏رشحني‏فيما‏يتعلق‏بانتخاب‏املدير‏اإلقليمي‪،‬‏من‏أجل‏تعزيز‏عدالة‏العملية‏‬ ‫املنشود‏من‏جانب‏الدول‏األعضاء‏والـم‬ ‫‏‪،‬‏فإن‏املدونة‏ليست‏ملزمة‏قانوناً‏ولوكن‏ينبغي‏‬ ‫وانفتاحها‏وشفافيتها‪،‬‏وبالتايل‏شرعيتها‪،‬‏وشرعية‏نتائجها‏وقبوهلا‪.‬‏ومن‏ث‬ ‫‏رشحني‏احرتام‏حمتوياهتا‪.‬‬ ‫على‏الدول‏األعضاء‏وعلى‏الـم‬ ‫وترتوكز ‏املدونة ‏على ‏األحوكام ‏املتعلقة ‏بتسمية ‏املدير ‏اإلقليمي ‏لشرق ‏املتوسط ‏على ‏النحو ‏الوارد ‏باملادة ‏‪ 51‬‏من‏‬ ‫النظام‏األساسي‏للجنة‏اإلقليمية‏ملنظمة‏الصحة‏العاملية‏لشرق‏املتوسط‪،‬‏وتعزز‏تلك‏األحوكام‪.‬‬ ‫الشروط العامة‬ ‫المبادئ األساسية‬ ‫كذلك‏أنشطة ‏احلملة‏االنتخابية‏املتعلقة‏هبا ‏بأحوكام‏املادة‏‪ 51‬‏من‏‬ ‫ينبغي‏أن‏تسرتشد‏عملية‏التسمية‏بأكملها‏و‬ ‫يد‏من‏الشرعية‏على‏العملية‏وعلى‏نتائجها‪:‬‬ ‫‏‬ ‫النظام‏الداخلي‏وباملبادئ‏التالية‏اليت‏تضفي‏املز‬ ‫العدالة‬ ‫اإلنصاف‬ ‫الشفافية‬ ‫حسن‏النية‬ ‫الوكرامة‏واالحرتام‏املتبادل‏واالعتدال‬ ‫عدم‏التمييز‬ ‫اجلدارة‏‬ ‫توافق ‏ الدول ‏األعضاء ‏على ‏سلطة ‏اللجنة ‏اإلقليمية ‏لشرق ‏املتوسط ‏(اللجنة ‏اإلقليمية) ‏يف ‏القيام ‏بتسمية ‏املدير‏‬ ‫اإلقليمي‏وفقاً‏للمادة‏‪51‬‏من‏نظامها‏الداخلي‪.‬‬ ‫وجيوز‏للدول‏األعضاء‏اليت‏ترشح‏األشخاص‏ملنصب‏املدير‏اإلقليمي‏الرتويج‏لرتشيحاهتا‪.‬‏وينطبق‏هذا‏أيضاً‏على‏‬ ‫‏رشحني‏‬ ‫‏رشحني ‏فيما ‏يتعلق ‏برتشيحهم ‏ألنفسهم‪ .‬‏وعند ‏ممارسة ‏هذا ‏احلق‪ ،‬‏ينبغي ‏على ‏الدول ‏األعضاء ‏والـم‬ ‫الـم‬ ‫التقيد‏جبميع‏القواعد‏اليت‏حتوكم‏عملية‏تسمية‏املدير‏اإلقليمي‪،‬‏اليت‏وردت‏يف‏املادة‏‪ 51‬‏من‏النظام‏الداخلي‏للجنة‏‬ ‫اإلقليمية‏ويف‏قراراهتا‏ومقرراهتا‏اإلجرائية‏ذات‏الصلة‪،‬‏ويف‏هذه‏املدونة‏اخلاصة‏بقواعد‏السلوك‪.‬‬ ‫‏رشحون‏مسؤولني‏عن‏االلتزام‏هبذه‏املدونة‏واحرتامها‪.‬‏‏‬ ‫تعد‏الدول‏األعضاء‏والـم‬ ‫‪8‬‬ ‫‪‬‬ ‫‪‬‬ ‫‪‬‬ ‫‪‬‬ ‫‪‬‬ ‫‪‬‬ ‫‪‬‬

‫وتقر‏ الدول‏األعضاء‏بأن‏عملية‏تسمية‏املدير‏اإلقليمي‏ينبغي‏أن‏تتسم‏بالعدالة‏واالنفتاح‏والشفافية‏واإلنصاف‏وأن‏‬ ‫‏رشحني‪.‬‏وينبغي‏أن‏توكون‏املدونة‏معروفة‏للجميع‏وأن‏يتاح‏االطالع‏‬ ‫تقوم‏على‏أساس‏جدارة‏كل‏مرشح‏من‏الـم‬ ‫عليها‏بسهولة‪.‬‬

‫الشروط الخاصة بالخطوات المختلفة لعملية التسمية‬ ‫أوالً‪ :‬تقديم الترشيحات‬ ‫ِم‏التفاصيل‏‬ ‫يطلب‏املدير‏العام‏من‏الدول‏األعضاء‪،‬‏عند‏ترشيح‏شخص‏أو‏أكثر‏ملنصب‏املدير‏اإلقليمي‪،‬‏أن‏تقد‬ ‫الضرورية‏ملؤهالت‏كل‏شخص‏وخرباته‪،‬‏باستخدام‏النموذج‏املوحد‏املرفق‏هبذه‏املدونة‪،‬‏هبدف‏حتسني‏إموكانية‏مقارنة‏‬ ‫مزايا‏املرشح ني‏ومؤهالهتم‏يف‏مقابل‏املعايري‏اليت‏اعتمدهتا‏اللجنة‏اإلقليمية‏يف‏املقرر‏اإلجرائي‏ش‏م‪/‬ل‏إ‪.13-59‬‬ ‫ثانياً‪ :‬الحملة االنتخابية‬ ‫تنطبق‏ هذه‏املدونة‏على‏األنشطة‏االنتخابية‏املرتبطة‏بتسمية‏املدير‏اإلقليمي‏كلما‏أقيمت‏مثل‏هذه‏األنشطة‏وحىت‏‬ ‫تتم‏التسمية‏من‏جانب‏اللجنة‏اإلقليمية‪.‬‬ ‫وينبغي‏على‏كافة‏الدول‏األعضاء‏والـمرشحني‏تشجيع‏وتعزيز‏التواصل‏والتعاون‏خالل‏عملية‏التسمية‏بأكملها‪.‬‏‬ ‫كة‏اليت‏تتمثل‏يف‏تعزيز‏املساواة‏واالنفتاح‏‬ ‫وينبغي‏على‏الدول‏ األعضاء‏أن‏تتصرف‏حبسن‏نية‏وأن‏تراعي‏األهداف‏املشرت‬ ‫والشفافية‏والعدالة‏خالل‏عملية‏التسمية‏بأكملها‪.‬‬ ‫‏رشحني‏أن‏يشري‏كل‏منهم‏إىل‏اآلخر‏باحرتام‪،‬‏وينبغي‏أال‏تعطل‏أو‏تعوق‏أي‏من‏‬ ‫وينبغي‏على‏الدول‏األعضاء‏والـم‬ ‫كذلك‏ينبغي‏أال‏تديل‏أي‏من‏الدول‏األعضاء‏أو‏‬ ‫‏رشحني‏اآلخرين‪.‬‏و‬ ‫‏رشحني‏أنشطة‏محالت‏الـم‬ ‫الدول‏األعضاء‏أو‏الـم‬ ‫الـمرشحني‏بأي‏بيان‏شفوي‏أو‏كتايب‏أو‏أي‏بيان‏آخر‏قد‏يعد‏من‏قبيل‏االفرتاء‏أو‏التشهري‪.‬‬ ‫وينبغي‏على‏الدول‏األعضاء ‏واملرشحني‏اإلفصاح‏عن‏أنشطة‏محالهتم‏(مثل‏استضافة‏االجتماعات ‏أو ‏حلقات‏‬ ‫العمل‏أو‏الزيارات)‪ .‬‏وسوف‏تنشر‏املعلومات‏اليت‏يتم‏اإلفصاح‏عنها‏على‏إحدى‏الصفحات‏املخصصة‏لذلك‏على‏‬ ‫املوقع‏اإللوكرتوين‏للموكتب‏اإلقليمي‪.‬‬ ‫‏رشحني‏االمتناع‏عن‏التأثري‏على‏عملية‏التسمية‏على‏حنو‏غري‏مشروع‪،‬‏على‏سبيل‏‬ ‫وينبغي‏على‏الدول‏األعضاء‏والـم‬ ‫امل ثال‏عن‏طريق‏منح‏أو‏قبول‏منافع‏مالية‏أو‏غري‏مالية‏أو‏عن‏طريق‏الوعد‏مبثل‏هذه‏الفوائد‏يف‏مقابل‏دعم‏أحد‏‬ ‫‏رشحني‪.‬‬ ‫الـم‬ ‫‏رشحني‏عدم‏قطع‏الوعود‏أو‏االلتزامات‏لصاحل‏أي‏شخص‏أو‏كيان‏سواء‏كان‏‬ ‫وينبغي‏على‏الدول‏األعضاء‏والـم‬ ‫وض‏نزاهة‏عملية‏التسمية‏أو‏يبدو‏على‏أنه‏‬ ‫عاماً‏أو‏خاصاً‪،‬‏أو‏قبول‏تعليمات‏منه‪،‬‏عندما‏يوكون‏من‏شأن‏ذلك‏أن‏يق ِ‬ ‫وضها‪.‬‬ ‫يق ِ‬ ‫سر ‏االجتماعات ‏بني ‏مرشحهم ‏وبني ‏الدول ‏األعضاء‏‬ ‫وينبغي ‏على ‏الدول ‏األعضاء ‏اليت ‏اقرتحت ‏مرشحاً ‏أن ‏تي ِ‬ ‫‏رشحني‏والدول‏األعضاء‏عند‏انعقاد‏‬ ‫األخرى‪،‬‏إن‏طلب‏منها‏ذلك‪.‬‏وحيثما‏أموكن‪،‬‏ينبغي‏ترتيب‏االجتماعات‏بني‏الـم‬ ‫املؤمترات‏أو‏غريها‏من‏األحداث‏اليت‏تشارك‏فيها‏الدول‏األعضاء‏باإلقليم‏وليس‏من‏خالل‏الزيارات‏الثنائية‪.‬‬

