<part xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="part-1"><num>Part 1</num><heading>Introduction</heading><section eId="section-1"><num>1</num><heading>The Agreement</heading><subsection eId="section-1-1"><num>(1)</num><content><p>In this Act, “<term refersTo="#term-the-agreement" eId="term-the-agreement">the Agreement</term>” means the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction, opened for signature at New York on 20 September 2023.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>For the purposes of this Act, the following terms have the meanings that they have in the Agreement (see Article 1)—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-areas-beyond-national-jurisdiction" eId="term-areas-beyond-national-jurisdiction">areas beyond national jurisdiction</term>”, and</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-marine-genetic-resources" eId="term-marine-genetic-resources">marine genetic resources</term>”.</p></content></hcontainer></subsection></section></part>
<part xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" xmlns:ukl="http://www.legislation.gov.uk/namespaces/legislation" eId="part-2"><num>Part 2</num><heading>Marine genetic resources</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-provision-of-information"><heading>Provision of information</heading><section eId="section-2"><num>2</num><heading>Collection</heading><subsection eId="section-2-1"><num>(1)</num><content><p>This section applies in relation to a project (a “collection project”) in which a UK craft is used to collect marine genetic resources in an area beyond national jurisdiction.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>The relevant person in relation to the collection project must ensure that no marine genetic resources are collected for the purposes of the project unless—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>the information described in paragraphs (a) to (j) of Article 12(2) of the Agreement (pre-collection information) has been given to the Secretary of State, and</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>subject to <ref href="#section-2-3">subsection (3)</ref>, a period of at least 7 months has passed, beginning with the day (or the last day) on which that information was given to the Secretary of State.</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>The Secretary of State may, by notice in writing given to the relevant person, reduce the period mentioned in <ref href="#section-2-2">subsection (2)</ref><ref href="#section-2-2-b">(b)</ref> where the Secretary of State considers that there is a compelling reason for marine genetic resources to be collected as part of the project despite less than 7 months having passed since the information was given to the Secretary of State.</p></content></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>The relevant person must ensure that the information described in paragraphs (a) to (d) of Article 12(5) of the Agreement (post-collection information) is given to the Secretary of State—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>as soon as it is all available, and</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>in any case, before the end of the period of 11 months beginning with the last day on which marine genetic resources are collected in an area beyond national jurisdiction as part of the project.</p></content></level></subsection><subsection eId="section-2-5"><num>(5)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-collect" eId="term-collect">collect</term>”, in relation to marine genetic resources, means collecting or sampling such resources other than incidentally when carrying out an activity for another purpose;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-relevant-person" eId="term-the-relevant-person">the relevant person</term>”, in relation to a collection project, is the individual with principal responsibility for the scientific or technical aspects of the project so far as it concerns marine genetic resources.</p></content></hcontainer></subsection></section><section eId="section-3"><num>3</num><heading>Utilisation</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>This section applies in relation to a project (a “utilisation project”) involving the utilisation in the United Kingdom of—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>marine genetic resources of areas beyond national jurisdiction, or</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>digital sequence information on such resources.</p></content></level></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>The person who controls the utilisation project (“<term refersTo="#term-the-relevant-person" eId="term-the-relevant-person">the relevant person</term>”) must ensure that information is given to the Secretary of State in accordance with the Schedule.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>The relevant person must ensure that samples of any marine genetic resources the utilisation of which falls within <ref href="#section-3-1">subsection (1)</ref><ref href="#section-3-1-a">(a)</ref> are deposited in a suitable repository.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>The relevant person must ensure that any digital sequence information the utilisation of which falls within <ref href="#section-3-1">subsection (1)</ref><ref href="#section-3-1-b">(b)</ref> is recorded in a suitable database.</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><content><p>The relevant person must comply with <ref href="#section-3-3">subsection (3)</ref> or <ref href="#section-3-4">(4)</ref> within the period of 3 years beginning with the day on which the utilisation project begins.</p></content></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>The relevant person must ensure that the deposited samples are, or the recorded information is, identifiable by reference to any Article 12(3) identifier relating to the marine genetic resources concerned.</p></content></subsection><subsection eId="section-3-7"><num>(7)</num><intro><p>Repositories and databases are “suitable” if they are—</p></intro><level class="para1" eId="section-3-7-a"><num>(a)</num><content><p>publicly accessible, and</p></content></level><level class="para1" eId="section-3-7-b"><num>(b)</num><content><p>operated, in any part of the world, in accordance with current international practice.</p></content></level></subsection></section><section eId="section-4"><num>4</num><heading>Onward disclosure</heading><subsection eId="section-4-1"><num>(1)</num><content><p>This section applies to information given to the Secretary of State as mentioned in <ref href="#section-2">section 2</ref> or <ref href="#section-3">3</ref>.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>The Secretary of State may give the information to the Clearing-House Mechanism established under Article 51 of the Agreement.</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><intro><p>But the Secretary of State may not give the information where—</p></intro><level class="para1" eId="section-4-3-a"><num>(a)</num><content><p>it is protected information within the meaning given by <ref eId="c00001" href="https://www.legislation.gov.uk/ukpga/2023/32/section/1">section 1</ref><ref eId="c00002" href="https://www.legislation.gov.uk/ukpga/2023/32/section/1">(2)</ref> of the <ref eId="c00003" href="https://www.legislation.gov.uk/ukpga/2023/32/contents">National Security Act 2023</ref>, or</p></content></level><level class="para1" eId="section-4-3-b"><num>(b)</num><content><p>in the opinion of the Secretary of State, the Agreement does not require it to be given (see Article 51(6)).