<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1"><num>1</num><heading>Prohibition on import and export of shark fins</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>It is prohibited—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>to import shark fins, or things containing shark fins, into the United Kingdom as a result of their entry into Great Britain, or</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>to export shark fins, or things containing shark fins, from the United Kingdom as a result of their removal from Great Britain.</p></content></level></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>The prohibition in <ref href="#section-1-1">subsection (1)</ref> does not apply where—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>the shark fins are naturally attached to the body of the shark, and</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>the body is substantially intact, ignoring any removal of the head and internal organs.</p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><ref href="#schedule">The Schedule</ref> contains provision for exemption certificates relating to the prohibition in <ref href="#section-1-1">subsection (1)</ref>.</p></content></subsection><subsection eId="section-1-4"><num>(4)</num><intro><p>In <ref href="#section-1">this section</ref> and <ref href="#schedule">the Schedule</ref>—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-shark-fins" eId="term-shark-fins">shark fins</term>” means any fins or parts of fins of a shark, other than the pectoral fins or parts of pectoral fins of a ray;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-shark" eId="term-shark">shark</term>” means any fish of the taxon Elasmobranchii.</p></content></hcontainer></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading>Removal of shark fins on board fishing vessels</heading><content><p><mod>In Council Regulation <ref eId="c00001" href="http://www.legislation.gov.uk/european/regulation/2003/1185">(EC) No 1185/2003</ref> on the removal of fins of sharks on board vessels, for Article 1 substitute—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="eur" ukl:TargetClass="euretained" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><num>Article 1</num><heading>Scope</heading><article><intro><p>This Regulation applies to the removal of shark fins, retention on board, transhipment and landing of shark fins:</p></intro><article><num>1.</num><content><p>by United Kingdom fishing vessels in any maritime waters;</p></content></article><article><num>2.</num><content><p>by other fishing vessels in United Kingdom waters.</p></content></article></article></hcontainer></quotedStructure></mod></p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Extent, commencement and short title</heading><subsection eId="section-3-1"><num>(1)</num><content><p>This Act extends to England and Wales, Scotland and Northern Ireland.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>Section <ref href="#section-1">1</ref> and the Schedule come into force on such day as the Secretary of State may by regulations made by statutory instrument appoint.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>Section <ref href="#section-2">2</ref> comes into force at the end of the period of two months beginning with the day on which this Act is passed.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>This section comes into force on the day on which this Act is passed.</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><content><p>The Secretary of State may by regulations made by statutory instrument make transitional or saving provision in connection with the coming into force of any provision of this Act.</p></content></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>This Act may be cited as the Shark Fins Act 2023.</p></content></subsection></section>

class="schGroup7" eId="d25e262"><heading>Exemption certificates</heading><paragraph eId="schedule-paragraph-1" class="schProv1"><num>1</num><subparagraph eId="schedule-paragraph-1-1"><num>(1)</num><intro><p>The import or export of shark fins, or things containing them, is exempt from the prohibition in <ref href="#section-1">section 1</ref> if—</p></intro><level class="para1" eId="schedule-paragraph-1-1-a"><num>(a)</num><content><p>the appropriate authority has issued a certificate under <ref href="#schedule-paragraph-1-1-a">this paragraph</ref> (an “exemption certificate”) in respect of the import or export,</p></content></level><level class="para1" eId="schedule-paragraph-1-1-b"><num>(b)</num><content><p>it takes place on the date, or within the period, specified in the certificate, and</p></content></level><level class="para1" eId="schedule-paragraph-1-1-c"><num>(c)</num><content><p>the certificate has not been revoked.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-1-2"><num>(2)</num><intro><p>An exemption certificate must—</p></intro><level class="para1" eId="schedule-paragraph-1-2-a"><num>(a)</num><content><p>contain a unique number (or a combination of letters and figures);</p></content></level><level class="para1" eId="schedule-paragraph-1-2-b"><num>(b)</num><content><p>contain enough information to identify the shark fins concerned;</p></content></level><level class="para1" eId="schedule-paragraph-1-2-c"><num>(c)</num><content><p>specify whether it relates to an import or export.