attorney</heading><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2</num><intro><p>In paragraph 4—</p></intro><level class="para1" comply with paragraph 1(1)(c), the Public Guardian must take any steps that may be prescribed for ensuring that the instrument complies with paragraph 1(1)(c) in that respect.</p></content></paragraph></quotedStructure></mod></p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Notifications</heading><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4</num><subparagraph eId="schedule-paragraph-4-1"><num>(1)</num><content><p>Omit paragraph 6.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-2"><num>(2)</num><content><p><mod>For paragraph 7 substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="ukpga" ukl:TargetClass="primary" conditions in sub-paragraph (2) are met, the Public Guardian must notify the donor, the donee (or, if more than one, each of them) and each named person that those conditions have been met.</p></content></subparagraph><subparagraph><num>(2)</num><intro><p>The conditions are—</p></intro><level class="para1"><num>(a)</num><content><p>that the Public Guardian has received an application under paragraph 4 in relation to an instrument intended to create a lasting power of attorney, and</p></content></level><level class="para1"><num>(b)</num><content><p>that it appears to the Public Guardian that the instrument has been made in accordance with this Schedule.</p></content></level></subparagraph></paragraph></quotedStructure></mod></p></content></subparagraph><subparagraph eId="schedule-paragraph-4-3"><num>(3)</num><content><p>Omit paragraph 8.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Exclusion of notification requirements</heading><paragraph eId="schedule-paragraph-5" instrument, requirements for the purpose of establishing or verifying the identity of persons named in an instrument or taking part in the process of an application.</p></content></subparagraph><subparagraph><num>(2)</num><content><p>If it appears to the Public Guardian that a requirement imposed by regulations under sub-paragraph (1) is not met in the case of an instrument, the Public Guardian must not register the instrument unless directed to do so by the court.</p></content></subparagraph></paragraph></hcontainer></quotedStructure></mod></p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Objections to registration</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7</num><subparagraph eId="schedule-paragraph-7-1"><num>(1)</num><intro><p>In paragraph 13—</p></intro><level to the Public Guardian of an objection to the registration on a prescribed ground.</p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="schedule-paragraph-7-1-b"><num>(b)</num><content><p><mod>for sub-paragraph (4) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="double"><subparagraph><num>(4)</num><intro><p>The Public Guardian must not register the instrument unless—</p></intro><level class="para1"><num>(a)</num><content><p>the Public Guardian is satisfied that no evidence has been provided which reasonably supports the making of the objection on that ground, or</p></content></level><level class="para1"><num>(b)</num><content><p>the court, on the application of the donor or the donee (or, if more than one, any of them), directs the Public Guardian to register the instrument.</p></content></level></subparagraph></quotedStructure></mod></p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-2"><num>(2)</num><content><p><mod>After that paragraph insert—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="double"><hcontainer name="crossheading" class="schGroup7"><heading>Objection by third party</heading><paragraph class="schProv1"><num>13A</num><subparagraph eId="d25e471"><num>(1)</num><intro><p>This paragraph applies where—</p></intro><level class="para1" eId="d25e477"><num>(a)</num><content><p>an application has been made under paragraph 4 for the registration of an instrument (and at the time when the notice mentioned in <ref href="#d25e486">paragraph (b)</ref> is given that application has not been determined),</p></content></level><level class="para1" eId="d25e486"><num>(b)</num><content><p>a third party has given the Public Guardian notice of an objection on a relevant ground to the registration of the instrument (“the notice of objection”), and</p></content></level><level class="para1"><num>(c)</num><content><p>that notice was given after the Public Guardian was first notified in a prescribed manner by (or on behalf of) the donor of the donor’s intention to make the application mentioned in <ref href="#d25e477">paragraph (a)</ref>.</p></content></level></subparagraph><subparagraph eId="d25e501"><num>(2)</num><intro><p>In <ref href="#d25e471">sub-paragraph (1)</ref> “<term refersTo="#term-on-a-relevant-ground">on a relevant ground</term>” means—</p></intro><level class="para1" eId="d25e513"><num>(a)</num><content><p>on the ground that an event mentioned in section 13(3) or (6)(a) to (d) has occurred which has revoked the instrument, or</p></content></level><level class="para1" eId="d25e519"><num>(b)</num><content><p>on a prescribed ground.</p></content></level></subparagraph><subparagraph><num>(3)</num><intro><p>Where the notice of objection is given on the ground within <ref href="#d25e501">sub-paragraph (2)</ref><ref href="#d25e513">(a)</ref> and the Public Guardian is satisfied that the ground for making the objection is established, the Public Guardian must not register the instrument unless the court, on the application of the donor or the donee (or, if more than one, any of them)—</p></intro><level class="para1"><num>(a)</num><content><p>is satisfied that the ground is not established, and</p></content></level><level class="para1"><num>(b)</num><content><p>directs the Public Guardian to register the instrument.