activities</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>A person commits an offence if, in a relevant part of the United Kingdom, the person sells, or offers or arranges to sell, any right to observe or participate in an activity which—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>involves an animal,</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>takes place outside the United Kingdom, and</p></content></level><level class="para1" eId="section-1-1-c"><num>(c)</num><content><p>is of a description specified for that part of the United Kingdom by regulations made by the appropriate national authority (“<term refersTo="#term-activity-regulations" eId="term-activity-regulations">activity regulations</term>”).</p></content></level></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>The appropriate national authority may specify a description of activity in activity regulations only if it considers that an activity of that description involves or is likely to involve—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>keeping the animal in conditions within <ref href="#section-1-3">subsection (3)</ref>, or</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>subjecting it to treatment (whether before, during or after the activity) within that subsection.</p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><content><p>An animal is kept in conditions, or is subject to treatment, within this subsection if keeping the animal in the conditions, or subjecting it to the treatment, in the appropriate national authority’s part of the United Kingdom would constitute an offence under the appropriate national legislation.</p></content></subsection></section><section eId="section-2"><num>2</num><heading>Prohibition on advertising of low-welfare animal activities</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>For the purposes of this section an advertisement is a prohibited advertisement in a relevant part of the United Kingdom if the advertisement has the purpose or effect of promoting the observation of, or participation in, an activity which—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>involves an animal,</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>takes place outside the United Kingdom, and</p></content></level><level class="para1" eId="section-2-1-c"><num>(c)</num><content><p>is of a description specified for that part of the United Kingdom by activity regulations.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>A person commits an offence if, in the course of a business, the person—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>publishes in a relevant part of the United Kingdom an advertisement that is a prohibited advertisement in that part, or</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>causes such an advertisement to be so published.</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>A person commits an offence if, in the course of a business, the person—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>prints in a relevant part of the United Kingdom an advertisement published in that part of the United Kingdom that is a prohibited advertisement in that part, or</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>causes such an advertisement to be so printed.</p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>A person commits an offence if, in the course of a business, the person—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>distributes in a relevant part of the United Kingdom an advertisement published in that part of the United Kingdom that is a prohibited advertisement in that part, or</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>causes such an advertisement to be so distributed.</p></content></level></subsection><subsection eId="section-2-5"><num>(5)</num><intro><p>A person does not commit an offence under <ref href="#section-2-2">subsection (2)</ref> or <ref href="#section-2-4">(4)</ref> if the advertisement is contained in a publication (other than an in-flight magazine)—</p></intro><level class="para1" eId="section-2-5-a"><num>(a)</num><content><p>which is printed outside a relevant part of the United Kingdom, and</p></content></level><level class="para1" eId="section-2-5-b"><num>(b)</num><content><p>whose principal market is not, or does not include, a relevant part of the United Kingdom or any part of one.</p></content></level></subsection><subsection eId="section-2-6"><num>(6)</num><intro><p>A person does not commit an offence under <ref href="#section-2-4">subsection (4)</ref> if—</p></intro><level class="para1" eId="section-2-6-a"><num>(a)</num><content><p>the distribution is by means of electronic transmission, and</p></content></level><level class="para1" eId="section-2-6-b"><num>(b)</num><content><p>the person did not carry on business in a relevant part of the United Kingdom at the time of the distribution.</p></content></level></subsection><subsection eId="section-2-7"><num>(7)</num><content><p>A person does not commit an offence under <ref href="#section-2-4">subsection (4)</ref> by selling a publication to a member of the public.</p></content></subsection><subsection eId="section-2-8"><num>(8)</num><content><p>It is a defence for a person charged with an offence under <ref href="#section-2-3">subsection (3)</ref> or <ref href="#section-2-4">(4)</ref> in relation to the printing or distribution of an advertisement in a relevant part of the United Kingdom to prove that the person did not know, and had no reason to suspect, that the advertisement would be published in that part.</p></content></subsection></section></hcontainer>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-b"><num>(b)</num><content><p>takes place outside the United Kingdom, and</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-c"><num>(c)</num><content><p>is of a description specified for that part of the United Kingdom by regulations made by the appropriate national authority (“<term refersTo="#term-activity-regulations" eId="term-activity-regulations">activity regulations</term>”).