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e324"><heading>Applications</heading><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2</num><subparagraph eId="schedule-paragraph-2-1"><num>(1)</num><content><p>A person applying for an exemption certificate (an “applicant”) must provide such information as the appropriate authority requests.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-2"><num>(2)</num><intro><p>The appropriate authority must grant the application and issue an exemption certificate to the applicant if—</p></intro><level class="para1" eId="schedule-paragraph-2-2-a"><num>(a)</num><content><p>the applicant has provided all the information, and paid any fee, required by the authority, and</p></content></level><level class="para1" eId="schedule-paragraph-2-2-b"><num>(b)</num><content><p>the authority is satisfied that the shark fins concerned are to be used for purposes connected with the conservation of sharks,</p></content></level><wrapUp><p>and must otherwise refuse the application.</p></wrapUp></subparagraph><subparagraph eId="schedule-paragraph-2-3"><num>(3)</num><content><p>If the appropriate authority refuses the application, the authority must inform the applicant why it has been refused.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e364"><heading>Revocation and revision</heading><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3</num><subparagraph eId="schedule-paragraph-3-1"><num>(1)</num><intro><p>Where an exemption certificate has been issued but, before the import or export takes place, it appears to the appropriate authority that any information supplied in connection with the application is, or has become, inaccurate or incomplete, the authority may—</p></intro><level class="para1" eId="schedule-paragraph-3-1-a"><num>(a)</num><content><p>revoke the certificate, or</p></content></level><level class="para1" eId="schedule-paragraph-3-1-b"><num>(b)</num><content><p>issue a revised certificate.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-3-2"><num>(2)</num><intro><p>The appropriate authority must revoke an exemption certificate if—</p></intro><level class="para1" eId="schedule-paragraph-3-2-a"><num>(a)</num><content><p>the authority ceases to be satisfied as described in <ref href="#schedule-paragraph-2">paragraph 2</ref><ref href="#schedule-paragraph-2-2">(2)</ref><ref href="#schedule-paragraph-2-2-b">(b)</ref> in relation to the shark fins concerned, and</p></content></level><level class="para1" eId="schedule-paragraph-3-2-b"><num>(b)</num><content><p>the import or export has not taken place.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-3-3"><num>(3)</num><content><p>If the appropriate authority revokes an exemption certificate, the authority must inform the applicant why it has been revoked.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e421"><heading>Penalty for providing inaccurate etc information in connection with an application</heading><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4</num><subparagraph eId="schedule-paragraph-4-1"><num>(1)</num><intro><p><ref href="#schedule-paragraph-4-2">Sub-paragraph (2)</ref> applies where the appropriate authority is satisfied that, in connection with an application for an exemption certificate, the applicant provided inaccurate or incomplete information or provided a document that contained an inaccuracy and—</p></intro><level class="para1" eId="schedule-paragraph-4-1-a"><num>(a)</num><content><p>the inaccuracy or incompleteness was deliberate or due to a failure by the applicant to take reasonable care,</p></content></level><level class="para1" eId="schedule-paragraph-4-1-b"><num>(b)</num><content><p>the applicant knew of the inaccuracy or incompleteness at the time the information or document was provided but did not inform the authority at that time, or</p></content></level><level class="para1" eId="schedule-paragraph-4-1-c"><num>(c)</num><content><p>the applicant discovered the inaccuracy or incompleteness before the import or export takes place and failed to take reasonable steps to inform the authority.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-4-2"><num>(2)</num><content><p>The appropriate authority may impose a monetary penalty on the applicant.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-3"><num>(3)</num><content><p>In this Schedule “<term refersTo="#term-monetary-penalty" eId="term-monetary-penalty">monetary penalty</term>” means a requirement to pay the appropriate authority a penalty of an amount, not exceeding £3,000, determined by the authority.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-4"><num>(4)</num><content><p>The appropriate authority may by regulations amend <ref href="#schedule-paragraph-4-3">sub-paragraph (3)</ref> so as to substitute a different amount for the amount for the time being specified there.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-5"><num>(5)</num><content><p>Regulations made by the Secretary of State under sub-paragraph (4) must be made by statutory instrument; and a statutory instrument containing such regulations may not be made unless a draft of the instrument has been laid before, and approved by resolution of, each House of Parliament.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-6"><num>(6)</num><content><p>Regulations made by the Welsh Ministers under sub-paragraph (4) must be made by statutory instrument; and a statutory instrument containing such regulations may not be made unless a draft of the instrument has been laid before, and approved by resolution of, Senedd Cymru.