</p></content></level></subparagraph><subparagraph><num>(4)</num><intro><p>Where the notice of objection is given on a ground within <ref href="#d25e501">sub-paragraph (2)</ref><ref href="#d25e519">(b)</ref> the Public Guardian must not register the instrument unless—</p></intro><level class="para1"><num>(a)</num><content><p>the Public Guardian is satisfied that no evidence has been provided which reasonably supports the making of the objection on that ground, or</p></content></level><level class="para1"><num>(b)</num><content><p>the court, on the application of the donor or the donee (or, if more than one, any of them) directs the Public Guardian to register the instrument.</p></content></level></subparagraph><subparagraph><num>(5)</num><content><p>In this paragraph “<term refersTo="#term-third-party">third party</term>” means a person who is not the donor, a donee or a named person.</p></content></subparagraph></paragraph></hcontainer></quotedStructure></mod></p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Evidence of registration</heading><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8</num><intro><p>In paragraph 16—</p></intro><level class="para1" eId="schedule-paragraph-8-a"><num>(a)</num><content><p><mod>in sub-paragraph (1), in the words before paragraph (a), after “Schedule” insert <quotedText>“before the day on which <ref <ref href="#d28e486">sub-paragraph (1)</ref> “<term refersTo="#term-on-a-relevant-ground">on a relevant ground</term>” means—</p></intro><level class="para1" eId="d28e528"><num>(a)</num><content><p>on the ground that an event mentioned in section 13(3) or (6)(a) to (d) has occurred which has revoked the instrument, or</p></content></level><level class="para1" has been made under paragraph 4 for the registration of an instrument (and at the time when the notice mentioned in <ref href="#d28e501">paragraph (b)</ref> is given that application has not been determined),</p></content></level><level class="para1" eId="d28e501"><num>(b)</num><content><p>a third party has given the Public Guardian notice of an objection on a relevant ground to the registration of the instrument (“the notice of objection”), and</p></content></level><level class="para1"><num>(c)</num><content><p>that notice was given after the Public Guardian was first notified in a prescribed manner by (or on behalf of) the donor of the donor’s intention to make the application mentioned in <ref href="#d28e492">paragraph (a)</ref>.</p></content></level></subparagraph><subparagraph eId="d28e516"><num>(2)</num><intro><p>In <ref href="#d28e486">sub-paragraph (1)</ref> “<term refersTo="#term-on-a-relevant-ground">on a relevant ground</term>” means—</p></intro><level class="para1" eId="d28e528"><num>(a)</num><content><p>on the ground that an event mentioned in section 13(3) or (6)(a) to (d) has occurred which has revoked the instrument, or</p></content></level><level class="para1" eId="d28e534"><num>(b)</num><content><p>on a prescribed ground.</p></content></level></subparagraph><subparagraph><num>(3)</num><intro><p>Where the notice of objection is given on the ground within <ref href="#d28e516">sub-paragraph (2)</ref><ref href="#d28e528">(a)</ref> and the Public Guardian is satisfied that the ground for making the objection is established, the Public Guardian must not register the instrument unless the court, on the application of the donor or the donee (or, if more than one, any of them)—</p></intro><level class="para1"><num>(a)</num><content><p>is satisfied that the ground is not established, and</p></content></level><level class="para1"><num>(b)</num><content><p>directs the Public Guardian to register the instrument.</p></content></level></subparagraph><subparagraph><num>(4)</num><intro><p>Where the notice of objection is given on a ground within <ref href="#d28e516">sub-paragraph (2)</ref><ref href="#d28e534">(b)</ref> the Public Guardian must not register the instrument unless—</p></intro><level class="para1"><num>(a)</num><content><p>the Public Guardian is satisfied that no evidence has donor of the donor’s intention to make the application mentioned in <ref href="#d28e492">paragraph (a)</ref>.</p></content></level></subparagraph><subparagraph eId="d28e516"><num>(2)</num><intro><p>In <ref href="#d28e486">sub-paragraph (1)</ref> “<term refersTo="#term-on-a-relevant-ground">on a relevant ground</term>” means—</p></intro><level class="para1" eId="d28e528"><num>(a)</num><content><p>on the ground that an event mentioned in section 13(3) or (6)(a) to (d) has occurred which has revoked the instrument, or</p></content></level><level class="para1" eId="d28e534"><num>(b)</num><content><p>on a prescribed ground.</p></content></level></subparagraph><subparagraph><num>(3)</num><intro><p>Where the notice of objection is given on the ground within <ref href="#d28e516">sub-paragraph (2)</ref><ref href="#d28e528">(a)</ref> and the Public Guardian is satisfied that the ground for making the objection is established, the Public Guardian must not register the instrument unless the court, on the application of the donor or the donee (or, if more than one, any of them)—</p></intro><level class="para1"><num>(a)</num><content><p>is satisfied that the ground is not established, and</p></content></level><level class="para1"><num>(b)</num><content><p>directs the Public Guardian to register the instrument.</p></content></level></subparagraph><subparagraph><num>(4)</num><intro><p>Where the notice of objection is given on a ground within <ref href="#d28e516">sub-paragraph (2)</ref><ref href="#d28e534">(b)</ref> the Public Guardian must not register the instrument unless—</p></intro><level class="para1"><num>(a)</num><content><p>the Public Guardian is satisfied that no evidence has
