CONVENTION FOR THE PROTECTION OF HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS*
The governments signatory hereto, being members of the Council of Europe, Considering the Universal Declaration of Human Rights proclaimed by the General Assembly of the United Nations on 10th December 1948; Considering that this Declaration aims at securing the universal and effective recognition and observance of the Rights therein declared; Considering that the aim of the Council of Europe is the achievement of greater unity between its members and that one of the methods by which that aim is to be pursued is the maintenance and further realisation of human rights and fundamental freedoms; Reaffirming their profound belief in those fundamental freedoms which are the foundation of justice and peace in the world and are best maintained on the one hand by an effective political democracy and on the other by a common understanding and observance of the human rights upon which they depend; Being resolved, as the governments of European countries which are like-minded and have a common heritage of political traditions, ideals, freedom and the rule of law, to take the first steps for the collective enforcement of certain of the rights stated in the Universal Declaration, Have agreed as follows:
Article 1 - Obligation to respect human rights
The High Contracting Parties shall secure to everyone within their jurisdiction the rights and freedoms defined in Section I of this Convention.
Section I - Rights and freedoms
Article 2 - Right to life
1. Everyone's right to life shall be protected by law. No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which this penalty is provided by law.
2. Deprivation of life shall not be regarded as inflicted in contravention of this article when it results from the use of force which is no more than absolutely necessary: a) in defence of any person from unlawful violence; b) in order to effect a lawful arrest or to prevent the escape of a person lawfully detained; c) in action lawfully taken for the purpose of quelling a riot or insurrection.
Article 3 - Prohibition of torture
No one shall be subjected to torture or to inhuman or degrading treatment or punishment.
Article 4 - Prohibition of slavery and forced labour
1. No one shall be held in slavery or servitude.
2. No one shall be required to perform forced or compulsory labour.
3. For the purpose of this article the term "forced or compulsory labour" shall not include: a) any work required to be done in the ordinary course of detention imposed according to the provisions of Article 5 of this Convention or during conditional release from such detention; b) any service of a military character or, in case of conscientious objectors in countries where they are recognised, service exacted instead of compulsory military service; c) any service exacted in case of an emergency or calamity threatening the life or well-being of the community; d) any work or service which forms part of normal civic obligations.
Article 5 - Right to liberty and security
1. Everyone has the right to liberty and security of person. No one shall be deprived of his liberty save in the following cases and in accordance with a procedure prescribed by law: a) the lawful detention of a person after conviction by a competent court; b) the lawful arrest or detention of a person for non- compliance with the lawful order of a court or in order to secure the fulfilment of any obligation prescribed by law; c) the lawful arrest or detention of a person effected for the purpose of bringing him before the competent legal authority on reasonable suspicion of having committed an offence or when it is reasonably considered necessary to prevent his committing an offence or fleeing after having done so; d) the detention of a minor by lawful order for the purpose of educational supervision or his lawful detention for the purpose of bringing him before the competent legal authority; e) the lawful detention of persons for the prevention of the spreading of infectious diseases, of persons of unsound mind, alcoholics or drug addicts or vagrants; f) the lawful arrest or detention of a person to prevent his effecting an unauthorised entry into the country or of a person against whom action is being taken with a view to deportation or extradition.
2. Everyone who is arrested shall be informed promptly, in a language which he understands, of the reasons for his arrest and of any charge against him.
3. Everyone arrested or detained in accordance with the provisions of paragraph 1.c of this article shall be brought promptly before a judge or other officer authorised by law to exercise judicial power and shall be entitled to trial within a reasonable time or to release pending trial. Release may be conditioned by guarantees to appear for trial.
4. Everyone who is deprived of his liberty by arrest or detention shall be entitled to take proceedings by which the lawfulness of his detention shall be decided speedily by a court and his release ordered if the detention is not lawful.
5. Everyone who has been the victim of arrest or detention in contravention of the provisions of this article shall have an enforceable right to compensation.
Article 6 - Right to a fair trial
1. In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part of the trial in the interests of morals, public order or national security in a democratic society, where the interests of juveniles or the protection of the private life of the parties so require, or to the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice.
2. Everyone charged with a criminal offence shall be presumed innocent until proved guilty according to law.
3. Everyone charged with a criminal offence has the following minimum rights: a) to be informed promptly, in a language which he understands and in detail, of the nature and cause of the accusation against him; b) to have adequate time and facilities for the preparation of his defence; c) to defend himself in person or through legal assistance of his own choosing or, if he has not sufficient means to pay for legal assistance, to be given it free when the interests of justice so require; d) to examine or have examined witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him; e) to have the free assistance of an interpreter if he cannot understand or speak the language used in court.
Article 7 - No punishment without law
1. No one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence under national or international law at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the criminal offence was committed.
2. This article shall not prejudice the trial and punishment of any person for any act or omission which, at the time when it was committed, was criminal according to the general principles of law recognised by civilised nations.
Article 8 - Right to respect for private and family life
1. Everyone has the right to respect for his private and family life, his home and his correspondence.
2. There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.
Article 9 - Freedom of thought, conscience and religion
1. Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief and freedom, either alone or in community with others and in public or private, to manifest his religion or belief, in worship, teaching, practice and observance.
2. Freedom to manifest one's religion or beliefs shall be subject only to such limitations as are prescribed by law and are necessary in a democratic society in the interests of public safety, for the protection of public order, health or morals, or for the protection of the rights and freedoms of others.
Article 10 - Freedom of expression
1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises.
2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.
Article 11 - Freedom of assembly and association
1. Everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and to join trade unions for the protection of his interests.
2. No restrictions shall be placed on the exercise of these rights other than such as are prescribed by law and are necessary in a democratic society in the interests of national security or public safety, for the prevention of disorder or crime, for the protection of health or morals or for the protection of the rights and freedoms of others. This article shall not prevent the imposition of lawful restrictions on the exercise of these rights by members of the armed forces, of the police or of the administration of the State.
Article 12 - Right to marry
Men and women of marriageable age have the right to marry and to found a family, according to the national laws governing the exercise of this right.
Article 13 - Right to an effective remedy
Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity.
Article 14 - Prohibition of discrimination
The enjoyment of the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status.
Article 15 - Derogation in time of emergency
1. In time of war or other public emergency threatening the life of the nation any High Contracting Party may take measures derogating from its obligations under this Convention to the extent strictly required by the exigencies of the situation, provided that such measures are not inconsistent with its other obligations under international law.
2. No derogation from Article 2, except in respect of deaths resulting from lawful acts of war, or from Articles 3, 4 (paragraph 1) and 7 shall be made under this provision.
3. Any High Contracting Party availing itself of this right of derogation shall keep the Secretary General of the Council of Europe fully informed of the measures which it has taken and the reasons therefor. It shall also inform the Secretary General of the Council of Europe when such measures have ceased to operate and the provisions of the Convention are again being fully executed.
Article 16 - Restrictions on political activity of aliens
Nothing in Articles 10, 11 and 14 shall be regarded as preventing the High Contracting Parties from imposing restrictions on the political activity of aliens.
Article 17 - Prohibition of abuse of rights
Nothing in this Convention may be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms set forth herein or at their limitation to a greater extent than is provided for in the Convention.
Article 18 - Limitation on use of restrictions on rights
The restrictions permitted under this Convention to the said rights and freedoms shall not be applied for any purpose other than those for which they have been prescribed.
Section II - European Court of Human Rights
Article 19 - Establishment of the Court
To ensure the observance of the engagements undertaken by the High Contracting Parties in the Convention and the Protocols thereto, there shall be set up a European Court of Human Rights, hereinafter referred to as "the Court". It shall function on a permanent basis.
Article 20 - Number of judges
The Court shall consist of a number of judges equal to that of the High Contracting Parties.
Article 21 - Criteria for office
1. The judges shall be of high moral character and must either possess the qualifications required for appointment to high judicial office or be jurisconsults of recognised competence.
2. The judges shall sit on the Court in their individual capacity.
3. During their term of office the judges shall not engage in any activity which is incompatible with their independence, impartiality or with the demands of a full-time office; all questions arising from the application of this paragraph shall be decided by the Court.
Article 22 - Election of judges
1. The judges shall be elected by the Parliamentary Assembly with respect to each High Contracting Party by a majority of votes cast from a list of three candidates nominated by the High Contracting Party.
2. The same procedure shall be followed to complete the Court in the event of the accession of new High Contracting Parties and in filling casual vacancies.
Article 23 - Terms of office
1. The judges shall be elected for a period of six years. They may be re-elected. However, the terms of office of one-half of the judges elected at the first election shall expire at the end of three years.
2. The judges whose terms of office are to expire at the end of the initial period of three years shall be chosen by lot by the Secretary General of the Council of Europe immediately after their election.
3. In order to ensure that, as far as possible, the terms of office of one-half of the judges are renewed every three years, the Parliamentary Assembly may decide, before proceeding to any subsequent election, that the term or terms of office of one or more judges to be elected shall be for a period other than six years but not more than nine and not less than three years.
4. In cases where more than one term of office is involved and where the Parliamentary Assembly applies the preceding paragraph, the allocation of the terms of office shall be effected by a drawing of lots by the Secretary General of the Council of Europe immediately after the election.
5. A judge elected to replace a judge whose term of office has not expired shall hold office for the remainder of his predecessor's term.
6. The terms of office of judges shall expire when they reach the age of 70.
7. The judges shall hold office until replaced. They shall, however, continue to deal with such cases as they already have under consideration.
Article 24 - Dismissal
No judge may be dismissed from his office unless the other judges decide by a majority of two-thirds that he has ceased to fulfil the required conditions.
Article 25 - Registry and legal secretaries
The Court shall have a registry, the functions and organisation of which shall be laid down in the rules of the Court. The Court shall be assisted by legal secretaries.
Article 26 - Plenary Court
The plenary Court shall a) elect its President and one or two Vice-Presidents for a period of three years; they may be re-elected; b) set up Chambers, constituted for a fixed period of time; c) elect the Presidents of the Chambers of the Court; they may be re-elected; d) adopt the rules of the Court, and e) elect the Registrar and one or more Deputy Registrars.
Article 27 - Committees, Chambers and Grand Chamber
1. To consider cases brought before it, the Court shall sit in committees of three judges, in Chambers of seven judges and in a Grand Chamber of seventeen judges. The Court's Chambers shall set up committees for a fixed period of time.
2. There shall sit as an ex officio member of the Chamber and the Grand Chamber the judge elected in respect of the State Party concerned or, if there is none or if he is unable to sit, a person of its choice who shall sit in the capacity of judge.
3. The Grand Chamber shall also include the President of the Court, the Vice-Presidents, the Presidents of the Chambers and other judges chosen in accordance with the rules of the Court. When a case is referred to the Grand Chamber under Article 43, no judge from the Chamber which rendered the judgment shall sit in the Grand Chamber, with the exception of the President of the Chamber and the judge who sat in respect of the State Party concerned.
Article 28 - Declarations of inadmissibility by committees
A committee may, by a unanimous vote, declare inadmissible or strike out of its list of cases an application submitted under Article 34 where such a decision can be taken without further examination. The decision shall be final.
Article 29 - Decisions by Chambers on admissibility and merits
1. If no decision is taken under Article 28, a Chamber shall decide on the admissibility and merits of individual applications submitted under Article 34.
2. A Chamber shall decide on the admissibility and merits of inter-State applications submitted under Article 33.
3. The decision on admissibility shall be taken separately unless the Court, in exceptional cases, decides otherwise.
Article 30 - Relinquishment of jurisdiction to the Grand Chamber
Where a case pending before a Chamber raises a serious question affecting the interpretation of the Convention or the protocols thereto, or where the resolution of a question before the Chamber might have a result inconsistent with a judgment previously delivered by the Court, the Chamber may, at any time before it has rendered its judgment, relinquish jurisdiction in favour of the Grand Chamber, unless one of the parties to the case objects.
Article 31 - Powers of the Grand Chamber
The Grand Chamber shall a) determine applications submitted either under Article 33 or Article 34 when a Chamber has relinquished jurisdiction under Article 30 or when the case has been referred to it under Article 43; and b) consider requests for advisory opinions submitted under Article 47.
Article 32 - Jurisdiction of the Court
1. The jurisdiction of the Court shall extend to all matters concerning the interpretation and application of the Convention and the protocols thereto which are referred to it as provided in Articles 33, 34 and 47.
2. In the event of dispute as to whether the Court has jurisdiction, the Court shall decide.
Article 33 - Inter-State cases
Any High Contracting Party may refer to the Court any alleged breach of the provisions of the Convention and the protocols thereto by another High Contracting Party.
Article 34 - Individual applications
The Court may receive applications from any person, non- governmental organisation or group of individuals claiming to be the victim of a violation by one of the High Contracting Parties of the rights set forth in the Convention or the protocols thereto. The High Contracting Parties undertake not to hinder in any way the effective exercise of this right.
Article 35 - Admissibility criteria
1. The Court may only deal with the matter after all domestic remedies have been exhausted, according to the generally recognised rules of international law, and within a period of six months from the date on which the final decision was taken.
2. The Court shall not deal with any application submitted under Article 34 that a) is anonymous; or b) is substantially the same as a matter that has already been examined by the Court or has already been submitted to another procedure of international investigation or settlement and contains no relevant new information.
3. The Court shall declare inadmissible any individual application submitted under Article 34 which it considers incompatible with the provisions of the Convention or the protocols thereto, manifestly ill-founded, or an abuse of the right of application.
4. The Court shall reject any application which it considers inadmissible under this Article. It may do so at any stage of the proceedings.
Article 36 - Third party intervention
1. In all cases before a Chamber or the Grand Chamber, a High Contracting Party one of whose nationals is an applicant shall have the right to submit written comments and to take part in hearings.
2. The President of the Court may, in the interest of the proper administration of justice, invite any High Contracting Party which is not a party to the proceedings or any person concerned who is not the applicant to submit written comments or take part in hearings.
Article 37 - Striking out applications
1. The Court may at any stage of the proceedings decide to strike an application out of its list of cases where the circumstances lead to the conclusion that a) the applicant does not intend to pursue his application; or b) the matter has been resolved; or c) for any other reason established by the Court, it is no longer justified to continue the examination of the application. However, the Court shall continue the examination of the application if respect for human rights as defined in the Convention and the protocols thereto so requires.
2. The Court may decide to restore an application to its list of cases if it considers that the circumstances justify such a course.
Article 38 - Examination of the case and friendly settlement proceedings
1. If the Court declares the application admissible, it shall a) pursue the examination of the case, together with the representatives of the parties, and if need be, undertake an investigation, for the effective conduct of which the States concerned shall furnish all necessary facilities; b) place itself at the disposal of the parties concerned with a view to securing a friendly settlement of the matter on the basis of respect for human rights as defined in the Convention and the protocols thereto.
2. Proceedings conducted under paragraph 1.b shall be confidential.
Article 39 - Finding of a friendly settlement
If a friendly settlement is effected, the Court shall strike the case out of its list by means of a decision which shall be confined to a brief statement of the facts and of the solution reached.
