<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-1"><num>(1)</num><intro>The Secretary of State may by regulations make provision, in relation to the marketing or use of products in the United Kingdom, for the purpose of—</intro><level class="para1" eId="sec

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-a"><num>(a)</num><content>reducing or mitigating risks presented by products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-b"><num>(b)</num><content>ensuring that products operate efficiently or effectively;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-1-c"><num>(c)</num><content>ensuring that products designed for weighing or measuring operate accurately.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-2"><num>(2)</num><content>The Secretary of State may also by regulations make provision, in relation to the marketing or use of products in the United Kingdom, which corresponds, or is similar, to a provision of r

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-3"><num>(3)</num><content>But the Secretary of State may not make regulations under <ref href="#section-1-1">subsection (1)</ref> or <ref href="#section-1-2">(2)</ref> that relate to products listed in <ref href="

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-4"><num>(4)</num><intro>For the purposes of this Act, a product presents a risk if, when used for the purpose for which it is intended or under conditions which can reasonably be foreseen, it could—</intro><le

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-a"><num>(a)</num><content>endanger the health or safety of persons,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-b"><num>(b)</num><content>endanger the health or safety of domestic animals,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-c"><num>(c)</num><content>endanger property (including the operability of other products), or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-1-4-d"><num>(d)</num><content>cause, or be susceptible to, electromagnetic disturbance.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-5"><num>(5)</num><content>The Secretary of State must publish a statement setting out how they expect to identify and assess risks presented by products for the purposes of this section.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-6"><num>(6)</num><content>A statement published under <ref href="#section-1-5">subsection (5)</ref> may be amended or replaced from time to time.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-1-7"><num>(7)</num><intro>In this Act—</intro><hcontainer name="definition"><content>“<term refersTo="#term-electromagnetic-disturbance" eId="term-electromagnetic-disturbance">electromagnetic disturbance</ter

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-electromagnetic-disturbance" eId="term-electromagnetic-disturbance">electromagnetic disturbance</term>” means any electromagnetic phenomenon which adversely affects the operation

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-marketing" eId="term-marketing">marketing</term>” means making available on the market; and related terms are to be interpreted accordingly;</content></hcontainer>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-product" eId="term-product">product</term>” means a tangible item that results from a method of production;</content></hcontainer>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><intro>“<term refersTo="#term-existing-product-provision" eId="term-existing-product-provision">existing product provision</term>” means provision in—</intro><level class="para1"><num>(a)</num><content>s

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1"><num>(a)</num><content>subordinate legislation made before the passing of this Act, or</content></level>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content>“<term refersTo="#term-existing-product-requirements" eId="term-existing-product-requirements">existing product requirements</term>” means requirements contained in existing product provision that coul

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1"><num>(b)</num><content>other EU law that has the purpose of harmonising the conditions for the marketing or use of products in the European Union;</content></level>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><intro>“<term refersTo="#term-relevant-eu-law" eId="term-relevant-eu-law">relevant EU law</term>” means—</intro><level class="para1"><num>(a)</num><content><ref eId="c00001" href="http://www.legislation.

<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2"><num>2</num><heading>Product requirements</heading><subsection eId="section-2-1"><num>(1)</num><intro>Product regulations may make provision about requirements (“product requirements”) that must be met—</intro><

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-1-b"><num>(b)</num><content>in order for products to be marketed or used in the United Kingdom.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-2"><num>(2)</num><intro>The regulations may include product requirements in relation to—</intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content>the production, components (whether tangible o

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-a"><num>(a)</num><content>the production, components (whether tangible or intangible), composition or other characteristics of products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-b"><num>(b)</num><content>the installation of products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-c"><num>(c)</num><content>the use of products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-d"><num>(d)</num><content>the marking of products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-e"><num>(e)</num><content>the marketing of products through an online marketplace;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-f"><num>(f)</num><intro>the provision of information (including information about risk) in relation to products to—</intro><level class="para2" eId="section-2-2-f-i"><num>(i)</num><content>person

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-2-f-i"><num>(i)</num><content>persons to whom products are marketed or who use products in the United Kingdom;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-2-f-ii"><num>(ii)</num><content>persons mentioned in <ref href="#section-2-3">subsection (3)</ref>;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-2-f-iii"><num>(iii)</num><content>relevant authorities;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-g"><num>(g)</num><content>the making of statements about products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-h"><num>(h)</num><content>the monitoring, assessment, verification or certification of products;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-i"><num>(i)</num><content>the recording or investigating of complaints;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-j"><num>(j)</num><content>the production or retention of documents or samples;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-k"><num>(k)</num><content>co-operation with relevant authorities;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-2-l"><num>(l)</num><content>the appointment of authorised representatives.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-3"><num>(3)</num><intro>The persons on whom product regulations may impose product requirements include—</intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content>a manufacturer of a product or