</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-sharing-of-benefits"><heading>Sharing of benefits</heading><section eId="section-5"><num>5</num><heading>Repositories</heading><subsection eId="section-5-1"><num>(1)</num><content><p>This section applies in relation to a repository in the United Kingdom in which samples of marine genetic resources of areas beyond national jurisdiction are stored.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><intro><p>The person who controls the repository must—</p></intro><level class="para1" eId="section-5-2-a"><num>(a)</num><intro><p>so far as reasonably practicable, ensure that the samples—</p></intro><level class="para2" eId="section-5-2-a-i"><num>(i)</num><content><p>can be identified, in accordance with current international practice, as originating from areas beyond national jurisdiction, and</p></content></level><level class="para2" eId="section-5-2-a-ii"><num>(ii)</num><content><p>in particular, can be identified by reference to any Article 12(3) identifier relating to the marine genetic resources concerned,</p></content></level></level><level class="para1" eId="section-5-2-b"><num>(b)</num><content><p>provide access to the samples for the purposes of their utilisation by another person (subject to <ref href="#section-7">section 7</ref><ref href="#section-7-1">(1)</ref>), and</p></content></level><level class="para1" eId="section-5-2-c"><num>(c)</num><content><p>for each relevant 2-year period (see <ref href="#section-7">section 7</ref><ref href="#section-7-2">(2)</ref>), give the Secretary of State a report stating, so far as reasonably practicable, the number of times access to the samples has been provided under paragraph <ref href="#section-5-2-b">(b)</ref>.</p></content></level></subsection><subsection eId="section-5-3"><num>(3)</num><content><p>A report under <ref href="#section-5-2">subsection (2)</ref><ref href="#section-5-2-c">(c)</ref> must identify the samples by reference to any Article 12(3) identifier relating to the marine genetic resources concerned.</p></content></subsection></section><section eId="section-6"><num>6</num><heading>Databases</heading><subsection eId="section-6-1"><num>(1)</num><content><p>This section applies in relation to a UK database in which digital sequence information (“<term refersTo="#term-dsi" eId="term-dsi">DSI</term>”) on marine genetic resources of areas beyond national jurisdiction is stored.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><intro><p>A “UK database” is a database that is—</p></intro><level class="para1" eId="section-6-2-a"><num>(a)</num><content><p>controlled by a person in the United Kingdom, and</p></content></level><level class="para1" eId="section-6-2-b"><num>(b)</num><content><p>accessible by members of the public.</p></content></level></subsection><subsection eId="section-6-3"><num>(3)</num><intro><p>The person who controls the UK database must—</p></intro><level class="para1" eId="section-6-3-a"><num>(a)</num><intro><p>so far as reasonably practicable, ensure that the DSI—</p></intro><level class="para2" eId="section-6-3-a-i"><num>(i)</num><content><p>can be identified, in accordance with current international practice, as relating to marine genetic resources of areas beyond national jurisdiction, and</p></content></level><level class="para2" eId="section-6-3-a-ii"><num>(ii)</num><content><p>in particular, can be identified by reference to any Article 12(3) identifier relating to the marine genetic resources concerned,</p></content></level></level><level class="para1" eId="section-6-3-b"><num>(b)</num><content><p>provide access to the DSI (subject to <ref href="#section-7">section 7</ref><ref href="#section-7-1">(1)</ref>), and</p></content></level><level class="para1" eId="section-6-3-c"><num>(c)</num><content><p>for each relevant 2-year period (see <ref href="#section-7">section 7</ref><ref href="#section-7-2">(2)</ref>), give the Secretary of State a report stating the number of times the DSI has been viewed or downloaded.</p></content></level></subsection><subsection eId="section-6-4"><num>(4)</num><content><p>A report under <ref href="#section-6-3">subsection (3)</ref><ref href="#section-6-3-c">(c)</ref> must identify the DSI by reference to any Article 12(3) identifier relating to the marine genetic resources concerned.</p></content></subsection><subsection eId="section-6-5"><num>(5)</num><intro><p>For the purposes of this section, the person who controls a database is in the United Kingdom if—</p></intro><level class="para1" eId="section-6-5-a"><num>(a)</num><content><p>in the case of an individual, the individual is habitually resident in the United Kingdom, and</p></content></level><level class="para1" eId="section-6-5-b"><num>(b)</num><content><p>in any other case, the person is incorporated or formed under the law of any part of the United Kingdom.</p></content></level></subsection></section><section eId="section-7"><num>7</num><heading>Supplementary provision</heading><subsection eId="section-7-1"><num>(1)</num><content><p>Access provided under <ref href="#section-5">section 5</ref><ref href="#section-5-2">(2)</ref><ref href="#section-5-2-b">(b)</ref> or <ref href="#section-6">6</ref><ref href="#section-6-3">(3)</ref><ref href="#section-6-3-b">(b)</ref> may be made subject to conditions consistent with paragraphs (a) to (d) of Article 14(4) of the Agreement (factors that may affect access).</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><intro><p>For the purposes of <ref href="#section-5">sections 5</ref><ref href="#section-5-2">(2)</ref><ref href="#section-5-2-c">(c)</ref> and <ref href="#section-6">6</ref><ref href="#section-6-3">(3)</ref><ref href="#section-6-3-c">(c)</ref>, a “relevant 2-year period” is—</p></intro><level class="para1" eId="section-7-2-a"><num>(a)</num><intro><p>the period of 2 years beginning with the day on which—</p></intro><level class="para2" eId="section-7-2-a-i"><num>(i)</num><content><p>the Agreement enters into force in accordance with Article 68(1), or</p></content></level><level class="para2" eId="section-7-2-a-ii"><num>(ii)</num><content><p>if later, the Agreement enters into force for the United Kingdom in accordance with Article 68(2), and</p></content></level></level><level class="para1" eId="section-7-2-b"><num>(b)</num><content><p>each subsequent period of 2 years.</p></content></level></subsection><subsection eId="section-7-3"><num>(3)</num><intro><p>A report under <ref href="#section-5">section 5</ref><ref href="#section-5-2">(2)</ref><ref href="#section-5-2-c">(c)</ref> or <ref href="#section-6">6</ref><ref href="#section-6-3">(3)</ref><ref href="#section-6-3-c">(c)</ref> must be given to the Secretary of State—</p></intro><level class="para1" eId="section-7-3-a"><num>(a)</num><content><p>before the end of the period of 2 months beginning with the day immediately after the relevant 2-year period in question, or</p></content></level><level class="para1" eId="section-7-3-b"><num>(b)</num><content><p>by such other time as the Secretary of State may, by directions given to the person required to give the report, specify for the purposes of complying with any timetable set by the access and benefit-sharing committee established under Article 15 of the Agreement.</p></content></level></subsection><subsection eId="section-7-4"><num>(4)</num><content><p>Directions under <ref href="#section-7-3">subsection (3)</ref><ref href="#section-7-3-b">(b)</ref> may be general or specific.