</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><content><p>An animal is kept in conditions, or is subject to treatment, within this subsection if keeping the animal in the conditions, or subjecting it to the treatment, in the appropriate national authority’s part of the United Kingdom would constitute an offence under the appropriate national legislation.</p></content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-c"><num>(c)</num><content><p>is of a description specified for that part of the United Kingdom by activity regulations.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><intro><p>A person commits an offence if, in the course of a business, the person—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>publishes in a relevant part of the United Kingdom an advertisement that is a prohibited advertisement in that part, or</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>causes such an advertisement to be so published.</p></content></level></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><intro><p>A person commits an offence if, in the course of a business, the person—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>prints in a relevant part of the United Kingdom an advertisement published in that part of the United Kingdom that is a prohibited advertisement in that part, or</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>causes such an advertisement to be so printed.</p></content></level></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><intro><p>A person commits an offence if, in the course of a business, the person—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>distributes in a relevant part of the United Kingdom an advertisement published in that part of the United Kingdom that is a prohibited advertisement in that part, or</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>causes such an advertisement to be so distributed.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-a"><num>(a)</num><content><p>distributes in a relevant part of the United Kingdom an advertisement published in that part of the United Kingdom that is a prohibited advertisement in that part, or</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><intro><p>A person does not commit an offence under <ref href="#section-2-2">subsection (2)</ref> or <ref href="#section-2-4">(4)</ref> if the advertisement is contained in a publication (other than an in-flight magazine)—</p></intro><level class="para1" eId="section-2-5-a"><num>(a)</num><content><p>which is printed outside a relevant part of the United Kingdom, and</p></content></level><level class="para1" eId="section-2-5-b"><num>(b)</num><content><p>whose principal market is not, or does not include, a relevant part of the United Kingdom or any part of one.</p></content></level></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-5-b"><num>(b)</num><content><p>whose principal market is not, or does not include, a relevant part of the United Kingdom or any part of one.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-6"><num>(6)</num><intro><p>A person does not commit an offence under <ref href="#section-2-4">subsection (4)</ref> if—</p></intro><level class="para1" eId="section-2-6-a"><num>(a)</num><content><p>the distribution is by means of electronic transmission, and</p></content></level><level class="para1" eId="section-2-6-b"><num>(b)</num><content><p>the person did not carry on business in a relevant part of the United Kingdom at the time of the distribution.</p></content></level></subsection>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-6-a"><num>(a)</num><content><p>the distribution is by means of electronic transmission, and</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-6-b"><num>(b)</num><content><p>the person did not carry on business in a relevant part of the United Kingdom at the time of the distribution.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-7"><num>(7)</num><content><p>A person does not commit an offence under <ref href="#section-2-4">subsection (4)</ref> by selling a publication to a member of the public.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-8"><num>(8)</num><content><p>It is a defence for a person charged with an offence under <ref href="#section-2-3">subsection (3)</ref> or <ref href="#section-2-4">(4)</ref> in relation to the printing or distribution of an advertisement in a relevant part of the United Kingdom to prove that the person did not know, and had no reason to suspect, that the advertisement would be published in that part.</p></content></subsection>

of the Phylum Chordata.</p></content></hcontainer></section><section eId="section-7"><num>7</num><heading>Extent, commencement and short title</heading><subsection eId="section-7-1"><num>(1)</num><content><p>This Act extends to England and Wales and Northern Ireland.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p>This Act comes into force at the end of the period of two months beginning with the day on which it is passed.</p></content></subsection><subsection eId="section-7-3"><num>(3)</num><content><p>This Act may be cited <subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5-3"><num>(3)</num><content><p>The power of the Department of Agriculture, Environment and Rural Affairs to make activity regulations is exercisable by statutory rule for the purposes of the Statutory Rules (Northern Ireland) Order 1979 (<ref eId="c00002" href="http://www.legislation.gov.uk/id/nisi/1979/1573">S.I. 1979/1573 (N.I. 12)</ref>).