‫وينبغي‏على‏الدول‏األعضاء‏اليت‏تسمي‏مرشحني‏ملنصب‏املدير‏اإلقليمي‏أن‏تنظر‏يف‏اإلفصاح‏عن‏املنح‏أو‏متويل‏‬ ‫املعونة‏اليت‏قدمتها‏خالل‏العامني‏السابقني‏لضمان‏الشفافية‏التامة‏والثقة‏املتبادلة‏بني‏الدول‏األعضاء‪.‬‬ ‫‏رشحني‏إىل‏الدول‏األعضاء‏من‏أجل‏الرتويج‏لرتشيحهم‏حمدوداً‏لتجنب‏النفقات‏املفرطة‏‬ ‫وينبغي‏أن‏يوكون‏سفر‏الـم‬ ‫ول ‏األعضاء‏‬ ‫‏رشحني‪ .‬‏ويف ‏هذا ‏الصدد ‏ينبغي ‏على ‏الد ‏‬ ‫اليت ‏قد ‏تؤدي ‏إىل ‏عدم ‏املساواة ‏بني ‏الدول ‏األعضاء ‏والـم‬ ‫‏رشحني‏النظر‏يف‏استخدام‏اآلليات‏القائمة‏بقدر‏اإلموكان‏(اللجان‏اإلقليمية‏واجمللس‏التنفيذي‏ومجعية‏الصحة‏‬ ‫والـم‬ ‫العاملية)‏لعقد‏االجتماعات‏وغريها‏من‏األنشطة‏الرتوجيية‏املرتبطة‏باحلملة‏االنتخابية‪.‬‬ ‫وينبغي‏جتنب‏الرتويج‏أو‏الدعاية‏االنتخابية‏حتت‏ستار‏االجتماعات‏التقنية‏أو‏األحداث‏األخرى‏املشاهبة‪.‬‬ ‫وبعد‏أن‏يرسل‏املدير‏العام‏أامساء‏املرشحني‏والتفاصيل‏اخلاصة‏هبم‏إىل‏الدول‏األعضاء‏مبوجب‏الفقرة‏الرابعة‏من‏‬ ‫ح‏األسئلة‏واألجوبة‏على‏املوقع‏اإللوكرتوين‏‬ ‫من‏النظام‏الداخلي‪،‬‏فإنه‏سينشئ‏منتدى ‏حممياً‏بوكلمة‏سر‏لطر‬ ‫املادة‏‪ 51‬‏‬ ‫ً‬ ‫كة‏فيه‪.‬‬ ‫‏رشحني‏الذين‏يطلبون‏املشار‬ ‫للمنظمة‪،‬‏على‏أن‏يوكون‏هذا‏املنتدى‏متاحاً‏جلميع‏الدول‏األعضاء‏والـم‬ ‫وبعد‏أن‏يرسل‏املدير‏العام‏أامساء‏املرشحني‏والتفاصيل‏اخلاصة‏هبم‏إىل‏الدول‏األعضاء‏مبوجب‏الفقرة‏الرابعة‏من‏‬ ‫املادة‏‪ 51‬‏ من‏النظام‏الداخلي‪،‬‏سوف‏ينشر‏املوكتب‏اإلقليمي‏على‏موقعه‏اإللوكرتوين‏معلومات‏عن‏مجيع‏املرشحني‏‬ ‫الذين‏يطلبون‏ذلك‪،‬‏ومن‏هذه‏املعلومات‏السري‏الذاتية‏وغريها‏من‏التفاصيل‏اخلاصة‏مبؤهالهتم‏وخرباهتم‏كما‏وردت‏من‏‬ ‫الدول‏األعضاء‪،‬‏فضالً‏عن‏بيانات‏االتصال‏اخلاصة‏هبم‪.‬‏وسيحتوي ‏املوقع‏على‏الروابط‏املؤدية‏إىل‏املواقع‏اإللوكرتونية‏‬ ‫‏رشحني ‏مسؤوالً ‏عن ‏إنشاء ‏موقعه‏‬ ‫لوكل ‏مرشح ‏من ‏الـمرشحني‪ ،‬‏وذلك ‏عند ‏الطلب‪ .‬‏وسيوكون ‏كل ‏مرشح ‏من ‏الـم‬ ‫اإللوكرتوين ‏ومتويله‪ .‬‏وسينشر ‏املوكتب ‏اإلقليمي ‏أيضاً ‏على ‏موقعه ‏اإللوكرتوين ‏معلومات ‏عن ‏عملية ‏التسمية ‏والقواعد‏‬ ‫واملقررات‏اإلجرائية‏املطبقة‪،‬‏وذلك‏يف‏الوقت‏الذي‏تشري‏إليه‏الفقرة‏األوىل‏من‏املادة‏‪ 51‬‏من‏النظام‏الداخلي‏للجنة‏‬ ‫اإلقليمية‪.‬‬ ‫ثالثاً‪ .‬التسمية‬ ‫تتم‏تسمية‏املدير‏اإلقليمي‏يف‏اجتماعات‏مغلقة‏للجنة ‏اإلقليمية‏وفقاً‏للمادة‏‪ 51‬‏من‏النظام‏الداخلي‪.‬‏وحضور‏‬ ‫االجتماعات ‏املغلقة‪ ،‬‏إىل ‏جانب ‏أعضاء ‏اللجنة‪ ،‬‏حيدده ‏املدير ‏العام ‏ويقتصر ‏على ‏موظفني ‏أساسيني ‏من ‏األمانة‪.‬‏‬ ‫وال‏حيضر‏املرشحون‏هذه‏االجتماعات‏حىت‏وإن‏كانوا‏أعضاءً ‏بوفود‏بلدانم‪.‬‏وجيري‏التصويت‏يف‏االجتماع‏املغلق‏‬ ‫باالقرتاع‏السري‪.‬‏وال‏ينبغي‏للدول‏األعضاء‏اإلفصاح‏عن‏نتائج‏االقرتاع‪.‬‬ ‫وينبغي ‏على ‏الدول ‏األعضاء ‏االلتزام ‏التزاماً ‏صارماً ‏بالنظام ‏الداخلي ‏وغريها ‏من ‏القرارات ‏املطبقة‪ ،‬‏واحرتام ‏نزاهة‏‬ ‫كيات‏واإلجراءات‏اليت‏قد‏يبدو‏أنا‏تستهدف‏التأثري‏على‏‬ ‫اإلجراءات‏وشرعيتها‏ووقارها‪ .‬‏ وبالتايل‏ينبغي‏جتنب‏السلو‬ ‫النتائج‪،‬‏وذلك‏داخل‏قاعة‏املؤمترات‏حيث‏جترى‏عملية‏التسمية‏وخارجها‏على‏حد‏سواء‪.‬‬ ‫وينبغي‏على‏الدول‏األعضاء‏احرتام‏سرية‏اإلجراءات‏وسرية‏األصوات‪.‬‏وينبغي‏على‏وجه‏اخلصوص‏االمتناع‏عن‏‬ ‫نقل‏أو‏بث‏اإلجراءات‏اليت‏تشهدها‏اجللسات‏املغلقة‏باستخدام‏األجهزة‏اإللوكرتونية‪.‬‬