Article 40 - Public hearings and access to documents
1. Hearings shall be in public unless the Court in exceptional circumstances decides otherwise.
2. Documents deposited with the Registrar shall be accessible to the public unless the President of the Court decides otherwise.
Article 41 - Just satisfaction
If the Court finds that there has been a violation of the Convention or the protocols thereto, and if the internal law of the High Contracting Party concerned allows only partial reparation to be made, the Court shall, if necessary, afford just satisfaction to the injured party.
Article 42 - Judgments of Chambers
Judgments of Chambers shall become final in accordance with the provisions of Article 44, paragraph 2.
Article 43 - Referral to the Grand Chamber
1. Within a period of three months from the date of the judgment of the Chamber, any party to the case may, in exceptional cases, request that the case be referred to the Grand Chamber.
2. A panel of five judges of the Grand Chamber shall accept the request if the case raises a serious question affecting the interpretation or application of the Convention or the protocols thereto, or a serious issue of general importance.
3. If the panel accepts the request, the Grand Chamber shall decide the case by means of a judgment.
Article 44 - Final judgments
1. The judgment of the Grand Chamber shall be final.
2. The judgment of a Chamber shall become final a) when the parties declare that they will not request that the case be referred to the Grand Chamber; or b) three months after the date of the judgment, if reference of the case to the Grand Chamber has not been requested; or c) when the panel of the Grand Chamber rejects the request to refer under Article 43.
3. The final judgment shall be published.
Article 45 - Reasons for judgments and decisions
1. Reasons shall be given for judgments as well as for decisions declaring applications admissible or inadmissible.
2. If a judgment does not represent, in whole or in part, the unanimous opinion of the judges, any judge shall be entitled to deliver a separate opinion.
Article 46 - Binding force and execution of judgments
1. The High Contracting Parties undertake to abide by the final judgment of the Court in any case to which they are parties.
2. The final judgment of the Court shall be transmitted to the Committee of Ministers, which shall supervise its execution.
Article 47 - Advisory opinions
1. The Court may, at the request of the Committee of Ministers, give advisory opinions on legal questions concerning the interpretation of the Convention and the protocols thereto.
2. Such opinions shall not deal with any question relating to the content or scope of the rights or freedoms defined in Section I of the Convention and the protocols thereto, or with any other question which the Court or the Committee of Ministers might have to consider in consequence of any such proceedings as could be instituted in accordance with the Convention.
3. Decisions of the Committee of Ministers to request an advisory opinion of the Court shall require a majority vote of the representatives entitled to sit on the Committee.
Article 48 - Advisory jurisdiction of the Court
The Court shall decide whether a request for an advisory opinion submitted by the Committee of Ministers is within its competence as defined in Article 47.
Article 49 - Reasons for advisory opinions
1. Reasons shall be given for advisory opinions of the Court.
2. If the advisory opinion does not represent, in whole or in part, the unanimous opinion of the judges, any judge shall be entitled to deliver a separate opinion.
3. Advisory opinions of the Court shall be communicated to the Committee of Ministers.
Article 50 - Expenditure on the Court
The expenditure on the Court shall be borne by the Council of Europe.
Article 51 - Privileges and immunities of judges
The judges shall be entitled, during the exercise of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the agreements made thereunder.
Section III - Miscellaneous provisions
Article 52 - Inquiries by the Secretary General
On receipt of a request from the Secretary General of the Council of Europe any High Contracting Party shall furnish an explanation of the manner in which its internal law ensures the effective implementation of any of the provisions of the Convention.
Article 53 - Safeguard for existing human rights
Nothing in this Convention shall be construed as limiting or derogating from any of the human rights and fundamental freedoms which may be ensured under the laws of any High Contracting Party or under any other agreement to which it is a Party.
Article 54 - Powers of the Committee of Ministers
Nothing in this Convention shall prejudice the powers conferred on the Committee of Ministers by the Statute of the Council of Europe.
Article 55 - Exclusion of other means of dispute settlement
The High Contracting Parties agree that, except by special agreement, they will not avail themselves of treaties, conventions or declarations in force between them for the purpose of submitting, by way of petition, a dispute arising out of the interpretation or application of this Convention to a means of settlement other than those provided for in this Convention.
Article 56 - Territorial application
1. Any State may at the time of its ratification or at any time thereafter declare by notification addressed to the Secretary General of the Council of Europe that the present Convention shall, subject to paragraph 4 of this Article, extend to all or any of the territories for whose international relations it is responsible.
2. The Convention shall extend to the territory or territories named in the notification as from the thirtieth day after the receipt of this notification by the Secretary General of the Council of Europe.
3. The provisions of this Convention shall be applied in such territories with due regard, however, to local requirements.
4. Any State which has made a declaration in accordance with paragraph 1 of this article may at any time thereafter declare on behalf of one or more of the territories to which the declaration relates that it accepts the competence of the Court to receive applications from individuals, non-governmental organisations or groups of individuals as provided by Article 34 of the Convention.
Article 57 - Reservations
1. Any State may, when signing this Convention or when depositing its instrument of ratification, make a reservation in respect of any particular provision of the Convention to the extent that any law then in force in its territory is not in conformity with the provision. Reservations of a general character shall not be permitted under this article.
2. Any reservation made under this article shall contain a brief statement of the law concerned.
Article 58 - Denunciation
1. A High Contracting Party may denounce the present Convention only after the expiry of five years from the date on which it became a party to it and after six months' notice contained in a notification addressed to the Secretary General of the Council of Europe, who shall inform the other High Contracting Parties.
2. Such a denunciation shall not have the effect of releasing the High Contracting Party concerned from its obligations under this Convention in respect of any act which, being capable of constituting a violation of such obligations, may have been performed by it before the date at which the denunciation became effective.
3. Any High Contracting Party which shall cease to be a member of the Council of Europe shall cease to be a Party to this Convention under the same conditions.
4. The Convention may be denounced in accordance with the provisions of the preceding paragraphs in respect of any territory to which it has been declared to extend under the terms of Article
56.
Article 59 - Signature and ratification
1. This Convention shall be open to the signature of the members of the Council of Europe. It shall be ratified. Ratifications shall be deposited with the Secretary General of the Council of Europe.
2. The present Convention shall come into force after the deposit of ten instruments of ratification.
3. As regards any signatory ratifying subsequently, the Convention shall come into force at the date of the deposit of its instrument of ratification.
4. The Secretary General of the Council of Europe shall notify all the members of the Council of Europe of the entry into force of the Convention, the names of the High Contracting Parties who have ratified it, and the deposit of all instruments of ratification which may be effected subsequently.
Done at Rome this 4th day of November 1950, in English and French, both texts being equally authentic, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary General shall transmit certified copies to each of the signatories. ____________ * The text of the Convention had been amended according to the provisions of Protocol No. 3 (ETS No. 45), which entered into force on 21 September 1970, of Protocol No. 5 (ETS No. 55), which entered into force on 20 December 1971 and of Protocol No. 8 (ETS No. 118), which entered into force on 1 January 1990, and comprised also the text of Protocol No. 2 (ETS N 44) which, in accordance with Article 5, paragraph 3 thereof, had been an integral part of the Convention since its entry into force on 21 September 1970. All provisions which had been amended or added by these Protocols are replaced by Protocol No. 11 (ETS No. 155), as from the date of its entry into force on 1 November 1998. As from that date, Protocol No. 9 (ETS N 140), which entered into force on 1 October 1994, is repealed and Protocol No. 10 (ETS No. 146), which has not entered into forse, has lost its purpose.

CONVENTION DE SAUVEGARDE DES DROITS DE L'HOMME ET DES LIBERTЙS FONDAMENTALES*
Les gouvernements signataires, membres du Conseil de l'Europe, Considйrant la Dйclaration universelle des Droits de l'Homme, proclamйe par l'Assemblйe gйnйrale des Nations Unies le 10 dйcembre 1948; Considйrant que cette dйclaration tend а assurer la reconnaissance et l'application universelles et effectives des droits qui y sont йnoncйs; Considйrant que le but du Conseil de l'Europe est de rйaliser une union plus йtroite entre ses membres, et que l'un des moyens d'atteindre ce but est la sauvegarde et le dйveloppement des droits de l'homme et des libertйs fondamentales; Rйaffirmant leur profond attachement а ces libertйs fondamentales qui constituent les assises mкmes de la justice et de la paix dans le monde et dont le maintien repose essentiellement sur un rйgime politique vйritablement dйmocratique, d'une part, et, d'autre part, sur une conception commune et un commun respect des droits de l'homme dont ils se rйclament; Rйsolus, en tant que gouvernements d'Etats europйens animйs d'un mкme esprit et possйdant un patrimoine commun d'idйal et de traditions politiques, de respect de la libertй et de prййminence du droit, а prendre les premiиres mesures propres а assurer la garantie collective de certains des droits йnoncйs dans la Dйclaration universelle, Sont convenus de ce qui suit:
Article 1 - Obligation de respecter les droits de l'homme
Les Hautes Parties contractantes reconnaissent а toute personne relevant de leur juridiction les droits et libertйs dйfinis au titre 1 de la prйsente Convention:
Titre I - Droits et libertйs
Article 2 - Droit а la vie
1. Le droit de toute personne а la vie est protйgй par la loi. La mort ne peut кtre infligйe а quiconque intentionnellement, sauf en exйcution d'une sentence capitale prononcйe par un tribunal au cas oщ le dйlit est puni de cette peine par la loi.
2. La mort n'est pas considйrйe comme infligйe en violation de cet article dans les cas oщ elle rйsulterait d'un recours а la force rendu absolument nйcessaire: a) pour assurer la dйfense de toute personne contre la violence illйgale; b) pour effectuer une arrestation rйguliиre ou pour empкcher l'йvasion d'une personne rйguliиrement dйtenue; c) pour rйprimer, conformйment а la loi, une йmeute ou une insurrection.
Article 3 - Interdiction de la torture
Nul ne peut кtre soumis а la toiture ni а des peines ou traitements inhumains ou dйgradants.
Article 4 - Interdiction de l'esclavage et du travail forcй
1. Nul ne peut кtre tenu en esclavage ni en servitude.
2. Nul ne peut кtre astreint а accomplir un travail forcй ou obligatoire.
3. N'est pas considйrй comme "travail forcй ou obligatoire" au sens du prйsent article: a) tout travail requis normalement d'une personne soumise а la dйtention dans les conditions prйvues par l'article 5 de la prйsente Convention, ou durant sa mise en libertй conditionnelle; b) tout service de caractиre militaire ou, dans le cas d'objecteurs de conscience dans les pays oщ l'objection de conscience est reconnue comme lйgitime, а un autre service а la place du service militaire obligatoire; c) tout service requis dans le cas de crises ou de calamitйs qui menacent la vie ou le bien-кtre de la communautй; d) tout travail ou service formant partie des obligations civiques normales.
Article 5 - Droit а la libertй et а la sыretй
1. Toute personne a droit а la libertй et а la sыretй. Nul ne peut кtre privй de sa libertй, sauf dans les cas suivants et selon les voies lйgales: a) s'il est dйtenu rйguliиrement aprиs condamnation par un tribunal compйtent; b) s'il a fait l'objet d'une arrestation ou d'une dйtention rйguliиres pour insou mission а une ordonnance rendue, conformйment а la loi, par un tribunal ou en vue de garantir l'exйcution d'une obligation prescrite par la loi; c) s'il a йtй arrкtй et dйtenu en vue d'кtre conduit devant l'autoritй judiciaire compйtente, lorsqu'il y a des raisons plausibles de soupзonner qu'il a commis une infraction ou qu'il y a des motifs raisonnables de croire а la nйcessitй de l'empкcher de commettre une infraction ou de s'enfuir aprиs l'accomplissement de celle-ci; d) s'il s'agit de la dйtention rйguliиre d'un mineur, dйcidйe pour son йducation surveillйe ou de sa dйtention rйguliиre, afin de le traduire devant l'autoritй compйtente; e) s'il s'agit de la dйtention rйguliиre d'une personne susceptible de propager une maladie contagieuse, d'un aliйnй, d'un alcoolique, d'un toxicomane ou d'un vagabond; f) s'il s'agit de l'arrestation ou de la dйtention rйguliиres d'une personne pour l'empкcher de pйnйtrer irrйguliиrement dans le territoire, ou contre laquelle une procйdure d'expulsion ou d'extradition est en cours.
2. Toute personne arrкtйe doit кtre informйe, dans le plus court dйlai et dans une langue qu'elle comprend, des raisons de son arrestation et de toute accusation portйe contre elle.
3. Toute personne arrкtйe ou dйtenue, dans les conditions prйvues au paragraphe l.c du prйsent article, doit кtre aussitфt traduite devant un juge ou un autre magistrat habilitй par la loi а exercer des fonctions judiciaires et a le droit d'кtre jugйe dans un dйlai raisonnable, ou libйrйe pendant la procйdure. La mise en libertй peut кtre subordonnйe а une garantie assurant la comparution de l'intйressй а l'audience.
4. Toute personne privйe de sa libertй par arrestation ou dйtention a le droit d'introduire un recours devant un tribunal, afin qu'il statue а bref dйlai sur la lйgalitй de sa dйtention et ordonne sa libйration si la dйtention est illйgale.
5. Toute personne victime d'une arrestation ou d'une dйtention dans des condi tions contraires aux dispositions de cet article a droit а rйparation.
Article 6 - Droit а un procиs йquitable
1. Toute personne a droit а ce que sa cause soit entendue йquitablement, publique ment et dans un dйlai raisonnable, par un tribunal indйpendant et impartial, йtabli par la loi, qui dйcidera, soit des contestations sur ses droits et obligations de caractиre civil, soit du bien-fondй de toute accusation en matiиre pйnale dirigйe contre elle. Le jugement doit кtre rendu publiquement, mais l'accиs de la salle d'audience peut кtre interdit а la presse et au public pendant la totalitй ou une partie du procиs dans l'intйrкt de la moralitй, de l'ordre public ou de la sйcuritй nationale dans une sociйtй dйmocratique, lorsque les intйrкts des mineurs ou la protection de la vie privйe des parties au procиs l'exigent, ou dans la mesure jugйe strictement nйcessaire par le tribunal, lorsque dans des circonstances spйciales la publicitй serait de nature а porter atteinte aux intйrкts de la justice.
2. Toute personne accusйe d'une infraction est prйsumйe innocente jusqu'а ce que sa culpabilitй ait йtй lйgalement йtablie.
3. Tout accusй a droit notamment а: a) кtre informй, dans le plus court dйlai, dans une langue qu'il comprend et d'une maniиre dйtaillйe, de la nature et de la cause de l'accusation portйe contre lui; b) disposer du temps et des facilitйs nйcessaires а la prйparation de sa dйfense; c) se dйfendre lui-mкme ou avoir l'assistance d'un dйfenseur de son choix et, s'il n'a pas les moyens de rйmunйrer un dйfenseur, pouvoir кtre assistй gratuite ment par un avocat d'office, lorsque les intйrкts de la justice l'exigent; d) interroger ou faire interroger les tйmoins а charge et obtenir la convocation et l'interrogation des tйmoins а dйcharge dans les mкmes conditions que les tйmoins а charge; e) se faire assister gratuitement d'un interprиte, s'il ne comprend pas ou ne parle pas la langue employйe а l'audience.
