<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><intro><p>Her Majesty’s Revenue and Customs (or anyone acting on their behalf) may disclose information for the purpose of—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>facilitating the exercise by a Minister of the Crown of the Minister’s functions relating to trade,</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>facilitating the exercise by a devolved authority of the authority’s functions relating to trade, or</p></content></level><level class="para1" eId="section-1-1-c"><num>(c)</num><content><p>facilitating the exercise by an international organisation or authority, or by any other body, of its public functions relating to trade.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-a"><num>(a)</num><content><p>facilitating the exercise by a Minister of the Crown of the Minister’s functions relating to trade,</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-b"><num>(b)</num><content><p>facilitating the exercise by a devolved authority of the authority’s functions relating to trade, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-c"><num>(c)</num><content><p>facilitating the exercise by an international organisation or authority, or by any other body, of its public functions relating to trade.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><intro><p>Those functions include, among other things, functions relating to—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>the analysis of the flow of traffic, goods and services into and out of the United Kingdom;</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>the analysis of the impact, or likely impact, of measures or practices relating to imports, exports, border security and transport on such flow;</p></content></level><level class="para1" eId="section-1-2-c"><num>(c)</num><content><p>the design, implementation and operation of such measures or practices.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-a"><num>(a)</num><content><p>the analysis of the flow of traffic, goods and services into and out of the United Kingdom;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-b"><num>(b)</num><content><p>the analysis of the impact, or likely impact, of measures or practices relating to imports, exports, border security and transport on such flow;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-c"><num>(c)</num><content><p>the design, implementation and operation of such measures or practices.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><intro><p>A person who receives information as a result of this section may not—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>use the information for a purpose other than one mentioned in subsection <ref href="#section-1-1">(1)</ref>, or</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p>further disclose the information,</p></content></level><wrapUp><p>except with the consent of the Commissioners for Her Majesty’s Revenue and Customs (which may be general or specific).</p></wrapUp></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-a"><num>(a)</num><content><p>use the information for a purpose other than one mentioned in subsection <ref href="#section-1-1">(1)</ref>, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-3-b"><num>(b)</num><content><p>further disclose the information,</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><intro><p>If—</p></intro><level class="para1" eId="section-1-4-a"><num>(a)</num><content><p>a person discloses information in contravention of subsection <ref href="#section-1-3-b">(3)(b)</ref>, and</p></content></level><level class="para1" eId="section-1-4-b"><num>(b)</num><content><p>the information relates to a person whose identity is specified in, or can be deduced from, the disclosure,</p></content></level><wrapUp><p>section 19 of the Commissioners for Revenue and Customs Act 2005 (offence of wrongful disclosure) applies in relation to that disclosure as it applies in relation to a disclosure of information in contravention of section 20(9) of that Act.</p></wrapUp></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-a"><num>(a)</num><content><p>a person discloses information in contravention of subsection <ref href="#section-1-3-b">(3)(b)</ref>, and</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-b"><num>(b)</num><content><p>the information relates to a person whose identity is specified in, or can be deduced from, the disclosure,</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><content><p>Nothing in this section limits the circumstances in which information may be disclosed under section 18(2) of the Commissioners for Revenue and Customs Act 2005 or under any other enactment or rule of law.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-6"><num>(6)</num><intro><p>Nothing in this section authorises the making of a disclosure which would—</p></intro><level class="para1" eId="section-1-6-a"><num>(a)</num><content><p>contravene the data protection legislation, or</p></content></level><level class="para1" eId="section-1-6-b"><num>(b)</num><content><p>be prohibited by the investigatory powers legislation.</p></content></level><wrapUp><p>In determining whether a disclosure would do either of those things, the powers conferred by this section are to be taken into account.</p></wrapUp></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-a"><num>(a)</num><content><p>contravene the data protection legislation, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-b"><num>(b)</num><content><p>be prohibited by the investigatory powers legislation.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-7"><num>(7)</num><intro><p>In this section “devolved authority” means—</p></intro><level class="para1" eId="section-1-7-a"><num>(a)</num><content><p>the Scottish Ministers,</p></content></level><level class="para1" eId="section-1-7-b"><num>(b)</num><content><p>the Welsh Ministers, or</p></content></level><level class="para1" eId="section-1-7-c"><num>(c)</num><content><p>a Northern Ireland department.