<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:uk="https://www.legislation.gov.uk/namespaces/UK-AKN" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="section-1"><num>1</num><heading>Deprivation of citizenship order to continue to have effect during appeal</heading><subsection eId="section-1-1"><num>(1)</num><content><p><mod>In section 40A of the British Nationality Act 1981 (deprivation of citizenship: appeals), after subsection (2A) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d28e86"><num>(2B)</num><intro><p>Where—</p></intro><level class="para1"><num>(a)</num><content><p>an order under section 40 is made in respect of a person, and</p></content></level><level class="para1" eId="d28e98"><num>(b)</num><content><p>the person appeals against the decision to make the order (under this section or under section 2B of the Special Immigration Appeals Commission Act 1997),</p></content></level><wrapUp><p>the order continues to have effect during the appeal period.</p></wrapUp></subsection><subsection eId="d28e106"><num>(2C)</num><intro><p>The appeal period is the period—</p></intro><level class="para1"><num>(a)</num><intro><p>beginning with—</p></intro><level class="para2"><num>(i)</num><content><p>the day on which the person appeals against the decision, or</p></content></level><level class="para2"><num>(ii)</num><content><p>if the order is made after that day, the day on which the order is made, and</p></content></level></level><level class="para1"><num>(b)</num><content><p>ending with the day on which the appeal is finally determined, withdrawn or abandoned.</p></content></level></subsection><subsection><num>(2D)</num><content><p>For the purposes of subsection <ref href="#d28e106">(2C)</ref> an appeal is not finally determined until the decision on the appeal, or on any further appeal, may not be overturned on a further appeal (ignoring the possibility of an appeal out of time with permission).</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p>The reference to an appeal in section 40A<ref href="#d28e86">(2B)</ref><ref href="#d28e98">(b)</ref> of the British Nationality Act 1981 (as inserted by <ref href="#section-1-1">subsection (1)</ref>) includes an appeal brought (but not finally determined, withdrawn or abandoned) before the day on which this Act is passed.</p></content></subsection></section>