Article 7 - Pas de peine sans loi
1. Nul ne peut кtre condamnй pour une action ou une omission qui, au moment oщ elle a йtй commise, ne constituait pas une infraction d'aprиs le droit national ou international. De mкme il n'est infligй aucune peine plus forte que celle qui йtait applicable au moment oщ l'infraction a йtй commise.
2. Le prйsent article ne portera pas atteinte au jugement et а la punition d'une personne coupable d'une action ou d'une omission qui, au moment oщ elle a йtй commise, йtait criminelle d'aprиs les principes gйnйraux de droit reconnus par les nations civilisйes.
Article 8 - Droit au respect de la vie privйe et familiale
1. Toute personne a droit au respect de sa vie privйe et familiale, de son domicile et de sa correspondance.
2. II ne peut y avoir ingйrence d'une autoritй publique dans l'exercice de ce droit que pour autant que cette ingйrence est prйvue par la loi et qu'elle constitue une mesure qui, dans une sociйtй dйmocratique, est nйcessaire а la sйcuritй nationale, а la sыretй publique, au bien-кtre йconomique du pays, а la dйfense de l'ordre et а la prйvention des infractions pйnales, а la protection de la santй ou de la morale, ou а la protection des droits et libertйs d'autrui.
Article 9 - Libertй de pensйe, de conscience et de religion
1. Toute personne a droit а la libertй de pensйe, de conscience et de religion; ce droit implique la libertй de changer de religion ou de conviction, ainsi que la libertй de manifester sa religion ou sa conviction individuellement ou collectivement, en public ou en privй, par le culte, l'enseignement, les pratiques et l'accomplissement des rites.
2. La libertй de manifester sa religion ou ses convictions ne peut faire l'objet d'autres restrictions que celles qui, prйvues par la loi, constituent des mesures nйcessaires, dans une sociйtй dйmocratique, а la sйcuritй publique, а la protection de l'ordre, de la santй ou de la morale publiques, ou а la protection des droits et libertйs d'autrui.
Article 10 - Libertй d'expression
1. Toute personne a droit а la libertй d'expression. Ce droit comprend la libertй d'opinion et la libertй de recevoir ou de communiquer des informations ou des idйes sans qu'il puisse y avoir ingйrence d'autoritйs publiques et sans considйration de frontiиre. Le prйsent article n'empкche pas les Etats de soumettre les entreprises de radiodiffusion, de cinйma ou de tйlйvision а un rйgime d'auto risations.
2. L'exercice de ces libertйs comportant des devoirs et des responsabilitйs peut кtre soumis а certaines formalitйs, conditions, restrictions ou sanctions prйvues par la loi, qui constituent des mesures nйcessaires, dans une sociйtй dйmocratique, а la sйcuritй nationale, а l'intйgritй territoriale ou а la sыretй publique, а la dйfense de l'ordre et а la prйvention du crime, а la protection de la santй ou de la morale, а la protection de la rйputation ou des droits d'autrui, pour empкcher la divulgation d'informations confidentielles ou pour garantir l'autoritй et l'impartialitй du pouvoir judiciaire.
Article 11 - Libertй de rйunion et d'association
1. Toute personne a droit а la libertй de rйunion pacifique et а la libertй d'associa tion, y compris le droit de fonder avec d'autres des syndicats et de s'affilier а des syndicats pour la dйfense de ses intйrкts.
2. L'exercice de ces droits ne peut faire l'objet d'autres restrictions que celles qui, prйvues par la loi, constituent des mesures nйcessaires, dans une sociйtй dйmocratique, а la sйcuritй nationale, а la sыretй publique, а la dйfense de l'ordre et а la prйvention du crime, а la protection de la santй ou de la morale, ou а la protection des droits et libertйs d'autrui. Le prйsent article n'interdit pas que des restrictions lйgitimes soient imposйes а l'exercice de ces droits par les membres des forces armйes, de la police ou de l'administration de l'Etat.
Article 12 - Droit au mariage
A partir de l'вge nubile, l'homme et la femme ont le droit de se marier et de fonder une famille selon les lois nationales rйgissant l'exercice de ce droit.
Article 13 - Droit а un recours effectif
Toute personne dont les droits et libertйs reconnus dans la prйsente Convention ont йtй violйs, a droit а l'octroi d'un recours effectif devant une instance nationale, alors mкme que la violation aurait йtй commise par des personnes agissant dans l'exercice de leurs fonctions officielles.
Article 14 - Interdiction de discrimination
La jouissance des droits et libertйs reconnus dans la prйsente Convention doit кtre assurйe, sans distinction aucune, fondйe notamment sur le sexe, la race, la couleur, la langue, la religion, les opinions politiques ou toutes autres opinions, l'origine nationale ou sociale, l'appartenance а une minoritй nationale, la fortune, la nais sance ou toute autre situation.
Article 15 - Dйrogation en cas d'йtat d'urgence
1. En cas de guerre ou en cas d'autre danger public menaзant la vie de la nation, toute Haute Partie contractante peut prendre des mesures dйrogeant aux obliga tions prйvues par la prйsente Convention, dans la stricte mesure oщ la situation l'exige et а la condition que ces mesures ne soient pas en contradiction avec les autres obligations dйcoulant du droit international.
2. La disposition prйcйdente n'autorise aucune dйrogation а l'article 2, sauf pour le cas de dйcиs rйsultant d'actes licites de guerre, et aux articles 3, 4 (paragraphe 1) et 7.
3. Toute Haute Partie contractante qui exerce ce droit de dйrogation tient le Secrйtaire Gйnйral du Conseil de l'Europe pleinement informй des mesures prises et des motifs qui les ont inspirйes. Elle doit йgalement informer le Secrйtaire Gйnйral du Conseil de l'Europe de la date а laquelle ces mesures ont cessй d'кtre en vigueur et les dispositions de la Convention reзoivent de nouveau pleine application.
Article 16 - Restrictions а l'activitй politique des йtrangers
Aucune des dispositions des articles 10, 11 et 14 ne peut кtre considйrйe comme interdisant aux Hautes Parties contractantes d'imposer des restrictions а l'activitй politique des йtrangers.
Article 17 - Interdiction de l'abus de droit
Aucune des dispositions de la prйsente Convention ne peut кtre interprйtйe comme impliquant pour un Etat, un groupement ou un individu, un droit quelconque de se livrer а une activitй ou d'accomplir un acte visant а la destruction des droits ou libertйs reconnus dans la prйsente Convention ou а des limitations plus amples de ces droits et libertйs que celles prйvues а ladite Convention.
Article 18 - Limitation de l'usage des restrictions aux droits
Les restrictions qui, aux termes de la prйsente Convention, sont apportйes auxdits droits et libertйs ne peuvent кtre appliquйes que dans le but pour lequel elles ont йtй prйvues.
Titre II - Cour europйenne des Droits de l'Homme
Article 19 - Institution de la Cour
Afin d'assurer le respect des engagements rйsultant pour les Hautes Parties contractantes de la prйsente Convention et de ses protocoles, il est instituй une Cour europйenne des Droits de l'Homme, ci-dessous nommйe "la Cour". Elle fonctionne de faзon permanente.
Article 20 - Nombre de juges
La Cour se compose d'un nombre de juges йgal а celui des Hautes Parties contractantes.
Article 21 - Conditions d'exercice des fonctions
1. Les juges doivent jouir de la plus haute considйration morale et rйunir les conditions requises pour l'exercice de hautes fonctions judiciaires ou кtre des jurisconsultes possйdant une compйtence notoire.
2. Les juges siиgent а la Cour а titre individuel.
3. Pendant la durйe de leur mandat, les juges ne peuvent exercer aucune activitй incompatible avec les exigences d'indйpendance, d'impartialitй ou de disponibilitй requise par une activitй exercйe а plein temps; toute question soulevйe en application de ce paragraphe est tranchйe par la Cour.
Article 22 - Election des juges
1. Les juges sont йlus par l'Assemblйe parlementaire au titre de chaque Haute Partie contractante, а la majoritй des voix exprimйes, sur une liste de trois candidats prйsentйs par la Haute Partie contractante.
2. La mкme procйdure est suivie pour complйter la Cour en cas d'adhйsion de nouvelles Hautes Parties contractantes et pourvoir les siиges devenus vacants.
Article 23 - Durйe du mandat
1. Les juges sont йlus pour une durйe de six ans. Ils sont rййligibles. Toutefois, les mandats d'une moitiй des juges dйsignйs lors de la premiиre йlection prendront fin au bout de trois ans.
2. Les juges dont le mandat prendra fin au terme de la pйriode initiale de trois ans sont dйsignйs par tirage au sort effectuй par le Secrйtaire Gйnйral du Conseil de l'Europe, immйdiatement aprиs leur йlection.
3. Afin d'assurer, dans la mesure du possible, le renouvellement des mandats d'une moitiй des juges tous les trois ans, l'Assemblйe parlementaire peut, avant de procйder а toute йlection ultйrieure, dйcider qu'un ou plusieurs mandats des juges а йlire auront une durйe autre que celle de six ans, sans qu'elle puisse toutefois excйder neuf ans ou кtre infйrieure а trois ans.
4. Dans le cas oщ il y a lieu de confйrer plusieurs mandats et oщ l'Assemblйe parlementaire fait application du paragraphe prйcйdent, la rйpartition des mandats s'opиre suivant un tirage au sort effectuй par le Secrйtaire Gйnйral du Conseil de l'Europe immйdiatement aprиs l'йlection.
5. Le juge йlu en remplacement d'un juge dont le mandat n'est pas expirй achиve le mandat de son prйdйcesseur.
6. Le mandat des juges s'achиve dиs qu'ils atteignent l'вge de 70 ans.
7. Les juges restent en fonctions jusqu'а leur remplacement. Ils continuent toute fois de connaоtre des affaires dont ils sont dйjа saisis.
Article 24 - Rйvocation
Un juge ne peut кtre relevй de ses fonctions que si les autres juges dйcident, а la majoritй des deux tiers, qu'il a cessй de rйpondre aux conditions requises. Article 25 - Greffe et rйfйrendaires
La Cour dispose d'un greffe dont les tвches et l'organisation sont fixйes par le rиglement de la Cour. Elle est assistйe de rйfйrendaires.
Article 26 - Assemblйe plйniиre de la Cour
La Cour rйunie en Assemblйe plйniиre a) йlit, pour une durйe de trois ans, son prйsident et un ou deux vice-prйsidents; ils sont rййligibles; b) constitue des Chambres pour une pйriode dйterminйe; c) йlit les prйsidents des Chambres de la Cour, qui sont rййligibles; d) adopte le rиglement de la Cour, et e) йlit le greffier et un ou plusieurs greffiers adjoints.
Article 27 - Comitйs, Chambres et Grande chambre
1. Pour l'examen des affaires portйes devant elle, la Cour siиge en comitйs de trois juges, en Chambres de sept juges et en une Grande Chambre de dix-sept juges. Les Chambres de la Cour constituent les comitйs pour une pйriode dйterminйe.
2. Le juge йlu au titre d'un Etat Partie au litige est membre de droit de la Chambre et de la Grande Chambre; en cas d'absence de ce juge, ou lorsqu'il n'est pas en mesure de siйger, cet Etat partie dйsigne une personne qui siиge en qualitй de juge.
3. Font aussi partie de la Grande Chambre, le prйsident de la Cour, les vice-prйsidents, les prйsidents des Chambres et d'autres juges dйsignйs conformйment au rиglement de la Cour. Quand l'affaire est dйfйrйe а la Grande Chambre en vertu de l'article 43, aucun juge de la Chambre qui a rendu l'arrкt ne peut y siйger, а l'exception du prйsident de la Chambre et du juge ayant siйgй au titre de l'Etat partie intйressй.
Article 28 - Dйclarations d'irrecevabilitй par les comitйs
Un comitй peut, par vote unanime, dйclarer irrecevable ou rayer du rфle une requкte individuelle introduite en vertu de l'article 34 lorsqu'une telle dйcision peut кtre prise sans examen complйmentaire. La dйcision est dйfinitive.
Article 29 - Dйcisions des Chambres sur la recevabilitй et le fond
1. Si aucune dйcision n'a йtй prise en vertu de l'article 28, une Chambre se prononce sur la recevabilitй et le fond des requкtes individuelles introduites en vertu de l'article 34.
2. Une Chambre se prononce sur la recevabilitй et le fond des requкtes йtatiques introduites en vertu de l'article 33.
3. Sauf dйcision contraire de la Cour dans des cas exceptionnels, la dйcision sur la recevabilitй est prise sйparйment.
Article 30 - Dessaisissement en faveur de la Grande Chambre
Si l'affaire pendante devant une Chambre soulиve une question grave relative а l'interprйtation de la Convention ou de ses protocoles, ou si la solution d'une question peut conduire а une contradiction avec un arrкt rendu antйrieurement par la Cour, la Chambre peut, tant qu'elle n'a pas rendu son arrкt, se dessaisir au profit de la Grande Chambre, а moins que l'une des parties ne s'y oppose.
Article 31 - Attributions de la Grande Chambre
La Grande Chambre a) se prononce sur les requкtes introduites en vertu de l'article 33 ou de l'article 34 lorsque l'affaire lui a йtй dйfйrйe par la Chambre en vertu de l'article 30 ou lorsque l'affaire lui a йtй dйfйrйe en vertu de l'article 43; et b) examine les demandes d'avis consultatifs introduites en vertu de l'article 47.
Article 32 - Compйtence de la Cour
1. La compйtence de la Cour s'йtend а toutes les questions concernant l'interprйtation et l'application de la Convention et de ses protocoles qui lui seront soumises dans les conditions prйvues par les articles 33, 34 et 47.
2. En cas de contestation sur le point de savoir si la Cour est compйtente, la Cour dйcide.
Article 33 - Affaires interйtatiques
Toute Haute Partie contractante peut saisir la Cour de tout manquement aux dispositions de la Convention et de ses protocoles qu'elle croira pouvoir кtre imputй а une autre Haute Partie contractante.
Article 34 - Requкtes individuelles
La Cour peut кtre saisie d'une requкte par toute personne physique, toute organi sation non gouvernementale ou tout groupe de particuliers qui se prйtend victime d'une violation par l'une des Hautes Parties contractantes des droits reconnus dans la Convention ou ses protocoles. Les Hautes Parties contractantes s'engagent а n'entraver par aucune mesure l'exercice efficace de ce droit.
Article 35 - Conditions de recevabilitй
1. La Cour ne peut кtre saisie qu'aprиs l'йpuisement des voies de recours internes, tel qu'il est entendu selon les principes de droit international gйnйralement recon nus, et dans un dйlai de six mois а partir de la date de la dйcision interne dйfinitive.
2. La Cour ne retient aucune requкte individuelle introduite en application de l'article 34, lorsque a) elle est anonyme; ou b) elle est essentiellement la mкme qu'une requкte prйcйdemment examinйe par la Cour ou dйjа soumise а une autre instance internationale d'enquкte ou de rиglement, et si elle ne contient pas de faits nouveaux.