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-a"><num>(a)</num><content><p>the Scottish Ministers,</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-b"><num>(b)</num><content><p>the Welsh Ministers, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-c"><num>(c)</num><content><p>a Northern Ireland department.</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-1"><num>(1)</num><content><p>A public authority specified in subsection <ref href="#section-2-3">(3)</ref> may disclose information for the purpose of facilitating the exercise by a Minister of the Crown of the Minister’s functions relating to trade.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><intro><p>Those functions include, among other things, functions relating to—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>the analysis of the flow of traffic, goods and services into and out of the United Kingdom;</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>the analysis of the impact, or likely impact, of measures or practices relating to imports, exports, border security and transport on such flow;</p></content></level><level class="para1" eId="section-2-2-c"><num>(c)</num><content><p>the design, implementation and operation of such measures or practices.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-a"><num>(a)</num><content><p>the analysis of the flow of traffic, goods and services into and out of the United Kingdom;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-b"><num>(b)</num><content><p>the analysis of the impact, or likely impact, of measures or practices relating to imports, exports, border security and transport on such flow;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-c"><num>(c)</num><content><p>the design, implementation and operation of such measures or practices.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><intro><p>The specified public authorities are—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>the Secretary of State;</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>the Minister for the Cabinet Office;</p></content></level><level class="para1" eId="section-2-3-c"><num>(c)</num><content><p>a strategic highways company appointed under section 1 of the Infrastructure Act 2015;</p></content></level><level class="para1" eId="section-2-3-d"><num>(d)</num><content><p>a port health authority constituted under section 2 of the Public Health (Control of Disease) Act 1984.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-a"><num>(a)</num><content><p>the Secretary of State;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-b"><num>(b)</num><content><p>the Minister for the Cabinet Office;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-c"><num>(c)</num><content><p>a strategic highways company appointed under section 1 of the Infrastructure Act 2015;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-d"><num>(d)</num><content><p>a port health authority constituted under section 2 of the Public Health (Control of Disease) Act 1984.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><content><p>A person who receives information as a result of this section may only use the information for the purpose of facilitating the exercise by a public authority of the authority’s functions relating to trade (which include, among other things, functions of a kind referred to in subsection <ref href="#section-2-2">(2)</ref>).</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><content><p>A person who receives information as a result of this section may further disclose the information, but only with the consent of the public authority that disclosed the information under subsection <ref href="#section-2-1">(1)</ref> (which may be general or specific).</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-6"><num>(6)</num><content><p>Nothing in this section limits the circumstances in which information may be disclosed under any other enactment or rule of law.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-7"><num>(7)</num><intro><p>A disclosure under this section does not breach—</p></intro><level class="para1" eId="section-2-7-a"><num>(a)</num><content><p>any obligation of confidence owed by the person disclosing the information, or</p></content></level><level class="para1" eId="section-2-7-b"><num>(b)</num><content><p>any other restriction on the disclosure of information (however imposed).</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-7-a"><num>(a)</num><content><p>any obligation of confidence owed by the person disclosing the information, or</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-9"><num>(9)</num><content><p>A Minister of the Crown may by regulations made by statutory instrument amend this section for the purpose of specifying a public authority in, or removing a public authority from, subsection <ref href="#section-2-3">(3)</ref>.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-10"><num>(10)</num><content><p>A statutory instrument containing regulations under subsection <ref href="#section-2-9">(9)</ref> (whether alone or with other provision) may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-11"><num>(11)</num><content><p>In this section “public authority” means an authority exercising functions of a public nature.</p></content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><intro><p>If a person discloses information in contravention of section 2 which relates to a person whose identity—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>is specified in the disclosure, or</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>can be deduced from it,</p></content></level><wrapUp><p>the person who disclosed the information commits an offence.</p></wrapUp></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-a"><num>(a)</num><content><p>is specified in the disclosure, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-b"><num>(b)</num><content><p>can be deduced from it,</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><intro><p>It is a defence for a person charged with an offence under this section to prove that the person reasonably believed—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>that the disclosure was lawful, or</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>that the information had already lawfully been made available to the public.