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-miscellaneous"><heading>Miscellaneous</heading><section eId="section-8"><num>8</num><heading>Exceptions</heading><subsection eId="section-8-1"><num>(1)</num><intro><p>Nothing in <ref href="#part-2">this Part</ref> applies in relation to—</p></intro><level class="para1" eId="section-8-1-a"><num>(a)</num><intro><p>the use of a UK craft for fishing—</p></intro><level class="para2" eId="section-8-1-a-i"><num>(i)</num><content><p>in accordance with a licence issued under <ref eId="c00004" href="https://www.legislation.gov.uk/ukpga/2020/22/section/15">section 15</ref><ref eId="c00005" href="https://www.legislation.gov.uk/ukpga/2020/22/section/15">(1)</ref> of the <ref eId="c00006" href="https://www.legislation.gov.uk/ukpga/2020/22/contents">Fisheries Act 2020</ref>, or</p></content></level><level class="para2" eId="section-8-1-a-ii"><num>(ii)</num><content><p>where such a licence is not required as a result of <ref eId="c00007" href="https://www.legislation.gov.uk/ukpga/2020/22/section/14">section 14</ref><ref eId="c00008" href="https://www.legislation.gov.uk/ukpga/2020/22/section/14">(2)</ref> of <ref eId="c00009" href="https://www.legislation.gov.uk/ukpga/2020/22/contents">that Act</ref>;</p></content></level></level><level class="para1" eId="section-8-1-b"><num>(b)</num><content><p>anything that is done in accordance with the joint fisheries statement, or any document or plan issued by the fisheries policy authorities or the Marine Management Organisation for the purposes of the <ref eId="c00010" href="https://www.legislation.gov.uk/ukpga/2020/22/contents">Fisheries Act 2020</ref>, to give effect to the scientific evidence objective within the meaning given by <ref eId="c00011" href="https://www.legislation.gov.uk/ukpga/2020/22/section/1">section 1</ref><ref eId="c00012" href="https://www.legislation.gov.uk/ukpga/2020/22/section/1">(5)</ref> of <ref eId="c00013" href="https://www.legislation.gov.uk/ukpga/2020/22/contents">that Act</ref> (including the utilisation, to give effect to that objective, of fish or other living marine resources known to have been taken in fishing and fishing-related activities in areas beyond national jurisdiction);</p></content></level><level class="para1" eId="section-8-1-c"><num>(c)</num><content><p>a warship, military aircraft or naval auxiliary, within the meaning of Article 4 of the Agreement;</p></content></level><level class="para1" eId="section-8-1-d"><num>(d)</num><content><p>anything done in the course of military activities, within the meaning of Article 10(3) of the Agreement;</p></content></level><level class="para1" eId="section-8-1-e"><num>(e)</num><content><p>anything done in Antarctica;</p></content></level><level class="para1" eId="section-8-1-f"><num>(f)</num><content><p>marine genetic resources of Antarctica (including digital sequence information on such resources).</p></content></level></subsection><subsection eId="section-8-2"><num>(2)</num><intro><p>In <ref href="#section-8-1">subsection (1)</ref>—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-antarctica" eId="term-antarctica">Antarctica</term>” has the meaning given by <ref eId="c00014" href="https://www.legislation.gov.uk/ukpga/1994/15/section/1">section 1</ref> of the <ref eId="c00015" href="https://www.legislation.gov.uk/ukpga/1994/15/contents">Antarctic Act 1994</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-fisheries-policy-authorities" eId="term-the-fisheries-policy-authorities">the fisheries policy authorities</term>” has the meaning given by <ref eId="c00016" href="https://www.legislation.gov.uk/ukpga/2020/22/section/52">section 52</ref> of the <ref eId="c00017" href="https://www.legislation.gov.uk/ukpga/2020/22/contents">Fisheries Act 2020</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-joint-fisheries-statement" eId="term-joint-fisheries-statement">joint fisheries statement</term>” means any joint fisheries statement published from time to time under <ref eId="c00018" href="https://www.legislation.gov.uk/ukpga/2020/22/section/2">section 2</ref> of <ref eId="c00019" href="https://www.legislation.gov.uk/ukpga/2020/22/contents">that Act</ref>.</p></content></hcontainer></subsection></section><section eId="section-9"><num>9</num><heading>Power to make regulations</heading><subsection eId="section-9-1"><num>(1)</num><content><p>The Secretary of State may by regulations make provision within <ref href="#section-9-2">subsection (2)</ref> for the purposes of implementing the United Kingdom’s obligations under Part 2 of the Agreement (marine genetic resources, including the fair and equitable sharing of benefits).</p></content></subsection><subsection eId="section-9-2"><num>(2)</num><intro><p>The provision that may be made is provision—</p></intro><level class="para1" eId="section-9-2-a"><num>(a)</num><content><p>to ensure that the United Kingdom complies with Part 2 of the Agreement in a way that is consistent with Article 5(2) of the Agreement (interaction between the Agreement and other instruments etc) so far as it applies to the United Kingdom in relation to any other international agreement or arrangement to which the United Kingdom is a party;</p></content></level><level class="para1" eId="section-9-2-b"><num>(b)</num><intro><p>to enable or facilitate the implementation of a decision of the Conference of the Parties under Article 14(7) of the Agreement (sharing of monetary benefits), including by imposing requirements—</p></intro><level class="para2" eId="section-9-2-b-i"><num>(i)</num><content><p>to disclose information relevant to the calculation of any payment required by the decision,</p></content></level><level class="para2" eId="section-9-2-b-ii"><num>(ii)</num><content><p>to make payments required by the decision, or</p></content></level><level class="para2" eId="section-9-2-b-iii"><num>(iii)</num><content><p>to make payments for the purpose of enabling the Secretary of State or another person to make payments required by the decision;</p></content></level></level><level class="para1" eId="section-9-2-c"><num>(c)</num><content><p>making any changes to this Part that are necessary in consequence of any determination that may be made by the Conference of the Parties in accordance with Article 51(2) of the Agreement about the operation of the Clearing-House Mechanism established by Article 51(1) of the Agreement;</p></content></level><level class="para1" eId="section-9-2-d"><num>(d)</num><content><p>to limit the application of this Part in accordance with Article 51(6) of the Agreement (protection from disclosure);</p></content></level><level class="para1" eId="section-9-2-e"><num>(e)</num><content><p>to secure that no person is required to comply both with a provision of or under this Part (“the domestic provision”) and with a corresponding provision of the law of another State that is a party to the Agreement;</p></content></level><level class="para1" eId="section-9-2-f"><num>(f)</num><content><p>about the enforcement of requirements imposed by or under this Part.</p></content></level></subsection><subsection eId="section-9-3"><num>(3)</num><content><p>In <ref href="#section-9-2">subsection (2)</ref><ref href="#section-9-2-e">(e)</ref>, a “corresponding provision” is a provision that has substantially the same effect as the domestic provision.</p></content></subsection><subsection eId="section-9-4"><num>(4)</num><content><p>Regulations under this section may make provision within <ref href="#section-9-2">subsection (2)</ref> that applies in areas beyond national jurisdiction or otherwise outside the United Kingdom.