<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1"><num>1</num><heading>Employer duty to prevent sexual harassment of employees</heading><content><p><mod>After section 40 of the Equality Act 2010 insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e93"><num>40A</num><heading>Employer duty to prevent sexual harassment of employees</heading><subsection eId="d25e97"><num>(1)</num><content><p>An employer (A) must take reasonable steps to prevent sexual harassment of employees of A in the course of their employment.</p></content></subsection><subsection><num>(2)</num><content><p>“Sexual harassment” in <ref href="#d25e97">subsection (1)</ref> means harassment of the kind described in section 26(2) (unwanted conduct of a sexual nature).</p></content></subsection><subsection><num>(3)</num><content><p>A contravention of <ref href="#d25e97">subsection (1)</ref> (or a contravention of section 111 or 112 that relates to a contravention of <ref href="#d25e97">subsection (1)</ref>) is enforceable as an unlawful act under Part 1 of the Equality Act 2006 (and, by virtue of section 120(8) and (9), is enforceable only by the Commission under that Part or by an employment tribunal in accordance with <ref href="#d25e186">section 124A</ref> (compensation uplift in employee sexual harassment cases)).</p></content></subsection></section></quotedStructure></mod></p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-2"><num>2</num><heading>Enforcement of duty to prevent sexual harassment of employees</heading><intro><p>In section 120 of the Equality Act 2010 (jurisdiction of employment tribunal)—</p></intro><level class="para1" eId="section-2-a"><num>(a)</num><content><p><mod>in subsection (8), for “a reference to section” substitute <quotedText>“references to section <ref href="#d25e93">40A</ref><ref href="#d25e97">(1)</ref> or”</quotedText>;</mod></p></content></level><level class="para1" eId="section-2-b"><num>(b)</num><content><p><mod>after that subsection insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(9)</num><content><p>Subsection (8) does not prevent an employment tribunal from considering a contravention of <ref href="#d25e93">section 40A</ref><ref href="#d25e97">(1)</ref> in accordance with <ref href="#d25e186">section 124A</ref> (compensation uplift in employee sexual harassment cases).</p></content></subsection></quotedStructure></mod></p></content></level></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-3"><num>3</num><heading>Sexual harassment of employees: compensation uplift</heading><content><p><mod>After section 124 of the Equality Act 2010 insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e186"><num>124A</num><heading>Remedies: compensation uplift in sexual harassment cases</heading><subsection><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1"><num>(a)</num><content><p>an employment tribunal has found that there has been a contravention of section 40 (harassment of employees) which involved, to any extent, harassment of the kind described in section 26(2) (sexual harassment), and</p></content></level><level class="para1"><num>(b)</num><content><p>the tribunal has ordered the respondent to pay compensation to the complainant under section 124(2)(b).</p></content></level></subsection><subsection><num>(2)</num><content><p>The tribunal must consider whether and to what extent the respondent has also contravened <ref href="#d25e93">section 40A</ref><ref href="#d25e97">(1)</ref> (duty to take reasonable steps to prevent harassment of employees).</p></content></subsection><subsection><num>(3)</num><content><p>If the tribunal is satisfied that the respondent has contravened <ref href="#d25e93">section 40A</ref><ref href="#d25e97">(1)</ref>, it may order the respondent to pay an amount to the complainant (a “compensation uplift”) in addition to the compensation amount determined in accordance with section 124(6).</p></content></subsection><subsection><num>(4)</num><intro><p>The amount of the compensation uplift—</p></intro><level class="para1"><num>(a)</num><content><p>must reflect the extent to which, in the tribunal’s opinion, the respondent has contravened <ref href="#d25e93">section 40A</ref><ref href="#d25e97">(1)</ref>, but</p></content></level><level class="para1"><num>(b)</num><content><p>may be no more than 25% of the amount awarded under section 124(2)(b).</p></content></level></subsection></section></quotedStructure></mod></p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-4"><num>4</num><heading>Consequential amendments to the Equality Act 2006</heading><subsection eId="section-4-1"><num>(1)</num><content><p>Part 1 of the Equality Act 2006 (the Commission for Equality and Human Rights) is amended as follows.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p><mod>In section 21 (unlawful act notice), after subsection (7) insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(8)</num><intro><p>Subsection (7) applies as though a claim could be made to an employment tribunal in respect of—</p></intro><level class="para1"><num>(a)</num><content><p>an alleged contravention of section <ref href="#d25e93">40A</ref><ref href="#d25e97">(1)</ref> of the Equality Act 2010 (duty to take reasonable steps to prevent harassment of employees), or</p></content></level><level class="para1"><num>(b)</num><content><p>an alleged contravention of section 111 or 112 of that Act which relates to a contravention of section <ref href="#d25e93">40A</ref><ref href="#d25e97">(1)</ref> of that Act.</p></content></level></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-4-3"><num>(3)</num><content><p><mod>In section 24A (enforcement powers: supplemental), in subsection (1), after paragraph (a) insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><level class="para1"><num>(aa)</num><content><p>an act which is unlawful because it amounts to a contravention of <ref href="#d25e93">section 40A</ref><ref href="#d25e97">(1)</ref> of that Act (or to a contravention of section 111 or 112 of that Act that relates to a contravention of <ref href="#d25e93">section 40A</ref><ref href="#d25e97">(1)</ref> of that Act) (employer duty to take reasonable steps to prevent sexual harassment of employees),</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-5"><num>5</num><heading>Extent, commencement and short title</heading><subsection eId="section-5-1"><num>(1)</num><content><p>This Act extends to England and Wales and Scotland.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>This section comes into force on the day on which this Act is passed.</p></content></subsection><subsection eId="section-5-3"><num>(3)</num><content><p>Sections <ref href="#section-1">1</ref> to <ref href="#section-4">4</ref> come into force at the end of the period of one year beginning with the day on which this Act is passed.</p></content></subsection><subsection eId="section-5-4"><num>(4)</num><content><p>This Act may be cited as the Worker Protection (Amendment of Equality Act 2010) Act 2023.</p></content></subsection></section>