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-a"><num>(a)</num><content>a manufacturer of a product or a person carrying out another method of production in relation to a product;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-b"><num>(b)</num><content>a person who markets a product in the United Kingdom;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-c"><num>(c)</num><content>a person who imports a product into the United Kingdom for it to be marketed or used in the United Kingdom;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-d"><num>(d)</num><content>a person who installs a product in the United Kingdom;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-e"><num>(e)</num><intro>a person who—</intro><level class="para2" eId="section-2-3-e-i"><num>(i)</num><content>controls access to an online marketplace,</content></level><level class="para2"

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-3-e-i"><num>(i)</num><content>controls access to an online marketplace,</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-3-e-ii"><num>(ii)</num><content>controls the contents of an online marketplace, or</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-2-3-e-iii"><num>(iii)</num><content>acts as an intermediary for a person who controls such access or contents;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-f"><num>(f)</num><content>an authorised representative of a person mentioned in <ref href="#section-2-3-a">paragraphs (a)</ref> to <ref href="#section-2-3-e">(e)</ref>;</content></level

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-h"><num>(h)</num><content>a person carrying out activities in relation to the certification or accreditation of a person mentioned in <ref href="#section-2-3-g">paragraph (g)</ref>;</content></level

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-3-i"><num>(i)</num><content>any other person carrying out activities in relation to a product.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><content>Product regulations may make provision for or in relation to technical standards relating to product requirements.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-5"><num>(5)</num><intro>Provision described in <ref href="#section-2-4">subsection (4)</ref> may include provision about—</intro><level class="para1" eId="section-2-5-a"><num>(a)</num><content>the persons w

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-5-a"><num>(a)</num><content>the persons who may prepare technical standards;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-5-b"><num>(b)</num><content>the procedure by which, and persons by whom, technical standards may be prepared;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-5-c"><num>(c)</num><content>the matters that must or may be covered by a technical standard.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-6"><num>(6)</num><intro>Product requirements may—</intro><level class="para1" eId="section-2-6-a"><num>(a)</num><content>refer to technical standards published by a person specified in the regulations (incl

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-6-a"><num>(a)</num><content>refer to technical standards published by a person specified in the regulations (including standards as amended from time to time), and</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-6-b"><num>(b)</num><content>provide that meeting a particular technical standard creates a presumption of compliance with a particular product requirement.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-7"><num>(7)</num><intro>Product regulations may provide that a product requirement is to be treated as met if—</intro><level class="para1" eId="section-2-7-a"><num>(a)</num><content>a requirement of relevan

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-7-b"><num>(b)</num><content>such a requirement is met and conditions specified in the regulations are also met.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-1"><num>(1)</num><content>Product regulations may designate one or more persons as a relevant authority.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><content>Product regulations may only designate a person under <ref href="#section-3-1">subsection (1)</ref> if the person exercises functions of a public nature.</content></subsection>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><intro>Product regulations may make provision conferring on a relevant authority one or more of the following functions—</intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-a"><num>(a)</num><content>monitoring compliance with product regulations;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-b"><num>(b)</num><content>investigating suspected non-compliance with product regulations;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-c"><num>(c)</num><content>securing compliance with product regulations;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-3-d"><num>(d)</num><content>mitigating the effect of non-compliance with product regulations.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><intro>Product regulations may include provision—</intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content>conferring power on a relevant authority to appoint inspectors to ca

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-3-4-b-ii"><num>(ii)</num><content>power to seize and retain products or evidence of non-compliance with product regulations;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-3-4-b-iii"><num>(iii)</num><content>power to require a person to retain or provide a document or information;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para2" eId="section-3-4-b-iv"><num>(iv)</num><content>power to dispose of a product or require a person to dispose of a product.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-5"><num>(5)</num><intro>Product regulations may not authorise entry into premises used wholly or mainly as a dwelling without a warrant issued by—</intro><level class="para1" eId="section-3-5-a"><num>(a)</num>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-5-a"><num>(a)</num><content>in England and Wales, a justice of the peace;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-5-b"><num>(b)</num><content>in Scotland, a sheriff, summary sheriff or a justice of the peace;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-5-c"><num>(c)</num><content>in Northern Ireland, a lay magistrate.</content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-6"><num>(6)</num><intro>Provision described in <ref href="#section-3-3">subsection (3)</ref><ref href="#section-3-3-c">(c)</ref> or <ref href="#section-3-3-d">(d)</ref> may include provision conferring power on a

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-c"><num>(c)</num><content>prohibit the marketing or use of a product;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-d"><num>(d)</num><content>require the recall of a product or its withdrawal from the market.</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-7-b"><num>(b)</num><content>non-compliance with a notice issued by a relevant authority under powers conferred by product regulations;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-7-c"><num>(c)</num><content>obstruction of, or failure to assist or co-operate with, a relevant authority or an inspector;</content></level>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-7-d"><num>(d)</num><content>provision of false or misleading information to a relevant authority or an inspector.</content></level>