</p></content></subsection>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content><p>“<term refersTo="#term-animal" eId="term-animal">animal</term>” means a vertebrate other than a human;</p></content></hcontainer>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="crossheading" class="schGroup7"><heading>Notices and representations</heading><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3</num><subparagraph eId="schedule-paragraph-3-1"><num>(1)</num><content><p>Where an enforcement authority proposes to impose a monetary penalty on a person the authority must give the person a notice of what is proposed (an “initial penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-2"><num>(2)</num><content><p>An initial penalty notice must offer the person the opportunity to avoid liability in relation to a monetary penalty by payment of a sum specified in the notice (which must be less than or equal to the amount of the proposed penalty).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-3"><num>(3)</num><content><p>The person may make written representations and objections to the enforcement authority in relation to the proposed imposition of the monetary penalty within the period of 28 days beginning with the day on which the initial penalty notice is given.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-4"><num>(4)</num><content><p>After the end of the period mentioned in <ref href="#schedule-paragraph-3-3">sub-paragraph (3)</ref> the enforcement authority must decide whether to give the person a notice imposing a monetary penalty (a “final penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-5"><num>(5)</num><content><p>The enforcement authority may not give a person a final penalty notice if the authority is no longer satisfied as mentioned in <ref href="#schedule-paragraph-2">paragraph 2</ref><ref href="#schedule-paragraph-2-1">(1)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-6"><num>(6)</num><intro><p>The penalty specified in the final penalty notice may be—</p></intro><level class="para1" eId="schedule-paragraph-3-6-a"><num>(a)</num><content><p>a penalty of the amount proposed in the initial penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-3-6-b"><num>(b)</num><content><p>a penalty of a smaller amount.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-3-7"><num>(7)</num><content><p>An initial or final penalty notice may be withdrawn at any time by the enforcement authority that issued it.</p></content></subparagraph></paragraph></hcontainer>

<paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-7" class="schProv1"><num>7</num><subparagraph eId="schedule-paragraph-7-1"><num>(1)</num><content><p>Sums received by local weights and measures authorities pursuant to monetary penalties imposed under this Schedule must be paid into the Consolidated Fund.</p></content></subparagraph><subparagraph eId="schedule-paragraph-7-2"><num>(2)</num><intro><p>But before paying such sums into the Consolidated Fund a local weights and measures authority may deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-2-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary penalties imposed by the authority under this Schedule relate, and</p></content></level><level class="para1" eId="schedule-paragraph-7-2-b"><num>(b)</num><content><p>the costs of imposing the penalties.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-3"><num>(3)</num><intro><p>The Department for the Economy in Northern Ireland may, before paying sums received by the Department pursuant to monetary penalties imposed under this Schedule into the Consolidated Fund of Northern Ireland, deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-3-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary penalties imposed by the Department under this Schedule relate, and</p></content></level><level class="para1" eId="schedule-paragraph-7-3-b"><num>(b)</num><content><p>the costs of imposing the penalties.</p></content></level></subparagraph></paragraph>

<paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-6" class="schProv1"><num>6</num><subparagraph eId="schedule-paragraph-6-1"><num>(1)</num><content><p>A person to whom a final penalty notice is given under <ref href="#schedule-paragraph-3">paragraph 3</ref> may appeal against the decision to give the notice on any of the grounds mentioned in <ref href="#schedule-paragraph-6-2">sub-paragraph (2)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><intro><p>The grounds are—</p></intro><level class="para1" eId="schedule-paragraph-6-2-a"><num>(a)</num><content><p>that the decision was based on an error of fact;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-b"><num>(b)</num><content><p>that the decision was wrong in law;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-c"><num>(c)</num><content><p>that the decision was unreasonable;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-d"><num>(d)</num><content><p>that the amount of penalty imposed by the notice is unreasonable.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-3"><num>(3)</num><intro><p>An appeal under this paragraph is—</p></intro><level class="para1" eId="schedule-paragraph-6-3-a"><num>(a)</num><content><p>in relation to a decision of a local weights and measures authority, to the First-tier Tribunal;</p></content></level><level class="para1" eId="schedule-paragraph-6-3-b"><num>(b)</num><content><p>in relation to a decision of the Department for the Economy in Northern Ireland, to a county court.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-4"><num>(4)</num><intro><p>On an appeal under this paragraph the tribunal or court may—</p></intro><level class="para1" eId="schedule-paragraph-6-4-a"><num>(a)</num><content><p>quash the final penalty notice,</p></content></level><level class="para1" eId="schedule-paragraph-6-4-b"><num>(b)</num><content><p>confirm the final penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-6-4-c"><num>(c)</num><content><p>vary the final penalty notice by reducing the amount of the penalty.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-5"><num>(5)</num><intro><p>Where an appeal under this paragraph is made—</p></intro><level class="para1" eId="schedule-paragraph-6-5-a"><num>(a)</num><content><p>the requirement to pay the monetary penalty is suspended pending the final determination or withdrawal of the appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-6-5-b"><num>(b)</num><content><p>no interest or other penalty is payable by virtue of <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-3">(3)</ref> in respect of the period during which that requirement is suspended.</p></content></level></subparagraph></paragraph>

