eId="section-2"><num>2</num><heading>Future provision of services</heading><subsection eId="section-2-1"><num>(1)</num><content><p>The Railways Act 1993 is amended as follows.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>In section 30 (duty of relevant franchising authority in absence of franchise)—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>in subsection (1)(b) omit from “but” to the end;</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p><mod>for subsection (2) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e263"><num>(1A)</num><content><p>The relevant franchising authority may secure the provision of services for the purpose of fulfilling the duty under subsection (1) only by making a direct award of a public service contract to a public sector company in accordance with regulation 17 (general direct award provision for rail) of the 2023 Regulations.</p></content></subsection><subsection><num>(1B)</num><content><p>Regulation 22 (pre-award publication) of the 2023 Regulations does not apply in relation to an award made as mentioned in <ref href="#d25e263">subsection (1A)</ref>.</p></content></subsection><subsection><num>(1C)</num><content><p>The duty in subsection (1) does not apply in respect of services at any time when they are being provided under <ref href="#d25e308">section 30A</ref> (temporary continuation of existing franchises).</p></content></subsection></quotedStructure><inline of existing franchises</heading><subsection><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1"><num>(a)</num><content><p>the Secretary of State is the appropriate franchising authority in relation to a franchise agreement (“<term refersTo="#term-the-existing-agreement">the existing agreement</term>”), and</p></content></level><level class="para1"><num>(b)</num><content><p>the Secretary of State is satisfied that it will not be reasonably practicable to provide, or secure the provision of, the franchised services under section 30(1) when the existing agreement comes to an end.</p></content></level></subsection><subsection eId="d25e333"><num>(2)</num><intro><p>Where this section applies—</p></intro><level class="para1"><num>(a)</num><content><p>the Secretary of State may enter into a new franchise agreement (“<term refersTo="#term-the-new-agreement">the new agreement</term>”) for the provision of the services, or</p></content></level><level class="para1" eId="d25e348"><num>(b)</num><content><p>the franchise term in relation to the existing agreement may be extended.</p></content></level></subsection><subsection><num>(3)</num><intro><p>The Secretary of State may enter into the new agreement only if—</p></intro><level class="para1"><num>(a)</num><content><p>the franchise term in relation to the new agreement is to begin immediately after the end of the franchise period in relation to the existing agreement, and</p></content></level><level class="para1"><num>(b)</num><content><p>the franchisee in relation to the new agreement is to be the same person as the franchisee in relation to the existing agreement.</p></content></level></subsection><subsection><num>(4)</num><content><p>The Secretary of State may by regulations repeal this section and <ref href="#d25e386">section 30B</ref>.</p></content></subsection></section><section eId="d25e386"><num>30B</num><heading>Agreements and extensions under <ref href="#d25e308">section 30A</ref></heading><subsection><num>(1)</num><content><p>A franchise agreement may be entered into under <ref href="#d25e308">section 30A</ref> only by making a direct award of a public service contract in accordance with regulation 16 (emergency measures) of the 2023 Regulations.</p></content></subsection><subsection><num>(2)</num><content><p>A franchise term may be extended under <ref href="#d25e308">section 30A</ref> only by means of a formal agreement to extend such a contract in accordance with regulation 16 of the 2023 Regulations.</p></content></subsection><subsection><num>(3)</num><content><p>For the purposes of this section the Secretary of State is to be treated as being entitled to take emergency measures under regulation 16 of the 2023 Regulations whether or not the requirements of paragraph (1) of that regulation are met.</p></content></subsection></section><section eId="d25e420"><num>30C</num><heading>Sections 30 to <ref href="#d25e386"> 30B</ref>: supplementary</heading><subsection><num>(1)</num><intro><p>In sections 30 to <ref href="#d25e386">30B</ref> and this section—</p></intro><level class="para1"><num>(a)</num><content><p>“<term refersTo="#term-direct-award">direct award</term>” and “<term refersTo="#term-public-service-contract">public service contract</term>” have the same meanings as in the 2023 Regulations (see regulation 2(1));</p></content></level><level class="para1"><num>(b)</num><intro><p>“<term refersTo="#term-public-sector-company">public sector company</term>” means a company that is—</p></intro><level class="para2"><num>(i)</num><content><p>wholly owned by the Secretary of State, the Welsh Ministers or the Scottish Ministers,</p></content></level><level class="para2"><num>(ii)</num><content><p>jointly owned by the Secretary of State and the Welsh Ministers, or</p></content></level><level class="para2"><num>(iii)</num><content><p>jointly owned by the Secretary of State and the Scottish Ministers;</p></content></level></level><level class="para1"><num>(c)</num><content><p>“<term refersTo="#term-the-2023-regulations">the 2023 Regulations</term>” means the Public Service Obligations in Transport Regulations 2023 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2023/1369">S.I. 2023/1369</ref>).</p></content></level></subsection><subsection><num>(2)</num><content><p>Subsections (4) and (5) of section 58 of the Railways Act 2005 (meaning of “<term refersTo="#term-wholly-owned">wholly owned</term>” and “<term refersTo="#term-jointly-owned">jointly owned</term>”) apply for the purposes of this section as they apply for the purposes of that Act.</p></content></subsection></section></quotedStructure></mod></p></content></subsection></section>
