<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><content>A person who sets a glue trap in England for the purpose of catching a rodent commits an offence.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><content>A person who sets a glue trap in England in a manner which gives rise to a risk that a rodent will become caught in the glue trap commits an offence.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><content>Subsections <ref href="#section-1-1">(1)</ref> and <ref href="#section-1-2">(2)</ref> do not apply if the glue trap is set under, and in accordance with the terms of, a glue trap licence

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-a"><num>(a)</num><content>finds a glue trap in England that has been set in a manner which gives rise to a risk that a rodent will become caught in the glue trap, and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-5-b"><num>(b)</num><content>without reasonable excuse, fails to ensure that the glue trap no longer gives rise to such a risk.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-6"><num>(6)</num><content>If the person reasonably believes that the glue trap was set under, and in accordance with the terms of, a glue trap licence, the person has a reasonable excuse for the purposes of <ref h

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-6"><num>(6)</num><intro>Regulations under <ref href="#section-2-5">subsection (5)</ref><ref href="#section-2-5-b">(b)</ref> may, in particular, include provision about—</intro><level class="para1" eId="section

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-6-a"><num>(a)</num><content>the grounds upon which an appeal may be made;</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-11"><num>(11)</num><content>In this section “<term refersTo="#term-public-authority" eId="term-public-authority">public authority</term>” means any person certain of whose functions are functions of a public natur

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><intro>A person commits an offence if, in connection with an application for the grant or modification of a glue trap licence, the person—</intro><level class="para1" eId="section-3-1-a"><num>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-a"><num>(a)</num><content>makes a statement or representation, or provides a document or information, which the person knows to be false in a material particular, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-1-b"><num>(b)</num><content>recklessly makes a statement or representation, or provides a document or information, which is false in a material particular.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><content>A person guilty of an offence under this section is liable on summary conviction to imprisonment for a term not exceeding 51 weeks or a fine (or both).</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5-4"><num>(4)</num><content>An authorised inspector must produce evidence of the inspector’s authorisation under <ref href="#section-5-1">subsection (1)</ref> before entering any premises under <ref href="#section-5

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5-8"><num>(8)</num><intro>Anything which has been seized in the exercise of a power under <ref href="#section-5-5">subsection (5)</ref><ref href="#section-5-5-f">(h)</ref> may be retained so long as is necessary in
