Pedicabs (London) Act 2024

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1"><num>1</num><heading>Power to regulate pedicabs</heading><subsection eId="section-1-1"><num>(1)</num><content><p>Transport for London may make regulations for the purpose of regulating pedicabs in public places in Greater London.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>In this Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-pedicab" eId="term-pedicab">pedicab</term>” means a pedal cycle, or a pedal cycle in combination with a trailer, that is constructed or adapted for carrying one or more passengers and is made available with a driver for hire or reward;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-pedicab-regulations" eId="term-pedicab-regulations">pedicab regulations</term>” means regulations under <ref href="#section-1-1">subsection (1)</ref>.</p></content></hcontainer></subsection><subsection eId="section-1-3"><num>(3)</num><content><p>Before making pedicab regulations, Transport for London must consult whoever it considers appropriate.</p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Licences, fares and other matters</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>Pedicab regulations may make provision for the licensing by Transport for London of pedicabs, their drivers or their operators, including provision about—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>conditions of licences;</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>the duration, renewal, variation, suspension or revocation of licences;</p></content></level><level class="para1" eId="section-2-1-c"><num>(c)</num><content><p>the display or production of licences.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>Pedicab regulations that make provision about the licensing of drivers or operators of pedicabs must include provision corresponding to the provision made by the Private Hire Vehicles (London) Act 1998 in relation to immigration status.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>Pedicab regulations may provide for a fee to be payable—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>by an applicant for a licence or an applicant for variation or renewal of a licence;</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>by a person who is granted a licence or whose licence is varied or renewed.</p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><content><p>The fees may be set at a level that enables the recovery of any costs incurred by Transport for London by virtue of the regulations.</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><intro><p>Pedicab regulations may make provision about fares for pedicabs, including provision about—</p></intro><level class="para1" eId="section-2-5-a"><num>(a)</num><content><p>what fares may be charged;</p></content></level><level class="para1" eId="section-2-5-b"><num>(b)</num><content><p>when and how passengers are to be made aware of fares;</p></content></level><level class="para1" eId="section-2-5-c"><num>(c)</num><content><p>methods of payment.</p></content></level></subsection><subsection eId="section-2-6"><num>(6)</num><intro><p>Pedicab regulations may make provision about—</p></intro><level class="para1" eId="section-2-6-a"><num>(a)</num><content><p>eligibility requirements for drivers or operators of pedicabs;</p></content></level><level class="para1" eId="section-2-6-b"><num>(b)</num><content><p>the quality, roadworthiness or cleanliness of pedicabs;</p></content></level><level class="para1" eId="section-2-6-c"><num>(c)</num><content><p>safety requirements or insurance requirements;</p></content></level><level class="para1" eId="section-2-6-d"><num>(d)</num><content><p>equipment that may or must be carried on pedicabs;</p></content></level><level class="para1" eId="section-2-6-e"><num>(e)</num><content><p>the appearance or marking of pedicabs;</p></content></level><level class="para1" eId="section-2-6-f"><num>(f)</num><content><p>the testing of pedicabs;</p></content></level><level class="para1" eId="section-2-6-g"><num>(g)</num><content><p>speed restrictions;</p></content></level><level class="para1" eId="section-2-6-h"><num>(h)</num><content><p>the working conditions of drivers;</p></content></level><level class="para1" eId="section-2-6-i"><num>(i)</num><content><p>the conduct of drivers (including, in particular, provision about making noise).</p></content></level></subsection><subsection eId="section-2-7"><num>(7)</num><intro><p>Pedicab regulations may—</p></intro><level class="para1" eId="section-2-7-a"><num>(a)</num><intro><p>prohibit drivers from using pedicabs for standing or plying for hire—</p></intro><level class="para2" eId="section-2-7-a-i"><num>(i)</num><content><p>in specified places,</p></content></level><level class="para2" eId="section-2-7-a-ii"><num>(ii)</num><content><p>at specified times, or</p></content></level><level class="para2" eId="section-2-7-a-iii"><num>(iii)</num><content><p>in other specified circumstances;</p></content></level></level><level class="para1" eId="section-2-7-b"><num>(b)</num><content><p>make provision to prevent pedicabs from operating in specified places, at specified times or in other specified circumstances;</p></content></level><level class="para1" eId="section-2-7-c"><num>(c)</num><content><p>make provision to restrict the number of pedicabs operating in specified places or at specified times.</p></content></level></subsection><subsection eId="section-2-8"><num>(8)</num><content><p>Pedicab regulations may make provision for Transport for London to make publicly available information about licences or the pedicabs, operators or drivers to which they relate.</p></content></subsection><subsection eId="section-2-9"><num>(9)</num><content><p>Pedicab regulations may impose requirements on drivers or operators of pedicabs.