3. La Cour dйclare irrecevable toute requкte individuelle introduite en application de l'article 34, lorsqu'elle estime la requкte incompatible avec les dispositions de la Convention ou de ses protocoles, manifestement mal fondйe ou abusive.
4. La Cour rejette toute requкte qu'elle considиre comme irrecevable par applica tion du prйsent article. Elle peut procйder ainsi а tout stade de la procйdure.
Article 36 - Tierce intervention
1. Dans toute affaire devant une Chambre ou la Grande Chambre, une Haute Partie contractante dont un ressortissant est requйrant a le droit de prйsenter des observations йcrites et de prendre part aux audiences.
2. Dans l'intйrкt d'une bonne administration de la justice, le prйsident de la Cour peut inviter toute Haute Partie contractante qui n'est pas partie а l'instance ou toute personne intйressйe autre que le requйrant а prйsenter des observations йcrites ou а prendre part aux audiences.
Article 37 - Radiation
1. A tout moment de la procйdure, la Cour peut dйcider de rayer une requкte du rфle lorsque les circonstances permettent de conclure a) que le requйrant n'entend plus la maintenir; ou b) que le litige a йtй rйsolu; ou c) que, pour tout autre motif dont la Cour constate l'existence, il ne se justifie plus de poursuivre l'examen de la requкte. Toutefois, la Cour poursuit l'examen de la requкte si le respect des droits de l'homme garantis par la Convention et ses protocoles l'exige.
2. La Cour peut dйcider la rйinscription au rфle d'une requкte lorsqu'elle estime que les circonstances le justifient.
Article 38 - Examen contradictoire de l'affaire et procйdure de rиglement amiable
1. Si la Cour dйclare une requкte recevable, elle a) poursuit l'examen contradictoire de l'affaire avec les reprйsentants des parties et, s'il y a lieu, procиde а une enquкte pour la conduite efficace de laquelle les Etats intйressйs fourniront toutes facilitйs nйcessaires; b) se met а la disposition des intйressйs en vue de parvenir а un rиglement amiable de l'affaire s'inspirant du respect des droits de l'homme tels que les reconnaissent la Convention et ses protocoles.
2. La procйdure dйcrite au paragraphe l.b est confidentielle.
Article 39 - Conclusion d'un rиglement amiable

Article 41 - Satisfaction йquitable

Article 42 - Arrкts des Chambres
Les arrкts des Chambres deviennent dйfinitifs conformйment aux dispositions de 1'article 44, paragraphe 2.
Article 43 - Renvoi devant la Grande Chambre
1. Dans un dйlai de trois mois а compter de la date de l'arrкt d'une Chambre, toute partie а l'affaire peut, dans des cas exceptionnels, demander le renvoi de l'affaire devant la Grande Chambre.
2. Un collиge de cinq juges de la Grande Chambre accepte la demande si l'affaire soulиve une question grave relative а l'interprйtation ou а l'application de la Convention ou de ses protocoles, ou encore une question grave de caractиre gйnйral.
3. Si le collиge accepte la demande, la Grande Chambre se prononce sur l'affaire par un arrкt.
Article 44 - Arrкts dйfinitifs
1. L'arrкt de la Grande Chambre est dйfinitif.
2. L'arrкt d'une Chambre devient dйfinitif a) lorsque les parties dйclarent qu'elles ne demanderont pas le renvoi de l'affaire devant la Grande Chambre; ou b) trois mois aprиs la date de l'arrкt, si le renvoi de l'affaire devant la Grande Chambre n'a pas йtй demandй; ou c)lorsque le collиge de la Grande Chambre rejette la demande de renvoi formulйe en application de l'article 43.
3. L'arrкt dйfinitif est publiй.
Article 45 - Motivation des arrкts et dйcisions
1. Les arrкts, ainsi que les dйcisions dйclarant des requкtes recevables ou irrecev ables, sont motivйs.

Article 46 - Force obligatoire et exйcution des arrкts
1. Les Hautes Parties contractantes s'engagent а se conformer aux arrкts dйfinitifs de la Cour dans les litiges auxquels elles sont parties.
2. L'arrкt dйfinitif de la Cour est transmis au Comitй des Ministres qui en surveille l'exйcution.
Article 47 - Avis consultatifs
1. La Cour peut, а la demande du Comitй des Ministres, donner des avis consult atifs sur des questions juridiques concernant l'interprйtation de la Convention et de ses protocoles.
2. Ces avis ne peuvent porter ni sur les questions ayant trait au contenu ou а l'йtendue des droits et libertйs dйfinis au titre 1 de la Convention et dans les protocoles ni sur les autres questions dont la Cour ou le Comitй des Ministres pourraient avoir а connaоtre par suite de l'introduction d'un recours prйvu par la Convention.
3. La dйcision du Comitй des Ministres de demander un avis а la Cour est prise par un vote а la majoritй des reprйsentants ayant le droit de siйger au Comitй.
Article 48 - Compйtence consultative de la Cour
La Cour dйcide si la demande d'avis consultatif prйsentйe par le Comitй des Ministres relиve de sa compйtence telle que dйfinie par l'article 47.
Article 49 - Motivation des avis consultatifs
1. L'avis de la Cour est motivй.

Article 50 - Frais de fonctionnement de la Cour

Article 51 - Privilиges et immunitйs des juges
Les juges jouissent, pendant l'exercice de leurs fonctions, des privilиges et immunitйs prйvus а l'article 40 du Statut du Conseil de l'Europe et dans les accords conclus au titre de cet article.
Titre III - Dispositions diverses
Article 52 - Enquкtes du Secrйtaire Gйnйral
Toute Haute Partie contractante fournira sur demande du Secrйtaire Gйnйral du Conseil de l'Europe les explications requises sur la maniиre dont son droit interne assure l'application effective de toutes les dispositions de cette Convention.
Article 53 - Sauvegarde des droits de l'homme reconnus
Aucune des dispositions de la prйsente Convention ne sera interprйtйe comme limitant ou portant atteinte aux droits de l'homme et aux libertйs fondamentales qui pourraient кtre reconnus conformйment aux lois de toute Partie contractante ou а toute autre Convention а laquelle cette Partie contractante est partie.
Article 54 - Pouvoirs du Comitй des Ministres
Aucune disposition de la prйsente Convention ne porte atteinte aux pouvoirs confйrйs au Comitй des Ministres par le Statut du Conseil de l'Europe.
Article 55 - Renonciation а d'autres modes de rиglement des diffйrends
Les Hautes Parties contractantes renoncent rйciproquement, sauf compromis spйcial, а se prйvaloir des traitйs, conventions ou dйclarations existant entre elles, en vue de soumettre, par voie de requкte, un diffйrend nй de l'interprйtation ou de l'application de la prйsente Convention а un mode de rиglement autre que ceux prйvus par ladite Convention.
Article 56 - Application territoriale
1. Tout Etat peut, au moment de la ratification ou а tout autre moment par la suite, dйclarer, par notification adressйe au Secrйtaire Gйnйral du Conseil de l'Europe, que la prйsente Convention s'appliquera, sous rйserve du paragraphe 4 du prйsent article, а tous les territoires ou а l'un quelconque des territoires dont il assure les relations internationales.
2. La Convention s'appliquera au territoire ou aux territoires dйsignйs dans la notification а partir du trentiиme jour qui suivra la date а laquelle le Secrйtaire Gйnйral du Conseil de l'Europe aura reзu cette notification.
3. Dans lesdits territoires les dispositions de la prйsente Convention seront appliquйes en tenant compte des nйcessitйs locales.
4. Tout Etat qui a fait une dйclaration conformйment au premier paragraphe de cet article, peut, а tout moment par la suite, dйclarer relativement а un ou plusieurs des territoires visйs dans cette dйclaration qu'il accepte la compйtence de la Cour pour connaоtre des requкtes de personnes physiques, d'organisations non gou vernementales ou de groupes de particuliers, comme le prйvoit l'article 34 de la Convention.
Article 57 - Rйserves
1. Tout Etat peut, au moment de la signature de la prйsente Convention ou du dйpфt de son instrument de ratification, formuler une reserve au sujet d'une disposition particuliиre de la Convention, dans la mesure oщ une loi alors en vigueur sur son territoire n'est pas conforme а cette disposition. Les rйserves de caractиre gйnйral ne sont pas autorisйes aux termes du prйsent article.
2. Toute rйserve йmise conformйment au prйsent article comporte un bref exposй de la loi en cause.
Article 58 - Dйnonciation
1. Une Haute Partie contractante ne peut dйnoncer la prйsente Convention qu'aprиs l'expiration d'un dйlai de cinq ans а partir de la date d'entrйe en vigueur de la Convention а son йgard et moyennant un prйavis de six mois, donnй par une notification adressйe au Secrйtaire Gйnйral du Conseil de l'Europe, qui en informe les autres Parties contractantes.
2. Cette dйnonciation ne peut avoir pour effet de dйlier la Haute Partie contrac tante intйressйe des obligations contenues dans la prйsente Convention en ce qui concerne tout fait qui, pouvant constituer une violation de ces obligations, aurait йtй accompli par elle antйrieurement а la date а laquelle la dйnonciation produit effet.
3. Sous la mкme rйserve cesserait d'кtre Partie а la prйsente Convention toute Partie contractante qui cesserait d'кtre membre du Conseil de l'Europe.
4. La Convention peut кtre dйnoncйe conformйment aux dispositions des para graphes prйcйdents en ce qui concerne tout territoire auquel elle a йtй dйclarйe applicable aux termes de l'article 56.
Article 59 - Signature et ratification
1. La prйsente Convention est ouverte а la signature des membres du Conseil de l'Europe. Elle sera ratifiйe. Les ratifications seront dйposйes prиs le Secrйtaire Gйnйral du Conseil de l'Europe.
2. La prйsente Convention entrera en vigueur aprиs le dйpфt de dix instruments de ratification.
3. Pour tout signataire qui la ratifiera ultйrieurement, la Convention entrera en vigueur dиs le dйpфt de l'instrument de ratification.
4. С т а т ь я 1 Обязательство соблюдать права человека
Высокие Договаривающиеся Стороны обеспечивают каждому, находящемуся под их юрисдикцией, права и свободы, определенные в разделе I настоящей Конвенции.
РАЗДЕЛ I ПРАВА И СВОБОДЫ
С т а т ь я 2 Право на жизнь
1. Право каждого лица на жизнь охраняется законом. Никто не может быть умышленно лишен жизни иначе как во исполнение смертного приговора, вынесенного судом за совершение преступления, в отношении которого законом предусмотрено такое наказание.
2. Лишение жизни не рассматривается как нарушение настоящей статьи, когда оно является результатом абсолютно необходимого применения силы: a) для защиты любого лица от противоправного насилия; b) для осуществления законного задержания или предотвращения побега лица, заключенного под стражу на законных основаниях; c) для подавления, в соответствии с законом, бунта или мятежа.
С т а т ь я 3 Запрещение пыток
Никто не должен подвергаться ни пыткам, ни бесчеловечному или унижающему достоинство обращению или наказанию.
С т а т ь я 4 Запрещение рабства и принудительного труда
1. Никто не должен содержаться в рабстве или подневольном состоянии.
2. Никто не должен привлекаться к принудительному или обязательному труду.
3. Для целей настоящей статьи термин "принудительный или обязательный труд" не включает в себя: a) всякую работу, которую обычно должно выполнять лицо, находящееся в заключении согласно положениям статьи 5 настоящей Конвенции или условно освобожденное от такого заключения; b) всякую службу военного характера, а в тех странах, в которых правомерным признается отказ от военной службы на основании убеждений, службу, назначенную вместо обязательной военной службы; c) всякую службу, обязательную в случае чрезвычайного положения или бедствия, угрожающего жизни или благополучию населения; d) всякую работу или службу, являющуюся частью обычных гражданских обязанностей.
С т а т ь я 5 Право на свободу и личную неприкосновенность
1. Каждый имеет право на свободу и личную неприкосновенность. Никто не может быть лишен свободы иначе как в следующих случаях и в порядке, установленном законом: a) законное содержание под стражей лица, осужденного компетентным судом; b) законное задержание или заключение под стражу (арест) лица за неисполнение вынесенного в соответствии с законом решения суда или с целью обеспечения исполнения любого обязательства, предписанного законом; c) законное задержание или заключение под стражу лица, произведенное с тем, чтобы оно предстало перед компетентным органом по обоснованному подозрению в совершении правонарушения или в случае, когда имеются достаточные основания полагать, что необходимо предотвратить совершение им правонарушения или помешать ему скрыться после его совершения; d) заключение под стражу несовершеннолетнего лица на основании законного постановления для воспитательного надзора или его законное заключение под стражу, произведенное с тем, чтобы оно предстало перед компетентным органом; e) законное заключение под стражу лиц с целью предотвращения распространения инфекционных заболеваний, а также законное заключение под стражу душевнобольных, алкоголиков, наркоманов или бродяг; f) законное задержание или заключение под стражу лица с целью предотвращения его незаконного въезда в страну или лица, против которого принимаются меры по его высылке или выдаче.
2. Каждому арестованному незамедлительно сообщаются на понятном ему языке причины его ареста и любое предъявляемое ему обвинение.
3. Каждый задержанный или заключенный под стражу в соответствии с подпунктом "с" пункта 1 настоящей статьи незамедлительно доставляется к судье или к иному должностному лицу, наделенному, согласно закону, судебной властью, и имеет право на судебное разбирательство в течение разумного срока или на освобождение до суда. Освобождение может быть обусловлено предоставлением гарантий явки в суд.
4. Каждый, кто лишен свободы в результате ареста или заключения под стражу, имеет право на безотлагательное рассмотрение судом правомерности его заключения под стражу и на освобождение, если его заключение под стражу признано судом незаконным.
5. Каждый, кто стал жертвой ареста или заключения под стражу в нарушение положений настоящей статьи, имеет право на компенсацию.
С т а т ь я 6 Право на справедливое судебное разбирательство
1. Каждый в случае спора о его гражданских правах и обязанностях или при предъявлении ему любого уголовного обвинения имеет право на справедливое и публичное разбирательство дела в разумный срок независимым и беспристрастным судом, созданным на основании закона. Судебное решение объявляется публично, однако пресса и публика могут не допускаться на судебные заседания в течение всего процесса или его части по соображениям морали, общественного порядка или национальной безопасности в демократическом обществе, а также когда того требуют интересы несовершеннолетних или для защиты частной жизни сторон, или - в той мере, в какой это, по мнению суда, строго необходимо - при особых обстоятельствах, когда гласность нарушала бы интересы правосудия.
2. Каждый обвиняемый в совершении уголовного преступления считается невиновным до тех пор, пока его виновность не будет установлена законным порядком.