Governance reform 1. Introduction

1. Following the Special Session of the WHO Executive Board held in November 2011 and the 130th session of the Executive Board in January 2012, WHO has embarked on a governance reform programme as part of a comprehensive reform agenda covering three critical areas: programmes and priority-setting, managerial reforms and governance. 2. Deliberations of successive meetings of the Executive Board and World Health Assembly have resulted in a series of recommendations aimed at strengthening and increasing the harmonization of the procedures and processes of the Governing Bodies across the Organization. 3. Acting on operative paragraphs 4 and 5 of decision WHA65(9) of the Sixty-fifth World Health Assembly, in 2012 the 59th session of the Regional Committee for the Eastern Mediterranean decided to revise several of its rules of procedure. The revisions concerned: a) section I, Rule 2 on attendance of States not members of the Committee and nongovernmental organizations; b) section I, Rule 3 on credentials; c) section X, Rule 37 on the voting of submission of proposals to the Regional Committee; d) section XI, Rule 48 on the election of the Regional Director and Rule 51 on the nomination of the Regional Director including the criteria for assessing candidates for the post of the Regional Director. 4. This paper proposes a number of further amendments to the Rules of Procedure of the WHO Regional Committee for the Eastern Mediterranean. It also outlines proposed reforms to regional processes for nomination of countries to the Executive Board and World Health Assembly and other governance issues.

2. Proposed amendments and reforms 2.1 Nomination of the Regional Director for the Eastern Mediterranean 5. Amendments to the Rules of Procedure of the Regional Committee are proposed in the following areas (Annex 1): section VI, Rule 15 on reporting of sessions; section XI, Rule 51(b) on a Code of Conduct for the nomination of the Regional Director (Annex 2); Rule 51(f) on interim procedures; Rule 51(i) on the announcement of the nominee; and 51(j) on the duration of appointment of the Regional Director. 6. A Code of Conduct (Annex 2) is proposed for the nomination of the Regional Director for the Eastern Mediterranean Region. This Code is in line with decision WHA65(9) calling for increased harmonization across regional committees in the nomination of Regional Directors and decision WHA69(8) inviting each Regional Committee, in accordance with decision WHA65(9) to consider measures to improve the process of nomination of Regional Directors, taking into consideration best practices from the six regions. 2.2 Election of the Chair, Vice-Chairs and Rapporteur of the Regional Committee 7. In accordance with established practice, it is proposed that the Chair of the Committee be the Minister of Health of the host country, except when the Regional Committee meeting takes place at the Regional Office. When the Regional Committee convenes at the Regional Office, such as when the Regional Committee considers the nomination of the Regional Director, the Chair should be selected from among the countries present at the meeting, following the English alphabetical order. When the Committee considers the nomination of the Regional Director, the elected officers of the Committee

should not be selected from among the countries that have candidates running for the position of the Regional Director. 8. While the principles as outlined are generally supported by all regions, on occasion the Committee has made an ad hoc decision to designate a Chair from among those Ministers present and available to stay for the entire session of the Committee. This has created an unequal representation of countries in the elected officers of the Regional Committee. 9. It is proposed to maintain the selection of the Chair and the two Vice-Chairs following the English alphabetical order, as this approach is considered to be the fairest and most transparent system and is in line with the practice of all other regional committees. While following the English alphabetical order, priority will be given to those countries that have never held one of the three elected positions of the Regional Committee. 10. Currently, the elected officials of the Regional Committee comprise the Chair, Vice-Chair and a Chair of the Technical Discussions. The latter office is not described in Rule 10 of the Rules of Procedure, which authorizes the Committee to designate a Chair and two Vice-Chairs. 11. The practice of designating a Chair for the Technical Discussions has resulted in the misconception that there are two Chairs of the Committee, one for the general Committee session while the other for substantive discussion of certain technical papers. 12. In line with Rule 10 of the Rules of Procedure, it is proposed to eliminate the practice of designating a Chair of the Technical Discussions and simply designate a Chair and two Vice-Chairs of the Regional Committee. 13. Annex 3 shows the number of times countries were elected to the post of the Chair, Vice-Chair and Chair of Technical Discussions of the Regional Committee. 2.3 Establishment of a Programme Subcommittee of the Regional Committee 14. As part of the harmonization process and alignment of methods of work of the regional committees across the Organization, it is proposed to establish a Programme Subcommittee of the Regional Committee for the Eastern Mediterranean with specific terms of reference and rotating membership. 15. Rule 16, under section VII of the current Rules of Procedure of the Regional Committee for the Eastern Mediterranean, provides the authority to establish subcommittees as the Committee deems necessary for the study on any item on its agenda. 16. All the other five regional committees have (a) subsidiary organ(s) reporting to the Regional Committee, depending on need. These subcommittees are established to strengthen the work, performance and the oversight functions of the regional committees. Proposed terms of reference of the Programme Subcommittee 17. In accordance with Rule 16 of the Rules of Procedure, the Programme Subcommittee would conduct its business under the following terms of reference.  Support the preparatory work of the Regional Committee by reviewing the agenda, the working documents, reports, and draft resolutions along with its financial implications submitted by the Regional Director. 
  Monitor the implementation of the recommendations and decisions of the Regional Committee. 2

 Recommend to the Committee additional resources required by the Regional Office and propose a mechanism for Member States to contribute additional funding for the implementation of Committee’s resolutions and decisions.  Examine the reports on the implementation of the recommendation of internal and external auditors and advise the Committee on any remedial action needed.  Consider any other programmatic, administrative, budgetary or financial matters that the Committee, including at the proposal of the Regional Director, refer to the Subcommittee.  Submit report on its deliberations to the Committee. 
 Proposed membership and meetings 18. The Programme Subcommittee would consist of eight Member States, three each from among Group 2 and Group 3 countries, and two from among Group 1 countries.1 19. Members of the Subcommittee should be highly competent and experienced public health officials in senior management positions at the level of deputy ministers or directors of key technical prorgammes. The office bearers of the Regional Committee (the Chair, Vice-Chairs and Rapporteur) may also participate as observers of the meeting. Membership will be on a rotating basis. 20. The Programme Subcommittee will elect its chair, vice-chair and a rapporteur from among the members of the Subcommittee. The office bearers of the Subcommittee would serve for a period of one year. 21. In consultation with the chair of the Subcommittee, the Regional Director may invite experts he or she considers as relevant in enhancing discussion of any particular agenda item(s) or technical paper(s) being considered by the Programme Subcommittee to its meetings. 
 22. All members of the Programme Subcommittee other than the observers will be appointed by the Committee and will serve for a period of two years. In order to maintain some institutional memory of the working of the Subcommittee, it is proposed to replace four members each year following the English alphabetical order in each group. To ensure a smooth replacement mechanism, four of the first eight members would serve the first year. 23. The Regional Director would, in consultation with the Chair of the Committee, convene a Programme Subcommittee meeting at least once annually for a duration not exceeding 4 working days. 24. The Regional Director would also designate technical experts and support staff from the WHO secretariat to this meeting. 25. The proposed schedule for membership of the Programme Subcommittee is attached in Annex 4. 2.4 Process for the nomination of Executive Board members 26. Membership in the Executive Board of the World Health Organization consists of 34 persons designated by Member States from each WHO region who are elected by the World Health Assembly. In accordance with constant, established and agreed practice, the Eastern Mediterranean Region designates 5 Member States to serve on the Executive Board. Each Member State serves on the Board for a period of 3 years. 1

Group 1: Egypt, Libya, Morocco, Tunisia. Group 2: Bahrain, Iraq, Kuwait, Oman, Qatar, Saudi Arabia, United Arab Emirates, Yemen. Group 3: Afghanistan, Djibouti, Islamic Republic of Iran, Jordan, Lebanon, Pakistan, Somalia, Sudan, Syrian Arab Republic.