</p></content></subsection><subsection eId="section-2-10"><num>(10)</num><intro><p>Pedicab regulations may—</p></intro><level class="para1" eId="section-2-10-a"><num>(a)</num><content><p>confer a discretion on Transport for London;</p></content></level><level class="para1" eId="section-2-10-b"><num>(b)</num><content><p>confer power on Transport for London to authorise others to carry out functions under the regulations on their behalf.</p></content></level></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Enforcement</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>Pedicab regulations may create offences relating to—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>the provision of false or misleading information in connection with applications for licences, or the renewal or variation of licences, or decisions about licences;</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>failure to comply with requirements, prohibitions or restrictions imposed by the regulations.</p></content></level></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>The regulations—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>must provide for any offences to be triable summarily only, and</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>may only provide for offences to be punishable with a fine not exceeding a level on the standard scale specified in the regulations, which may not exceed level 4 (but this limitation does not apply to provision made for the purpose of complying with <ref href="#section-2">section 2</ref><ref href="#section-2-2">(2)</ref>).</p></content></level></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>The regulations may make provision for or in connection with the giving of fixed penalty notices in respect of offences under <ref href="#section-3-1">subsection (1)</ref>.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>In <ref href="#section-3-3">subsection (3)</ref> “<term refersTo="#term-fixed-penalty-notice" eId="term-fixed-penalty-notice">fixed penalty notice</term>” means a notice giving a person accused of an offence an opportunity to discharge any liability to conviction for that offence by payment of a fixed penalty.</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><intro><p>The regulations may—</p></intro><level class="para1" eId="section-3-5-a"><num>(a)</num><content><p>make provision authorising Transport for London to impose civil penalties in respect of conduct described in <ref href="#section-3-1">subsection (1)</ref> (as well as, or instead of, provision for the conduct to be an offence);</p></content></level><level class="para1" eId="section-3-5-b"><num>(b)</num><content><p>make provision for the enforcement of such penalties.</p></content></level></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>Pedicab regulations may authorise the immobilisation, seizure, retention and disposal of pedicabs that contravene, or are used in contravention of, the regulations.</p></content></subsection><subsection eId="section-3-7"><num>(7)</num><content><p>Pedicab regulations may confer functions on a constable in connection with the enforcement of the regulations.</p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4"><num>4</num><heading>Appeals</heading><subsection eId="section-4-1"><num>(1)</num><intro><p>Pedicab regulations must provide for a person to whom any relevant decision relates to have the right—</p></intro><level class="para1" eId="section-4-1-a"><num>(a)</num><content><p>to request that the decision is reconsidered, and</p></content></level><level class="para1" eId="section-4-1-b"><num>(b)</num><content><p>to appeal to a magistrates’ court.</p></content></level></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>Pedicab regulations may confer further rights to request that decisions are reconsidered, or to appeal.</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><intro><p>A “<term refersTo="#term-relevant-decision" eId="term-relevant-decision">relevant decision</term>” means—</p></intro><level class="para1" eId="section-4-3-a"><num>(a)</num><content><p>a decision to refuse to grant, renew or vary a licence;</p></content></level><level class="para1" eId="section-4-3-b"><num>(b)</num><content><p>a decision to vary, suspend or revoke a licence;</p></content></level><level class="para1" eId="section-4-3-c"><num>(c)</num><content><p>a decision to impose a licence condition when granting or renewing a licence;</p></content></level><level class="para1" eId="section-4-3-d"><num>(d)</num><content><p>a decision to impose a civil penalty;</p></content></level><level class="para1" eId="section-4-3-e"><num>(e)</num><content><p>a decision to take action under provision made by virtue of <ref href="#section-3">section 3</ref><ref href="#section-3-6">(6)</ref>.</p></content></level></subsection><subsection eId="section-4-4"><num>(4)</num><intro><p>The regulations may make further provision about reconsideration or appeals, including—</p></intro><level class="para1" eId="section-4-4-a"><num>(a)</num><content><p>procedural provision (including time limits);</p></content></level><level class="para1" eId="section-4-4-b"><num>(b)</num><intro><p>provision for a licence to remain in force until—</p></intro><level class="para2" eId="section-4-4-b-i"><num>(i)</num><content><p>the period allowed for making a request for the reconsideration of a decision has expired and, if a request is made, the decision has been reconsidered, and</p></content></level><level class="para2" eId="section-4-4-b-ii"><num>(ii)</num><content><p>the period allowed for appealing has expired and, if an appeal is made, the appeal has been finally disposed of;</p></content></level></level><level class="para1" eId="section-4-4-c"><num>(c)</num><content><p>provision prohibiting Transport for London or another person from taking specified action during any such period.