3. Каждый обвиняемый в совершении уголовного преступления имеет как минимум следующие права: a) быть незамедлительно и подробно уведомленным на понятном ему языке о характере и основании предъявленного ему обвинения; b) иметь достаточное время и возможности для подготовки своей защиты; c) защищать себя лично или через посредство выбранного им самим защитника или, при недостатке у него средств для оплаты услуг защитника, пользоваться услугами назначенного ему защитника бесплатно, когда того требуют интересы правосудия; d) допрашивать показывающих против него свидетелей или иметь право на то, чтобы эти свидетели были допрошены, и иметь право на вызов и допрос свидетелей в его пользу на тех же условиях, что и для свидетелей, показывающих против него; e) пользоваться бесплатной помощью переводчика, если он не понимает языка, используемого в суде, или не говорит на этом языке.
С т а т ь я 7 Наказание исключительно на основании закона
1. Никто не может быть осужден за совершение какого-либо деяния или за бездействие, которое согласно действовавшему в момент его совершения национальному или международному праву не являлось уголовным преступлением. Не может также налагаться наказание более тяжкое, нежели то, которое подлежало применению в момент совершения уголовного преступления.
2. Настоящая статья не препятствует осуждению и наказанию любого лица за совершение какого-либо деяния или за бездействие, которое в момент его совершения являлось уголовным преступлением в соответствии с общими принципами права, признанными цивилизованными странами.
С т а т ь я 8 Право на уважение частной и семейной жизни
1. Каждый имеет право на уважение его личной и семейной жизни, его жилища и его корреспонденции.
2. Не допускается вмешательство со стороны публичных властей в осуществление этого права, за исключением случаев, когда такое вмешательство предусмотрено законом и необходимо в демократическом обществе в интересах национальной безопасности и общественного порядка, экономического благосостояния страны, в целях предотвращения беспорядков или преступлений, для охраны здоровья или нравственности или защиты прав и свобод других лиц.
С т а т ь я 9 Свобода мысли, совести и религии
1. Каждый имеет право на свободу мысли, совести и религии; это право включает свободу менять свою религию или убеждения и свободу исповедовать свою религию или убеждения как индивидуально, так и сообща с другими, публичным или частным порядком в богослужении, обучении, отправлении религиозных и культовых обрядов.
2. Свобода исповедовать свою религию или убеждения подлежит лишь тем ограничениям, которые предусмотрены законом и необходимы в демократическом обществе в интересах общественной безопасности, для охраны общественного порядка, здоровья или нравственности или для защиты прав и свобод других лиц.
С т а т ь я 10 Свобода выражения мнения
1. Каждый имеет право свободно выражать свое мнение. Это право включает свободу придерживаться своего мнения и свободу получать и распространять информацию и идеи без какого-либо вмешательства со стороны публичных властей и независимо от государственных границ. Настоящая статья не препятствует государствам осуществлять лицензирование радиовещательных, телевизионных или кинематографических предприятий.
2. Осуществление этих свобод, налагающее обязанности и ответственность, может быть сопряжено с определенными формальностями, условиями, ограничениями или санкциями, которые предусмотрены законом и необходимы в демократическом обществе в интересах национальной безопасности, территориальной целостности или общественного порядка, в целях предотвращения беспорядков или преступлений, для охраны здоровья и нравственности, защиты репутации или прав других лиц, предотвращения разглашения информации, полученной конфиденциально, или обеспечения авторитета и беспристрастности правосудия.
С т а т ь я 11 Свобода собраний и объединений
1. Каждый имеет право на свободу мирных собраний и на свободу объединения с другими, включая право создавать профессиональные союзы и вступать в таковые для защиты своих интересов.
2. Осуществление этих прав не подлежит никаким ограничениям, кроме тех, которые предусмотрены законом и необходимы в демократическом обществе в интересах национальной безопасности и общественного порядка, в целях предотвращения беспорядков и преступлений, для охраны здоровья и нравственности или защиты прав и свобод других лиц. Настоящая статья не препятствует введению законных ограничений на осуществление этих прав лицами, входящими в состав вооруженных сил, полиции или административных органов государства.
С т а т ь я 12 Право на вступление в брак
Мужчины и женщины, достигшие брачного возраста, имеют право вступать в брак и создавать семью в соответствии с национальным законодательством, регулирующим осуществление этого права.
С т а т ь я 13 Право на эффективное средство правовой защиты
Каждый, чьи права и свободы, признанные в настоящей Конвенции, нарушены, имеет право на эффективное средство правовой защиты в государственном органе, даже если это нарушение было совершено лицами, действовавшими в официальном качестве.
С т а т ь я 14 Запрещение дискриминации
Пользование правами и свободами, признанными в настоящей Конвенции, должно быть обеспечено без какой бы то ни было дискриминации по признаку пола, расы, цвета кожи, языка, религии, политических или иных убеждений, национального или социального происхождения, принадлежности к национальным меньшинствам, имущественного положения, рождения или по любым иным признакам.
С т а т ь я 15 Отступление от соблюдения обязательств в чрезвычайных ситуациях
1. В случае войны или при иных чрезвычайных обстоятельствах, угрожающих жизни нации, любая из Высоких Договаривающихся Сторон может принимать меры в отступление от ее обязательств по настоящей Конвенции только в той степени, в какой это обусловлено чрезвычайностью обстоятельств, при условии, что такие меры не противоречат другим ее обязательствам по международному праву.
2. Это положение не может служить основанием для какого бы то ни было отступления от положений статьи 2, за исключением случаев гибели людей в результате правомерных военных действий, или от положений статьи 3, пункта 1 статьи 4 и статьи 7.
3. Любая из Высоких Договаривающихся Сторон, использующая это право отступления, исчерпывающим образом информирует Генерального секретаря Совета Европы о введенных ею мерах и о причинах их принятия. Она также ставит в известность Генерального секретаря Совета Европы о дате прекращения действия таких мер и возобновлении осуществления положений Конвенции в полном объеме.
С т а т ь я 16 Ограничение на политическую деятельность иностранцев
Ничто в статьях 10, 11 и 14 не может рассматриваться как препятствие для Высоких Договаривающихся Сторон вводить ограничения на политическую деятельность иностранцев.
С т а т ь я 17 Запрещение злоупотреблений правами
Ничто в настоящей Конвенции не может толковаться как означающее, что какое-либо государство, какая-либо группа лиц или какое-либо лицо имеет право заниматься какой бы то ни было деятельностью или совершать какие бы то ни было действия, направленные на упразднение прав и свобод, признанных в настоящей Конвенции, или на их ограничение в большей мере, чем это предусматривается в Конвенции.
С т а т ь я 18 Пределы использования ограничений в отношении прав
Ограничения, допускаемые в настоящей Конвенции в отношении указанных прав и свобод, не должны применяться для иных целей, нежели те, для которых они были предусмотрены.
РАЗДЕЛ II ЕВРОПЕЙСКИЙ СУД ПО ПРАВАМ ЧЕЛОВЕКА
С т а т ь я 19 Учреждение Суда
В целях обеспечения соблюдения обязательств, принятых на себя Высокими Договаривающимися Сторонами по настоящей Конвенции и Протоколам к ней, учреждается Европейский суд по правам человека, далее именуемый "Суд". Он работает на постоянной основе.
С т а т ь я 20 Число судей
Число судей, входящих в состав Суда, равно числу Высоких Договаривающихся Сторон.
С т а т ь я 21 Предъявляемые к судьям требования
1. Судьи должны обладать самыми высокими моральными качествами и удовлетворять требованиям, предъявляемым при назначении на высокие судебные должности, или быть правоведами с общепризнанным авторитетом.
2. Судьи участвуют в работе Суда в личном качестве.
3. На протяжении всего срока пребывания в должности судьи не должны осуществлять никакой деятельности, несовместимой с их независимостью, беспристрастностью или с требованиями, вытекающими из характера их работы в течение полного рабочего дня. Все вопросы, возникающие в связи с применением положений настоящего пункта, решаются Судом.
С т а т ь я 22 Выборы судей
1. Судья от каждой из Высоких Договаривающихся Сторон избирается Парламентской ассамблеей большинством поданных за него голосов из списка, включающего трех кандидатов, представляемых этой Высокой Договаривающейся Стороной.
2. Аналогичная процедура действует при довыборах состава Суда в случае присоединения новых Высоких Договаривающихся Сторон, а также при заполнении открывающихся вакансий.
С т а т ь я 23 Срок полномочий
1. Судьи избираются сроком на шесть лет. Они могут быть переизбраны. Однако срок полномочий половины судей первого состава истекает через три года с момента избрания.
2. Судьи, чей срок полномочий истекает через первые три года, определяются Генеральным секретарем Совета Европы путем жребия сразу после их избрания.
3. В целях обеспечения, насколько это возможно, обновляемости состава Суда наполовину каждые три года Парламентская ассамблея может до проведения любых последующих выборов принять решение о том, что срок или сроки полномочий одного или нескольких избираемых судей будут иными, нежели шесть лет, но в любом случае не более девяти и не менее трех лет.
4. В случаях, когда речь идет о более чем одном сроке полномочий и Парламентская ассамблея применяет положения предыдущего пункта, определение сроков полномочий производится Генеральным секретарем Совета Европы путем жребия сразу после выборов.
5. Судья, избранный для замещения другого судьи, срок полномочий которого еще не истек, занимает этот пост на срок, оставшийся от срока полномочий его предшественника.
6. Срок полномочий Судей истекает по достижении ими 70 лет.
7. Судьи занимают свои посты вплоть до замены. Вместе с тем и после замены они продолжают рассматривать уже поступившие к ним дела.
С т а т ь я 24 Освобождение от должности
Судья может быть освобожден от должности, только в случае, если прочие судьи большинством в две трети голосов принимают решение о том, что он перестает соответствовать предъявляемым требованиям.
С т а т ь я 25 Секретариат и правовые референты
У Суда имеется Секретариат, права, обязанности и организация которого определяются Регламентом Суда. Суд пользуется услугами правовых референтов.
С т а т ь я 26 Пленарные заседания Суда
На пленарных заседаниях Суд: a) избирает своего Председателя и одного или двух заместителей Председателя сроком на три года; они могут быть переизбраны; b) образует Палаты, создаваемые на определенный срок; c) избирает Председателей Палат Суда; они могут быть переизбраны; d) принимает Регламент Суда; и e) избирает Секретаря-канцлера Суда и одного или нескольких его заместителей.
С т а т ь я 27 Комитеты, Палаты и Большая Палата
1. Для рассмотрения переданных ему дел Суд образует комитеты в составе трех судей, Палаты в составе семи судей и Большую Палату в составе семнадцати судей. Палаты Суда на определенный срок образуют комитеты.
2. Судья, избранный от государства, являющегося стороной в деле, является ех officio членом Палаты и Большой Палаты; в случае отсутствия такого судьи или если он не может участвовать в заседании, данное государство назначает лицо, которое выступает в качестве судьи.
3. В состав Большой Палаты входят также Председатель Суда, заместители Председателя Суда, Председатели Палат и другие члены Суда, назначенные в соответствии с Регламентом Суда. В тех случаях, когда дело передается в Большую Палату в соответствии с положениями статьи 43, в ее заседаниях не должен участвовать ни один из судей Палаты, вынесшей постановление, за исключением Председателя этой Палаты и судьи от соответствующего государства, являющегося стороной в деле.
С т а т ь я 28 Объявления комитетов о неприемлемости жалобы (заявления)
Комитет единогласным решением может объявить неприемлемой индивидуальную жалобу, поданную в соответствии со статьей 34, или исключить ее из списка подлежащих рассмотрению дел, если такое решение может быть принято без дополнительного изучения жалобы. Это решение является окончательным.
С т а т ь я 29 Решения Палат о приемлемости жалобы и по существу дела
1. Если не было принято никакого решения, предусмотренного статьей 28, Палата выносит решение о приемлемости индивидуальной жалобы, поданной в соответствии со статьей 34, и по существу дела.
2. Палата выносит решение о приемлемости жалобы государства, поданной в соответствии со статьей 33, и по существу дела.
3. Решение о приемлемости жалобы выносится отдельно, если Суд, в порядке исключения, не примет решения об обратном.
С т а т ь я 30 Уступка юрисдикции в пользу Большой Палаты
Если дело, находящееся на рассмотрении Палаты, затрагивает серьезный вопрос, касающийся толкования положений Конвенции или Протоколов к ней, или если решение вопроса может войти в противоречие с ранее вынесенным Судом постановлением, Палата может до вынесения своего постановления уступить юрисдикцию в пользу Большой Палаты, если ни одна из сторон не возражает против этого.
С т а т ь я 31 Полномочия Большой Палаты
Большая Палата: a) выносит решения по жалобам, поданным в соответствии со статьей 33 или статьей 34, когда какая-либо из Палат уступила юрисдикцию на основании положений статьи 30 или когда дело направлено ей в соответствии с положениями статьи 43; и b) рассматривает запросы о вынесении консультативных заключений, направленные в соответствии с положениями статьи 47.
С т а т ь я 32 Компетенция Суда
1. В ведении Суда находятся все вопросы, касающиеся толкования и применения положений Конвенции и Протоколов к ней, которые могут быть ему переданы в случаях, предусмотренных положениями статей 33, 34 и 47.
2. В случае спора относительно компетенции Суда по конкретному делу вопрос решает сам Суд.
С т а т ь я 33 Межгосударственные дела
Любая Высокая Договаривающаяся Сторона может передать в Суд вопрос о любом предполагаемом нарушении положений Конвенции и Протоколов к ней другой Высокой Договаривающейся Стороной.
С т а т ь я 34 Индивидуальные жалобы
Суд может принимать жалобы от любого физического лица, любой неправительственной организации или любой группы частных лиц, которые утверждают, что явились жертвами нарушения одной из Высоких Договаривающихся Сторон их прав, признанных в настоящей Конвенции или в Протоколах к ней. Высокие Договаривающиеся Стороны обязуются никоим образом не препятствовать эффективному осуществлению этого права.
С т а т ь я 35 Условия приемлемости
1. Суд может принимать дело к рассмотрению только после того, как были исчерпаны все внутренние средства правовой защиты, как это предусмотрено общепризнанными нормами международного права, и в течение шести месяцев с даты вынесения национальными органами окончательного решения по делу.
2. Суд не принимает к рассмотрению никакую индивидуальную жалобу, поданную в соответствии со статьей 34, если она: a) является анонимной; или b) является по существу аналогичной той, которая уже была рассмотрена Судом, или уже является предметом другой процедуры международного разбирательства или урегулирования, и если она не содержит новых относящихся к делу фактов.
3. Суд объявляет неприемлемой любую индивидуальную жалобу, поданную в соответствии со статьей 34, если сочтет ее несовместимой с положениями настоящей Конвенции или Протоколов к ней, явно необоснованной или злоупотреблением правом подачи жалоб.
4. Суд отклоняет любую переданную ему жалобу, которую сочтет неприемлемой в соответствии с настоящей статьей. Он может сделать это на любой стадии разбирательства.
С т а т ь я 36 Участие третьей стороны
1. В отношении любого дела, находящегося на рассмотрении какой-либо из Палат или Большой Палаты, каждая Высокая Договаривающаяся Сторона, гражданин которой является заявителем, вправе представлять письменные замечания и принимать участие в слушаниях.