class="schGroup7"><heading>Imposition of monetary penalties</heading><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2</num><subparagraph eId="schedule-paragraph-2-1"><num>(1)</num><content><p>Where an enforcement authority is satisfied beyond reasonable doubt that a person has committed an offence under <ref href="#section-1">section 1</ref> or <ref href="#section-2">2</ref> in the authority’s area, the authority may impose a monetary penalty on the person.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-2"><num>(2)</num><content><p>In this Schedule “<term refersTo="#term-monetary-penalty" eId="term-monetary-penalty">monetary penalty</term>” means a requirement to pay the enforcement authority a penalty of an amount determined by the authority.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-3"><num>(3)</num><content><p>In Northern Ireland, the amount of the penalty may not exceed an amount equivalent to level 5 on the standard scale.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" href="#schedule-paragraph-3">paragraph 3</ref> may appeal against the decision to give the notice on any of the grounds mentioned in <ref href="#schedule-paragraph-6-2">sub-paragraph (2)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><intro><p>The grounds are—</p></intro><level class="para1" eId="schedule-paragraph-6-2-a"><num>(a)</num><content><p>that the decision was based on an error of fact;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-b"><num>(b)</num><content><p>that the decision was wrong in law;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-c"><num>(c)</num><content><p>that the Fund a local weights and measures authority may deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-2-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary eId="schedule-paragraph-1-b"><num>(b)</num><content><p>the Department for the Economy in Northern Ireland.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e655"><heading>Imposition of monetary penalties</heading><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2</num><subparagraph eId="schedule-paragraph-2-1"><num>(1)</num><content><p>Where an enforcement authority is satisfied beyond reasonable doubt that a person has committed an offence under <ref href="#section-1">section 1</ref> or <ref href="#section-2">2</ref> in the authority’s area, the authority may impose a monetary penalty on the person.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-2"><num>(2)</num><content><p>In this Schedule “<term refersTo="#term-monetary-penalty" eId="term-monetary-penalty">monetary penalty</term>” means a requirement to pay the enforcement authority a penalty of an amount determined by the authority.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-3"><num>(3)</num><content><p>In Northern Ireland, the amount of the penalty may not exceed an amount equivalent to level 5 on the standard scale.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e690"><heading>Notices and representations</heading><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3</num><subparagraph eId="schedule-paragraph-3-1"><num>(1)</num><content><p>Where an enforcement authority proposes to impose a monetary penalty on a person the authority must give the person a notice of what is proposed (an “initial penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-2"><num>(2)</num><content><p>An initial penalty notice must offer the person the opportunity to avoid liability in relation to a monetary penalty by payment of a sum specified in the notice (which must be less than or equal to the amount of the proposed penalty).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-3"><num>(3)</num><content><p>The person may make written representations and objections to the enforcement authority in relation to the proposed imposition of the monetary penalty within the period of 28 days beginning with the day on which the initial penalty notice is given.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-4"><num>(4)</num><content><p>After the end of the period mentioned in <ref href="#schedule-paragraph-3-3">sub-paragraph (3)</ref> the enforcement authority must decide whether to give the person a notice imposing a monetary penalty (a “final penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-5"><num>(5)</num><content><p>The enforcement authority may not give a person a final penalty notice if the authority is no longer satisfied as mentioned in <ref href="#schedule-paragraph-2">paragraph 2</ref><ref href="#schedule-paragraph-2-1">(1)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-6"><num>(6)</num><intro><p>The penalty specified in the final penalty notice may <paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-1" class="schProv1"><num>1</num><intro><p>In this Schedule, “<term refersTo="#term-enforcement-authority" eId="term-enforcement-authority">enforcement authority</term>” means—</p></intro><level class="para1" eId="schedule-paragraph-1-a"><num>(a)</num><content><p>a local weights and measures authority in England, or</p></content></level><level class="para1" eId="schedule-paragraph-1-b"><num>(b)</num><content><p>the Department for the Economy in Northern Ireland.</p></content></level></paragraph>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="crossheading" class="schGroup7" eId="d25e630"><heading>Enforcement authority</heading><paragraph eId="schedule-paragraph-1" class="schProv1"><num>1</num><intro><p>In this Schedule, “<term refersTo="#term-enforcement-authority" eId="term-enforcement-authority">enforcement authority</term>” means—</p></intro><level class="para1" eId="schedule-paragraph-1-a"><num>(a)</num><content><p>a local weights and measures authority in England, or</p></content></level><level class="para1" eId="schedule-paragraph-1-b"><num>(b)</num><content><p>the Department for the Economy in Northern Ireland.</p></content></level></paragraph></hcontainer>