</p></content></subsection><subsection eId="section-9-5"><num>(5)</num><intro><p>Regulations made in reliance on <ref href="#section-9-2">subsection (2)</ref><ref href="#section-9-2-f">(f)</ref> may include provision—</p></intro><level class="para1" eId="section-9-5-a"><num>(a)</num><content><p>for a civil sanction to be imposed in relation to a failure to comply with requirements imposed by or under this Part,</p></content></level><level class="para1" eId="section-9-5-b"><num>(b)</num><content><p>for an undertaking given by a person to be enforceable as if it were a requirement imposed by or under this Part,</p></content></level><level class="para1" eId="section-9-5-c"><num>(c)</num><content><p>about monitoring compliance with requirements imposed by or under this Part,</p></content></level><level class="para1" eId="section-9-5-d"><num>(d)</num><content><p>about requirements for the making and keeping of records and documents, or</p></content></level><level class="para1" eId="section-9-5-e"><num>(e)</num><content><p>about requirements to provide information.</p></content></level></subsection><subsection eId="section-9-6"><num>(6)</num><content><p>Regulations under this section may amend or otherwise modify this Part (apart from this section) and <ref href="#section-27">section 27</ref>.</p></content></subsection><subsection eId="section-9-7"><num>(7)</num><content><p>The consequential provision that may be made by regulations under this section in reliance on <ref href="#section-29">section 29</ref><ref href="#section-29-2">(2)</ref><ref href="#section-29-2-b">(b)</ref> includes provision amending or repealing a provision of an Act of Parliament whenever passed (as well as provision made under such an Act).</p></content></subsection><subsection eId="section-9-8"><num>(8)</num><intro><p>Regulations under this section that include provision—</p></intro><level class="para1" eId="section-9-8-a"><num>(a)</num><content><p>amending or repealing a provision of an Act of Parliament,</p></content></level><level class="para1" eId="section-9-8-b"><num>(b)</num><content><p>made in reliance on <ref href="#section-9-2">subsection (2)</ref><ref href="#section-9-2-b">(b)</ref>, or</p></content></level><level class="para1" eId="section-9-8-c"><num>(c)</num><content><p>creating a civil sanction or varying the maximum amount of any monetary penalty,</p></content></level><wrapUp><p>are subject to the draft affirmative procedure.</p></wrapUp></subsection><subsection eId="section-9-9"><num>(9)</num><content><p>Any other regulations under this section are subject to the negative procedure.</p></content></subsection></section><section eId="section-10"><num>10</num><heading>Power to make regulations: Scotland and Northern Ireland</heading><subsection eId="section-10-1"><num>(1)</num><content><p>The appropriate national authority may by regulations make provision that is within <ref href="#section-9">section 9</ref><ref href="#section-10">this section</ref> may—</p></intro><level class="para1" eId="section-10-2-a"><num>(a)</num><content><p>confer a function (including a discretion) on any person;</p></content></level><level class="para1" eId="section-10-2-b"><num>(b)</num><content><p>make different provision for different purposes or for different areas;</p></content></level><level eId="section-13"><num>13</num><heading>Guidance</heading><subsection eId="section-13-1"><num>(1)</num><content><p>The Secretary of State must publish guidance about the requirements imposed by or under this Part.</p></content></subsection><subsection eId="section-13-2"><num>(2)</num><intro><p>The Secretary of State—</p></intro><level class="para1" eId="section-13-2-a"><num>(a)</num><content><p>must keep the guidance under review,</p></content></level><level class="para1" eId="section-13-2-b"><num>(b)</num><content><p>may from time to time revise the guidance, and</p></content></level><level class="para1" eId="section-13-2-c"><num>(c)</num><content><p>must publish any revised guidance.</p></content></level></subsection><subsection eId="section-13-3"><num>(3)</num><content><p>When preparing guidance to be published under this section, the Secretary of State must have regard to the importance of giving effect to the Agreement.</p></content></subsection><subsection eId="section-13-4"><num>(4)</num><content><p>The Secretary of State must lay any guidance (including any revised guidance) published under this section before Parliament.</p></content></subsection></section></hcontainer></part>

regulations</heading><subsection eId="section-14-1"><num>(1)</num><intro><p><ref href="#section-14">This section</ref> applies where the Conference of the Parties takes a decision under—</p></intro><level class="para1" eId="section-14-1-a"><num>(a)</num><content><p>Article 22(1)(a) of the Agreement (decisions on the establishment of area-based management tools, including marine protected areas, and related measures),</p></content></level><level class="para1" eId="section-14-1-b"><num>(b)</num><content><p>Article 22(1)(b) of the Agreement (decisions on measures compatible with other legal instruments and frameworks, and certain other matters), or</p></content></level><level class="para1" eId="section-14-1-c"><num>(c)</num><content><p>Article 24(1) of the Agreement (decisions to adopt measures to be applied on an emergency basis).</p></content></level></subsection><subsection eId="section-14-2"><num>(2)</num><content><p>The Secretary of State may by regulations make such provision as the Secretary of State considers appropriate for the purpose of meeting the obligation of the United Kingdom under Article 25(1) of the Agreement (implementing duty of states with respect to activities under their jurisdiction or control) as it applies in relation to the decision.</p></content></subsection><subsection eId="section-14-3"><num>(3)</num><intro><p>Regulations under <ref href="#section-14">this section</ref> may, among other things, make provision—</p></intro><level class="para1" eId="section-14-3-a"><num>(a)</num><content><p>that applies in areas beyond national jurisdiction or otherwise outside the United Kingdom;</p></content></level><level class="para1" eId="section-14-3-b"><num>(b)</num><content><p>about enforcement;</p></content></level><level class="para1" eId="section-14-3-c"><num>(c)</num><content><p>for the charging of fees in relation to the carrying out of functions under the regulations (including enforcement functions);</p></content></level><level class="para1" eId="section-14-3-d"><num>(d)</num><content><p>by reference to other documents as issued or having effect from time to time.</p></content></level></subsection><subsection eId="section-14-4"><num>(4)</num><intro><p>The provision that may be made in reliance on <ref href="#section-14-3">subsection (3)</ref><ref href="#section-14-3-b">(b)</ref> includes provision—</p></intro><level class="para1" eId="section-14-4-a"><num>(a)</num><content><p>creating a civil sanction or a criminal offence in relation to a failure to comply with requirements imposed by or under the regulations,</p></content></level><level class="para1" eId="section-14-4-b"><num>(b)</num><content><p>for an undertaking given by a person to be enforceable as if it were a requirement imposed by or under the regulations,</p></content></level><level class="para1" eId="section-14-4-c"><num>(c)</num><content><p>about monitoring compliance with requirements imposed by or under the regulations,</p></content></level><level class="para1" eId="section-14-4-d"><num>(d)</num><content><p>about requirements for the making and keeping of records and documents,</p></content></level><level class="para1" eId="section-14-4-e"><num>(e)</num><content><p>about requirements to provide information,</p></content></level><level class="para1" eId="section-14-4-f"><num>(f)</num><content><p>about the detention of a UK craft, and</p></content></level><level class="para1" eId="section-14-4-g"><num>(g)</num><content><p>corresponding or similar to, or applying (with or without modification), any provision of <ref eId="c00038" href="https://www.legislation.gov.uk/ukpga/1995/21/part/10">Part 10</ref> of the <ref eId="c00039" href="https://www.legislation.gov.uk/ukpga/1995/21/contents">Merchant Shipping Act 1995</ref> (enforcement officers and powers) or <ref eId="c00040" href="https://www.legislation.gov.uk/ukpga/2009/23/part/8">Part 8</ref> of the <ref eId="c00041" href="https://www.legislation.gov.uk/ukpga/2009/23/contents">Marine and Coastal Access Act 2009</ref> (enforcement).