<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-2-4"><num>(4)</num><intro><p>Before terminating a person’s designation as the Commander, the Secretary of State must—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>give the Commander a w
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-2-4-a"><num>(a)</num><content><p>give the Commander a written explanation of the reasons why the Secretary of State is proposing to do so,</p></content></level>

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-2"><num>(2)</num><intro><p>The Commander must from time to time issue a document (a “strategic priority document”) which sets out what, in the Commander’s view, are—</p></intro><level class="para1" eId="section-3-2-a
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-a"><num>(a)</num><content><p>the principal threats to border security when the document is issued, and</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-2-b"><num>(b)</num><content><p>the strategic priorities to which partner authorities should have regard in exercising their functions in relation to any of the threats identified under paragraph <ref href="#
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-3"><num>(3)</num><content><p>A partner authority must have regard to the strategic priority document in exercising its functions in relation to threats to border security.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-4"><num>(4)</num><intro><p>Before issuing a strategic priority document the Commander must—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p>consult the Board at a meeting of the Board, a
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-4-a"><num>(a)</num><content><p>consult the Board at a meeting of the Board, and</p></content></level>

<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content><p>“<term refersTo="#term-partner-authority" eId="term-partner-authority">partner authority</term>” means, subject to subsection <ref href="#section-3-6">(6)</ref> and section <ref href="#section-10">10</
<hcontainer xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" name="definition"><content><p>“<term refersTo="#term-public-authority" eId="term-public-authority">public authority</term>” means a person with functions of a public nature.</p></content></hcontainer>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-6"><num>(6)</num><intro><p>The following are not partner authorities for the purposes of this Chapter—</p></intro><level class="para1" eId="section-3-6-a"><num>(a)</num><content><p>the Security Service;</p></content>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-b"><num>(b)</num><content><p>the Secret Intelligence Service;</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-6-c"><num>(c)</num><content><p>GCHQ.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-7"><num>(7)</num><content><p>For the purposes of this Chapter (but subject to subsection <ref href="#section-3-9">(9)</ref>), threats to border security include the passage or conveyance of any person or thing toward
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-8"><num>(8)</num><intro><p>Those circumstances are where such passage or conveyance, or the organisation of or preparation for such passage or conveyance—</p></intro><level class="para1" eId="section-3-8-a"><num>(a)<
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-8-a"><num>(a)</num><content><p>constitutes an offence under the law of any part of the United Kingdom,</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-8-b"><num>(b)</num><content><p>creates a risk of the commission of an offence under the law of any part of the United Kingdom, or</p></content></level>
<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-3-8-c"><num>(c)</num><content><p>threatens harm of any kind to persons or property in the United Kingdom.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-3-9"><num>(9)</num><content><p>For the purposes of this Chapter, threats to border security do not include threats relating to a customs revenue matter within the meaning of Part 1 of the Borders, Citizenship and Immig
<section xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4"><num>4</num><heading>Duty to prepare annual reports</heading><subsection eId="section-4-1"><num>(1)</num><content><p>As soon as reasonably practicable after the end of each financial year, the Commander must prepare an

<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-4-3"><num>(3)</num><content><p>The Commander must send a copy of the report to the Secretary of State.</p></content></subsection>

<level xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="para1" eId="section-8-1-b"><num>(b)</num><content><p>the Commander is, or is going to be, temporarily incapacitated or temporarily unavailable to exercise the Commander’s functions.</p></content></level>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-8-2"><num>(2)</num><content><p>The Secretary of State may designate a civil servant as the Interim Border Security Commander to exercise the functions of the Commander under this Chapter for such period as the Secretar
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-8-3"><num>(3)</num><content><p>That period may not be longer than the period for which no Commander is designated or (as the case may be) the Commander is incapacitated or unavailable.</p></content></subsection>
<subsection xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="section-8-4"><num>(4)</num><content><p>While a designation under this section has effect, references in this Chapter (other than in this section) or in any other enactment or instrument to the Commander include a reference to