<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><intro><p>“<term refersTo="#term-appropriate-national-legislation" eId="term-appropriate-national-legislation">appropriate national legislation</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to England, the Animal Welfare Act 2006;</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to Northern Ireland, the <ref eId="c00003" href="http://www.legislation.gov.uk/id/nia/2011/16">Welfare of Animals Act (Northern Ireland) 2011 (c. 16 (N.I.)</ref>);</p></content></level></hcontainer>
<paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-2" class="schProv1"><num>2</num><subparagraph eId="schedule-paragraph-2-1"><num>(1)</num><content><p>Where an enforcement authority is satisfied beyond reasonable doubt that a person has committed an offence under <ref href="#section-1">section 1</ref> or <ref href="#section-2">2</ref> in the authority’s area, the authority may impose a monetary penalty on the person.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-2"><num>(2)</num><content><p>In this Schedule “<term refersTo="#term-monetary-penalty" eId="term-monetary-penalty">monetary penalty</term>” means a requirement to pay the enforcement authority a penalty of an amount determined by the authority.</p></content></subparagraph><subparagraph eId="schedule-paragraph-2-3"><num>(3)</num><content><p>In Northern Ireland, the amount of the penalty may not exceed an amount equivalent to level 5 on the standard scale.</p></content></subparagraph></paragraph>
<paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-5" class="schProv1"><num>5</num><subparagraph eId="schedule-paragraph-5-1"><num>(1)</num><intro><p>Where an initial penalty notice is given to a person (and has not been withdrawn)—</p></intro><level class="para1" eId="schedule-paragraph-5-1-a"><num>(a)</num><content><p>no criminal proceedings for the relevant offence may be instituted against the person in respect of the act or omission to which the notice relates before the end of the period within which the person’s liability may be avoided as mentioned in <ref href="#schedule-paragraph-3">paragraph 3</ref><ref href="#schedule-paragraph-3-2">(2)</ref> (see <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-1">(1)</ref><ref href="#schedule-paragraph-4-1-c">(c)</ref>);</p></content></level><level class="para1" eId="schedule-paragraph-5-1-b"><num>(b)</num><content><p>if the liability is so avoided the person may not at any time be convicted of the relevant offence in relation to that act or omission.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-5-2"><num>(2)</num><content><p>Where a final penalty notice is given to a person (and has not been withdrawn), the person may not at any time be convicted of the relevant offence in respect of the act or omission to which the notice relates.</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-3"><num>(3)</num><content><p>In this paragraph “<term refersTo="#term-relevant-offence" eId="term-relevant-offence">relevant offence</term>” means an offence under <ref href="#section-1">section 1</ref> or <ref href="#section-2">2</ref> in respect of which the monetary penalty is proposed to be imposed or is imposed (as the case may be).</p></content></subparagraph></paragraph>
<paragraph xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="schedule-paragraph-8" class="schProv1"><num>8</num><intro><p>If a person does not pay the whole or any part of a penalty which the person is liable to pay under this Schedule (including an amount payable by virtue of <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-3">(3)</ref>), the penalty or part of the penalty is recoverable—</p></intro><level class="para1" eId="schedule-paragraph-8-a"><num>(a)</num><content><p>in the case of a penalty imposed by a local weights and measures authority, as if it were payable under an order of the county court,</p></content></level><level class="para1" eId="schedule-paragraph-8-b"><num>(b)</num><content><p>in the case of a penalty imposed by the Department for the Economy in Northern Ireland, as if it were payable under an order of a county court in Northern Ireland.</p></content></level></paragraph>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="crossheading" class="schGroup7" eId="d25e690"><heading>Notices and representations</heading><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3</num><subparagraph eId="schedule-paragraph-3-1"><num>(1)</num><content><p>Where an enforcement authority proposes to impose a monetary penalty on a person the authority must give the person a notice of what is proposed (an “initial penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-2"><num>(2)</num><content><p>An initial penalty notice must offer the person the opportunity to avoid liability in relation to a monetary penalty by payment of a sum specified in the notice (which must be less than or equal to the amount of the proposed penalty).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-3"><num>(3)</num><content><p>The person may make written representations and objections to the enforcement authority in relation to the proposed imposition of the monetary penalty within the period of 28 days beginning with the day on which the initial penalty notice is given.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-4"><num>(4)</num><content><p>After the end of the period mentioned in <ref href="#schedule-paragraph-3-3">sub-paragraph (3)</ref> the enforcement authority must decide whether to give the person a notice imposing a monetary penalty (a “final penalty notice”).</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-5"><num>(5)</num><content><p>The enforcement authority may not give a person a final penalty notice if the authority is no longer satisfied as mentioned in <ref href="#schedule-paragraph-2">paragraph 2</ref><ref href="#schedule-paragraph-2-1">(1)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-3-6"><num>(6)</num><intro><p>The penalty specified in the final penalty notice may be—</p></intro><level class="para1" eId="schedule-paragraph-3-6-a"><num>(a)</num><content><p>a penalty of the amount proposed in the initial penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-3-6-b"><num>(b)</num><content><p>a penalty of a smaller amount.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-3-7"><num>(7)</num><content><p>An initial or final penalty notice may be withdrawn at any time by the enforcement authority that issued it.</p></content></subparagraph></paragraph></hcontainer>
