<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><content><ref href="#section-1">This section</ref> applies to a relevant provider that provides English-funded post-16 technical education or training that is material to a specified area.</co

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><content>English-funded post-16 technical education or training is “material” to a specified area if it could reasonably be regarded as material or potentially material to the skills, capabilities

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><content>If there is no approved local skills improvement plan for the specified area, the relevant provider must co-operate with the employer representative body for that area for the purposes of

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><intro>If there is an approved local skills improvement plan for the specified area, the relevant provider must—</intro><level class="para1" eId="section-1-4-a"><num>(a)</num><intro>co-oper

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-b"><num>(b)</num><content>have regard to the plan so far as it is relevant to any decision that the relevant provider is making in relation to the provision of English-funded post-16 technical education

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><intro>The relevant provider must have regard to any guidance published by the Secretary of State in connection with <ref href="#section-1">this section</ref>, including in relation to—</intro

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-a"><num>(a)</num><content>co-operation with an employer representative body under <ref href="#section-1-3">subsections (3)</ref> and <ref href="#section-1-4">(4)</ref>, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-a"><num>(a)</num><content>compliance with the duty imposed by section 1 of the Climate Change Act 2008 (UK net zero emissions target),</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-b"><num>(b)</num><content>adaptation to climate change, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-6-c"><num>(c)</num><content>meeting other environmental goals (such as restoration or enhancement of the natural environment).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-7"><num>(7)</num><intro>Where a specified area covers any of the area of a relevant authority, the Secretary of State may approve and publish a local skills improvement plan for the specified area only if satisfie

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-a"><num>(a)</num><content>a mayoral combined authority within the meaning of Part 6 of the Local Democracy, Economic Development and Construction Act 2009 (see section 107A(8) of that Act), or</cont

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-7-b"><num>(b)</num><content>the Greater London Authority.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-8"><num>(8)</num><intro>A “<term refersTo="#term-local-skills-improvement-plan" eId="term-local-skills-improvement-plan">local skills improvement plan</term>”, in relation to a specified area, means a plan which—<

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-9"><num>(9)</num><content>An “<term refersTo="#term-approved-local-skills-improvement-plan" eId="term-approved-local-skills-improvement-plan">approved local skills improvement plan</term>” means a local skills imp

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Designation of employer representative bodies</heading><subsection eId="section-2-1"><num>(1)</num><intro>The Secretary of State may designate an eligible body as the employer representative bod

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-1"><num>(1)</num><intro>The Secretary of State may designate an eligible body as the employer representative body for an area in England (the “specified area”) if—</intro><level class="para1" eId="section-2-1-

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-a"><num>(a)</num><intro>the Secretary of State is satisfied that—</intro><level class="para2" eId="section-2-1-a-i"><num>(i)</num><content>the body is capable of developing and keeping under revi

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-1-a-i"><num>(i)</num><content>the body is capable of developing and keeping under review a local skills improvement plan for the area, in an effective and impartial manner, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-1-a-ii"><num>(ii)</num><content>the body is reasonably representative of the employers operating within the specified area, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-b"><num>(b)</num><content>the body has consented in writing to being so designated (and to any terms and conditions to which the designation is subject).</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><content>A designation under <ref href="#section-2-1">subsection (1)</ref> may be made subject to such terms and conditions as the Secretary of State considers appropriate.</content></subsecti

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><intro>If the Secretary of State decides to designate an eligible body under <ref href="#section-2-1">subsection (1)</ref>, the Secretary of State must—</intro><level class="para1" eId="sectio

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-a"><num>(a)</num><content>notify the body of the designation before the date on which the designation takes effect (“<term refersTo="#term-the-effective-date" eId="term-the-effective-date">the effective

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-b"><num>(b)</num><content>publish the notice of the designation before that date.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><intro>The notice of the designation must state—</intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content>the name of the body,</content></level><level class="para1" eId="

