1</p></authorialNote></num><heading>Minimum service levels for certain strikes</heading><part eId="schedule-part-1"><num>PART 1</num><heading>Amendments to Part 5 of the 1992 Act: minimum service levels</heading><paragraph eId="schedule-paragraph-1" class="schProv1"><num>1</num><content><p>Part 5 of the 1992 Act (industrial action) is amended as follows.</p></content></paragraph><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2</num><content><p><mod>After section 234A insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Minimum service levels for certain services</heading><section eId="d25e246"><num>234B</num><heading>Power of Secretary of State to specify minimum service levels</heading><subsection><num>(1)</num><content><p>The Secretary of State may, for the purpose of enabling work notices under section <ref href="#d25e337">234C</ref> to be given, make provision by regulations for levels of service in relation to strikes as respects relevant services (“<term refersTo="#term-minimum-service-regulations">minimum service regulations</term>”).</p></content></subsection><subsection eId="d25e262"><num>(2)</num><intro><p>Minimum service regulations may be framed so as to have effect in relation to any strike that takes place after the day on which the regulations come into force, even if—</p></intro><level class="para1"><num>(a)</num><content><p>notice of the strike under section 234A was given on or before the day on which the regulations come into force, or</p></content></level><level class="para1"><num>(b)</num><content><p>the date of the ballot in respect of the strike was on or before the day on which the Strikes (Minimum Service Levels) Act 2023 comes into force.</p></content></level></subsection><subsection eId="d25e280"><num>(3)</num><content><p>In this Part, “<term refersTo="#term-relevant-services">relevant services</term>” has the meaning given by regulations made by the Secretary of State.</p></content></subsection><subsection><num>(4)</num><intro><p>Regulations under subsection <ref href="#d25e280">(3)</ref> may specify only services that fall within any of the following categories—</p></intro><level class="para1"><num>(a)</num><content><p>health services;</p></content></level><level class="para1"><num>(b)</num><content><p>fire and rescue services;</p></content></level><level class="para1"><num>(c)</num><content><p>education services;</p></content></level><level class="para1"><num>(d)</num><content><p>transport services;</p></content></level><level class="para1"><num>(e)</num><content><p>decommissioning of nuclear installations and management of radioactive waste and spent fuel;</p></content></level><level class="para1"><num>(f)</num><content><p>border security.</p></content></level></subsection></section><section eId="d25e337"><num>234C</num><heading>Work notices relating to minimum service levels</heading><subsection><num>(1)</num><intro><p>Where minimum service regulations have been made as respects a relevant service, an employer may give a work notice to a trade union in relation to any strike—</p></intro><level class="para1"><num>(a)</num><content><p>of which the union gives notice to the employer under section 234A, and</p></content></level><level class="para1"><num>(b)</num><content><p>which relates to the provision of the service.</p></content></level></subsection><subsection eId="d25e359"><num>(2)</num><content><p>In this Part “<term refersTo="#term-work-notice">work notice</term>” means a notice in writing that levels of service under minimum service regulations are to apply in relation to a strike.</p></content></subsection><subsection eId="d25e368"><num>(3)</num><intro><p>A work notice must be given within the period beginning with the day on which the notice under section 234A is given and ending with—</p></intro><level class="para1"><num>(a)</num><content><p>the 7th day before the earliest strike date to which it relates, or</p></content></level><level class="para1" eId="d25e380"><num>(b)</num><content><p>any later day that is agreed between the employer and the union.</p></content></level></subsection><subsection eId="d25e386"><num>(4)</num><intro><p>A work notice must—</p></intro><level class="para1" eId="d25e392"><num>(a)</num><content><p>identify the persons required to work during the strike in order to secure that the levels of service under the minimum service regulations are provided, and</p></content></level><level class="para1"><num>(b)</num><content><p>specify the work required to be carried out by them during the strike in order to secure that those levels of service are provided.</p></content></level></subsection><subsection><num>(5)</num><content><p>A work notice must not identify more persons than are reasonably necessary for the purpose of providing the levels of service under the minimum service regulations.</p></content></subsection><subsection><num>(6)</num><intro><p>In deciding whether to identify a person in a work notice, the employer must not have regard to—</p></intro><level class="para1"><num>(a)</num><content><p>whether the person is or is not a member of a trade union,</p></content></level><level class="para1" eId="d25e422"><num>(b)</num><intro><p>whether the person has or has not—</p></intro><level class="para2"><num>(i)</num><content><p>taken part in the activities of a trade union, or</p></content></level><level class="para2"><num>(ii)</num><content><p>made use of services made available to the person by a trade union by virtue of the person’s membership of the union, or</p></content></level></level><level class="para1" eId="d25e440"><num>(c)</num><intro><p>whether or not—</p></intro><level class="para2"><num>(i)</num><content><p>a matter has been raised on the person’s behalf (with or without the person’s consent), or</p></content></level><level class="para2"><num>(ii)</num><content><p>the person has consented to the raising of a matter on the person’s behalf,</p></content></level><wrapUp><p>by a trade union of which the person is a member.