<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="crossheading" class="schGroup7" eId="d25e760"><heading>Information to be included in notices under <ref href="#schedule-paragraph-3">paragraph 3</ref></heading><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4</num><subparagraph eId="schedule-paragraph-4-1"><num>(1)</num><intro><p>An initial penalty notice must include information as to—</p></intro><level class="para1" eId="schedule-paragraph-4-1-a"><num>(a)</num><content><p>the grounds for the proposal to impose the monetary penalty,</p></content></level><level class="para1" eId="schedule-paragraph-4-1-b"><num>(b)</num><content><p>the effect of payment of the sum mentioned in <ref href="#schedule-paragraph-3">paragraph 3</ref><ref href="#schedule-paragraph-3-2">(2)</ref>,</p></content></level><level class="para1" eId="schedule-paragraph-4-1-c"><num>(c)</num><content><p>the period within which payment may be made so as to avoid liability for a monetary penalty (which must be at least 28 days beginning with the day on which the notice is given),</p></content></level><level class="para1" eId="schedule-paragraph-4-1-d"><num>(d)</num><content><p>the right to make representations and objections within the period of 28 days beginning with the day on which the notice is given, and</p></content></level><level class="para1" eId="schedule-paragraph-4-1-e"><num>(e)</num><content><p>the effect of <ref href="#schedule-paragraph-3">paragraph 3</ref><ref href="#schedule-paragraph-3-5">(5)</ref>.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-4-2"><num>(2)</num><intro><p>A final penalty notice must include information as to—</p></intro><level class="para1" eId="schedule-paragraph-4-2-a"><num>(a)</num><content><p>the grounds for imposing the monetary penalty,</p></content></level><level class="para1" eId="schedule-paragraph-4-2-b"><num>(b)</num><content><p>how payment may be made,</p></content></level><level class="para1" eId="schedule-paragraph-4-2-c"><num>(c)</num><content><p>the period within which payment is to be made (which must be at least 28 days beginning with the day on which the notice is given),</p></content></level><level class="para1" eId="schedule-paragraph-4-2-d"><num>(d)</num><content><p>rights of appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-4-2-e"><num>(e)</num><content><p>the consequences of non-payment.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-4-3"><num>(3)</num><content><p>A final penalty notice may provide for interest or other penalties specified in the notice to be payable in the event that payment is not made in the period referred to in <ref href="#schedule-paragraph-4-2">sub-paragraph (2)</ref><ref href="#schedule-paragraph-4-2-c">(c)</ref>.</p></content></subparagraph></paragraph></hcontainer>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="crossheading" class="schGroup7" eId="d25e922"><heading>Appeals</heading><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6</num><subparagraph eId="schedule-paragraph-6-1"><num>(1)</num><content><p>A person to whom a final penalty notice is given under <ref href="#schedule-paragraph-3">paragraph 3</ref> may appeal against the decision to give the notice on any of the grounds mentioned in <ref href="#schedule-paragraph-6-2">sub-paragraph (2)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><intro><p>The grounds are—</p></intro><level class="para1" eId="schedule-paragraph-6-2-a"><num>(a)</num><content><p>that the decision was based on an error of fact;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-b"><num>(b)</num><content><p>that the decision was wrong in law;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-c"><num>(c)</num><content><p>that the decision was unreasonable;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-d"><num>(d)</num><content><p>that the amount of penalty imposed by the notice is unreasonable.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-3"><num>(3)</num><intro><p>An appeal under this paragraph is—</p></intro><level class="para1" eId="schedule-paragraph-6-3-a"><num>(a)</num><content><p>in relation to a decision of a local weights and measures authority, to the First-tier Tribunal;</p></content></level><level class="para1" eId="schedule-paragraph-6-3-b"><num>(b)</num><content><p>in relation to a decision of the Department for the Economy in Northern Ireland, to a county court.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-4"><num>(4)</num><intro><p>On an appeal under this paragraph the tribunal or court may—</p></intro><level class="para1" eId="schedule-paragraph-6-4-a"><num>(a)</num><content><p>quash the final penalty notice,</p></content></level><level class="para1" eId="schedule-paragraph-6-4-b"><num>(b)</num><content><p>confirm the final penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-6-4-c"><num>(c)</num><content><p>vary the final penalty notice by reducing the amount of the penalty.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-5"><num>(5)</num><intro><p>Where an appeal under this paragraph is made—</p></intro><level class="para1" eId="schedule-paragraph-6-5-a"><num>(a)</num><content><p>the requirement to pay the monetary penalty is suspended pending the final determination or withdrawal of the appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-6-5-b"><num>(b)</num><content><p>no interest or other penalty is payable by virtue of <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-3">(3)</ref> in respect of the period during which that requirement is suspended.</p></content></level></subparagraph></paragraph></hcontainer>