</p></content></level></subsection><subsection eId="section-14-5"><num>(5)</num><intro><p>Regulations creating a criminal offence may not provide—</p></intro><level class="para1" eId="section-14-5-a"><num>(a)</num><content><p>for an offence under the regulations to be punishable on summary conviction with imprisonment;</p></content></level><level class="para1" eId="section-14-5-b"><num>(b)</num><intro><p>in relation to Scotland or Northern Ireland—</p></intro><level class="para2" eId="section-14-5-b-i"><num>(i)</num><content><p>for an offence under the regulations that is triable only summarily to be punishable by a fine exceeding level 5 on the standard scale;</p></content></level><level class="para2" eId="section-14-5-b-ii"><num>(ii)</num><content><p>for an offence under the regulations that is triable summarily or on indictment to be punishable on summary conviction by a fine exceeding the statutory maximum;</p></content></level></level><level class="para1" eId="section-14-5-c"><num>(c)</num><content><p>for an offence under the regulations to be punishable on conviction on indictment with imprisonment for a term exceeding 2 years.</p></content></level></subsection><subsection eId="section-14-6"><num>(6)</num><content><p>The consequential provision that may be made by regulations under <ref href="#section-14">this section</ref> in reliance on <ref href="#section-29">section 29</ref><ref href="#section-29-2">(2)</ref><ref href="#section-29-2-b">(b)</ref> includes provision amending or repealing a provision of an Act of Parliament whenever passed (as well as provision made under such an Act).</p></content></subsection></section><section eId="section-15-3"><num>(3)</num><content><p>Where the Secretary of State considers that the regulations need to be made urgently in order to give effect to the measure to which they relate, the regulations are subject to the made affirmative procedure.</p></content></subsection><subsection eId="section-15-4"><num>(4)</num><content><p>Any other regulations under <ref href="#section-14">section 14</ref> are subject to the negative procedure.</p></content></subsection></section><section eId="section-16"><num>16</num><heading>Power to make regulations: Scotland and Northern Ireland</heading><subsection eId="section-16-1"><num>(1)</num><content><p>Where <ref href="#section-14">section 14</ref> applies, the appropriate national authority may by regulations make such provision as the authority considers appropriate for the purpose mentioned in <ref href="#section-14">section 14</ref><ref href="#section-14-2">(2)</ref>.</p></content></subsection><subsection eId="section-16-2"><num>(2)</num><content><p>Subsections <ref href="#section-14-3">(3)</ref> to <ref href="#section-14-5">(5)</ref> of <ref href="#section-14">section 14</ref> apply to regulations eId="section-17-10-b"><num>(b)</num><content><p>prevent the making of new regulations.</p></content></level></subsection></section><section eId="section-18"><num>18</num><heading>Consultation: Scotland and Northern Ireland</heading><subsection eId="section-18-1"><num>(1)</num><content><p>The Secretary of State must consult the Scottish Ministers before making regulations under <ref href="#section-14">section 14</ref> that contain provision that would be within the legislative competence of the Scottish Parliament if it were contained in an Act of that Parliament.</p></content></subsection><subsection eId="section-18-2"><num>(2)</num><intro><p>The Secretary of State must consult the Department of Agriculture, Environment and Rural Affairs in Northern Ireland before making regulations under <ref href="#section-14">section 14</ref> that contain provision that—</p></intro><level class="para1" eId="section-18-2-a"><num>(a)</num><content><p>would be within the legislative competence of the Northern Ireland Assembly if it were contained in an Act of that Assembly, and</p></content></level><level class="para1" eId="section-18-2-b"><num>(b)</num><content><p>would not, if it were contained in a Bill in the Northern Ireland Assembly, result in the Bill requiring the consent of the Secretary of State under <ref eId="c00057" href="https://www.legislation.gov.uk/ukpga/1998/47/section/8">section 8</ref> of the <ref eId="c00058" href="https://www.legislation.gov.uk/ukpga/1998/47/contents">Northern Ireland Act 1998</ref>.</p></content></level></subsection><subsection eId="section-18-3"><num>(3)</num><content><p><ref href="#section-18-1">Subsections (1)</ref> and <ref href="#section-18-2">(2)</ref> do not apply where the Secretary of State considers that the regulations need to be made urgently in order to give effect to a measure adopted under Article 24(1) of the Agreement (decisions to adopt measures to be applied on an emergency basis).</p></content></subsection></section><section eId="section-19"><num>19</num><heading>Directions</heading><subsection eId="section-19-1"><num>(1)</num><content><p>This section applies where the Conference of the Parties takes a decision under Article 24 of the Agreement (decisions to adopt measures to be applied on an emergency basis).</p></content></subsection><subsection eId="section-19-2"><num>(2)</num><content><p>The Secretary of State may by directions impose such requirements in respect of a UK craft as the Secretary of State considers appropriate for the purpose of meeting the obligation of the United Kingdom under Article 25(1) of the Agreement (implementing duty of states with respect to activities under their jurisdiction or control) as it applies in relation to the decision.</p></content></subsection><subsection eId="section-19-3"><num>(3)</num><intro><p>A direction under this section must be—</p></intro><level class="para1" eId="section-19-3-a"><num>(a)</num><content><p>given in writing to the person or persons to whom it applies, or</p></content></level><level class="para1" eId="section-19-3-b"><num>(b)</num><intro><p>where it is not reasonably practicable to give it in writing, must be—</p></intro><level class="para2" eId="section-19-3-b-i"><num>(i)</num><content><p>read out to that person or those persons, and</p></content></level><level class="para2" eId="section-19-3-b-ii"><num>(ii)</num><content><p>confirmed in writing as soon as is reasonably possible.</p></content></level></level></subsection><subsection eId="section-19-4"><num>(4)</num><content><p>A direction under this section must be laid before Parliament.</p></content></subsection><subsection eId="section-19-5"><num>(5)</num><content><p>The Secretary of State may vary (by further direction) or revoke a direction under this section.</p></content></subsection><subsection eId="section-19-6"><num>(6)</num><content><p>A direction under this section (if it has not already been revoked) ceases to have effect upon the termination of the measure adopted under Article 24 of the Agreement to which it relates.</p></content></subsection><subsection eId="section-19-7"><num>(7)</num><content><p>A person commits an offence if the person fails, without reasonable excuse, to comply with a direction given to them under this section.</p></content></subsection><subsection eId="section-19-8"><num>(8)</num><intro><p>A person who commits an offence under this section is liable—</p></intro><level class="para1" eId="section-19-8-a"><num>(a)</num><intro><p>on summary conviction—</p></intro><level class="para2" eId="section-19-8-a-i"><num>(i)</num><content><p>in England and Wales, to a fine;</p></content></level><level class="para2" eId="section-19-8-a-ii"><num>(ii)</num><content><p>in Scotland or Northern Ireland, to a fine not exceeding the statutory maximum;</p></content></level></level><level class="para1" eId="section-19-8-b"><num>(b)</num><content><p>on conviction on indictment to imprisonment for a term not exceeding 2 years or a fine (or both).</p></content></level></subsection><subsection eId="section-19-9"><num>(9)</num><content><p>Proceedings for an offence under this section that is committed outside the United Kingdom may be taken, and the offence may for all incidental purposes be treated as having been committed, at any place in the United Kingdom.</p></content></subsection></section></part>