2. В интересах надлежащего отправления правосудия Председатель Суда может пригласить любую Высокую Договаривающуюся Сторону, не являющуюся стороной в деле, или любое заинтересованное лицо, не являющееся заявителем, представить письменные замечания или принять участие в слушаниях.
С т а т ь я 37 Прекращение производства по делу
1. Суд может на любой стадии разбирательства принять решение о прекращении производства по делу, если обстоятельства позволяют сделать вывод о том, что: a) заявитель более не намерен добиваться рассмотрения своей жалобы; или b) спор был урегулирован; или c) по любой другой причине, установленной Судом, если дальнейшее рассмотрение жалобы является неоправданным. Тем не менее, Суд продолжает рассмотрение жалобы, если этого требует соблюдение прав человека, гарантированных настоящей Конвенцией и Протоколами к ней.
2. Суд может принять решение восстановить жалобу в списке подлежащих рассмотрению дел, если сочтет, что это оправдано обстоятельствами.
С т а т ь я 38 Процедура рассмотрения дела с участием заинтересованных сторон и процедура мирового соглашения
1. Если Суд объявляет жалобу приемлемой, он: a) продолжает рассмотрение дела с участием представителей заинтересованных сторон и, если это необходимо, осуществляет исследование обстоятельств дела, для эффективного проведения которого заинтересованные государства создают все необходимые условия, b) предоставляет себя в распоряжение заинтересованных сторон с целью заключения мирового соглашения по делу на основе соблюдения прав человека, признанных в настоящей Конвенции и Протоколах к ней.
2. Процедура, предусмотренная подпунктом "b" пункта 1, носит конфиденциальный характер.
С т а т ь я 39 Заключение мирового соглашения
В случае достижения мирового соглашения Суд исключает дело из своего списка посредством вынесения постановления, в котором дается лишь краткое изложение фактов и достигнутого решения.
С т а т ь я 40 Открытые судебные заседания и доступ к документам
1. Если в силу исключительных обстоятельств Суд не примет иного решения, его заседания являются открытыми.
2. Доступ к документам, переданным на хранение в Секретариат, открыт для публики, если Председатель Суда не примет иного решения.
С т а т ь я 41 Справедливая компенсация
Если Суд объявляет, что имело место нарушение Конвенции или Протоколов к ней, а внутреннее право Высокой Договаривающейся Стороны допускает возможность лишь частичного устранения последствий этого нарушения, Суд, в случае необходимости, присуждает справедливую компенсацию потерпевшей стороне.
С т а т ь я 42 Постановления Палат
Постановления Палат становятся окончательными в соответствии с положениями пункта 2 статьи 44.
С т а т ь я 43 Передача дела в Большую Палату
1. В течение трех месяцев с даты вынесения Палатой постановления в исключительных случаях возможно обращение любой из сторон в деле о передаче его на рассмотрение Большой Палаты.
2. Коллегия в составе пяти членов Большой Палаты принимает обращение, если дело поднимает серьезный вопрос, касающийся толкования или применения положений настоящей Конвенции или Протоколов к ней, или другой серьезный вопрос общего характера.
3. Если Коллегия принимает обращение, то Большая Палата выносит по делу свое постановление.
С т а т ь я 44 Окончательные постановления
1. Постановление Большой Палаты является окончательным.
2. Постановление любой из Палат становится окончательным, если: a) стороны не заявляют, что они будут просить о передаче дела в Большую Палату; или b) по истечении трех месяцев с даты вынесения постановления не поступило обращения о передаче дела в Большую Палату; или c) Коллегия Большой Палаты отклоняет обращение о передаче дела согласно статье 43.
3. Окончательное постановление подлежит публикации.
С т а т ь я 45 Мотивировка постановлений и решений
1. Постановления, а также решения о приемлемости или неприемлемости жалоб должны быть мотивированными.
2. Если постановление в целом или частично не выражает единогласного мнения судей, то любой судья вправе представить свое особое мнение.
С т а т ь я 46 Обязательная сила и исполнение постановлений
1. Высокие Договаривающиеся Стороны обязуются исполнять окончательные постановления Суда по делам, в которых они являются сторонами.
2. Окончательное постановление Суда направляется Комитету министров, который осуществляет надзор за его исполнением.
С т а т ь я 47 Консультативные заключения
1. Суд может по просьбе Комитета министров выносить консультативные заключения по юридическим вопросам, касающимся толкования положений Конвенции и Протоколов к ней.
2. Такие заключения не должны затрагивать ни вопросы, относящиеся к содержанию или объему прав или свобод, определенных в Разделе I Конвенции и Протоколах к ней, ни другие вопросы, которые Суду или Комитету министров, возможно, потребовалось бы затронуть при рассмотрении какого-либо обращения, предусмотренного Конвенцией.
3. Решение Комитета министров запросить консультативное заключение Суда принимается большинством голосов представителей, имеющих право заседать в Комитете.
С т а т ь я 48 Компетенция Суда в отношении консультативных заключений
Вопрос о том, относится ли направленный Комитетом министров запрос о вынесении консультативного заключения к компетенции Суда, как она определена в статье 47, решает Суд.
С т а т ь я 49 Мотивировка консультативных заключений
1. Консультативные заключения Суда должны быть мотивированными.
2. Если консультативное заключение в целом или частично не выражает единогласного мнения судей, то любой судья вправе представить свое особое мнение.
3. Консультативное заключение Суда направляется Комитету министров.
С т а т ь я 50 Расходы на содержание Суда
Расходы, связанные с деятельностью Суда, несет Совет Европы.
С т а т ь я 51 Привилегии и иммунитеты Судей
Судьи при исполнении своих функций пользуются привилегиями и иммунитетами, предусмотренными статьей 40 Устава Совета Европы и в соглашениях, заключенных на ее основе.
РАЗДЕЛ III РАЗЛИЧНЫЕ ПОЛОЖЕНИЯ
С т а т ь я 52 Запросы Генерального секретаря
По получении просьбы от Генерального секретаря Совета Европы каждая Высокая Договаривающаяся Сторона представляет разъяснения относительно того, каким образом ее внутреннее право обеспечивает эффективное применение любого из положений настоящей Конвенции.
С т а т ь я 53 Гарантии в отношении признанных прав человека
Ничто в настоящей Конвенции не может быть истолковано как ограничение или умаление любого из прав человека и основных свобод, которые могут обеспечиваться законодательством любой Высокой Договаривающейся Стороны или любым иным соглашением, в котором она участвует.
С т а т ь я 54 Полномочия Комитета министров
Ничто в настоящей Конвенции не умаляет полномочий Комитета министров, которыми он наделен в силу Устава Совета Европы.
С т а т ь я 55 Отказ от иных средств урегулирования споров
Высокие Договаривающиеся Стороны согласны, если иное не установлено особым соглашением, не прибегать к действующим между ними договорам, конвенциям или декларациям при передаче на рассмотрение, путем направления заявления, спора по поводу толкования или применения положений настоящей Конвенции и не использовать иные средства урегулирования спора, чем предусмотренные настоящей Конвенцией.
С т а т ь я 56 Территориальная сфера действия
1. Любое государство при ратификации или впоследствии может заявить путем уведомления Генерального секретаря Совета Европы о том, что настоящая Конвенция, с учетом пункта 4 настоящей статьи, распространяется на все территории или на любую из них, за внешние сношения которых оно несет ответственность.
2. Действие Конвенции распространяется на территорию или территории, указанные в уведомлении, с тридцатого дня после получения Генеральным секретарем Совета Европы этого уведомления.
3. Положения настоящей Конвенции применяются на упомянутых территориях с надлежащим учетом местных условий.
4. Любое государство, которое сделало заявление в соответствии с пунктом 1 настоящей статьи, может впоследствии в любое время заявить, применительно к одной или нескольким территориям, указанным в этом заявлении, о признании компетенции Суда принимать жалобы от физических лиц, неправительственных организаций или групп частных лиц, как это предусмотрено статьей 34 Конвенции.
С т а т ь я 57 Оговорки
1. Любое государство при подписании настоящей Конвенции или при сдаче им на хранение его ратификационной грамоты может сделать оговорку к любому конкретному положению Конвенции в отношении того, что тот или иной закон, действующий в это время на его территории, не соответствует этому положению. В соответствии с настоящей статьей оговорки общего характера не допускаются.
2. Любая оговорка, сделанная в соответствии с настоящей статьей, должна содержать краткое изложение соответствующего закона.
С т а т ь я 58 Денонсация
1. Высокая Договаривающаяся Сторона может денонсировать настоящую Конвенцию только по истечении пяти лет с даты, когда она стала Стороной Конвенции, и по истечении шести месяцев после направления уведомления Генеральному секретарю Совета Европы, который информирует об этом другие Высокие Договаривающиеся Стороны.
2. Денонсация не освобождает соответствующую Высокую Договаривающуюся Сторону от ее обязательств по настоящей Конвенции в отношении любого действия, которое могло явиться нарушением таких обязательств и могло быть совершено ею до даты вступления денонсации в силу.
3. Любая Высокая Договаривающаяся Сторона, которая перестает быть членом Совета Европы, на тех же условиях перестает быть и Стороной настоящей Конвенции.
4. Конвенция может быть денонсирована в соответствии с положениями предыдущих пунктов в отношении любой территории, на которую распространялось ее действие согласно положениям статьи 56.
С т а т ь я 59 Подписание и ратификация
1. Настоящая Конвенция открыта для подписания государствами - членами Совета Европы. Она подлежит ратификации. Ратификационные грамоты сдаются на хранение Генеральному секретарю Совета Европы.
2. Настоящая Конвенция вступает в силу после сдачи на хранение десяти ратификационных грамот.
3. Для тех государств, которые ратифицируют Конвенцию впоследствии, она вступает в силу с даты сдачи ими на хранение их ратификационных грамот.
4. Генеральный секретарь Совета Европы уведомляет все государства - члены Совета Европы о вступлении Конвенции в силу, о Высоких Договаривающихся Сторонах, ратифицировавших ее, и о сдаче ратификационных грамот, которые могут быть получены впоследствии.
Совершено в Риме 4 ноября 1950 года на английском и французском языках, причем оба текста имеют одинаковую силу, в единственном экземпляре, который хранится в архиве Совета Европы. PROTOCOL [No. 1]* to the Convention for the Protection of Human Rights and Fundamental Freedoms, as amended by Protocol No. 11
The governments signatory hereto, being members of the Council of Europe, Being resolved to take steps to ensure the collective enforcement of certain rights and freedoms other than those already included in Section I of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4 November 1950 (hereinafter referred to as "the Convention"), Have agreed as follows:
Article 1 - Protection of property
Every natural or legal person is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law. The preceding provisions shall not, however, in any way impair the right of a State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties.
Article 2 - Right to education
No person shall be denied the right to education. In the exercise of any functions which it assumes in relation to education and to teaching, the State shall respect the right of parents to ensure such education and teaching in conformity with their own religious and philosophical convictions.
Article 3 - Right to free elections
The High Contracting Parties undertake to hold free elections at reasonable intervals by secret ballot, under conditions which will ensure the free expression of the opinion of the people in the choice of the legislature.
Article 4 - Territorial application
Any High Contracting Party may at the time of signature or ratification or at any time thereafter communicate to the Secretary General of the Council of Europe a declaration stating the extent to which it undertakes that the provisions of the present Protocol shall apply to such of the territories for the international relations of which it is responsible as are named therein. Any High Contracting Party which has communicated a declaration in virtue of the preceding paragraph may from time to time communicate a further declaration modifying the terms of any former declaration or terminating the application of the provisions of this Protocol in respect of any territory. A declaration made in accordance with this article shall be deemed to have been made in accordance with paragraph 1 of Article 56 of the Convention.
Article 5 - Relationship to the Convention
As between the High Contracting Parties the provisions of Articles 1, 2, 3 and 4 of this Protocol shall be regarded as additional articles to the Convention and all the provisions of the Convention shall apply accordingly.
Article 6 - Signature and ratification
This Protocol shall be open for signature by the members of the Council of Europe, who are the signatories of the Convention; it shall be ratified at the same time as or after the ratification of the Convention. It shall enter into force after the deposit of ten instruments of ratification. As regards any signatory ratifying subsequently, the Protocol shall enter into force at the date of the deposit of its instrument of ratification. The instruments of ratification shall be deposited with the Secretary General of the Council of Europe, who will notify all members of the names of those who have ratified.
Done at Paris on the 20th day of March 1952, in English and French, both texts being equally authentic, in a single copy which shall remain deposited in the archives of the Council of Europe. Article 1 - Protection de la propriйtй
Toute personne physique ou morale a droit au respect de ses biens. Nul ne peut кtre privй de sa propriйtй que pour cause d'utilitй publique et dans les conditions prйvues par la loi et les principes gйnйraux du droit international. Article 4 - Application territoriale
Toute Haute Partie contractante peut, au moment de la signature ou de la ratifica tion du prйsent Protocole ou а tout moment par la suite, communiquer au Secrйtaire Gйnйral du Conseil de l'Europe une dйclaration indiquant la mesure dans laquelle elle s'engage а ce que les dispositions du prйsent Protocole s'ap pliquent а tels territoires qui sont dйsignйs dans ladite dйclaration et dont elle assure les relations internationales. Toute Haute Partie contractante qui a communiquй une dйclaration en vertu du paragraphe prйcйdent peut, de temps а autre, communiquer une nouvelle dйclaration modifiant les termes de toute dйclaration antйrieure ou mettant fin а l'application des dispositions du prйsent Protocole sur un territoire quelconque. Une dйclaration faite conformйment au prйsent article sera considйrйe comme ayant йtй faite conformйment au paragraphe 1 de l'article 56 de la Convention.
Article 5 - Relations avec la Convention
Les Hautes Parties contractantes considйreront les articles 1, 2, 3 et 4 de ce Protocole comme des articles additionnels а la Convention et toutes les disposi tions de la Convention s'appliqueront en consйquence.
Article 6 - Signature et ratification
Le prйsent Protocole est ouvert а la signature des membres du Conseil de l'Europe, signataires de la Convention; il sera ratifiй en mкme temps que la Convention ou aprиs la ratification de celle-ci. Il entrera en vigueur aprиs le dйpфt de dix instruments de ratification. Pour tout signataire qui le ratifiera ultйrieurement, le Protocole entrera en vigueur dиs le dйpфt de l'instrument de ratification. П Р О Т О К О Л [N 1]* К КОНВЕНЦИИ О ЗАЩИТЕ ПРАВ ЧЕЛОВЕКА И ОСНОВНЫХ СВОБОД
Правительства, подписавшие настоящий Протокол, являющиеся членами Совета Европы, преисполненные решимости принять меры по обеспечению коллективного осуществления некоторых прав и свобод помимо тех, которые уже включены в Раздел 1 Конвенции о защите прав человека и основных свобод, подписанной в Риме 4 ноября 1950 года (далее именуемой "Конвенция"), согласились о нижеследующем:
С т а т ь я 1 Защита собственности
Каждое физическое или юридическое лицо имеет право на уважение своей собственности. Никто не может быть лишен своего имущества иначе как в интересах общества и на условиях, предусмотренных законом и общими принципами международного права. Предыдущие положения не умаляют права государства обеспечивать выполнение таких законов, какие ему представляются необходимыми для осуществления контроля за использованием собственности в соответствии с общими интересами или для обеспечения уплаты налогов или других сборов или штрафов.