27. The Executive Board meets at least twice a year, in January (7–10 days) and in May (3–4 days), immediately after the end of World Health Assembly. Members complete their term of office at the closing of the Health Assembly, at which time the new members take office. 28. Until May 2002, the practice of designating countries of the Region as members of the Executive Board did not follow a system that assured transparent and equitable geographical representation of the countries in the Region. 29. Recognizing that the process for designating Executive Board members from the Region needed reconsideration, an informal working group was constituted in 2001 with the objective of reviewing the current situation and identifying a fair and transparent process for designating Executive Board members in line with the experience and practices already adopted by other WHO regions. The working group was drawn from among Member States and led by the (former) Minister of Public Health of Qatar. 30. The efforts of the working group resulted in an agreement that grouped the countries of the Region into three subregional groups in order to ensure that countries in each subregion are represented at the Executive Board at all times. This approach allocates two seats from each of the larger subregional groups (2 and 3), while the smaller group (1) is allocated one seat as shown in Annex 5. 31. The Regional Director presented the new approach to the 48th session of the Regional Committee in 2001. The Committee supported the proposed approach and decided to put it into effect following discussion at a Ministerial meeting on the sidelines of the Fifty-fifth World Health Assembly in May 2002. 32. Since May 2002, all vacant Executive Board seats for the Region are filled in accordance with the approach described above, which is considered to be fair, transparent and geographically representative. 33. For the rotating Chairmanship of the Executive Board, which comes every six years, a regional Executive Board member will be elected from among those countries of the Region that have never held the Executive Board chair or have held it the fewest number of times. 34. Similarly, the Vice-Chairmen of the Executive Board will be elected from among the Executive Board members of the regions not chairing that session. The tenure of office for the elected officials of the Executive Board is one year. 35. Should a country decide not to propose a candidate, the next country in line may select a representative on the Board. 36. Countries are reminded that, in accordance with Article 24 of the Constitution and as recalled by the Health Assembly in resolution WHA51.26, individuals designated to serve on the Board must be technically qualified in the field of health. Consideration should be given to individuals with a broad mix of skills and practical experience in public health and national public administration at a senior position close to the political decision-making level. The candidates for the Executive Board should also demonstrate the ability to collaborate, coordinate and communicate within their country, between countries of the Region and with international partners. 37. The schedule membership of countries of the Eastern Mediterranean Region to the Executive Board is shown in Annex 6.

2.5 Nomination of a country of the Region for the President and other elected officials of the World Health Assembly 38. The elected officials of the World Health Assembly are composed of the President and the VicePresidents of the Health Assembly, the Chairmen, Vice-Chairmen and Rapporteurs of Committees A and B, and the Chairmen and Vice-Chairmen of the Committee on Credentials and the Committee on Nominations. Member States nominate their candidates and the Health Assembly appoints them to the Office of the Bureau of the Assembly. 39. The Presidency and other elected offices of the Health Assembly are rotated among the WHO regions every year. 40. In the past, the nominations of the above officials had not followed a consistent approach agreed by Member States. On the first day of the World Health Assembly, the Health Minsters and Heads of Delegations nominate from among their members a candidate for the elected offices of the Health Assembly including the President of the Health Assembly. 41. Annex 7 shows the number of times each country in the Region has served as President of the World Health Assembly and as other elected officials. 42. It is proposed that the regional nomination for the President of the Health Assembly follow the English alphabetical order, giving priority to countries that have never held this office. 43. Similarly, the nomination of the other elected officials including the Chairmen of Committees A and B and the Vice-Presidents of the Health Assembly should follow the same approach. Elected officials of the World Health Assembly are expected to stay and to be available for the entire duration of the Assembly. 44. In the event that a Member State declines to nominate a candidate for the above position, the next country in line may nominate a candidate. Once approved by the Regional Committee, the new system would be effective from 2017.

3. Other governance issues 45. As part of WHO reform efforts to increase transparency and accountability of the Secretariat, and in accordance with the Health Assembly’s request in decision WHA69(8), the Regional Director has posted on the internet his delegation of authority from the Director-General and the Letter of Representation. The 2015 Letter of Representation and the 2016 Delegation of Authority of the Regional Director have also been posted on the Regional Director’s webpage of the WHO corporate http://who.int/dg/regional_directors/alwan_emro/en/ along with the Letters of Representation and Delegations of Authority of the other Regional Directors. 46. The current Regional Director’s annual report provides an overview of the actions taken, the achievements made and the challenges the Region is facing. Effective next year, the Regional Director will also provide at the end of each biennium a consolidated report on the results achieved in the regional and country offices along with associated financial information to the Regional Committee. 47. The Regional Director will also provide to the Regional Committee a biennial report on WHO country presence starting at the end of current biennium (2016–2017).

Annex 1. Proposed changes to the Rules of Procedure Original text VI. Reports of sessions Rule 15 The Secretariat shall prepare a draft report of the Committee for consideration and adoption before the end of each session. Formal appointment of Rapporteurs is not required unless so decided by the Committee. The final report of each session in the working languages, including resolutions, recommendations and other important decisions, with details of voting, if any, shall be communicated by the Regional Director to the Member States and to the Director-General. XI. Voting Rule 51 (b) Any Member State of the Region may propose the name of one or more persons from within the Region who has indicated willingness to act as Regional Director, submitting with the proposal particulars of the person’s qualifications and experience. Such proposals shall be sent to the DirectorGeneral so as to reach him or her not less than twelve weeks before the date fixed for the opening of the session. Proposed change VI. Reports of sessions Rule 15 The drafting committee, supported by the Secretariat, shall prepare a draft report of the Committee for consideration and adoption before the end of each session. The final report of each session in the working languages, including resolutions, recommendations and other important decisions, with details of voting, if any, shall be communicated by the Regional Director to the Member States and to the Director-General. XI. Voting Rule 51 (b) Any Member State of the Region may propose the name of one or more persons from within the Region who has indicated willingness to act as Regional Director, submitting with the proposal particulars of the person’s qualifications and experience. Member States shall be mindful of the Code of Conduct adopted by the Regional Committee and shall bring it to the attention of such persons. Such proposals shall be sent to the Director-General so as to reach him or her not less than twelve weeks before the date fixed for the opening of the session. Rule 51 (f) If the Regional Director is unable to perform the functions of his or her office or if his or her office becomes vacant before his or her term of office is completed, the Committee shall nominate a person for the post of Regional Director at its next session, provided that the other provisions of this Rule are met. If the other provisions of this Rule cannot be met, the Committee shall take a decision at its next session or in a special session. with a view to nominating a person and submitting his or her name to the Executive Board as soon as possible. In the interim, the Director-General shall designate an acting Regional Director until the appointment of the new incumbent. Rule 51 (i) The name of the person so nominated shall be announced at a public meeting of the Regional Committee and submitted to the Executive Board. (j) The appointment of the Regional Director shall be for five years and he or she shall be eligible for reappointment once only.

Rule 51 (f) If the Regional Director is unable to perform the functions of his or her office or if his or her office becomes vacant before his or her term of office is completed, the Committee shall nominate a person for the post of Regional Director at its next session, provided that the other provisions of this Rule are met. If the other provisions of this Rule cannot be met, the Committee shall take a decision at its next session with a view to nominating a person and submitting his or her name to the Executive Board as soon as possible.

Rule 51(i) The name of the person so nominated shall be submitted to the Executive Board.

