<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-2-b"><num>(b)</num><content><p>the offence was prosecuted by the Post Office or the Crown Prosecution Service, and</p></content></level>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Meaning of “relevant offence”</heading><subsection eId="section-2-1"><num>(1)</num><content><p>For the purposes of this Act, an offence alleged to have been committed by a person is a “relevant off
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-1"><num>(1)</num><content><p>For the purposes of this Act, an offence alleged to have been committed by a person is a “relevant offence” if conditions A to E are met.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><intro><p>Condition A is that the offence was alleged to have been committed—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>on a date or dates falling within the perio

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-d"><num>(d)</num><content><p>money laundering;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-e"><num>(e)</num><content><p>theft;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-f"><num>(f)</num><content><p>an ancillary offence relating to any of those offences (see subsection <ref href="#section-2-7">(7)</ref>).</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><intro><p>Condition C is that, at the time of the alleged offence, the person—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>was carrying on a post office business, or
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-a"><num>(a)</num><content><p>was carrying on a post office business, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-b"><num>(b)</num><content><p>was working in a post office (whether under a contract of employment or otherwise) for the purposes of a post office business.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><content><p>Condition D is that the person was alleged to have committed the offence in connection with carrying on, or working for the purposes of, the post office business.</p></content></subsectio

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content><p>“<term refersTo="#term-relevant-offence" eId="term-relevant-offence">relevant offence</term>” has the meaning given by section <ref href="#section-2">2</ref>.</p></content></hcontainer>

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3"><num>3</num><heading>Determining when a conviction has been considered by Court of Appeal</heading><subsection eId="section-3-1"><num>(1)</num><content><p>For the purposes of this Act, a conviction has been considered
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><content><p>For the purposes of this Act, a conviction has been considered by the Court of Appeal only if one of the cases in subsections <ref href="#section-3-2">(2)</ref> to <ref href="#section-3-4
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><content><p>The first case is where the Court of Appeal has dismissed an appeal against the conviction.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><content><p>The second case is where the Court of Appeal has refused to give leave to appeal against the conviction.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><intro><p>The third case is where—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p>a single judge of the Court of Appeal has refused to give leave to appeal against the
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-4-a"><num>(a)</num><content><p>a single judge of the Court of Appeal has refused to give leave to appeal against the conviction, and</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-4-b"><num>(b)</num><content><p>the Court of Appeal has not subsequently given leave to appeal against the conviction.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-5"><num>(5)</num><content><p>Nothing in this Act prevents a further appeal against a conviction that has been considered by the Court of Appeal.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-6"><num>(6)</num><intro><p>In this section “<term refersTo="#term-the-court-of-appeal" eId="term-the-court-of-appeal">the Court of Appeal</term>” means—</p></intro><level class="para1" eId="section-3-6-a"><num>(a)</n

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4"><num>4</num><heading>Identification and notification of quashed convictions</heading><subsection eId="section-4-1"><num>(1)</num><content><p>The appropriate authority must take all reasonable steps to identify the conv

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-3"><num>(3)</num><content><p>Where the appropriate authority identifies that a person’s conviction has been quashed by section <ref href="#section-1">1</ref><ref href="#section-1-1">(1)</ref>, the authority must noti
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-4"><num>(4)</num><content><p>As soon as is reasonably practicable after receiving notification under subsection <ref href="#section-4-3">(3)</ref>, the convicting court must enter, instead of the record of conviction