<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="crossheading" class="schGroup7" eId="d25e1037"><heading>Use of proceeds</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7</num><subparagraph eId="schedule-paragraph-7-1"><num>(1)</num><content><p>Sums received by local weights and measures authorities pursuant to monetary penalties imposed under this Schedule must be paid into the Consolidated Fund.</p></content></subparagraph><subparagraph eId="schedule-paragraph-7-2"><num>(2)</num><intro><p>But before paying such sums into the Consolidated Fund a local weights and measures authority may deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-2-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary penalties imposed by the authority under this Schedule relate, and</p></content></level><level class="para1" eId="schedule-paragraph-7-2-b"><num>(b)</num><content><p>the costs of imposing the penalties.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-3"><num>(3)</num><intro><p>The Department for the Economy in Northern Ireland may, before paying sums received by the Department pursuant to monetary penalties imposed under this Schedule into the Consolidated Fund of Northern Ireland, deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-3-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary penalties imposed by the Department under this Schedule relate, and</p></content></level><level class="para1" eId="schedule-paragraph-7-3-b"><num>(b)</num><content><p>the costs of imposing the penalties.</p></content></level></subparagraph></paragraph></hcontainer>

eId="schedule-paragraph-3-6-a"><num>(a)</num><content><p>a penalty of the amount proposed in the initial penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-3-6-b"><num>(b)</num><content><p>a penalty of a smaller amount.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-3-7"><num>(7)</num><content><p>An initial or final penalty notice may be withdrawn at any time by the enforcement authority that issued it.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e760"><heading>Information to be included in notices under <ref href="#schedule-paragraph-3">paragraph 3</ref></heading><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4</num><subparagraph eId="schedule-paragraph-4-1"><num>(1)</num><intro><p>An initial penalty notice must include information as to—</p></intro><level class="para1" eId="schedule-paragraph-4-1-a"><num>(a)</num><content><p>the grounds for the proposal to impose the monetary penalty,</p></content></level><level class="para1" eId="schedule-paragraph-4-1-b"><num>(b)</num><content><p>the effect of payment of the sum mentioned in <ref href="#schedule-paragraph-3">paragraph 3</ref><ref href="#schedule-paragraph-3-2">(2)</ref>,</p></content></level><level class="para1" eId="schedule-paragraph-4-1-c"><num>(c)</num><content><p>the period within which payment may be made so as to avoid liability for a monetary penalty (which must be at least 28 days beginning with the day on which the notice is given),</p></content></level><level class="para1" eId="schedule-paragraph-4-1-d"><num>(d)</num><content><p>the right to make representations and objections within the period of 28 days beginning with the day on which the notice is given, and</p></content></level><level class="para1" eId="schedule-paragraph-4-1-e"><num>(e)</num><content><p>the effect of <ref href="#schedule-paragraph-3">paragraph 3</ref><ref href="#schedule-paragraph-3-5">(5)</ref>.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-4-2"><num>(2)</num><intro><p>A final penalty notice must include information as to—</p></intro><level class="para1" eId="schedule-paragraph-4-2-a"><num>(a)</num><content><p>the grounds for imposing the monetary penalty,</p></content></level><level class="para1" eId="schedule-paragraph-4-2-b"><num>(b)</num><content><p>how payment may be made,</p></content></level><level class="para1" eId="schedule-paragraph-4-2-c"><num>(c)</num><content><p>the period within which payment is to be made (which must be at least 28 days beginning with the day on which the notice is given),</p></content></level><level class="para1" eId="schedule-paragraph-4-2-d"><num>(d)</num><content><p>rights of appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-4-2-e"><num>(e)</num><content><p>the consequences of non-payment.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-4-3"><num>(3)</num><content><p>A final penalty notice may provide for interest or other penalties specified in the notice to be payable in the event that payment is not made in the period referred to in <ref href="#schedule-paragraph-4-2">sub-paragraph (2)</ref><ref href="#schedule-paragraph-4-2-c">(c)</ref>.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e863"><heading>Monetary penalties: criminal proceedings</heading><paragraph eId="schedule-paragraph-5" class="schProv1"><num>5</num><subparagraph eId="schedule-paragraph-5-1"><num>(1)</num><intro><p>Where an initial penalty notice is given to a person (and has not been withdrawn)—</p></intro><level class="para1" eId="schedule-paragraph-5-1-a"><num>(a)</num><content><p>no criminal proceedings for the relevant offence may be instituted against the person in respect of the act or omission to which the notice relates before the end of the period within which the person’s liability may be avoided as mentioned in <ref href="#schedule-paragraph-3">paragraph 3</ref><ref href="#schedule-paragraph-3-2">(2)</ref> (see <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-1">(1)</ref><ref href="#schedule-paragraph-4-1-c">(c)</ref>);</p></content></level><level class="para1" eId="schedule-paragraph-5-1-b"><num>(b)</num><content><p>if the liability is so avoided the person may not at any time be convicted of the relevant offence in relation to that act or omission.