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-b"><num>(b)</num><content>the specified area for which the body has been designated,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-c"><num>(c)</num><content>the effective date, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-d"><num>(d)</num><content>any terms and conditions to which the designation is subject.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><intro>The Secretary of State may from time to time modify the terms and conditions to which a designation is subject, in which case the Secretary of State must—</intro><level class="para1" eI

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-5-a"><num>(a)</num><content>notify the employer representative body of the modification before the date on which the modification takes effect, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-5-b"><num>(b)</num><content>amend the notice of designation accordingly, and publish it as amended, before that date.</content></level>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Removal of designations</heading><subsection eId="section-3-1"><num>(1)</num><intro>The Secretary of State may by notice remove the designation of a body under <ref href="#section-2">section 2</

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-a"><num>(a)</num><content>the body no longer meets the requirements in <ref href="#section-2">section 2</ref><ref href="#section-2-1">(1)</ref><ref href="#section-2-1-a">(a)</ref>,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-b"><num>(b)</num><content>the body is no longer an eligible body,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-c"><num>(c)</num><content>the body does not comply with a term or condition to which the designation is subject,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-d"><num>(d)</num><content>the body does not have regard to any relevant guidance published by the Secretary of State or departs from any such guidance without good cause, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-e"><num>(e)</num><content>the Secretary of State considers that removing the designation is otherwise necessary or expedient.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><content>The Secretary of State must by notice remove a designation of a body under <ref href="#section-2">section 2</ref> if the body requests the removal in writing.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><intro>A notice under this section must—</intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content>include reasons for the removal of the designation, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-a"><num>(a)</num><content>include reasons for the removal of the designation, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-b"><num>(b)</num><content>specify when the designation is to be removed.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><content> The Secretary of State must publish a notice under this section.</content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-2-d"><num>(d)</num><content>a registered higher education provider who provides only higher education;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-2-e"><num>(e)</num><content>the responsible body for an institution within any of paragraphs <ref href="#section-19-2-a">(a)</ref> to <ref href="#section-19-2-d">(d) </ref>when acting in its capacity as

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-2-f"><num>(f)</num><content>a local authority in England;</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-19-3"><num>(3)</num><intro>“<term refersTo="#term-relevant-education-or-training" eId="term-relevant-education-or-training">Relevant education or training</term>” means education or training that falls within one or

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-3-a"><num>(a)</num><content>further education;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-3-b"><num>(b)</num><content>education or training provided by means of a further education course, or a module of a further education course, designated for the purposes of section 22 of the Teaching and

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-3-c"><num>(c)</num><content>training for persons over compulsory school age which is funded by the Secretary of State under section 2 of the Employment and Training Act 1973;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-19-3-d"><num>(d)</num><content>education or training for persons over compulsory school age provided as part of an approved technical education qualification or approved steps towards occupational competenc

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-27-1"><num>(1)</num><content>It is an offence for a person to provide, or arrange for another person to provide, in commercial circumstances, a relevant service for a student in relation to a relevant assignment.</p

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-4-b"><num>(b)</num><content>that the student was required to complete the assignment personally;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-4-c"><num>(c)</num><content>that the relevant service was not permitted assistance.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-27-5"><num>(5)</num><intro>A statement in the form of a written standard term of the contract or arrangement under which the relevant service was provided or arranged—</intro><level class="para1" eId="section-27

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-5-a"><num>(a)</num><content>that the student would not use any material provided as a result of the relevant service in completing all or part of the assignment,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-5-b"><num>(b)</num><content>that the student was not required to complete the assignment personally, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-5-c"><num>(c)</num><content>that the relevant service was permitted assistance,</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-27-6"><num>(6)</num><intro>A student does not commit either of the following merely by making use of a relevant service to complete all or part of an assignment—</intro><level class="para1" eId="section-27-6-a">

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-6-a"><num>(a)</num><content>an offence under Part 2 of the Serious Crime Act 2007 where the offence that the student intended or believed would be committed is an offence under this section;</content

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-27-6-b"><num>(b)</num><content>an offence under this section committed by aiding, abetting, counselling or procuring the commission of an offence under this section.</content></level>
