MEETING OF THE PARTIES TO THE PROTOCOL TO ELIMINATE ILLICIT TRADE IN TOBACCO PRODUCTS FCTC/MOP/2/14 24 June 2021 Second session Geneva, Switzerland, 15–18 November 2021 Provisional agenda item 6.6 13 Declaration of Interest for Members of the Bureau and Regional Coordinators of the Meeting of the Parties Purpose of the document This report describes a proposal by the Bureau of the Meeting of the Parties (MOP) to the Protocol to Eliminate Illicit Trade in Tobacco Products to amend the Declaration of Interest form for Bureau Members and Regional Coordinators, adopted in decision FCTC/MOP1(13), in order to reflect the fact that the Protocol requires the implementation of public policies beyond those that are purely health related. Action by the Meeting of the Parties The Meeting of the Parties (MOP) is invited to note the report, including the recommendation of the Bureau to amend the Declaration of Interest form for Bureau Members and Regional Coordinators of the MOP as contained in Annex 1, and to consider adopting the draft decision contained in Annex 2. The First Session of the Meeting of the Parties (MOP1) to the Protocol to Eliminate Illicit Trade in Tobacco Products adopted, in decision FCTC/MOP1(13), the Code of Conduct and the Declaration of Interest form for Members of the Bureau and Regional Coordinators of the Meeting of the Parties (MOP). 2. During its First Meeting in March 2019, the Bureau elected by MOP1 requested the Convention Secretariat to prepare a proposal to adapt the Declaration of Interest (DOI) form for Bureau Members and Regional Coordinators so that it fully reflects the fact that the Protocol requires the implementation of public policies beyond those that are purely health related. The broad range of that work is reflected in the composition of the Bureau, which consists of individuals from different sectors and with various competencies. 3. In response to that request from the Bureau and following a consultation with Members of the Bureau and Regional Coordinators of the MOP, the Convention Secretariat amended the DOI adopted by MOP1, deleting the word “health” to reflect the wider scope of Protocol implementation and adding the word “exportation” as a category in the updated DOI. 4. At its Fourth Meeting in April 2021, the Bureau approved the amendment and is submitting its proposal to the Second Session of the Meeting of the Parties (MOP2) for its consideration and adoption. ACTION BY THE MEETING OF THE PARTIES 5. The MOP is invited to note the report, including the recommendation of the Bureau to amend the Declaration of Interest form for Bureau Members and Regional Coordinators of the MOP as contained in Annex 1, and to consider adopting the draft decision contained in Annex 2. Signed by: (full name and title) Date: Signature: FCTC/MOP/2/14 4 ANNEX 2 DRAFT DECISION: AMENDMENT OF DECLARATION OF INTEREST FORM FOR MEMBERS OF THE BUREAU AND REGIONAL COORDINATORS OF THE MEETING OF THE PARTIES TO THE PROTOCOL TO ELIMINATE ILLICIT TRADE IN TOBACCO PRODUCTS The Meeting of the Parties, Recalling decision FCTC/MOP1(13), adopting the Code of Conduct for the Members of the Bureau and Regional Coordinators of the Meeting of the Parties to the Protocol to Eliminate Illicit Trade in Tobacco Products and the Declaration of Interest form contained in document FCTC/MOP/1/17, Recalling also that according to the Code of Conduct, Members of the Bureau and Regional Coordinators of the Meeting of the Parties have the duty to protect implementation of the Protocol against the influence of and interference by commercial and other vested interests of the tobacco industry or vested interests of economic and commercial actors whose main part of business is related to implementation of the Protocol, Recognizing the need to reflect in the Declaration of Interest form accompanying the Code of Conduct the fact that the Protocol requires implementation of public policies beyond those that are purely health related, Noting the information provided in document FCTC/MOP/2/14, 1. DECIDES: (a) to adopt the proposal for amendment of the Declaration of Interest Form for Members of the Bureau and Regional Coordinators of the Meeting of the Parties to the Protocol to Eliminate Illicit Trade in Tobacco Products, as contained in Annex 1 of document FCTC/MOP/2/14; (b) that, upon their election, Members of the Bureau and Regional Coordinators of the Meeting of the Parties shall submit, on a mandatory basis, the amended Declaration of Interest form contained in document FCTC/MOP/2/14; (c) that, upon their election, Members of the Bureau and Regional Coordinators of the Meeting of the Parties shall abide during their tenure by the provisions of the Code of Conduct adopted in decision FCTC/MOP1(13); Annex 2 FCTC/MOP/2/14 5 2. CALLS on Parties: (a) to continue to nominate the candidates to be elected as Members of the Bureau of the Meeting of the Parties and Regional Coordinators, in line with Article 5.3 of the WHO Convention on Tobacco Control and recommendations 4.9 and 8.3 of its Guidelines, as urged in decision FCTC/MOP1(13), and be vigilant towards other vested interests of economic and commercial actors whose main part of business is related to the implementation of the Protocol; 3.