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-5-2"><num>(2)</num><content><p>Where a final penalty notice is given to a person (and has not been withdrawn), the person may not at any time be convicted of the relevant offence in respect of the act or omission to which the notice relates.</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-3"><num>(3)</num><content><p>In this paragraph “<term refersTo="#term-relevant-offence" eId="term-relevant-offence">relevant offence</term>” means an offence under <ref href="#section-1">section 1</ref> or <ref href="#section-2">2</ref> in respect of which the monetary penalty is proposed to be imposed or is imposed (as the case may be).</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e922"><heading>Appeals</heading><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6</num><subparagraph eId="schedule-paragraph-6-1"><num>(1)</num><content><p>A person to whom a final penalty notice is given under <ref href="#schedule-paragraph-3">paragraph 3</ref> may appeal against the decision to give the notice on any of the grounds mentioned in <ref href="#schedule-paragraph-6-2">sub-paragraph (2)</ref>.</p></content></subparagraph><subparagraph eId="schedule-paragraph-6-2"><num>(2)</num><intro><p>The grounds are—</p></intro><level class="para1" eId="schedule-paragraph-6-2-a"><num>(a)</num><content><p>that the decision was based on an error of fact;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-b"><num>(b)</num><content><p>that the decision was wrong in law;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-c"><num>(c)</num><content><p>that the decision was unreasonable;</p></content></level><level class="para1" eId="schedule-paragraph-6-2-d"><num>(d)</num><content><p>that the amount of penalty imposed by the notice is unreasonable.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-3"><num>(3)</num><intro><p>An appeal under this paragraph is—</p></intro><level class="para1" eId="schedule-paragraph-6-3-a"><num>(a)</num><content><p>in relation to a decision of a local weights and measures authority, to the First-tier Tribunal;</p></content></level><level class="para1" eId="schedule-paragraph-6-3-b"><num>(b)</num><content><p>in relation to a decision of the Department for the Economy in Northern Ireland, to a county court.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-4"><num>(4)</num><intro><p>On an appeal under this paragraph the tribunal or court may—</p></intro><level class="para1" eId="schedule-paragraph-6-4-a"><num>(a)</num><content><p>quash the final penalty notice,</p></content></level><level class="para1" eId="schedule-paragraph-6-4-b"><num>(b)</num><content><p>confirm the final penalty notice, or</p></content></level><level class="para1" eId="schedule-paragraph-6-4-c"><num>(c)</num><content><p>vary the final penalty notice by reducing the amount of the penalty.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-6-5"><num>(5)</num><intro><p>Where an appeal under this paragraph is made—</p></intro><level class="para1" eId="schedule-paragraph-6-5-a"><num>(a)</num><content><p>the requirement to pay the monetary penalty is suspended pending the final determination or withdrawal of the appeal, and</p></content></level><level class="para1" eId="schedule-paragraph-6-5-b"><num>(b)</num><content><p>no interest or other penalty is payable by virtue of <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-3">(3)</ref> in respect of the period during which that requirement is suspended.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1037"><heading>Use of proceeds</heading><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7</num><subparagraph eId="schedule-paragraph-7-1"><num>(1)</num><content><p>Sums received by local weights and measures authorities pursuant to monetary penalties imposed under this Schedule must be paid into the Consolidated Fund.</p></content></subparagraph><subparagraph eId="schedule-paragraph-7-2"><num>(2)</num><intro><p>But before paying such sums into the Consolidated Fund a local weights and measures authority may deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-2-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary penalties imposed by the authority under this Schedule relate, and</p></content></level><level class="para1" eId="schedule-paragraph-7-2-b"><num>(b)</num><content><p>the costs of imposing the penalties.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-7-3"><num>(3)</num><intro><p>The Department for the Economy in Northern Ireland may, before paying sums received by the Department pursuant to monetary penalties imposed under this Schedule into the Consolidated Fund of Northern Ireland, deduct—</p></intro><level class="para1" eId="schedule-paragraph-7-3-a"><num>(a)</num><content><p>the costs of investigating offences to which monetary penalties imposed by the Department under this Schedule relate, and</p></content></level><level class="para1" eId="schedule-paragraph-7-3-b"><num>(b)</num><content><p>the costs of imposing the penalties.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1087"><heading>Enforcement</heading><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8</num><intro><p>If a person does not pay the whole or any part of a penalty which the person is liable to pay under this Schedule (including an amount payable by virtue of <ref href="#schedule-paragraph-4">paragraph 4</ref><ref href="#schedule-paragraph-4-3">(3)</ref>), the penalty or part of the penalty is recoverable—</p></intro><level class="para1" eId="schedule-paragraph-8-a"><num>(a)</num><content><p>in the case of a penalty imposed by a local weights and measures authority, as if it were payable under an order of the county court,</p></content></level><level class="para1" eId="schedule-paragraph-8-b"><num>(b)</num><content><p>in the case of a penalty imposed by the Department for the Economy in Northern Ireland, as if it were payable under an order of a county court in Northern Ireland.</p></content></level></paragraph></hcontainer></hcontainer></hcontainer>