Annex 2.Code of Conduct for the nomination of the Regional Director of the Eastern Mediterranean Region of the World Health Organization This Code of Conduct (Code) aims to promote an open, fair, equitable and transparent process for the nomination of the Regional Director of the Eastern Mediterranean Region of the World Health Organization (WHO). In seeking to improve the overall process, this Code addresses a number of areas, including the submission of proposals and the conduct of electoral campaigns by Member States and candidates. The Code is a political understanding reached by the Member States of the Eastern Mediterranean (Member States). It recommends desirable behavior by Member States and candidates with regard to the nomination of the Regional Director to increase the fairness, openness and transparency of the process and thus its legitimacy, as well as the legitimacy and acceptance of its outcome. As such, the Code is not legally binding, but Member States and candidates are expected to honour its contents. The Code builds on, and reinforces, the provisions pertaining to nomination of Regional Director for the Eastern Mediterranean Region as set out in Rule 51 of the Rules of Procedure of the WHO Regional Committee for the Eastern Mediterranean.

General requirements Basic principles The whole nomination process, as well as electoral campaign activities related to it, should be guided both by the provision of Rule 51 of the Rules of Procedure and by the following principles that further the legitimacy of the process and of its result:        Fairness Equity Transparency Good faith Dignity, mutual respect and moderation Non-discrimination, and Merit-based.

Authority of the Regional Committee and its Rules of Procedure  Member States accept the authority of the Regional Committee for the Eastern Mediterranean (Regional Committee) to conduct the nomination of the Regional Director in accordance with Rule 51 of its Rules of Procedure.  Member States that propose persons for the post of Regional Director have the right to promote their candidature. The same applies to candidates with regard of their own candidature. In the exercise of that right, Member States and candidates should abide by all rules governing the nomination of the Regional Director contained in Rule 51 of the Rules of Procedure of the Regional Committee, relevant resolutions and decisions of the Regional Committee, and this Code of Conduct.

Responsibilities  It is the responsibility of Member States and candidates to observe and respect this Code.  Member States acknowledge that the process of nomination of the Regional Director should be fair, open, transparent, equitable and based on the merits of the individual candidates. They should make this Code publicly known and easily accessible. 7

Requirements concerning the different steps of the nomination process I. Submission of proposals

When proposing the name of one or more persons for the post of Regional Director, Member States will be requested by the Director-General to submit the necessary particulars of each person’s qualifications and experience using the standard form annexed to this Code as an appendix, in order to improve the comparability of the merits and qualifications of candidates against the criteria adopted by the Regional Committee with Decision EM/RC59/13. II. Electoral campaign This Code applies to electoral activities related to the nomination of the Regional Director whenever they take place until the nomination by the Regional Committee. All Member States and candidates should encourage and promote communication and cooperation among one another during the entire nomination process. Member States and candidates should act in good faith bearing in mind the shared objectives of promoting equity, openness, transparency and fairness throughout the nomination process. Member States and candidates should refer to one another with respect; no Member State or candidate should at any time disrupt or impede the campaign activities of other candidates. Nor should any Member State or any candidate make any oral or written statements or other representation that could be deemed slanderous or libelous. All Member States and candidates should disclose their campaign activities (e.g. hosting of meetings, workshops, visits). Information disclosed will be posted on a dedicated page of the web site of the Regional Office. Member States and candidates should refrain from improperly influencing the nomination process, by, for example, granting or accepting financial or other benefits as a quid pro quo for the support of a candidate, or by promising such benefits. Member States and candidates should not make promises or commitments in favour of, or accept instruction from, any person or entity, public or private, when that could undermine, or be perceived an undermining, the integrity of the nomination process. Member States that have proposed a candidate should facilitate meetings between their candidate and other Member States, if so requested. Wherever possible, meetings between candidates and Member States should be arranged on the occasion of conferences or other events involving Member States of the Region rather than through bilateral visits. Member States nominating candidates for the post of Regional Director should consider disclosing grants or aid funding for the previous two years in order to ensure full transparency and mutual confidence among Member States. Travel by candidates to Member States to promote their candidature should be limited in order to avoid excessive expenditure, which could lead to inequality among Member States and candidates. In this connection, Member States and candidates should consider using as much as possible existing mechanisms (regional committees, Executive Board, World Health Assembly) for meetings and other promotional activities linked to the electoral campaign.

Electoral promotion or propaganda under the guise of technical meetings or similar events should be avoided. After the Director-General has dispatched the names and particulars of candidates to Member States in accordance with the fourth paragraph of Rule 51 of the Rules of Procedure, he/she will open on the web site of WHO a password-protected question-and-answer web forum open to all Member States and the candidates who request to participate in such a forum. After the Director-General has dispatched the name and particulars of candidates to Member States in accordance with the fourth paragraph of Rule 51 of the Rules of Procedure, the Regional Office will post on its web site information on all candidates who so request including their curricula vitae and other particulars of their qualification and experience as received from Member States, as well as their contact information. The web site will also provide links to individual web sites of candidates upon request. Each candidate is responsible for setting up and financing his/her own web site. The Regional Office will also post on its web site, at the time referred to in the first paragraph of Rule 51 of the Rules of Procedure of the Regional Committee, information on the nomination process and the applicable rules and decisions. III. Nomination 1. The nomination of the Regional Director is conducted in private meetings of the Regional Committee in accordance with Rule 51 of the Rules of Procedure. Attendance at the private meetings besides Committee members is prescribed by the Director-General and limited to essential Secretariat staff. Candidates should not attend those meetings even if they form part of the delegation of their country. The votes in the private meeting are conducted by secret ballot. The results of the ballots should not be disclosed by Member States. 2. Member States should abide strictly by the Rules of Procedure and other applicable resolutions and respect the integrity, legitimacy and dignity of the proceedings. As such, they should avoid behaviors and actions, both inside and outside the conference room where the nomination take place, which could be perceived as aiming at influencing its outcome. 3. Member States should respect the confidentiality of the proceedings and the secrecy of the votes. In particular, they should refrain from communicating or broadcasting the proceedings during the private meetings through electronic devices. IV. Internal candidates 1. WHO staff members, including the incumbent Regional Director, who are proposed for the post of Regional Director are subject to the obligations contained in the WHO Staff Regulations and Rules, as well as to the guidance that may be issued from time to time by the Director-General. 2. WHO staff members who are proposed for the post of Regional Director must observe the highest standard of ethical conduct and strive to avoid any appearance of impropriety. WHO staff members must clearly separate there WHO functions from their candidacy and avoid any overlap, or perception of overlap, between campaign activities and their work for WHO. They also have to avoid any perception of conflict of interest. 3. WHO staff members are subject to the authority of the Regional Director and the Director -General, in accordance with the applicable regulations and rules, in case of allegations of breach of their duties with regard to their campaign activities.

Réforme de la gouvernance 1. Introduction

1. À la suite de la Session extraordinaire du Conseil exécutif de l’OMS qui s’est tenue en novembre 2011 et de la cent trentième session du Conseil exécutif qui a eu lieu en janvier 2012, l’OMS s’est lancée dans un programme de réforme de la gouvernance, dans le cadre d’un programme de réforme global couvrant trois domaines critiques que sont les programmes et la définition des priorités, les réformes gestionnaires et la gouvernance. 2. Les délibérations de réunions successives du Conseil exécutif et de l’Assemblée mondiale de la Santé ont conduit à la formulation d’une série de recommandations visant à renforcer et à améliorer l’harmonisation des procédures et des processus des organes directeurs au sein de l’Organisation. 3. Conformément aux paragraphes 4 et 5 de la décision WHA65(9) de la Soixante-Cinquième Assemblée mondiale de la Santé, le Comité régional de la Méditerranée orientale a décidé, lors de sa cinquante-neuvième session en 2012, de réviser plusieurs des articles de son règlement. Les révisions portent sur les passages suivants : a) section I, article 2 sur la participation des États qui ne sont pas membres du Comité et des organisations non gouvernementales ; b) section I, article 3 sur les pouvoirs ; c) section X, article 37 sur le vote concernant les propositions soumises aux Comité régional ; d) section XI, article 48 sur l’élection du Directeur régional, et l’article 51 sur la désignation du Directeur régional incluant les critères d’évaluation des candidats se présentant au poste de Directeur régional. 4. Le présent document propose un certain nombre d’amendements supplémentaires au Règlement intérieur du Comité régional de la Méditerranée orientale. Il passe également en revue les réformes proposées pour les processus régionaux de désignation des pays au Conseil exécutif et à l’Assemblée mondiale de la Santé, ainsi que d’autres questions de gouvernance.