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-7"><num>(7)</num><content><p>Regulations made by the Scottish Ministers under sub-paragraph (4) are subject to the affirmative procedure (see Part 2 of the Interpretation and Legislative Reform (Scotland) Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/asp/2010/10">2010 (asp 10)</ref>).</p></content></subparagraph></paragraph><paragraph eId="schedule-paragraph-5" class="schProv1"><num>5</num><subparagraph eId="schedule-paragraph-5-1"><num>(1)</num><content><p>Where the appropriate authority proposes to impose a monetary penalty on an applicant the authority must give the applicant a notice of what is proposed (an “initial penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-2"><num>(2)</num><content><p>An initial penalty notice must offer the applicant the opportunity to avoid liability in relation to a monetary penalty by payment of a sum specified in the notice (which must be less than or equal to the amount of the proposed penalty).</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-3"><num>(3)</num><content><p>The applicant may make written representations and objections to the appropriate authority in relation to the proposed imposition of the monetary penalty within the period of 28 days beginning with the day on which the initial penalty notice is given.</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-4"><num>(4)</num><content><p>After the end of the period mentioned in <ref href="#schedule-paragraph-5-3">sub-paragraph (3)</ref> the appropriate authority must decide whether to give the applicant a notice imposing a monetary penalty (a “final penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-5"><num>(5)</num><content><p>The appropriate authority may not give an applicant a final penalty notice if the authority is no longer satisfied as mentioned in <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-1">(1)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-6"><num>(6)</num><intro><p>The penalty specified in the final penalty notice may be—</p></intro><level class="para1" eId="schedule-paragraph-5-6-a"><num>(a)</num><content><p>a penalty of the amount proposed in the initial penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-5-6-b"><num>(b)</num><content><p>a penalty of a smaller amount.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-5-7"><num>(7)</num><content><p>An initial or final penalty notice may be withdrawn at any time by the appropriate authority.</p></content></subparagraph></paragraph><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6</num><subparagraph eId="schedule-paragraph-6-1"><num>(1)</num><intro><p>An initial penalty notice must include information as to—</p></intro><level class="para1" eId="schedule-paragraph-6-1-a"><num>(a)</num><content><p>the grounds for the proposal to impose the monetary penalty,</p></content></level><level class="para1" eId="schedule-paragraph-6-1-b"><num>(b)</num><content><p>the period within which payment may be made so as to avoid liability for a monetary penalty (which must be at least 28 days beginning with the day on which the notice is given),</p></content></level><level class="para1" eId="schedule-paragraph-6-1-c"><num>(c)</num><content><p>the right to make representations and objections within the period of 28 days beginning with the day on which the notice is given, and</p></content></level><level class="para1" eId="schedule-paragraph-6-1-d"><num>(d)</num><content><p>the effect of <ref href="#schedule-paragraph-5">paragraph 5</ref><ref href="#schedule-paragraph-5-5">(5)</ref>.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><intro><p>A final penalty notice must include information as to—</p></intro><level class="para1" eId="schedule-paragraph-6-2-a"><num>(a)</num><content><p>the grounds for imposing the monetary penalty,</p></content></level><level class="para1" eId="schedule-paragraph-6-2-b"><num>(b)</num><content><p>how payment may be made,</p></content></level><level class="para1" eId="schedule-paragraph-6-2-c"><num>(c)</num><content><p>the period within which payment is to be made (which must be at least 28 days beginning with the day on which the notice is given),</p></content></level><level class="para1" eId="schedule-paragraph-6-2-d"><num>(d)</num><content><p>rights of appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-6-2-e"><num>(e)</num><content><p>the consequences of non-payment.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-3"><num>(3)</num><content><p>A final penalty notice may provide for interest or other penalties specified in the notice to be payable in the event that payment is not made in the period referred to in <ref href="#schedule-paragraph-6-2">sub-paragraph (2)</ref><ref href="#schedule-paragraph-6-2-c">(c)</ref>.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e654"><heading>Appeals</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7</num><subparagraph eId="schedule-paragraph-7-1"><num>(1)</num><intro><p>An applicant may appeal to the First-tier Tribunal against the decision—</p></intro><level class="para1" eId="schedule-paragraph-7-1-a"><num>(a)</num><content><p>to refuse an application for an exemption certificate,</p></content></level><level class="para1" eId="schedule-paragraph-7-1-b"><num>(b)</num><content><p>to revoke an exemption certificate, or</p></content></level><level class="para1" eId="schedule-paragraph-7-1-c"><num>(c)</num><content><p>to give a final penalty notice.