eId="part-4-crossheading-marine-licensing-under-the-marine-and-coastal-access-act-2009"><heading>Marine licensing under the Marine and Coastal Access Act 2009</heading><section eId="section-20"><num>20</num><heading>Licensable marine activities</heading><subsection eId="section-20-1"><num>(1)</num><content><p>In the <ref eId="c00059" href="https://www.legislation.gov.uk/ukpga/2009/23/contents">Marine and Coastal Access Act 2009</ref>, <ref eId="c00060" href="https://www.legislation.gov.uk/ukpga/2009/23/part/4">Part 4</ref> (marine licensing) is amended as follows.</p></content></subsection><subsection eId="section-20-2"><num>(2)</num><content><p><mod>In <ref eId="c00061" eId="c00110" href="https://www.legislation.gov.uk/ukpga/2009/23/section/66">(1)</ref> of the <ref eId="c00111" href="https://www.legislation.gov.uk/ukpga/2009/23/contents">Marine and Coastal Access Act 2009</ref> (as that section has effect from time to time).</p></content></hcontainer></subsection><subsection eId="section-22-3"><num>(3)</num><content><p>Regulations under <ref href="#section-22">this section</ref> may, among other things, amend or otherwise modify <ref eId="c00112" href="https://www.legislation.gov.uk/ukpga/2009/23/part/4">Part 4</ref> of the <ref eId="section-23"><num>23</num><heading>Licensable marine activities</heading><subsection eId="section-23-1"><num>(1)</num><content><p>In the <ref eId="c00114" Regulations do not require an environmental impact assessment to be carried out in relation to BBNJ works if they are satisfied that an equivalent assessment has been carried out, is being carried out Ministers consider appropriate for the purpose of implementing any Article 38 standards or guidelines, and</p></content></level><level class="para1" eId="section-25-1-c"><num>(c)</num><content><p>would be within the legislative competence of the Scottish Parliament if it were contained in an Act of that Parliament.</p></content></level></subsection><subsection eId="section-25-2"><num>(2)</num><intro><p>In <ref href="#section-25-1">subsection (1)</ref>—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-article-38-standards-or-guidelines" eId="term-article-38-standards-or-guidelines">Article 38 standards or guidelines</term>” means standards or guidelines that may be adopted by the Conference of the Parties from time to time as mentioned in Article 38 of the Agreement;</p></content></hcontainer><hcontainer (Scotland) Act 2010</ref> (asp 5) (as <ref eId="c00152" href="https://www.legislation.gov.uk/asp/2010/5/section/21">that section</ref> has effect from time to time).</p></content></hcontainer></subsection><subsection eId="section-25-3"><num>(3)</num><content><p>Regulations under <ref href="#section-25">this section</ref> may amend or otherwise modify <ref eId="c00153" href="https://www.legislation.gov.uk/asp/2010/5/part/4">Part 4</ref> of the <ref eId="c00154" href="https://www.legislation.gov.uk/asp/2010/5/contents">Marine (Scotland) Act 2010</ref> (marine licensing).</p></content></subsection><subsection eId="section-25-4"><num>(4)</num><intro><p>Regulations under <ref href="#section-25">this section</ref> may—</p></intro><level class="para1" regulations in reliance on <ref href="#section-25-4">subsection (4)</ref><ref href="#section-25-4-c">(c)</ref> includes provision amending an enactment within the meaning given by <ref eId="c00155" href="https://www.legislation.gov.uk/asp/2010/10/schedule/1">Schedule 1</ref> to the <ref eId="c00156" href="https://www.legislation.gov.uk/asp/2010/10/contents">Interpretation and Legislative Reform <part xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" eId="part-5"><num>Part 5</num><heading>General</heading><section eId="section-27"><num>27</num><heading>Interpretation</heading><subsection eId="section-27-1"><num>(1)</num><intro><p>In this Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-article-123-identifier" eId="term-article-123-identifier">Article 12(3) identifier</term>” means an identifier generated in relation to marine genetic resources as described in Article 12(3) of the Agreement (“BBNJ” standardised batch identifiers);</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-civil-sanction" eId="term-civil-sanction">civil sanction</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a monetary penalty,</p></content></level><level class="para1"><num>(b)</num><content><p>a stop notice, or</p></content></level><level class="para1"><num>(c)</num><content><p>a compliance notice;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-commercialisation" eId="term-commercialisation">commercialisation</term>”, in relation to research and development, means the making available of a relevant product—</p></intro><level class="para1"><num>(a)</num><content><p>in the course of a commercial activity, and</p></content></level><level class="para1"><num>(b)</num><content><p>other than for the purposes of trialling the effectiveness of the product;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-compliance-notice" eId="term-compliance-notice">compliance notice</term>” means a notice imposing on a person, in relation to a failure to comply with a provision made by or under this Act, a requirement to take such steps as may be specified in the notice, within such period as may be specified, to secure that the non-compliance does not continue or recur;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-conference-of-the-parties" eId="term-conference-of-the-parties">Conference of the Parties</term>” means the Conference of the Parties established under Article 47(1) of the Agreement;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-craft" eId="term-craft">craft</term>” includes any vessel, machine, structure or other item;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-digital-sequence-information" eId="term-digital-sequence-information">digital sequence information</term>”, in relation to marine genetic resources, has such meaning as the Secretary of State may provide in regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-2-year-period" eId="term-relevant-2-year-period">relevant 2-year period</term>” has the meaning given by <ref href="#section-7">section 7</ref><ref href="#section-7-2">(2)</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-product" eId="term-relevant-product">relevant product</term>”, in relation to research and development, means a product developed through or as a result of that research and development;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-research-and-development" eId="term-relevant-research-and-development">relevant research and