С т а т ь я 2 Право на образование
Никому не может быть отказано в праве на образование. Государство при осуществлении функций, которые оно принимает на себя в области образования и обучения, уважает право родителей обеспечивать такое образование и такое обучение, которые соответствуют их религиозным и философским убеждениям.
С т а т ь я 3 Право на свободные выборы
Высокие Договаривающиеся Стороны обязуются проводить с разумной периодичностью свободные выборы путем тайного голосования в таких условиях, которые обеспечивали бы свободное волеизъявление народа при выборе органов законодательной власти.
С т а т ь я 4 Территориальная сфера действия
Любая Высокая Договаривающаяся Сторона может при подписании или ратификации или в любое время впоследствии направить Генеральному секретарю Совета Европы заявление о пределах своих обязательств относительно применения положений настоящего Протокола к тем указанным в заявлении территориям, за внешние сношения которых она несет ответственность. Любая Высокая Договаривающаяся Сторона, направившая заявление в соответствии с положениями предыдущего пункта, может время от времени направлять новое заявление об изменении условий любого предыдущего заявления или о прекращении применения положений настоящего Протокола в отношении какой-либо территории. Заявление, сделанное в соответствии с положениями настоящей статьи, рассматривается как сделанное в соответствии с пунктом 1 статьи 56 Конвенции.
С т а т ь я 5 Соотношение с Конвенцией
Высокие Договаривающиеся Стороны рассматривают статьи 1, 2, 3 и 4 настоящего Протокола как дополнительные статьи к Конвенции, и все положения Конвенции применяются соответственно.
С т а т ь я 6 Подписание и ратификация
Настоящий Протокол открыт для подписания государствами - членами Совета Европы, подписавшими Конвенцию. Он подлежит ратификации одновременно с ратификацией Конвенции или после таковой. Протокол вступает в силу после сдачи на хранение десяти ратификационных грамот. В отношении каждого подписавшего государства, которое ратифицирует Протокол впоследствии, он вступает в силу с даты сдачи им на хранение его ратификационной грамоты.
Ратификационные грамоты сдаются на хранение Генеральному секретарю Совета Европы, который уведомляет все государства - члены Совета Европы о государствах, ратифицировавших Протокол.

PROTOCOL No. 4* to the Convention for the Protection of Human Rights and Fundamental Freedoms, securing certain rights and freedoms other than those already included in the Convention and in the first Protocol thereto, as amended by Protocol No. 11
The governments signatory hereto, being members of the Council of Europe, Being resolved to take steps to ensure the collective enforcement of certain rights and freedoms other than those already included in Section 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4th November 1950 (hereinafter referred to as the "Convention") and in Articles 1 to 3 of the First Protocol to the Convention, signed at Paris on 20th March 1952, Have agreed as follows:
Article 1 - Prohibition of imprisonment for debt
No one shall be deprived of his liberty merely on the ground of inability to fulfil a contractual obligation.
Article 2 - Freedom of movement
1. Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence.
2. Everyone shall be free to leave any country, including his own.
3. No restrictions shall be placed on the exercise of these rights other than such as are in accordance with law and are necessary in a democratic society in the interests of national security or public safety, for the maintenance of ordre public, for the prevention of crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.
4. The rights set forth in paragraph 1 may also be subject, in particular areas, to restrictions imposed in accordance with law and justified by the public interest in a democratic society.
Article 3 - Prohibition of expulsion of nationals
1. No one shall be expelled, by means either of an individual or of a collective measure, from the territory of the State of which he is a national.
2. No one shall be deprived of the right to enter the territory of the state of which he is a national.
Article 4 - Prohibition of collective expulsion of aliens
Collective expulsion of aliens is prohibited.
Article 5 - Territorial application
1. Any High Contracting Party may, at the time of signature or ratification of this Protocol, or at any time thereafter, communicate to the Secretary General of the Council of Europe a declaration stating the extent to which it undertakes that the provisions of this Protocol shall apply to such of the territories for the international relations of which it is responsible as are named therein.
2. Any High Contracting Party which has communicated a declaration in virtue of the preceding paragraph may, from time to time, communicate a further declaration modifying the terms of any former declaration or terminating the application of the provisions of this Protocol in respect of any territory.
3. A declaration made in accordance with this article shall be deemed to have been made in accordance with paragraph 1 of Article 56 of the Convention.
4. The territory of any State to which this Protocol applies by virtue of ratification or acceptance by that State, and each territory to which this Protocol is applied by virtue of a declaration by that State under this article, shall be treated as separate territories for the purpose of the references in Articles 2 and 3 to the territory of a State.
5. Any State which has made a declaration in accordance with paragraph 1 or 2 of this Article may at any time thereafter declare on behalf of one or more of the territories to which the declaration relates that it accepts the competence of the Court to receive applications from individuals, non-governmental organisations or groups of individuals as provided in Article 34 of the Convention in respect of all or any of Articles 1 to 4 of this Protocol.
Article 6 - Relationship to the Convention
As between the High Contracting Parties the provisions of Articles 1 to 5 of this Protocol shall be regarded as additional Articles to the Convention, and all the provisions of the Convention shall apply accordingly.
Article 7 - Signature and ratification
1. This Protocol shall be open for signature by the members of the Council of Europe who are the signatories of the Convention; it shall be ratified at the same time as or after the ratification of the Convention. It shall enter into force after the deposit of five instruments of ratification. As regards any signatory ratifying subsequently, the Protocol shall enter into force at the date of the deposit of its instrument of ratification.
2. The instruments of ratification shall be deposited with the Secretary General of the Council of Europe, who will notify all members of the names of those who have ratified.
In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol. Done at Strasbourg, this 16th day of September 1963, in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. Article 3 - Interdiction de l'expulsion des nationaux
1. Nul ne peut кtre expulsй, par voie de mesure individuelle ou collective, du territoire de l'Etat dont il est le ressortissant.
2. Nul ne peut кtre privй du droit d'entrer sur le territoire de l'Etat dont il est le ressortissant.

Les expulsions collectives d'йtrangers sont interdites.
Article 5 - Application territoriale
1. Toute Haute Partie contractante peut, au moment de la signature ou de la ratification du prйsent Protocole ou а tout moment par la suite, communiquer au Secrйtaire Gйnйral du Conseil de l'Europe une dйclaration indiquant la mesure dans laquelle elle s'engage а ce que les dispositions du prйsent Protocole s'ap pliquent а tels territoires qui sont dйsignйs dans ladite dйclaration et dont elle assure les relations internationales.
2. Toute Haute Partie contractante qui a communiquй une dйclaration en vertu du paragraphe prйcйdent peut, de temps а autre, communiquer une nouvelle dйclaration modifiant les termes de toute dйclaration antйrieure ou mettant fin а l'application des dispositions du prйsent Protocole sur un territoire quelconque. 3 Une dйclaration faite conformйment au prйsent article sera considйrйe comme ayant йtй faite conformйment au paragraphe 1 de l'article 56 de la Convention.
4. Le territoire de tout Etat auquel le prйsent Protocole s'applique en vertu de sa ratification ou de son acceptation par ledit Etat, et chacun des territoires auxquels le Protocole s'applique en vertu d'une dйclaration souscrite par ledit Etat conformйment au prйsent article, seront considйrйs comme des territoires distincts aux fins des rйfйrences au territoire d'un Etat faites par les articles 2 et 3.
5. Article 6 - Relations avec la Convention
Les Hautes Parties contractantes considйreront les articles 1 а 5 de ce Protocole comme des articles additionnels а la Convention et toutes les dispositions de la Convention s'appliqueront en consйquence.
Article 7 - Signature et ratification
1. Le prйsent Protocole est ouvert а la signature des membres du Conseil de l'Europe, signataires de la Convention; il sera ratifiй en mкme temps que la Convention ou aprиs la ratification de celle-ci. Il entrera en vigueur aprиs le dйpфt de cinq instruments de ratification. С т а т ь я 2 Свобода передвижения
1. Каждый, кто на законных основаниях находится на территории какого-либо государства, имеет в пределах этой территории право на свободу передвижения и свободу выбора местожительства.
2. Каждый свободен покидать любую страну, включая свою собственную.
3. Пользование этими правами не подлежит никаким ограничениям, кроме тех, которые предусмотрены законом и необходимы в демократическом обществе в интересах национальной безопасности или общественного спокойствия, для поддержания общественного порядка, предотвращения преступлений, охраны здоровья или нравственности или для защиты прав и свобод других лиц.
4. Права, признанные в пункте 1, могут также, в определенных районах, подлежать ограничениям, вводимым в соответствии с законом и обоснованным общественными интересами в демократическом обществе.
С т а т ь я 3 Запрещение высылки граждан
1. Никто не может быть выслан путем индивидуальных или коллективных мер с территории государства, гражданином которого он является.
2. Никто не может быть лишен права на въезд на территорию государства, гражданином которого он является.
С т а т ь я 4 Запрещение коллективной высылки иностранцев
Коллективная высылка иностранцев запрещается.
С т а т ь я 5 Территориальная сфера действия
1. Любая Высокая Договаривающаяся Сторона может при подписании или ратификации настоящего Протокола или в любое время впоследствии направить Генеральному секретарю Совета Европы заявление о пределах своих обязательств относительно применения положений настоящего Протокола к тем указанным в заявлении территориям, за внешние сношения которых она несет ответственность.

PROTOCOL N 7* to the Convention for the Protection of Human Rights and Fundamental Freedoms, as amended by Protocol No. 11
The member States of the Council of Europe signatory hereto, Being resolved to take further steps to ensure the collective enforcement of certain rights and freedoms by means of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4 November 1950 (hereinafter referred to as "the Convention"), Have agreed as follows:
Article 1 - Procedural safeguards relating to expulsion of aliens
1. An alien lawfully resident in the territory of a State shall not be expelled therefrom except in pursuance of a decision reached in accordance with law and shall be allowed: a) to submit reasons against his expulsion, b) to have his case reviewed, and c) to be represented for these purposes before the competent authority or a person or persons designated by that authority.
2. An alien may be expelled before the exercise of his rights under paragraph 1.a, b and c of this Article, when such expulsion is necessary in the interests of public order or is grounded on reasons of national security.
Article 2 - Right of appeal in criminal matters
1. Everyone convicted of a criminal offence by a tribunal shall have the right to have his conviction or sentence reviewed by a higher tribunal. The exercise of this right, including the grounds on which it may be exercised, shall be governed by law.
2. This right may be subject to exceptions in regard to offences of a minor character, as prescribed by law, or in cases in which the person concerned was tried in the first instance by the highest tribunal or was convicted following an appeal against acquittal.
Article 3 - Compensation for wrongful conviction
When a person has by a final decision been convicted of a criminal offence and when subsequently his conviction has been reversed, or he has been pardoned, on the ground that a new or newly discovered fact shows conclusively that there has been a miscarriage of justice, the person who has suffered punishment as a result of such conviction shall be compensated according to the law or the practice of the State concerned, unless it is proved that the non-disclosure of the unknown fact in time is wholly or partly attributable to him.
Article 4 - Right not to be tried or punished twice
1. No one shall be liable to be tried or punished again in criminal proceedings under the jurisdiction of the same State for an offence for which he has already been finally acquitted or convicted in accordance with the law and penal procedure of that State.
2. The provisions of the preceding paragraph shall not prevent the reopening of the case in accordance with the law and penal procedure of the State concerned, if there is evidence of new or newly discovered facts, or if there has been a fundamental defect in the previous proceedings, which could affect the outcome of the case.
3. No derogation from this Article shall be made under Article 15 of the Convention.
Article 5 - Equality between spouses
Spouses shall enjoy equality of rights and responsibilities of a private law character between them, and in their relations with their children, as to marriage, during marriage and in the event of its dissolution. This Article shall not prevent States from taking such measures as are necessary in the interests of the children.
Article 6 - Territorial application
1. Any State may at the time of signature or when depositing its instrument of ratification, acceptance or approval, specify the territory or territories to which the Protocol shall apply and state the extent to which it undertakes that the provisions of this Protocol shall apply to such territory or territories.
2. Any State may at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Protocol to any other territory specified in the declaration. In respect of such territory the Protocol shall enter into force on the first day of the month following the expiration of a period of two months after the date of receipt by the Secretary General of such declaration.
3. Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn or modified by a notification addressed to the Secretary General. The withdrawal or modification shall become effective on the first day of the month following the expiration of a period of two months after the date of receipt of such notification by the Secretary General.
4. A declaration made in accordance with this Article shall be deemed to have been made in accordance with paragraph 1 of Article 56 of the Convention.
5. The territory of any State to which this Protocol applies by virtue of ratification, acceptance or approval by that State, and each territory to which this Protocol is applied by virtue of a declaration by that State under this Article, may be treated as separate territories for the purpose of the reference in Article 1 to the territory of a State.
6. Any State which has made a declaration in accordance with paragraph 1 or 2 of this Article may at any time thereafter declare on behalf of one or more of the territories to which the declaration relates that it accepts the competence of the Court to receive applications from individuals, non-governmental organisations or groups of individuals as provided in Article 34 of the Convention in respect of Articles 1 to 5 of this Protocol.
Article 7 - Relationship to the Convention
As between the States Parties, the provisions of Article 1 to 6 of this Protocol shall be regarded as additional Articles to the Convention, and all the provisions of the Convention shall apply accordingly.
Article 8 - Signature and ratification
This Protocol shall be open for signature by member States of the Council of Europe which have signed the Convention. It is subject to ratification, acceptance or approval. A member State of the Council of Europe may not ratify, accept or approve this Protocol without previously or simultaneously ratifying the Convention. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.
Article 9 - Entry into force
1. This Protocol shall enter into force on the first day of the month following the expiration of a period of two months after the date on which seven member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 8.
2. In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the expiration of a period of two months after the date of the deposit of the instrument of ratification, acceptance or approval.
Article 10 - Depositary functions
The Secretary General of the Council of Europe shall notify all the member States of the Council of Europe of: a) any signature; b) the deposit of any instrument of ratification, acceptance or approval; c) any date of entry into force of this Protocol in accordance with Articles 6 and 9; d) any other act, notification or declaration relating to this Protocol. In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.

PROTOCOLE N 7* а la Convention de sauvegarde des Droits de l'Homme et des Libertйs fondamentales, tel qu'amendй par le Protocole N 11
Les Etats membres du Conseil de l'Europe, signataires du prйsent Protocole, Rйsolus а prendre de nouvelles mesures propres а assurer la garantie collective de certains droits et libertйs par la Convention de Sauvegarde des Droits de l'Homme et des Libertйs fondamentales, signйe а Rome le 4 novembre 1950 (ci-aprиs dйnommйe "la Convention"), Sont convenus de ce qui suit:
Article 1 - Garanties procйdurales en cas d'expulsion d'йtrangers
1. Un йtranger rйsidant rйguliиrement sur le territoire d'un Etat ne peut en кtre expulsй qu'en exйcution d'une dйcision prise conformйment а la loi et doit pouvoir: a) faire valoir les raisons qui militent contre son expulsion, b) faire examiner son cas, et c) se faire reprйsenter а ces fins devant l'autoritй compйtente ou une ou plusieurs personnes dйsignйes par cette autoritй.