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-a"><num>(a)</num><content><p>that the disclosure was lawful, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-b"><num>(b)</num><content><p>that the information had already lawfully been made available to the public.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><intro><p>A prosecution for an offence under this section—</p></intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content><p>may be brought in England and Wales only with the consent of the Director of Public Prosecutions;</p></content></level><level class="para1" eId="section-3-3-b"><num>(b)</num><content><p>may be brought in Northern Ireland only with the consent of the Director of Public Prosecutions for Northern Ireland.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-a"><num>(a)</num><content><p>may be brought in England and Wales only with the consent of the Director of Public Prosecutions;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-b"><num>(b)</num><content><p>may be brought in Northern Ireland only with the consent of the Director of Public Prosecutions for Northern Ireland.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><intro><p>A person guilty of an offence under this section is liable—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p>on conviction on indictment, to imprisonment for a term not exceeding two years, to a fine or to both, or</p></content></level><level class="para1" eId="section-3-4-b"><num>(b)</num><intro><p>on summary conviction—</p></intro><level class="para2" eId="section-3-4-b-i"><num>(i)</num><content><p>in England and Wales, to imprisonment for a term not exceeding 12 months, to a fine or to both;</p></content></level><level class="para2" eId="section-3-4-b-ii"><num>(ii)</num><content><p>in Scotland, to imprisonment for a term not exceeding 12 months, to a fine not exceeding the statutory maximum or to both;</p></content></level><level class="para2" eId="section-3-4-b-iii"><num>(iii)</num><content><p>in Northern Ireland, to imprisonment for a term not exceeding 6 months, to a fine not exceeding the statutory maximum or to both.</p></content></level></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-4-a"><num>(a)</num><content><p>on conviction on indictment, to imprisonment for a term not exceeding two years, to a fine or to both, or</p></content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-3-4-b-i"><num>(i)</num><content><p>in England and Wales, to imprisonment for a term not exceeding 12 months, to a fine or to both;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-3-4-b-ii"><num>(ii)</num><content><p>in Scotland, to imprisonment for a term not exceeding 12 months, to a fine not exceeding the statutory maximum or to both;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-3-4-b-iii"><num>(iii)</num><content><p>in Northern Ireland, to imprisonment for a term not exceeding 6 months, to a fine not exceeding the statutory maximum or to both.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-5"><num>(5)</num><content><p>In relation to an offence committed before the commencement of paragraph 24(2) of Schedule 22 to the Sentencing Act 2020, the reference in subsection <ref href="#section-3-4-b-i">(4)(b)(i)</ref> to 12 months is to be read as a reference to 6 months.</p></content></subsection>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4"><num>4</num><heading>Expiry of sections 1 to 3</heading><subsection eId="section-4-1"><num>(1)</num><content><p>Subsection (2) applies if, in the Session in which this Act is passed, an Act resulting from the Trade Bill is passed which contains provisions that, in the opinion of the Secretary of State, have the same effect as, or similar effect to, sections 1 to 3 (the “corresponding provisions”).</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>The Secretary of State must by regulations made by statutory instrument provide for sections 1 to 3 to expire at the time that the corresponding provisions come into force to any extent.</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>Regulations under this section may include transitional, transitory or saving provision.</p></content></subsection></section>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-1"><num>(1)</num><content><p>Subsection (2) applies if, in the Session in which this Act is passed, an Act resulting from the Trade Bill is passed which contains provisions that, in the opinion of the Secretary of State, have the same effect as, or similar effect to, sections 1 to 3 (the “corresponding provisions”).</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-2"><num>(2)</num><content><p>The Secretary of State must by regulations made by statutory instrument provide for sections 1 to 3 to expire at the time that the corresponding provisions come into force to any extent.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-3"><num>(3)</num><content><p>Regulations under this section may include transitional, transitory or saving provision.</p></content></subsection>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5"><num>5</num><heading>Interpretation</heading><intro><p>In this Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the-data-protection-legislation" eId="term-the-data-protection-legislation">the data protection legislation</term>” has the same meaning as in the Data Protection Act 2018 (see section 3 of that Act);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-enactment" eId="term-enactment">enactment</term>” has the same meaning as in the European Union (Withdrawal Agreement) Act 2020 (see section 39 of that Act);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-investigatory-powers-legislation" eId="term-the-investigatory-powers-legislation">the investigatory powers legislation</term>” means Parts 1 to 7 and Chapter 1 of Part 9 of the Investigatory Powers Act 2016;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-minister-of-the-crown" eId="term-minister-of-the-crown">Minister of the Crown</term>” has the same meaning as in the Ministers of the Crown Act 1975.</p></content></hcontainer></section>