development</term>” means research and development within Article 1(14) of the Agreement (meaning of “<term refersTo="#term-utilization" eId="term-utilization">utilization</term>”);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-stop-notice" eId="term-stop-notice">stop notice</term>” means a notice prohibiting a person from carrying on an activity specified in the notice until the person has taken such steps as may be specified in the notice;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-uk-craft" eId="term-uk-craft">UK craft</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a ship that is a British ship by virtue of <ref eId="c00170" href="https://www.legislation.gov.uk/ukpga/1995/21/section/1">section 1</ref><ref eId="c00171" href="https://www.legislation.gov.uk/ukpga/1995/21/section/1">(1)</ref><ref eId="c00172" href="https://www.legislation.gov.uk/ukpga/1995/21/section/1">(a)</ref> or <ref eId="c00173" href="https://www.legislation.gov.uk/ukpga/1995/21/section/1">(d)</ref> of the <ref eId="c00174" href="https://www.legislation.gov.uk/ukpga/1995/21/contents">Merchant Shipping Act 1995</ref> (ships registered in the United Kingdom and certain small ships with qualifying owners),</p></content></level><level class="para1"><num>(b)</num><content><p>a Government ship within the meaning given by <ref eId="c00175" href="https://www.legislation.gov.uk/ukpga/1995/21/section/308">section 308</ref><ref eId="c00176" href="https://www.legislation.gov.uk/ukpga/1995/21/section/308">(4)</ref> of <ref eId="c00177" href="https://www.legislation.gov.uk/ukpga/1995/21/contents">that Act</ref>, or</p></content></level><level class="para1"><num>(c)</num><content><p>any other craft to which the Agreement applies and which has a qualifying UK connection (see <ref href="#section-27-2">subsection (2)</ref>);</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-unclos" eId="term-unclos">UNCLOS</term>” means the United Nations Convention on the Law of the Sea 1982 (Cmnd 8941);</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-united-kingdom-person" eId="term-united-kingdom-person">United Kingdom person</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an individual who is a British citizen or habitually resident in the United Kingdom, or</p></content></level><level class="para1"><num>(b)</num><content><p>a person that is incorporated or formed under the law of any part of the United Kingdom;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-utilisation" eId="term-utilisation">utilisation</term>”, in relation to marine genetic resources or digital sequence information, means—</p></intro><level class="para1"><num>(a)</num><content><p>the use of those resources or that information in carrying out relevant research and development, or</p></content></level><level class="para1"><num>(b)</num><content><p>the commercialisation of relevant research and development carried out using those resources or that information;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-utilisation-project" eId="term-utilisation-project">utilisation project</term>” has the meaning given by <ref href="#section-3">section 3</ref><ref href="#section-3-1">(1)</ref>.</p></content></hcontainer></subsection><subsection eId="section-27-2"><num>(2)</num><intro><p>For the purposes of paragraph (c) of the definition of “UK craft” in <ref href="#section-27-1">subsection (1)</ref>, a craft has “a qualifying UK connection” if—</p></intro><level class="para1" eId="section-27-2-a"><num>(a)</num><content><p>it is not a British ship by virtue of <ref eId="c00178" href="https://www.legislation.gov.uk/ukpga/1995/21/section/1">section 1</ref><ref eId="c00179" href="https://www.legislation.gov.uk/ukpga/1995/21/section/1">(c)</ref> of the <ref eId="c00180" href="https://www.legislation.gov.uk/ukpga/1995/21/contents">Merchant Shipping Act 1995</ref> (ships registered under the law of a relevant British possession),</p></content></level><level class="para1" eId="section-27-2-b"><num>(b)</num><content><p>it is not, and has not been deployed from, a ship which has been granted the nationality of a state other than the United Kingdom in accordance with Article 91 of UNCLOS, and</p></content></level><level class="para1" eId="section-27-2-c"><num>(c)</num><intro><p>it is—</p></intro><level class="para2" eId="section-27-2-c-i"><num>(i)</num><content><p>owned or operated by a United Kingdom person, or</p></content></level><level class="para2" eId="section-27-2-c-ii"><num>(ii)</num><content><p>being used after being deployed from the United Kingdom or from a ship within paragraph (a) or (b) of the definition of “UK craft” in <ref href="#section-27-1">subsection (1)</ref>.</p></content></level></level></subsection><subsection eId="section-27-3"><num>(3)</num><content><p>The Secretary of State may by regulations amend or otherwise modify the meaning of “a qualifying UK connection”.</p></content></subsection><subsection eId="section-27-4"><num>(4)</num><content><p>For the purposes of interpreting references in this Act to areas beyond national jurisdiction, a relevant maritime zone of any of the British overseas territories is to be treated as if it were an exclusive economic zone within the meaning of UNCLOS (see Article 55).</p></content></subsection><subsection eId="section-27-5"><num>(5)</num><intro><p>In <ref href="#section-27-4">subsection (4)</ref>, “<term refersTo="#term-relevant-maritime-zone" eId="term-relevant-maritime-zone">relevant maritime zone</term>” includes—</p></intro><level class="para1" eId="section-27-5-a"><num>(a)</num><content><p>an exclusive fishing zone,</p></content></level><level class="para1" eId="section-27-5-b"><num>(b)</num><content><p>an ecological protection zone, and</p></content></level><level class="para1" eId="section-27-5-c"><num>(c)</num><content><p>any other zone in relation to which the territory in question asserts or exercises any rights or jurisdiction of the sort referred to in Article 56(1) of UNCLOS.</p></content></level></subsection><subsection eId="section-27-6"><num>(6)</num><content><p>Regulations under <ref href="#section-27-1">subsection (1)</ref> that are made for the purposes of the definition of “digital sequence information” are subject to the negative procedure.</p></content></subsection><subsection eId="section-27-7"><num>(7)</num><content><p>Regulations under <ref href="#section-27-3">subsection (3)</ref> that amend <ref href="#section-27">this section</ref> are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-27-8"><num>(8)</num><content><p>Any other regulations under <ref href="#section-27-3">subsection (3)</ref> are subject to the negative procedure.</p></content></subsection></section><section eId="section-28"><num>28</num><heading>Power to make consequential provision</heading><subsection eId="section-28-1"><num>(1)</num><content><p>The Secretary of State may by regulations make provision that is consequential on this Act.</p></content></subsection><subsection eId="section-28-2"><num>(2)</num><intro><p>Regulations under this section may amend or repeal provision made by an Act passed—</p></intro><level class="para1" eId="section-28-2-a"><num>(a)</num><content><p>before this Act, or</p></content></level><level class="para1" eId="section-28-2-b"><num>(b)</num><content><p>later in the same session of Parliament as this Act,</p></content></level><wrapUp><p>(as well as provision made under such an Act).</p></wrapUp></subsection><subsection eId="section-28-3"><num>(3)</num><content><p>Regulations under this section that amend or repeal provision made by an Act are subject to the draft affirmative procedure.