2. Amendements et réformes proposés 2.1 Désignation du Directeur régional de la Méditerranée orientale 5. Des amendements du Règlement intérieur du Comité régional sont proposés dans les domaines suivants (voir Annexe 1) : section IV, article 15 sur les rapports des sessions ; section XI, article 51 b) sur le Code de conduite pour la désignation du Directeur régional (voir Annexe 2) ; article 51 f) sur les procédures intérimaires ; article 51 i) sur l’annonce du nom de la personne désignée ; et l’article 51 j) sur la durée du mandat du Directeur régional. 6. Un Code de conduite (voir Annexe 2) est proposé pour la désignation du Directeur régional de la Méditerranée orientale. Ce Code est aligné sur les décisions WHA65(9) appelant à une harmonisation améliorée entre les comités régionaux dans le processus de désignation des directeurs régionaux, WHA69(8) invitant chaque Comité régional, en accord avec la décision WHA65(9), à envisager l’adoption de mesures pour améliorer le processus de désignation des directeurs régionaux, qui tiennent compte des meilleures pratiques à travers les six régions. 2.2 Élection du Président, des Vice-présidents et du Rapporteur du Comité régional 7. Selon la pratique établie, il est proposé que le Président du Comité soit le Ministre de la Santé du pays d’accueil, sauf quand le Comité régional se tient au Bureau régional. Lorsque le Comité régional se réunit au Bureau régional, de même que quand le Comité régional envisage la désignation du Directeur régional, le Président est choisi parmi les pays présents à la réunion, suivant l’ordre alphabétique anglais. Lorsque le Comité envisage la désignation du Directeur régional, les membres du Bureau du Comité ne

peuvent pas être choisis parmi les pays ayant des candidats qui ont posé leur candidature au poste de Directeur régional. 8. Si les principes tels qu’exposés sont généralement acceptés par l’ensemble des régions, il est arrivé que le Comité prenne la décision ad hoc de désigner un Président parmi les Ministres présents et disponibles pour présider durant toute la durée de la session du Comité. Ceci a conduit à une représentation inégale des pays parmi les membres du Bureau du Comité régional élus. 9. Il est proposé que la sélection du Président et des deux Vice-présidents continue de s’effectuer suivant l’ordre alphabétique anglais, cette méthode étant considérée comme la plus équitable et la plus transparente, et étant conforme aux pratiques de tous les autres comités régionaux. Tout en suivant l’ordre alphabétique anglais, la priorité sera donnée aux pays qui n’ont jamais occupé l’un des trois postes électifs du Comité régional. 10. Actuellement, les membres du Bureau du Comité régional élus comprennent le Président, le viceprésident et un Président des discussions techniques. Ce dernier poste ne fait pas l’objet d’une description à l’article 10 du Règlement intérieur dans lequel le Comité est autorisé à désigner un Président et deux Vice-présidents. 11. La pratique consistant à désigner un Président des discussions techniques a contribué à l’idée fausse qu’il y aurait deux Présidents du Comité, l’un pour les sessions du Comité général, et l’autre pour les débats de fond portant sur certains documents techniques. 12. Conformément à l’article 10 du Règlement intérieur, il est proposé de supprimer la pratique consistant à désigner un Président des discussions techniques, et de simplement désigner un Président et deux Vice-présidents du Comité régional. 13. L’Annexe 3 indique le nombre de fois où les pays ont été élus aux postes de Président, de Viceprésidents et de Président des discussions techniques du Comité régional. 2.3 Établissement d’un Sous-comité du Programme du Comité régional 14. Dans le cadre du processus d’harmonisation et d’alignement des méthodes de travail des comités régionaux au sein de l’Organisation, il est proposé d’établir un Sous-comité du Programme du Comité régional de la Méditerranée orientale, disposant d’un mandat spécifique et dont le renouvellement des membres s’effectue par rotation. 15. L’article 16 de la section VII de l’actuel Règlement intérieur du Comité régional de la Méditerranée orientale donne le pouvoir au Comité de créer les sous-comités qu’il juge nécessaires pour l’étude de toute question qui figure à son ordre du jour. 16. Les cinq autres comités régionaux disposent tous d’un ou de plusieurs organe(s) subsidiaire(s) faisant rapport au Comité régional, selon les besoins. Ces sous-comités sont établis dans le but de renforcer le travail, les performances et les fonctions de supervision des comités régionaux. Mandat proposé du Sous-comité du Programme 17. Conformément à l’article 16 du Règlement intérieur, le Sous-comité du Programme mène ses activités en vertu du mandat qui suit. • Il accomplit le travail préparatoire du Comité régional en examinant le projet d’ordre du jour, les documents de travail, les rapports et les projets de résolutions ainsi que leurs incidences financières soumis par le Directeur régional ; 2

• Il suit la mise en œuvre des recommandations et des décisions du Comité régional ; • Il recommande au Comité régional de mobiliser les ressources additionnelles qui sont requises par le Bureau régional et propose un mécanisme permettant aux États Membres de verser des contributions supplémentaires en vue de la mise en œuvre des résolutions du Comité ; • Il examine les rapports sur la mise en œuvre des recommandations des rapports du commissaire aux comptes et du vérificateur intérieur des comptes, et conseille le Comité sur toute mesure correctrice requise ; • Il étudie toute autre question programmatique, administrative, budgétaire ou financière que le Comité régional pourrait adresser au Sous-Comité, notamment sur proposition du Directeur régional ; • Il remet des rapports sur ses délibérations au Comité. Composition et réunions proposées 18. Le Sous-comité du Programme sera constitué de huit États Membres, dont trois issus du Groupe 2 et du Groupe 3 respectivement, et deux du Groupe 1 de pays. 1 19. Les membres du Sous-comité doivent être des responsables hautement qualifiés et expérimentés en matière de santé publique, occupant des postes de haut rang tels que adjoints aux ministres ou directeurs de programmes techniques clés. Les membres du Bureau du Comité régional (le Président, les Viceprésidents et le Rapporteur) peuvent également participer à la réunion en tant qu’observateurs. Les membres sont désignés par rotation. 20. Le Sous-comité du Programme élira son président, son vice-président et son rapporteur parmi les membres du Sous-comité. Le Bureau du Sous-comité siègera pendant un an. 21. En consultation avec le directeur du Sous-comité, le Directeur régional peut inviter d’autres experts à participer à la réunion en tant qu’observateurs s’il ou elle considère que leurs compétences peuvent constituer un apport aux discussions de certains points de l’ordre jour ou documents techniques soumis au Sous-comité du Programme lors de sa réunion. 22. Tous les membres du Sous-Comité du Programme, hormis les observateurs, seront nommés par le Comité pour un mandat de deux ans Afin de conserver une certaine mémoire institutionnelle du fonctionnement du Sous-comité, il est proposé que quatre membres soient remplacés chaque année, dans chaque groupe, dans l’ordre alphabétique anglais des noms des Membres. Afin de garantir le bon déroulement du processus de remplacement, quatre des huit premiers membres siègeront la première année. 23. Le Directeur régional devra organiser, en consultation avec le Président du Comité, une réunion du Sous-comité du Programme au moins une fois par an, pour une durée n’excédant pas quatre jours ouvrables. 24. Le Directeur régional désignera également des experts techniques et du personnel d’appui issus du Secrétariat de l’OMS pour cette réunion. 25. La liste proposée pour la composition du Sous-comité du Programme est jointe à l’Annexe 4.