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-2"><num>(2)</num><intro><p>An appeal may be on the ground—</p></intro><level class="para1" eId="schedule-paragraph-7-2-a"><num>(a)</num><content><p>that the decision was based on an error of fact,</p></content></level><level class="para1" eId="schedule-paragraph-7-2-b"><num>(b)</num><content><p>that the decision was wrong in law, or</p></content></level><level class="para1" eId="schedule-paragraph-7-2-c"><num>(c)</num><content><p>that the decision was unreasonable.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-3"><num>(3)</num><content><p>An appeal against a decision mentioned in <ref href="#schedule-paragraph-7-1">sub-paragraph (1)</ref><ref href="#schedule-paragraph-7-1-c">(c)</ref> may also be on the ground that the amount of penalty imposed by the notice is unreasonable.</p></content></subparagraph><subparagraph eId="schedule-paragraph-7-4"><num>(4)</num><intro><p>On an appeal against a decision mentioned in <ref href="#schedule-paragraph-7-1">sub-paragraph (1)</ref><ref href="#schedule-paragraph-7-1-a">(a)</ref> or <ref href="#schedule-paragraph-7-1-b">(b)</ref>, the First-tier Tribunal may—</p></intro><level class="para1" eId="schedule-paragraph-7-4-a"><num>(a)</num><content><p>confirm the appropriate authority’s decision to refuse the application or revoke the exemption certificate,</p></content></level><level class="para1" eId="schedule-paragraph-7-4-b"><num>(b)</num><content><p>require the appropriate authority to issue an exemption certificate, or to cancel the decision to revoke an existing exemption certificate, or</p></content></level><level class="para1" eId="schedule-paragraph-7-4-c"><num>(c)</num><content><p>remit the decision to refuse the application or revoke the exemption certificate to the appropriate authority for reconsideration.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-5"><num>(5)</num><intro><p>On an appeal against a decision mentioned in <ref href="#schedule-paragraph-7-1">sub-paragraph (1)</ref><ref href="#schedule-paragraph-7-1-c">(c)</ref>, the First-tier Tribunal may—</p></intro><level class="para1" eId="schedule-paragraph-7-5-a"><num>(a)</num><content><p>confirm the final penalty notice,</p></content></level><level class="para1" eId="schedule-paragraph-7-5-b"><num>(b)</num><content><p>quash the final penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-7-5-c"><num>(c)</num><content><p>vary the final penalty notice by reducing the amount of the penalty.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-6"><num>(6)</num><intro><p>Where an appeal under this paragraph is made against a decision mentioned in <ref href="#schedule-paragraph-7-1">sub-paragraph (1)</ref><ref href="#schedule-paragraph-7-1-c">(c)</ref>—</p></intro><level class="para1" eId="schedule-paragraph-7-6-a"><num>(a)</num><content><p>the requirement to pay the monetary penalty is suspended pending the final determination or withdrawal of the appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-7-6-b"><num>(b)</num><content><p>no interest or other penalty is payable by virtue of <ref href="#schedule-paragraph-6">paragraph 6</ref><ref href="#schedule-paragraph-6-3">(3)</ref> in respect of the period during which that requirement is suspended.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-7"><num>(7)</num><content><p>In this paragraph, references to the First-tier Tribunal, in relation to a decision of the Scottish Ministers, are to the First-tier Tribunal for Scotland.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e816"><heading>Enforcement</heading><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8</num><intro><p>If a person does not pay the whole or any part of a penalty which the person is liable to pay under this Schedule (including an amount payable by virtue of <ref href="#schedule-paragraph-6">paragraph 6</ref><ref href="#schedule-paragraph-6-3">(3)</ref>), the penalty or part of the penalty is recoverable—</p></intro><level class="para1" eId="schedule-paragraph-8-a"><num>(a)</num><content><p>in England and Wales, as if it were payable under an order of the county court,</p></content></level><level class="para1" eId="schedule-paragraph-8-b"><num>(b)</num><content><p>in Scotland, in the same manner as an extract registered decree arbitral bearing a warrant for execution issued by the sheriff court of any sheriffdom in Scotland, and</p></content></level><level class="para1" eId="schedule-paragraph-8-c"><num>(c)</num><content><p>in Northern Ireland, as if it were payable under an order of a county court in Northern Ireland.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e849"><heading>“Appropriate authority”</heading><paragraph eId="schedule-paragraph-9" class="schProv1"><num>9</num><intro><p>In this Schedule “<term refersTo="#term-appropriate-authority" eId="term-appropriate-authority">appropriate authority</term>” means—</p></intro><level class="para1" eId="schedule-paragraph-9-a"><num>(a)</num><content><p>the Secretary of State, in relation to the entry into, or removal from, England of shark fins or things containing them,</p></content></level><level class="para1" eId="schedule-paragraph-9-b"><num>(b)</num><content><p>the Scottish Ministers, in relation to the entry into, or removal from, Scotland of shark fins or things containing them, and</p></content></level><level class="para1" eId="schedule-paragraph-9-c"><num>(c)</num><content><p>the Welsh Ministers, in relation to the entry into, or removal from, Wales of shark fins or things containing them.</p></content></level></paragraph></hcontainer></hcontainer></hcontainer>