</p></content></subsection><subsection eId="section-28-4"><num>(4)</num><content><p>Any other regulations under this section are subject to the negative procedure.</p></content></subsection></section><section eId="section-29"><num>29</num><heading>Regulations under this Act</heading><subsection eId="section-29-1"><num>(1)</num><content><p>Regulations under this Act are to be made by statutory instrument.</p></content></subsection><subsection eId="section-29-2"><num>(2)</num><intro><p>A power to make regulations under this Act includes power to—</p></intro><level class="para1" eId="section-29-2-a"><num>(a)</num><content><p>confer a function (including a discretion) on any person;</p></content></level><level class="para1" eId="section-29-2-b"><num>(b)</num><content><p>make consequential, supplementary, incidental, transitional, transitory or saving provision;</p></content></level><level class="para1" eId="section-29-2-c"><num>(c)</num><content><p>make different provision for different purposes or for different areas.</p></content></level></subsection><subsection eId="section-29-3"><num>(3)</num><intro><p>Regulations under this Act that provide for civil sanctions—</p></intro><level class="para1" eId="section-29-3-a"><num>(a)</num><content><p>must provide a right of appeal against the imposition of any such sanction;</p></content></level><level class="para1" eId="section-29-3-b"><num>(b)</num><content><p>may make any provision corresponding to, or dealing with similar matters to, provision made by or capable of being made under the Regulatory Enforcement and Sanctions Act 2008.</p></content></level></subsection><subsection eId="section-29-4"><num>(4)</num><content><p>Where regulations under this Act are subject to “the draft affirmative procedure”, the regulations may not be made unless a draft of the statutory instrument containing them has been laid before, and approved by a resolution of, each House of Parliament.</p></content></subsection><subsection eId="section-29-5"><num>(5)</num><content><p>Where regulations under this Act are subject to “the made affirmative procedure”, the statutory instrument containing the regulations must be laid before Parliament after being made.</p></content></subsection><subsection eId="section-29-6"><num>(6)</num><content><p>Regulations contained in a statutory instrument laid before Parliament under <ref href="#section-29-5">subsection (5)</ref> cease to have effect at the end of the period of 28 days beginning with the day on which the instrument is made unless, during that period, the instrument is approved by a resolution of each House of Parliament.</p></content></subsection><subsection eId="section-29-7"><num>(7)</num><intro><p>In calculating the period of 28 days, no account is to be taken of any whole days that fall within a period during which—</p></intro><level class="para1" eId="section-29-7-a"><num>(a)</num><content><p>Parliament is dissolved or prorogued, or</p></content></level><level class="para1" eId="section-29-7-b"><num>(b)</num><content><p>either House of Parliament is adjourned for more than 4 days.</p></content></level></subsection><subsection eId="section-29-8"><num>(8)</num><intro><p>If regulations cease to have a effect as a result of <ref href="#section-29-6">subsection (6)</ref>, that does not—</p></intro><level class="para1" eId="section-29-8-a"><num>(a)</num><content><p>affect the validity of anything previously done under the regulations, or</p></content></level><level class="para1" eId="section-29-8-b"><num>(b)</num><content><p>prevent the making of new regulations.</p></content></level></subsection><subsection eId="section-29-9"><num>(9)</num><content><p>Where regulations under this Act are subject to “the negative procedure”, the statutory instrument containing them is subject to annulment in pursuance of a resolution of either House of Parliament.</p></content></subsection><subsection eId="section-29-10"><num>(10)</num><content><p>Any provision that may be made by regulations under this Act subject to the negative procedure may be made in regulations subject to the draft affirmative procedure or the made affirmative procedure.</p></content></subsection><subsection eId="section-29-11"><num>(11)</num><intro><p>This section does not apply to regulations under—</p></intro><level class="para1" eId="section-29-11-a"><num>(a)</num><content><p>section <ref href="#section-10">10</ref>,</p></content></level><level class="para1" eId="section-29-11-b"><num>(b)</num><content><p>section <ref href="#section-16">16</ref>,</p></content></level><level class="para1" eId="section-29-11-c"><num>(c)</num><content><p><ref href="#section-25">section 25</ref>, or</p></content></level><level class="para1" eId="section-29-11-d"><num>(d)</num><content><p><ref href="#section-32">section 32</ref>.</p></content></level></subsection></section><section eId="section-30"><num>30</num><heading>Crown application</heading><subsection eId="section-30-1"><num>(1)</num><content><p>This Act binds the Crown (but see <ref href="#section-8">section 8</ref> and Article 4 of the Agreement).</p></content></subsection><subsection eId="section-30-2"><num>(2)</num><content><p>The Crown is not criminally liable as a result of anything in this Act.</p></content></subsection><subsection eId="section-30-3"><num>(3)</num><content><p>Despite <ref href="#section-30-2">subsection (2)</ref>, this Act applies to persons in the service of the Crown as it applies to other persons.</p></content></subsection></section><section eId="section-31"><num>31</num><heading>Extent</heading><subsection eId="section-31-1"><num>(1)</num><content><p><ref href="#section-23">Sections 23</ref> and <ref href="#section-25">25</ref> extend to Scotland only.</p></content></subsection><subsection eId="section-31-2"><num>(2)</num><content><p>The rest of this Act extends to England and Wales, Scotland and Northern Ireland.</p></content></subsection><subsection eId="section-31-3"><num>(3)</num><content><p>His Majesty may by Order in Council provide for any of the provisions of this Act to extend, with or without modifications, to the Isle of Man or to any British overseas territory.</p></content></subsection></section><section eId="section-32"><num>32</num><heading>Commencement</heading><subsection eId="section-32-1"><num>(1)</num><content><p>Except as provided in subsection <ref href="#section-32-2">(2)</ref>, this Act comes into force on the day on which it is passed.</p></content></subsection><subsection eId="section-32-2"><num>(2)</num><content><p>Sections <ref href="#section-2">2</ref> to <ref href="#section-8">8</ref>, <ref href="#section-13">13</ref>, <ref href="#section-21">21</ref> and <ref href="#section-24">24</ref> come into force on such day as the Secretary of State may by regulations appoint.</p></content></subsection><subsection eId="section-32-3"><num>(3)</num><content><p>Different days may be appointed for different purposes.</p></content></subsection><subsection eId="section-32-4"><num>(4)</num><content><p>The Secretary of State may by regulations make transitional or saving provision in connection with the coming into force of any provision of this Act.</p></content></subsection><subsection eId="section-32-5"><num>(5)</num><content><p>The power to make regulations under <ref href="#section-32-4">subsection (4)</ref> includes power to make different provision for different purposes.</p></content></subsection><subsection eId="section-32-6"><num>(6)</num><content><p>Regulations under this section are to be made by statutory instrument.</p></content></subsection></section><section eId="section-33"><num>33</num><heading>Short title</heading><content><p>This Act may be cited as the Biodiversity Beyond National Jurisdiction
