<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1"><num>1</num><heading>Automatic enrolment: persons and earnings affected</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Pensions Act 2008 is amended as follows.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p><mod>In section 3 (automatic enrolment), after subsection (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(1A)</num><content><p>The Secretary of State may by regulations amend subsection (1)(a) so as to decrease the age for the time being specified in that paragraph.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><mod>In section 5 (automatic re-enrolment), after subsection (1B) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(1C)</num><content><p>The Secretary of State may by regulations amend subsections (1)(a) and (1A)(a) so as to decrease either or both of the ages for the time being specified in those paragraphs.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-1-4"><num>(4)</num><content><p><mod>After section 13 (qualifying earnings) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>13A</num><heading>Qualifying earnings: reduction or removal of lower limit</heading><subsection><num>(1)</num><intro><p>The Secretary of State may by regulations—</p></intro><level class="para1"><num>(a)</num><content><p>amend section 13(1)(a) so as to reduce the amount for the time being specified in that paragraph, or</p></content></level><level class="para1"><num>(b)</num><intro><p>repeal—</p></intro><level class="para2"><num>(i)</num><content><p>section 9 (workers without qualifying earnings), and</p></content></level><level class="para2"><num>(ii)</num><content><p>section 13(1)(a).</p></content></level></level></subsection><subsection><num>(2)</num><content><p>Regulations under subsection (1)(a) may include provision modifying the requirements as to the timing and subject matter of a review under section 14 (review of earnings trigger and qualifying earnings band) as it relates to section 13(1)(a).</p></content></subsection><subsection><num>(3)</num><intro><p>Regulations under this section may include such amendments, repeals or revocations of any provision of or under this or any other Act as appear to the Secretary of State to be expedient in consequence of—</p></intro><level class="para1"><num>(a)</num><content><p>the repeal of sections 9 and 13(1)(a), or</p></content></level><level class="para1"><num>(b)</num><content><p>the amendment of section 14 (as the case may be).</p></content></level></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-1-5"><num>(5)</num><intro><p>In section 143 (orders and regulations)—</p></intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content><p><mod>in subsection (5) (statutory instruments subject to affirmative resolution procedure), in paragraph (a), after “section” insert <quotedText>“3(1A), 5(1C), 13A,”</quotedText>;</mod></p></content></level><level class="para1" eId="section-1-5-b"><num>(b)</num><content><p><mod>after subsection (5) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(6)</num><content><p>Before making regulations under section 3(1A), 5(1C) or 13A, the Secretary of State must consult such persons as the Secretary of State considers appropriate.</p></content></subsection><subsection><num>(7)</num><content><p>Where the Secretary of State lays before Parliament a draft of an instrument containing regulations under section 3(1A), 5(1C) or 13A, it must be accompanied by a report by the Secretary of State about the consultation under subsection (6).</p></content></subsection></quotedStructure></mod></p></content></level></subsection></section>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Extent, commencement and short title</heading><subsection eId="section-2-1"><num>(1)</num><content><p><ref href="#section-1">Section 1</ref><ref href="#section-1-1">(1)</ref> and <ref href="#section-1-5">(5)</ref> and <ref href="#section-2">this section</ref> extend to England and Wales, Scotland and Northern Ireland.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p><ref href="#section-1">Section 1</ref><span><ref href="#section-1-2">(2)</ref> to <ref href="#section-1-4">(4)</ref></span> extends to England and Wales and Scotland.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p><ref href="#section-1">Section 1</ref> comes into force on such day or days as the Secretary of State may by regulations made by statutory instrument appoint.</p></content></subsection><subsection eId="section-2-4"><num>(4)</num><content><p><ref href="#section-2">This section</ref> comes into force on the day on which this Act is passed.</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>This Act may be cited as the Pensions (Extension of Automatic Enrolment) Act 2023.</p></content></subsection></section>