2.4 Processus de désignation des membres du Conseil exécutif 26. Le Conseil exécutif de l’Organisation mondiale de la Santé est composé de 34 personnes désignées par les États Membres de chaque région OMS et élues par l’Assemblée mondiale de la Santé. Conformément à la pratique constante, établie et convenue, la Région de la Méditerranée orientale nomme cinq États Membres pour siéger au Conseil exécutif. Chaque État Membre siège au Conseil pour une période de trois ans. 27. Le Conseil exécutif se réunit au moins deux fois par an, en janvier (entre 7 à 10 jours) et en mai (entre 3 à 4 jours), immédiatement après la clôture de l’Assemblée mondiale de la Santé. Les membres remplissent leur mandat jusqu’à la clôture de l’Assemblée mondiale, au cours de laquelle les nouveaux membres prennent leurs fonctions. 28. Jusqu’en mai 2002, la pratique de désignation des pays de la Région comme membres du Conseil exécutif ne suivait pas un système garantissant une représentation géographique transparente et équitable des pays de la Région. 29. Admettant que le processus de désignation des membres du Conseil exécutif dans la Région demandait à être revu, un groupe de travail informel a été constitué en 2001 dans l’optique d’examiner la situation actuelle et de déterminer un processus juste et transparent pour la désignation des membres du Conseil exécutif, conformément à l’expérience et aux pratiques déjà adoptées par les autres régions de l’OMS. Le groupe de travail a été constitué de représentants d’États Membres et était dirigé par l’exMinistre de la Santé publique du Qatar. 30. Les efforts du groupe de travail ont permis d’aboutir à un accord regroupant les pays de la Région en trois groupes sous-régionaux visant à garantir que les pays de chaque sous-région soient représentés en tout temps au Conseil exécutif. Cette approche accorde deux sièges à chacun des grands groupes sous-régionaux (2 et 3), tandis que le plus petit groupe (1) se voit attribuer un siège, comme le montre l’Annexe 5. 31. Le Directeur régional a présenté cette nouvelle approche lors de la quarante-huitième session du Comité régional en 2001. Le Comité a soutenu l’approche proposée et a décidé de la mettre en application à la suite d’une discussion menée lors d’une réunion ministérielle en marge de la CinquanteCinquième Assemblée mondiale de la Santé en mai 2002. 32. Depuis mai 2002, tout siège vacant au Conseil exécutif et réservé à la Région doit être pourvu conformément à l’approche décrite ci-dessus, considérée juste, transparente et représentative des caractéristiques géographiques. 33. Concernant la rotation de la présidence du Conseil exécutif, qui a lieu tous les 6 ans, un membre du Conseil exécutif régional sera élu parmi les pays de la Région qui n’ont jamais présidé au Conseil exécutif ou qui ont occupé cette fonction le moins souvent. 34. De façon similaire, les |Vice-présidents du Conseil exécutif seront élus parmi les membres du Conseil exécutif des régions n’assumant pas la présidence de cette session. Le mandat des membres du Bureau élus au Conseil exécutif est d’un an. 35. Dans le cas où un pays décide de ne pas proposer de candidat, le pays en lice suivant peut sélectionner un représentant au Conseil. 36. Il est rappelé aux pays que, conformément à l’article 24 de la Constitution, et tel que mentionné de nouveau dans la résolution WHA51.26 de l’Assemblée mondiale de la Santé, les personnes désignées 4

pour siéger au Conseil doivent être techniquement qualifiées dans le domaine de la santé. Les profils de personnes réunissant un large éventail de compétences et d’expérience pratique dans les domaines de la santé publique et de l’administration publique, et occupant un rang de haut niveau proche de la prise de décisions politiques devraient être pris en compte. Les candidats pour le Conseil exécutif devront aussi faire preuve d’une aptitude à collaborer, à coordonner et à communiquer à l’intérieur de leur propre pays, entre les pays de la Région et avec les partenaires internationaux. 37. La liste des pays de la Région de la Méditerranée orientale membres du Conseil exécutif est indiquée à l’Annexe 6. 2.5 Désignation d’un pays de la Région au poste de Président de l’Assemblée mondiale de la Santé ou à d’autres postes électifs du Bureau de ladite Assemblée 38. Le Bureau de l’Assemblée mondiale de la Santé se compose du Président et des Vice-présidents de l’Assemblée de la Santé, les présidents, les vice-présidents et les rapporteurs des Comités A et B, et les présidents et les vice-présidents du Comité des Pouvoirs et du Comité des Désignations. Les États Membres désignent leurs candidats et l’Assemblée mondiale de la Santé les nomme au Bureau de l’Assemblée. 39. La présidence et les autres postes de l’Assemblée de la Santé pourvus par voie d’élection font l’objet d’une rotation chaque année entre les différentes régions OMS. 40. Dans le passé, les désignations des membres du Bureau ci-dessus ne s’étaient pas déroulées selon une approche cohérente convenue entre les États Membres. Le premier jour de l’Assemblée mondiale de la Santé, les Ministres de la Santé et les chefs de délégation désignent un candidat parmi leurs membres aux postes électifs de l’Assemblée de la Santé, incluant notamment le Président de l’Assemblée de la Santé. 41. L’Annexe 7 indique le nombre de fois où chaque pays de la Région a siégé à la présidence de l’Assemblée mondiale de la Santé ou à d’autres postes électifs. 42. Il est proposé que la désignation régionale du Président de l’Assemblée de la Santé suive l’ordre de l’alphabet anglais, et donne la priorité aux pays qui n’ont jamais occupé ce poste. 43. De la même façon, la désignation des autres membres du Bureau, incluant les présidents et les Comités A et B, ainsi que les vice-présidents de l’Assemblée de la Santé, devrait suivre la même approche. Les membres du Bureau de l’Assemblée mondiale de la Santé sont supposés occuper leurs fonctions et rester disponibles pour la durée complète de l’Assemblée. 44. Dans le cas où un État Membre décide de ne pas désigner de candidat au poste ci-dessus, le pays en lice suivant peut désigner un candidat. Une fois approuvé par le Comité régional, ce nouveau système sera en vigueur à partir de 2017.

3. Autres questions de gouvernance 45. Dans le cadre des efforts de réforme de l’OMS visant à améliorer la transparence et la responsabilisation du Secrétariat, et conformément à la demande de l’Assemblée de la Santé dans la décision WHA69(8), le Directeur régional a publié sur Internet sa délégation de pouvoir du Directeur général ainsi que sa lettre de déclaration. La lettre de déclaration 2015 et la délégation de pouvoir 2016 du Directeur régional ont également été postées sur la page du Directeur régional du site institutionnel de l’OMS http://who.int/dg/regional_directors/alwan_emro/en/, accompagnée des lettres de déclaration et des délégations de pouvoir des autres directeurs régionaux. 5

46. Le rapport annuel actuel du Directeur régional donne un aperçu des actions menées, des réalisations effectuées ainsi que des défis auxquels la Région est confrontée. À compter de l’année prochaine, le Directeur régional remettra également au Comité régional, à la fin de chaque période biennale, un rapport consolidé sur les résultats obtenus dans les bureaux régionaux et les bureaux de pays accompagné d’informations financières associées. 47. Le Directeur régional soumettra également au Comité régional un rapport biennal sur la présence de l’OMS dans les pays, dès la fin de la période biennale actuelle (2016-2017).

Si les autres dispositions de cet article ne peuvent être respectées, le Comité doit prendre une décision lors de sa prochaine session ou au cours d’une session extraordinaire dans l’optique de désigner une personne et de soumettre son nom au Conseil exécutif dans les plus brefs délais. Entre temps, le Directeur général désignera un Directeur régional par intérim jusqu’à la nomination d’un nouveau titulaire. Article 51 i) Le nom de la personne ainsi désignée est annoncé lors d’une réunion publique du Comité régional et soumis au Conseil exécutif. j) La nomination du Directeur régional sera pour un mandat de cinq ans qui ne pourra être reconduit qu’une seule fois.

Annexe 2 Code de conduite pour la désignation du directeur régional de la Région de la Méditerranée orientale de l’Organisation mondiale de la Santé Ce Code de conduite (Code) vise à promouvoir une procédure ouverte, juste, équitable et transparente en vue de la désignation du directeur régional de l’Organisation mondiale de la santé (OMS) pour la Méditerranée orientale. Dans un but d’amélioration de l’ensemble de la procédure, ce Code traite d’un certain nombre de domaines, notamment la soumission de propositions et la conduite de campagnes électorales par les États membres et les candidats. Ledit Code constitue un accord politique conclu entre les États membres de la Région de la Méditerranée orientale (États Membres). Il recommande le comportement que l’on souhaiterait voir adopter par les États Membres et les candidats lors de la désignation du Directeur régional, dans le but de renforcer l’équité, l’ouverture et la transparence de la procédure, et partant, sa légitimité, de même que la légitimité et l’acceptation de son résultat. Le Code n’est pas juridiquement contraignant en soi, mais les États Membres et les candidats doivent en respecter la teneur. Le Code s’appuie sur, et renforce, les dispositions relatives à la désignation du Directeur régional de la Méditerranée orientale, telles qu’exposées dans l’article 51 du règlement intérieur du Comité régional de la Méditerranée orientale,

Conditions générales Principes fondamentaux L’ensemble de la procédure de désignation, de même que les activités de la campagne électorale qui y sont liées, seront régis à la fois par les dispositions de l’article 51 du règlement intérieur et par les principes ci-dessous, qui servent la légitimité de la procédure et de ses résultats : • • • • • • • impartialité équité transparence bonne foi dignité, respect mutuel et modération non-discrimination, et mérite.