</p></wrapUp></level></subsection><subsection><num>(7)</num><intro><p>In subsection (6) “<term refersTo="#term-a-trade-union">a trade union</term>” includes—</p></intro><level class="para1"><num>(a)</num><content><p>a particular trade union, and</p></content></level><level class="para1"><num>(b)</num><content><p>a particular branch or section of a particular trade union.</p></content></level></subsection><subsection eId="d25e481"><num>(8)</num><intro><p>Before giving a work notice, the employer must—</p></intro><level class="para1" eId="d25e487"><num>(a)</num><content><p>consult the union about the number of persons to be identified and the work to be specified in the notice, and</p></content></level><level class="para1"><num>(b)</num><content><p>have regard to any views expressed by the union in response.</p></content></level></subsection><subsection eId="d25e499"><num>(9)</num><intro><p>The employer may vary a work notice, so far as relating to a strike date, and give the notice as varied to the trade union—</p></intro><level class="para1" eId="d25e505"><num>(a)</num><content><p>before the end of the 4th day before the strike date, or</p></content></level><level class="para1"><num>(b)</num><content><p>before the end of any later day that is agreed between the employer and the union.</p></content></level></subsection><subsection><num>(10)</num><intro><p>Before varying a work notice the employer must—</p></intro><level class="para1"><num>(a)</num><content><p>consult the union about the variation, so far as it relates to the matters mentioned in subsection <ref href="#d25e487">(8)(a)</ref>, and</p></content></level><level class="para1"><num>(b)</num><content><p>have regard to any views expressed by the union in response.</p></content></level></subsection><subsection eId="d25e538"><num>(11)</num><content><p>For the purposes of this section, where a strike takes place over more than one day (continuously or discontinuously) each day is to be treated as a separate “strike date”.</p></content></subsection></section><section><num>234D</num><heading>Work notices: disclosure of information</heading><subsection><num>(1)</num><intro><p>Except as provided by subsection <ref href="#d25e575">(2)</ref>, a disclosure of information authorised by section <ref href="#d25e337">234C</ref> does not breach—</p></intro><level class="para1"><num>(a)</num><content><p>any obligation of confidence owed by the person making the disclosure, or</p></content></level><level class="para1"><num>(b)</num><content><p>any other restriction on the disclosure of information (however imposed).</p></content></level></subsection><subsection eId="d25e575"><num>(2)</num><content><p>Section <ref href="#d25e337">234C</ref> does not authorise a disclosure of information that would contravene the data protection legislation (but in determining whether a disclosure would do so, that section is to be taken into account).</p></content></subsection><subsection><num>(3)</num><content><p>In this section “<term refersTo="#term-the-data-protection-legislation">the data protection legislation</term>” has the same meaning as in the Data Protection Act 2018 (see section 3 of that Act).</p></content></subsection></section><section><num>234E</num><heading>Work notices: no protection if union fails to take reasonable steps</heading><subsection eId="d25e600"><num>(1)</num><intro><p>Where an employer gives a trade union a work notice in relation to a strike, an act done by the union to induce a person to take part, or to continue to take part, in the strike is not protected as respects that person’s employer if—</p></intro><level class="para1"><num>(a)</num><content><p>the work notice is given in accordance with section <ref href="#d25e337">234C</ref>, and</p></content></level><level class="para1" eId="d25e615"><num>(b)</num><content><p>the union fails to take reasonable steps to ensure that all members of the union who are identified in the work notice comply with the notice.</p></content></level></subsection><subsection eId="d25e621"><num>(2)</num><content><p>In proceedings in tort that are brought against a trade union in reliance on paragraph <ref href="#d25e615">(b)</ref> of subsection <ref href="#d25e600">(1)</ref>, any loss that would have been suffered even if the union had taken the reasonable steps mentioned in that paragraph is to be disregarded in calculating any amount to be awarded against the union by way of damages.</p></content></subsection></section><section eId="d25e636"><num>234F</num><heading>Regulations: consultation and supplementary</heading><subsection eId="d25e640"><num>(1)</num><content><p>Before making regulations under section <ref href="#d25e246">234B</ref> the Secretary of State must consult such persons as the Secretary of State considers appropriate.</p></content></subsection><subsection eId="d25e649"><num>(2)</num><intro><p>A power to make regulations under section <ref href="#d25e246">234B</ref> includes power to make—</p></intro><level class="para1"><num>(a)</num><content><p>consequential, supplementary, incidental, transitional or saving provision;</p></content></level><level class="para1"><num>(b)</num><content><p>different provision for different purposes or areas.</p></content></level></subsection><subsection><num>(3)</num><content><p>Regulations under section <ref href="#d25e246">234B</ref> are to be made by statutory