2. Un йtranger peut кtre expulsй avant l'exercice des droits йnumйrйs au para graphe l.a, b et c de cet article lorsque cette expulsion est nйcessaire dans l'intйrкt de l'ordre public ou est basйe sur des motifs de sйcuritй nationale.
Article 2 - Droit а un double degrй de juridiction en matiиre pйnale
1. Toute personne dйclarйe coupable d'une infraction pйnale par un tribunal a le droit de faire examiner par une juridiction supйrieure la dйclaration de culpabilitй ou la condamnation. L'exercice de ce droit, y compris les motifs pour lesquels il peut кtre exercй, sont rйgis par la loi.
2. Ce droit peut faire l'objet d'exceptions pour des infractions mineures telles qu'elles sont dйfinies par la loi ou lorsque l'intйressй a йtй jugй en premiиre instance par la plus haute juridiction ou a йtй dйclarй coupable et condamnй а la suite d'un recours contre son acquittement.
Article 3 - Droit d'indemnisation en cas d'erreur judiciaire
Lorsqu'une condamnation pйnale dйfinitive est ultйrieurement annulйe, ou lorsque la grвce est accordйe, parce qu'un fait nouveau ou nouvellement rйvйlй prouve qu'il s'est produit une erreur judiciaire, la personne qui a subi une peine en raison de cette condamnation est indemnisйe, conformйment а la loi ou а l'usage en vigueur dans l'Etat concernй, а moins qu'il ne soit prouvй que la non-rйvйlation en temps utile du fait inconnu lui est imputable en tout ou en partie.
Article 4 - Droit а ne pas кtre jugй ou puni deux fois
1. Nul ne peut кtre poursuivi ou puni pйnalement par les juridictions du mкme Etat en raison d'une infraction pour laquelle il a dйjа йtй acquittй ou condamnй par un jugement dйfinitif conformйment а la loi et а la procйdure pйnale de cet Etat.
2. Les dispositions du paragraphe prйcйdent n'empкchent pas la rйouverture du procиs, conformйment а la loi et а la procйdure pйnale de l'Etat concernй, si des faits nouveaux ou nouvellement rйvйlйs ou un vice fondamental dans la procйdure prйcйdente sont de nature а affecter le jugement intervenu.
3. Aucune dйrogation n'est autorisйe au prйsent article au titre de l'article 15 de la Convention.
Article 5 - Egalitй entre йpoux
Les йpoux jouissent de l'йgalitй de droits et de responsabilitйs de caractиre civil entre eux et dans leurs relations avec leurs enfants au regard du mariage, durant le mariage et lors de sa dissolution. Le prйsent article n'empкche pas les Etats de prendre les mesures nйcessaires dans l'intйrкt des enfants.
Article 6 - Application territoriale
1. Tout Etat peut, au moment de la signature ou au moment du dйpфt de son instrument de ratification, d'acceptation ou d'approbation, dйsigner le ou les territoires auxquels s'appliquera le prйsent Protocole, en indiquant la mesure dans laquelle il s'engage а ce que les dispositions du prйsent Protocole s'appliquent а ce ou ces territoires.
2. Tout Etat peut, а tout autre moment par la suite, par une dйclaration adressйe au Secrйtaire Gйnйral du Conseil de l'Europe, йtendre l'application du prйsent Protocole а tout autre territoire dйsignй dans la dйclaration. Le Protocole entrera en vigueur а l'йgard de ce territoire le premier jour du mois qui suit l'expiration d'une pйriode de deux mois aprиs la date de rйception de la dйclaration par le Secrйtaire Gйnйral.
3. Toute dйclaration faite en vertu des deux paragraphes prйcйdents pourra кtre retirйe ou modifiйe en ce qui concerne tout territoire dйsignй dans cette dйclaration, par notification adressйe au Secrйtaire Gйnйral. Le retrait ou la modification prendra effet le premier jour du mois qui suit l'expiration d'une pйriode de deux mois aprиs la date de rйception de la notification par le Secrйtaire Gйnйral.
4. Une dйclaration faite conformйment au prйsent article sera considйrйe comme ayant йtй faite conformйment au paragraphe 1 de l'article 56 de la Convention.
5. Le territoire de tout Etat auquel le prйsent Protocole s'applique en vertu de sa ratification, de son acceptation ou de son approbation par ledit Etat, et chacun des territoires auxquels le Protocole s'applique en vertu d'une dйclaration souscrite par ledit Etat conformйment au prйsent article, peuvent кtre considйrйs comme des territoires distincts aux fins de la rйfйrence au territoire d'un Etat faite par l'article 1.
6. Tout Etat ayant fait une dйclaration conformйment au paragraphe 1 ou 2 du prйsent article peut, а tout moment par la suite, dйclarer relativement а un ou plusieurs des territoires visйs dans cette dйclaration qu'il accepte la compйtence de la Cour pour connaоtre des requкtes de personnes physiques, d'organisations non gouvernementales ou de groupes de particuliers, comme le prйvoit l'article 34 de la Convention, au titre des articles 1 а 5 du prйsent Protocole.
Article 7 - Relations avec la Convention
Les Etats Parties considиrent les articles 1 а 6 du prйsent Protocole comme des articles additionnels а la Convention et toutes les dispositions de la Convention s'appliquent en consйquence.
Article 8 - Signature et ratification
Le prйsent Protocole est ouvert а la signature des Etats membres du Conseil de l'Europe qui ont signй la Convention. Il sera soumis а ratification, acceptation ou approbation. Un Etat membre du Conseil de l'Europe ne peut ratifier, accepter ou approuver le prйsent Protocole sans avoir simultanйment ou antйrieurement ratifiй la Convention. Les instruments de ratification, d'acceptation ou d'approbation seront dйposйs prиs le Secrйtaire Gйnйral du Conseil de l'Europe.
Article 9 - Entrйe en vigueur
1. Le prйsent Protocole entrera en vigueur le premier jour du mois qui suit l'expiration d'une pйriode de deux mois aprиs la date а laquelle sept Etats membres du Conseil de l'Europe auront exprimй leur consentement а кtre liйs par le Protocole conformйment aux dispositions de l'article 8.
2. Pour tout Etat membre qui exprimera ultйrieurement son consentement а кtre liй par le Protocole, celui-ci entrera en vigueur le premier jour du mois qui suit l'expiration d'une pйriode de deux mois aprиs la date du dйpфt de l'instrument de ratification, d'acceptation ou d'approbation.
Article 10 - Fonctions du dйpositaire
Le Secrйtaire Gйnйral du Conseil de l'Europe notifiera а tous les Etats membres du Conseil de l'Europe: a) toute signature; b) le dйpфt de tout instrument de ratification, d'acceptation ou d'approbation; c) toute date d'entrйe en vigueur du prйsent Protocole conformйment a ses articles 6 et 9; d) tout autre acte, notification ou dйclaration ayant trait au prйsent Protocole. En foi de quoi, les soussignйs dыment autorisйs а cet effet, ont signй le prйsent Protocole. Fait а Strasbourg, le 22 novembre 1984, en franзais et en anglais, les deux textes faisant йgalement foi, en un seul exemplaire, qui sera dйposй dans les archives du Conseil de l'Europe. Le Secrйtaire Gйnйral du Conseil de l'Europe en commu niquera copie certifiйe conforme а chacun des Etats membres du Conseil de l'Europe. _______________ *Intitulйs d'articles ajoutйs et texte amendй conformйment aux dispositions du Protocole n 11 (STE n 155), а compter de son entrйe en vigueur le 1er novembre 1998.

ПРОТОКОЛ N 7* к Конвенции о защите прав человека и основных свобод
Государства - члены Совета Европы, подписавшие настоящий Протокол, преисполненные решимости принять дальнейшие меры по обеспечению коллективного осуществления некоторых прав и свобод посредством применения Конвенции о защите прав человека и основных свобод, подписанной в Риме 4 ноября 1950 года (далее именуемой "Конвенция"), согласились о нижеследующем:
С т а т ь я 1 Процедурные гарантии в случае высылки иностранцев
1. Иностранец, на законных основаниях проживающий на территории какого-либо государства, не может быть выслан из него иначе как во исполнение решения, принятого в соответствии с законом, и должен иметь возможность: a) представить аргументы против его высылки, b) требовать пересмотра его дела, и c) для этих целей быть представленным перед компетентным органом или перед одним или несколькими лицами, назначенными таким органом.
2. Иностранец может быть выслан до осуществления его прав, перечисленных в подпунктах "а", "b" и "с" пункта 1 настоящей статьи, если такая высылка необходима в интересах общественного порядка или обусловлена соображениями национальной безопасности.
С т а т ь я 2 Право на обжалование приговоров по уголовным делам во второй инстанции
1. Каждый осужденный за совершение уголовного преступления, имеет право на то, чтобы вынесенный в отношении него приговор или определенное ему наказание были пересмотрены вышестоящей судебной инстанцией. Осуществление этого права, включая основания, на которых оно может быть осуществлено, регулируется законом.
2. Из этого права могут делаться исключения в отношении незначительных правонарушений, признанных таковыми законом, или когда соответствующее лицо было судимо уже в первой инстанции верховным судом или признано виновным и осуждено в результате судебного пересмотра его оправдания.
С т а т ь я 3 Компенсация в случае судебной ошибки
Если какое-либо лицо на основании окончательного приговора было осуждено за совершение уголовного преступления, а вынесенный ему приговор впоследствии был отменен, или оно было помиловано на том основании, что какое-либо новое или вновь открывшееся обстоятельство убедительно доказывает, что имела место судебная ошибка, то лицо, понесшее наказание в результате такого осуждения, получает компенсацию согласно закону или существующей практике соответствующего государства, если только не будет доказано, что ранее неизвестное обстоятельство не было своевременно обнаружено полностью или частично по его вине.
С т а т ь я 4 Право не быть судимым или наказанным дважды
1. Никто не должен быть повторно судим или наказан в уголовном порядке в рамках юрисдикции одного и того же государства за преступление, за которое уже был оправдан или осужден в соответствии с законом и уголовно-процессуальными нормами этого государства.
2. Положения предыдущего пункта не препятствуют повторному рассмотрению дела в соответствии с законом и уголовно-процессуальными нормами соответствующего государства, если имеются сведения о новых или вновь открывшихся обстоятельствах или если в ходе предыдущего разбирательства были допущены существенные нарушения, повлиявшие на исход дела.
3. Отступления от выполнения настоящей статьи на основании положений статьи 15 Конвенции не допускаются.
С т а т ь я 5 Равноправие супругов
Супруги обладают равными правами и несут равную гражданско-правовую ответственность в отношениях между собой и со своими детьми в том, что касается вступления в брак, пребывания в браке и при его расторжении. Настоящая статья не препятствует государствам принимать такие меры, которые необходимы для соблюдения интересов детей.
С т а т ь я 6 Территориальная сфера действия
1. Любое государство может при подписании или сдаче им на хранение его ратификационной грамоты или документа о принятии или утверждении указать территорию или территории, на которые распространяется действие настоящего Протокола, и указать, в каких пределах оно обязуется применять положения настоящего Протокола к этой территории или этим территориям.
2. Любое государство может впоследствии в любое время, путем направления заявления Генеральному секретарю Совета Европы, распространить применение настоящего Протокола на любую другую территорию, указанную в заявлении. Протокол вступает в силу в отношении этой территории в первый день месяца, следующего по истечении двух месяцев с даты получения Генеральным секретарем этого заявления.
3. Любое заявление, сделанное на основании двух предыдущих пунктов и касающееся любой указанной в нем территории, может быть отозвано или изменено путем уведомления Генерального секретаря Совета Европы. Отзыв или изменение вступает в силу в первый день месяца, следующего по истечении двух месяцев с даты получения Генеральным секретарем этого уведомления.
4. Заявление, сделанное в соответствии с положениями настоящей статьи, рассматривается как сделанное в соответствии с пунктом 1 статьи 56 Конвенции.
5. Территория любого государства, к которой настоящий Протокол применяется в силу его ратификации, принятия или утверждения этим государством, и каждая из территорий, к которой настоящий Протокол применяется в силу заявления этого государства в соответствии с положениями настоящей статьи, могут рассматриваться как отдельные территории для целей ссылки на территорию государства в статье 1.
6. Любое государство, сделавшее заявление в соответствии с пунктами 1 или 2 настоящей статьи, может впоследствии в любое время заявить, применительно к одной или нескольким территориям, указанным в этом заявлении, что оно признает компетенцию Суда принимать жалобы от физических лиц, неправительственных организаций или групп частных лиц, как это предусмотрено статьей 34 Конвенции, относительно соблюдения статей 1, 2, 3, 4 и 5 настоящего Протокола.
С т а т ь я 7 Соотношение с Конвенцией
Государства-участники рассматривают статьи 1, 2, 3, 4, 5 и 6 настоящего Протокола как дополнительные статьи к Конвенции, и все положения Конвенции применяются соответственно.
С т а т ь я 8 Подписание и ратификация
Настоящий Протокол открыт для подписания государствами - членами Совета Европы, подписавшими Конвенцию. Он подлежит ратификации, принятию или утверждению. Государство - член Совета Европы не может ратифицировать, принять или утвердить настоящий Протокол без предшествующей или одновременной ратификации Конвенции. Ратификационные грамоты или документы о принятии или утверждении сдаются на хранение Генеральному секретарю Совета Европы.
С т а т ь я 9 Вступление в силу
1. Настоящий Протокол вступает в силу в первый день месяца, следующего по истечении двух месяцев с даты, когда семь государств - членов Совета Европы выразят свое согласие на обязательность для них Протокола в соответствии с положениями статьи 8.
2. Для любого государства-члена, которое выразит впоследствии свое согласие на обязательность для него Протокола, он вступает в силу в первый день месяца, следующего по истечении двух месяцев с даты сдачи им на хранение его ратификационной грамоты или документа о принятии или утверждении.
С т а т ь я 10 Функции депозитария
Генеральный секретарь Совета Европы уведомляет все государства - члены Совета Европы о: a) каждом подписании; b) сдаче на хранение каждой ратификационной грамоты или документа о принятии или утверждении; c) каждой дате вступления настоящего Протокола в силу в соответствии со статьями 6 и 9; d) каждом ином акте, уведомлении или заявлении, относящемся к настоящему Протоколу. В удостоверение чего нижеподписавшиеся, должным образом на то уполномоченные, подписали настоящий Протокол.
Совершено в Страсбурге 22 ноября 1984 года на английском и французском языках, причем оба текста имеют одинаковую силу, в единственном экземпляре, который хранится в архиве Совета Европы.