Autorité du Comité régional et de son règlement intérieur • Les États Membres acceptent l’autorité dont le Comité régional de la Méditerranée orientale (Comité régional) est investi pour procéder à la désignation du Directeur régional conformément à l’article 51 de son règlement intérieur. • Les États Membres qui proposent des personnes au poste de directeur régional ont le droit de promouvoir leur candidature. Ce principe s’applique aux candidats et à la promotion de leur propre candidature. Dans l’exercice de ce droit, les États Membres et les candidats respecteront toutes les règles relatives à la désignation du Directeur régional stipulées à l’article 51 du Règlement intérieur du Comité régional, de même que dans les résolutions et décisions concernées du Comité régional, et de ce Code de conduite.

Responsabilités • Il est de la responsabilité des États Membres et des candidats d’observer et de respecter ce Code. • Les États Membres reconnaissent que la procédure de désignation du directeur régional doit être juste, ouverte, transparente, équitable et fondée sur les mérites de chaque candidat. Ils diffuseront publiquement ce Code et faciliteront l’accès à celui-ci. Conditions à remplir aux différentes étapes de la procédure de désignation I. Soumission des propositions

Lorsqu’ils proposent le nom d’une ou de plusieurs personnes pour le poste de directeur régional, les États Membres soumettront, à la demande du directeur général, les renseignements nécessaires en matière de qualifications et d’expérience de chaque personne, conformément aux critères adoptés par le Comité régional dans sa décision EM/RC59/13. II. Campagne électorale Ce Code s’applique aux activités électorales relatives à la désignation du directeur régional, quel que soit le moment où elles ont lieu, jusqu’à la désignation par le Comité régional Tous les États Membres et les candidats encourageront et promouvront la communication et la coopération entre eux tout au long de la procédure de désignation. Les États Membres et les candidats agiront de bonne foi et garderont à l’esprit les objectifs communs de promotion de l’équité, de l’ouverture, de la transparence et de l’impartialité tout au long de la procédure de désignation. Les États membres et les candidats feront référence les uns aux autres avec respect ; aucun État membre ou candidat ne perturbera ni n’entravera les activités de campagne des autres candidats, et ce à aucun moment. Aucun État Membre ou candidat ne formulera des déclarations orales ou écrites, ou n’entreprendra des démarches, qui pourraient être jugées calomnieuses ou diffamatoires. Tous les États membres et les candidats divulgueront leurs activités de campagne (telles que la tenue de réunions, d’ateliers, de visites). Les informations divulguées seront affichées sur une page prévue à cet effet sur le site Web du Bureau régional. Les États membres et les candidats s’abstiendront d’influencer de manière inappropriée la procédure de désignation, par exemple en donnant ou en acceptant des avantages financiers ou autres en contrepartie du soutien d’un candidat, ou en promettant ces avantages. Les États membres et les candidats ne feront pas de promesses et ne prendront pas d’engagements en faveur d’aucune personne ou entité, publique ou privée, et n’accepteront pas d’instructions de ces personnes ou entités, si cela peut saper, ou être perçu comme pouvant saper, l’intégrité de la procédure de désignation. Les États Membres ayant proposé un candidat faciliteront la tenue de réunions entre leur candidat et d’autres États Membres, si une telle demande est émise, Lorsque cela est possible, les réunions entre candidats et États Membres seront organisées à l’occasion de conférences ou autres événements impliquant les États Membres de la Région plutôt que lors de visites bilatérales. Les États Membres désignant des candidats pour le poste de directeur régional envisageront de divulguer les dons ou financements reçus pendant les deux années précédentes, afin d’assurer une totale transparence et une confiance mutuelle entre États Membres 9

Les voyages des candidats dans les États Membres aux fins de promotion de leur candidature seront limités pour éviter des dépenses excessives, qui pourraient engendrer une inégalité entre États Membres et entre candidats. À ce propos, les États Membres et les candidats envisageront d’utiliser autant que possible les structures existantes (Comités régionaux, Conseil exécutif, Assemblée mondiale de la santé) pour les réunions et autres activités promotionnelles liées à la campagne électorale. On évitera toute activité de promotion électorale ou de propagande organisée sous prétexte de réunions techniques ou d’événements similaires. Après la diffusion des noms et des informations relatives aux candidats auprès des États membres, conformément aux dispositions de l’article 51 du règlement intérieur, par le directeur général, ce dernier ouvrira un forum de questions-réponses sur le site Web de l’OMS, qui sera protégé par un mot de passe et ouvert à tous les États Membres et aux candidats qui souhaiteraient y participer. Après la diffusion des noms et des informations relatives aux candidats auprès des États Membres par le directeur général conformément au quatrième paragraphe du Règlement intérieur, le Bureau régional affichera sur son site Web les renseignements sur les candidats qui en auraient fait la demande, notamment leur curriculum vitæ et les autres informations précisant leurs qualifications et leur expérience, telles que les États Membres les ont transmises, de même que leurs coordonnées. Le site Web fournira aussi sur demande les liens vers les sites Web des candidats. Chaque candidat est responsable de la création et du financement de son propre site Web. Le Bureau régional postera également sur son site Web, au moment indiqué dans le premier paragraphe du règlement intérieur du Comité régional, des informations sur le processus de désignation et les règles et décisions applicables. III. Désignation 1. La désignation du Directeur régional a lieu lors de séances privées du Comité régional, conformément à l’article 51 du règlement intérieur. Outre les membres du Comité, la présence aux séances privées est requise par le Directeur général, et limitée au personnel essentiel du Secrétariat. Les candidats n’assisteront pas à ces réunions, même s’ils font partie de la délégation de leur pays. Les votes lors des séances privées sont organisés au scrutin secret. Les résultats des scrutins ne seront pas divulgués par les États Membres. 2. Les États Membres observeront strictement le règlement intérieur, ainsi que les autres résolutions applicables, et respecteront l’intégrité, la légitimité et la dignité des délibérations. Dans ce cadre, ils éviteront les comportements et les actes, à l’intérieur et à l’extérieur de la salle de conférences où se déroule la désignation, qui pourraient être perçus comme de nature à en influencer le résultat. 3. Les États Membres respecteront la confidentialité des délibérations et le secret du vote. En particulier, ils s’abstiendront de communiquer ou de diffuser les délibérations au moyen d’appareils électroniques pendant les séances privées. IV. Candidats internes 1. Les membres du personnel de l’OMS, y compris le directeur régional en exercice, qui sont proposés au poste de directeur régional, sont tenus de respecter les obligations exposées dans le Règlement du personnel et le Statut du personnel, ainsi que les recommandations que peut émettre occasionnellement le directeur général. 2. Les membres du personnel de l’OMS proposés au poste de directeur régional observeront la plus stricte déontologie et s’efforceront d’éviter toute apparence d’irrégularité. Les membres du personnel de l’OMS opéreront une nette séparation entre leurs fonctions et leur candidature, et éviteront que se 10

chevauchent, ou semblent se chevaucher, leurs activités de campagne et le travail qu’ils accomplissent pour l’OMS. Ils éviteront aussi toute apparence de conflit d’intérêt. 3. S’il est allégué que les membres du personnel de l’OMS ont manqué à leurs obligations dans le cadre de leurs activités de campagne, ils sont placés sous l’autorité du directeur régional et du directeur général, conformément au statut et au règlement applicables. 4. Le Comité régional peut proposer au Directeur général d’appliquer l’article 5.1 du Règlement du personnel, prévoyant un congé spécial, avec ou sans rémunération, pour les membres du personnel proposés pour le poste de Directeur régional
