disclosure</heading><subsection eId="section-2-1"><num>(1)</num><content><p>The <ref eId="c00002" href="https://www.legislation.gov.uk/ukpga/1996/23">Arbitration Act 1996</ref> is amended as follows.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p><mod>After <a href="https://www.legislation.gov.uk/ukpga/1996/23/section/23">section 23</a> individual’s possible appointment as an arbitrator must, as soon as reasonably practical, disclose to the person any relevant circumstances of which the individual is, or becomes, aware.</p></content></subsection><subsection><num>(2)</num><content><p>An arbitrator must, as soon as reasonably practical, disclose to the parties to the arbitral proceedings any relevant circumstances of which the arbitrator is, or becomes, aware.</p></content></subsection><subsection><num>(3)</num><intro><p>For the purposes of this section—</p></intro><level class="para1"><num>(a)</num><content><p>“<term refersTo="#term-relevant-circumstances">relevant circumstances</term>”, in relation to an individual, are circumstances that might reasonably give rise to justifiable doubts as to the individual’s impartiality in relation to the proceedings, or potential proceedings, concerned, and</p></content></level><level class="para1"><num>(b)</num><content><p>an individual is to be treated as being aware of circumstances of which the individual ought reasonably to be 24</a> (power of court to remove arbitrator), after <a href="https://www.legislation.gov.uk/ukpga/1996/23/section/24">subsection (5)</a> insert—<quotedStructure startQuote="“" endQuote="”" href="https://www.legislation.gov.uk/ukpga/1996/23/section/25">section 25</a> (resignation of arbitrator)—</p></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>in <a href="https://www.legislation.gov.uk/ukpga/1996/23/section/25">subsection (1)</a>, omit <a href="https://www.legislation.gov.uk/ukpga/1996/23/section/25">paragraph (b)</a> (together with the “and” relevant persons) apply to the court to make such order as it thinks fit with respect to the arbitrator’s entitlement (if any) to fees or expenses or the repayment of any fees or expenses already paid.</p></content></subsection><subsection><num>(4)</num><content><p>For the purposes of subsection <ref href="#d25e410">(3)</ref>, each of the parties and the arbitrator is a “relevant