</p></content></level></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-5"><num>5</num><heading>Exclusion from private hire vehicles legislation</heading><intro><p>In section 36 of the Private Hire Vehicles (London) Act 1998 (interpretation)—</p></intro><level class="para1" eId="section-5-a"><num>(a)</num><content><p><mod>in the definition of “vehicle”, for “(other than a tramcar)” substitute <quotedText>“, other than a power-assisted pedicab or a tramcar,”</quotedText>;</mod></p></content></level><level class="para1" eId="section-5-b"><num>(b)</num><content><p><mod>at the appropriate place insert—<quotedStructure startQuote="&#x201C;" endQuote="&#x201D;" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="definition"><content><p>“<term refersTo="#term-power-assisted-pedicab">power-assisted pedicab</term>” means a power-assisted pedal cycle, or a power-assisted pedal cycle in combination with a trailer, that is constructed or adapted for carrying one or more passengers (and for this purpose “<term refersTo="#term-trailer">trailer</term>” has the same meaning as in the Pedicabs (London) Act 2024 (see <ref href="#section-8">section 8</ref> of that Act));</p></content></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-6"><num>6</num><heading>Procedure for pedicab regulations</heading><subsection eId="section-6-1"><num>(1)</num><content><p>The power to make pedicab regulations is exercisable by statutory instrument.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><content><p>The Statutory Instruments Act 1946 applies to an instrument containing regulations under this Act as if they had been made by a Minister of the Crown.</p></content></subsection><subsection eId="section-6-3"><num>(3)</num><intro><p>Pedicab regulations—</p></intro><level class="para1" eId="section-6-3-a"><num>(a)</num><content><p>may make different provision for different purposes;</p></content></level><level class="para1" eId="section-6-3-b"><num>(b)</num><content><p>may contain incidental, supplemental, consequential, transitional or saving provision.</p></content></level></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-7"><num>7</num><heading>Guidance</heading><subsection eId="section-7-1"><num>(1)</num><content><p>The Secretary of State may issue guidance to Transport for London about the exercise of their functions under pedicab regulations.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p>The guidance may, in particular, include guidance about how those functions may be exercised so as to protect children, and vulnerable individuals who are 18 or over, from harm.</p></content></subsection><subsection eId="section-7-3"><num>(3)</num><content><p>The Secretary of State may revise any guidance issued under this section.</p></content></subsection><subsection eId="section-7-4"><num>(4)</num><content><p>The Secretary of State must arrange for any guidance issued under this section, and any revision of it, to be published.</p></content></subsection><subsection eId="section-7-5"><num>(5)</num><content><p>Transport for London, and any person authorised by them to carry out functions under pedicab regulations on their behalf, must have regard to any guidance issued under this section when exercising their functions under the regulations.</p></content></subsection><subsection eId="section-7-6"><num>(6)</num><content><p>Before issuing guidance under this section the Secretary of State must consult whoever the Secretary of State considers appropriate.</p></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-8"><num>8</num><heading>Interpretation</heading><subsection eId="section-8-1"><num>(1)</num><intro><p>In this Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-civil-penalty" eId="term-civil-penalty">civil penalty</term>” means a civil penalty under pedicab regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-licence" eId="term-licence">licence</term>” means a licence under pedicab regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-pedal-cycle" eId="term-pedal-cycle">pedal cycle</term>” includes a power-assisted pedal cycle;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-pedicab" eId="term-pedicab">pedicab</term>” has the meaning given by <ref href="#section-1">section 1</ref><ref href="#section-1-2">(2)</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-pedicab-regulations" eId="term-pedicab-regulations">pedicab regulations</term>” has the meaning given by <ref href="#section-1">section 1</ref><ref href="#section-1-2">(2)</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-public-place" eId="term-public-place">public place</term>” means a place to which the public have access (whether or not on payment);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-specified" eId="term-specified">specified</term>” means specified in, or determined in accordance with, pedicab regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-trailer" eId="term-trailer">trailer</term>”, in relation to a pedal cycle, includes a sidecar or a vehicle pushed by a pedal cycle.</p></content></hcontainer></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>In section 2(2) “<term refersTo="#term-provision-made-by-the-private-hire-vehicles-london-act-1998-in-relation-to-immigration-status" eId="term-provision-made-by-the-private-hire-vehicles-london-act-1998-in-relation-to-immigration-status">provision made by the Private Hire Vehicles (London) Act 1998 in relation to immigration status</term>” means the following provisions of that Act—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>section 3(3)(aa) and (3A),</p></item><item><p>section 3A(1) to (7),</p></item><item><p>section 13(2)(aa) and (2A),</p></item><item><p>section 13A(1) to (7),</p></item><item><p>section 16(2)(aa), (2A), (4)(aa) and (5),</p></item><item><p>section 25(8),</p></item><item><p>section 35A, and</p></item><item><p>section 35B.</p></item></blockList></content></subsection></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-9"><num>9</num><heading>Commencement</heading><content><p>This Act comes into force at the end of the period of two months beginning with the day on which it is passed.</p></content></section>
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-10"><num>10</num><heading>Extent</heading><content><p>This Act extends to England and Wales.</p></content></section>
