<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1"><num>1</num><heading>Miniature rifle ranges and shooting galleries</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Firearms Act 1968 is amended as follows.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p><mod>In section 11 (use of firearms for sports, athletics and other approved activities), for subsection (4) substitute—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(3A)</num><content><p>Subsection <ref href="#d25e104">(4)</ref> applies to a person at a relevant rifle range or shooting gallery who is not the operator of the range or gallery.</p></content></subsection><subsection eId="d25e104"><num>(4)</num><intro><p>The person may, without holding a certificate, have in their possession—</p></intro><level class="para1"><num>(a)</num><content><p>a miniature rifle, and</p></content></level><level class="para1"><num>(b)</num><content><p>ammunition for a miniature rifle,</p></content></level><wrapUp><p>provided by the operator of the range or gallery.</p></wrapUp></subsection><subsection><num>(4A)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-miniature-rifle">miniature rifle</term>” means a rifle chambered for .22 rim-fire cartridges;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-operator">operator</term>” means the person conducting or carrying on the relevant rifle range or shooting gallery;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-rifle-range-or-shooting-gallery">relevant rifle range or shooting gallery</term>” means a rifle range or shooting gallery at which no firearms are used other than air weapons or miniature rifles.</p></content></hcontainer></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><mod>In section 23(2)(b) (use of weapons or ammunition at shooting gallery), for “miniature rifles not exceeding .23 inch calibre” substitute <quotedText>“rifles chambered for .22 rim-fire cartridges”</quotedText>.</mod></p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading>Possessing component parts of ammunition with intent to manufacture</heading><content><p><mod>In the Firearms Act 1968, after section 3 insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>3A</num><heading>Possessing component parts of ammunition with intent to manufacture</heading><subsection><num>(1)</num><intro><p>A person commits an offence if—</p></intro><level class="para1"><num>(a)</num><content><p>the person has in their possession any component parts of ammunition (see subsection <ref href="#d25e219">(2)</ref>),</p></content></level><level class="para1"><num>(b)</num><content><p>the person intends to manufacture ammunition to which section 1 applies using those parts, and</p></content></level><level class="para1"><num>(c)</num><intro><p>were the person to do so—</p></intro><level class="para2"><num>(i)</num><content><p>possession of the ammunition by the person would constitute an offence under section 1, or</p></content></level><level class="para2"><num>(ii)</num><content><p>the manufacture or possession of the ammunition by the person would constitute an offence under section 3. </p></content></level></level></subsection><subsection eId="d25e219"><num>(2)</num><intro><p>For the purposes of this section the component parts of ammunition are—</p></intro><level class="para1"><num>(a)</num><content><p>bullet;</p></content></level><level class="para1"><num>(b)</num><content><p>cartridge case;</p></content></level><level class="para1"><num>(c)</num><content><p>primer;</p></content></level><level class="para1"><num>(d)</num><content><p>propellant.</p></content></level></subsection><subsection><num>(3)</num><intro><p>A person who commits an offence under this section is liable—</p></intro><level class="para1"><num>(a)</num><content><p>on conviction on indictment, to imprisonment for a term not exceeding 5 years or a fine (or both);</p></content></level><level class="para1"><num>(b)</num><content><p>on summary conviction in England and Wales, to imprisonment for a term not exceeding the general limit in a magistrates’ court or a fine (or both);</p></content></level><level class="para1"><num>(c)</num><content><p>on summary conviction in Scotland, to imprisonment for a term not exceeding 12 months or a fine not exceeding the statutory maximum (or both).</p></content></level></subsection></section></quotedStructure></mod></p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Extent, commencement and short title</heading><subsection eId="section-3-1"><num>(1)</num><content><p>An amendment made by this Act has the same extent as the provision amended.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>Subject to that, this Act extends to England and Wales and Scotland.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>Sections <ref href="#section-1">1</ref> and <ref href="#section-2">2</ref> come into force on such day or days as the Secretary of State may by regulations made by statutory instrument appoint.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><intro><p>Regulations under subsection <ref href="#section-3-3">(3)</ref> may—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p>make transitional, transitory or saving provision;</p></content></level><level class="para1" eId="section-3-4-b"><num>(b)</num><content><p>make different provision for different purposes.</p></content></level></subsection><subsection eId="section-3-5"><num>(5)</num><content><p>This section comes into force on the day on which this Act is passed.</p></content></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>This Act may be cited as the Firearms Act 2023.</p></content></subsection></section>
